				I have been trying to do a workout plan or forbearance through citi mortgage and even though I have confirmation pages where I sent them proof of income documents by fax (which they require) they are saying if they did receive them that they were unable to read them. I only discovered this after waiting the time the representative said to wait to be contacted for the initial deposit payment. we now owe 10,000 dollars and I have 4000 i can make as an initial payment but the sale closure date will be set soon. they say they are trying to get an approval but I should call every day to see if the foreclosure department will approve it. I have been calling for 2 days now and they still have no answers. is it to late to avoid foreclosure?

				<title>Bank of America refused my partial claim</title>

				I have my mortgage with Bank of America. They are giving me unreasonable options to save my home; it seems like they actually WANT to foreclose my house. I feel I qualify for an FHA partial claim. They say I don't because their "computer says so", but they are unable to tell me the criteria that's keeping me from this option as others say I should qualify. Please advise. 				I would like to do a Foreclosure Loan Modification Plan with this loan because I can afford my payments, however I fell behind because I had a hardship within my transportation business, and we stopped working due to a wreck, but we have been working consistently. I tried to make several payments, but GMAC sent my check back to me( I have a copy) saying that they don't accept partial payments and I'm in breach of contract and because of this I stopped sending them altogether. Also, I'm in an Interest only loan which I had no idea that I signed on this and I haven't even started to pay the Interest. I would like to have this loan amortize and take advantage of the low interest rates right now. I feel currently I'm in a predatory loan, and hope somebody can help me. Thank you

				<title>Suntrust is no help to stop foreclosure</title>

				In June of 2009 my then husband moved out. He was dealing with addictions that he could not maintain and I had been hurt enough to last a lifetime. At that point we were both still contributing to the marital property. That didn’t last very long; only until fall. He drug out the divorce until November of 2009 when, after a very disturbing event for me, I was finally able to harass him into signing papers. He agreed to pay $600 per month in spousal support for one year, or until the property sold. The house was placed on the market at the first of the year. At this point, I was already behind on a few things, but had caught up most of my bills. I paid for the majority of the divorce, plus a few other marital bills in my name, alone. No help! On December 14, 2009 I was in a car accident and totaled my vehicle. I had not had a car payment in three years, and my insurance was very low since I had this car for ten years. I was devastated and broke at this point. The accident was not my fault, and no one was seriously injured, but I was out of work for almost three weeks due to a sprained back and torn shoulder. My ex-husband offered no assistance during this time, and left me destitute and with no option but to be late on the mortgage payments. I began a new, better job on January 5th, but did not receive my first paycheck until January 31st, so I was already at this point, two months behind on everything. As of December 15, 2009 I have been in communication with SunTrust in an attempt to salvage delinquent payments on the property. As was communicated with my ex-husband in January and February, the mortgage payment for the property would be delinquent. The $600 for spousal support was used those two months for living expenses and utilities due at the property in light of my being without pay for six weeks. In mid March 2010 my Realtor and I had found a buyer for the home for short sale and were under contract when the payment was due for March. I barely had enough for a payment at that time and was advised to hold off on the payment until we found out if the buyers were going to close. My income tax refund that was supposed to go to catching up the mortgage, went to outstanding bills and late fees accrued during my absence of pay and the new car payment. The buyers backed out on the contract and I called SunTrust and explained the situation. At that point the payments were 90 days late and SunTrust would not accept a payment unless I had accumulated all three months. I attempted to do so and called again the first week of April 2010, I had accumulated two months worth (Jan and Feb), which would have made the payments at that time only two months behind. Scott Smith was laid off in March so I knew that the spousal support I had been receiving would be delayed and sporadic rather than receiving regular checks every two weeks to go toward the payments. I was receiving solid paychecks and would have had the other two payments in May, leaving me caught up. When I called in April (twice) I was informed that I could not make a payment until I received a “repayment plan package” in the mail from SunTrust. At that time, the representative told me that the property was not facing foreclosure and that I should receive the package in a matter of days to a week or so. I did not receive spousal support from my ex husband until the end of April. I did not receive the package by the first of May and called again attempting to make a payment and to see what the hold up was. I was again told that I could not make a payment but that the property was not in danger. I was laid off May 4 leaving me with no income other than the spousal support, which I was saving and not spending. By the second week of May I was receiving letters from an attorney stating that foreclosure had been initiated. My ex husband notified me of a letter that he received also. Since I called SunTrust and they advised me that foreclosure was not initiated, I told him that I was attempting to solve the problem with the payments, that SunTrust would not allow me to pay them, and that the money he sent for spousal support in March and April had gone into my savings account for the payments once I received the package. I continued receiving documents from the attorney and called SunTrust once again on May 25 to determine what I needed to do. They instructed me that foreclosure was initiated and they didn’t have an answer as to why I was told that it had not been. I got the run around from the representatives and was finally told that they could not reach a resolution due to my unemployment. I wanted to scream at them by this point. All the promises of repayment plans, modifications, etc. was all a joke! I was immediately angry and disappointed that I had been working with SunTrust for six months to reinstate my loan, and was told that they could not help me. The last week of May my ex husband text messaged that he would be mailing the check for May’s spousal support. I instructed him not to, since I had to get some things ironed out and email him the options available to him. I was also going to be out of state the last weekend in May, and did not want a check sitting in my mailbox. I have been in touch with my attorney since the end of May to help me find a solution to this problem with the property. I felt as though bankruptcy was my only option and was destitute enough to follow through with it. When I met with my attorney on June 2 2010, I was instructed that there may be other options. I was informed that there are a great many people facing this same issue and that Mortgage companies are not helping those who are in need. The Obama plan is failing in my opinion. At this point, I was instructed to call the attorney and notify them of my attorney’s intent to counsel me and represent me through this ordeal. I did so on June 3, 2010. They told me that I needed to fax a written authorization letter to them giving permission for my attorney to discuss my case. I followed every instruction and filled out every paper necessary for someone to help me. I have even tried lowering the asking price on the home IN HALF in order to try a short sale, but no one wants to do a short sale. Now I am facing foreclosure and have had to move in with my parents until the ordeal is worked out. I am unemployed, destitute, and angry that I received nothing but more hurt from SunTrust and their “hope” solutions. I have never found myself in such an ordeal. I am planning on attending law school, but now may not be able to since I may face bankruptcy due to the foreclosure on my home. My ex husband is three months behind in his spousal support and has made no effort to pay it. He has made no effort to help reinstate the loan, or to offer me any additional assistance. I don’t know what to do.

				I am currently two months behind on my mortgage payment through Chase. The bank refuses to refinance or do loan modification to help us out. This has been an issue for us for quite some time. Chase will defer payments, but it does not seem to help. My health was what happened this time, diabetic & congestive heart failure. Medications and doctor bills are in the way now. My wife had talked to the bank yesterday and they said that they are looking toward foreclosure.

				I've really gotten hit lately financially: divorce, patent lawsuit, business partner embezzlement, and more. I've considered bankruptcy, but my situation is rather complex even for that. Bottom line regarding the mortgage: The house is in Milwaukee, Wisconsin and was jointly owned by my ex and I for many years. I got sole ownership of the house upon the divorce. Initially I lived there, but since I became in a bind financially, a few months ago I moved out and let my ex, his new wife and my 2 college-age daughters move in. My ex, in affect, paid me rent payments for the amount of the mortgage, which was a stretch even for him. Having made my last mortgage payment three months ago, I am in default. I moved to Little Rock and am staying with a friend. My ex, his wife and my 2 daughters still live in my house in Milwaukee, although they realize the situation and that they might be forced to move soon. To add to the situation, with the real estate crash and large-ticket repairs needed such as a new roof, it's going to be hard to sell the house for enough to cover my mortgage. The last tax-assessed market value was $224,000, which frankly is high given what I've seen the homes in the area selling for lately. My mortgage is $194,000 and with the repairs needed, it'll be lucky to sell for enough to cover the mortgage IF I could find a buyer. What are my options? In some ways I'd rather get rid of the property as it's an albatross around my neck, but I have family living there. Could I get a deed in lieu of foreclosure with some stipulation to give my family maybe 3 months to move out? Maybe Bank of America might be willing to work something out with my ex, i.e rent, sale, etc.

				<title>Chase put me in this trouble</title>

				I applied for loan modification months ago. I was under 60 days late on my mortgage payment. I was having financial troubles so I applied for Loan Modification with Chase. I completed my trial payment for 3 months and my trial payment continued for another 6-7 months. I may have missed a couple payments on time after first 3 months but I payed extra some months to make up for late payments. My Loan modification was denied and Chase says they applied my trial payments to cover other costs in my loan and now demands $14,221.00 for being 10 months late. Their reason to deny my modification was that I was not under default risk because I have significant equity in my property and was less than 60 days past due on my mortgage. Also they paid my property taxes of about $8000.00 and issued property insurance for annual $9000.00 and put it under escrow. I did not know they would pay my property taxes under Loan modification process. I requested them to pay back these amounts as I am willing to handle property taxes on my own via monthly payments and issue my own property insurance with another much cheaper provider. So long story short, Chase has put me in a big hole as they now claim I am behind 10 months on my mortgage payments and they did not apply any of the mortgage payments and trial payments I made towards my principal. How can I save my house as I cant pay $14,221.00 to bring my account current! Please help. Should I re-apply for modification?

				I have been working with my mortgage company (Litton) to do a loan modification. After being told not to make a payment for the entire time they were working on the loan, they came back with an offer for loan modification: the offer was to raise my mortgage by approx. 200.00 a month. I sent the hardship letter in, all my info, and it took several months for them to work out. They came back after approximately 8-9 months and said I didn't qualify for lower payments. Now, the arrearage added on to the end of the loan will increase my payments. I couldn't even afford them before, this is why I needed a loan modification. How can I get a loan modification with Litton to lower the payment?

				The problem i am encountering with Saxon, my mortgage company, is that i got behind two month they decided to put me on a 3 month fixed trial loan modification to pay 715.00 a month for 3 month until Dec. 2009. I sent the payment of 715.00 on 2010 and they rejected the payment. they accepted Feb, March April, Rejected May, June, and July. I was first informed that my loan modification was turned done in May and in June I was awarded the trial loan modification again. I have been informed that they have come up with this new payment of 515.00 a month starting Aug. with their in-house loan modification. They have refused 4 of my payments. In the past my understanding is that no mortgage company is suppose to refuse a payment but they have refused my payments and they have me on hold. Please help me. I need a loan modification with Saxon to stop foreclosure. I also have COPD,Asthma and this was one of the reason why I made my payments late.

WITH ME HAVING NO NOTICE, AND AFTER I WOULD CALL FOR HELP. THEY TOLD ME I DID NOT QUALIFY FOR THE LOAN MODIFICATION TO HELP ME AND MY FAMILY. 				I need to save my home now. I need to know if I can get this done. Have had a very bad 18 months. My mother in law moved in and then past away 2 months later with no money saved for expenses. Her husband also lived with us and has been out of work for 18 months. In July of 2009 I was placed on a six month Forbearance agreement with Chase. Chase does not accept personal checks for foreclosure, so they returned mine and started foreclosure. Shortly, I receive a letter from Chase Lawyers confirming foreclosure proceedings. This is what brings me here asking for help. I need help getting a loan modification from Chase.

				We have tried numerous times to settle our mortgage situation with Bank of America. Till this date we are stuck wondering what is going to happen to our home. We have been on several phone interviews with them but still no forbearance. My husband and i had transitions in our jobs which greatly affected our finances. We are getting back on our feet and are ready to do whatever it takes to stay in our home. We love it and want to keep the promise we made at closing to pay for it.
