Egypt, Obama and HAMP Program

After two years of the Obama Administrations effort to Stop Preventable Foreclosures the Country is in worst shape now than it was in 2008 when the crisis started. We all know the damage the governments effort, HAMP, has caused families, community, cities and the economy overall.

We all know where the problem lies; the servicing industry, and their unwillingness and inability to implement what is a good program. HAMP has failed not because of the program design but because of the servicing industry’s greed.

I our opinion we have only one option left to save millions of families from losing their homes - and real estate values continual decline which will impacts every American homeowner and the economy for years to come.

The main problems with the servicer are improper underwriting according HAMP guidelines and lost document resulting in long delays and denial of application. We know there are other problems but this effort, which will be referred to going forward as “This Egyptian Thing” or “TET”, will be an attempt to change what we can change. “TET” main objective will be to take the sole underwriting authority out of the hands of the servicer when possible. Neutral Third Parties are needed to make sure every American is being given a fair hearing on a case by case basis. The servicing industry will change once they know they no longer have a monopoly on the underwriting process and that professional underwriters are checking on their work product.
“This Egyptian Thing” when referencing this effort - has been chosen for a number of reason; we just witness a large group of people organize quickly, offering a single message for change. Americans should stand-up and take notice; we have just seen in Egypt – one hundred thousand people, organized with social networking, and had the power to bring a government down in 17 days. It is not our intent to bring down our government but to get them to listen and save our Country’s economy and the millions of hard working Americans homes when possible.

Our goal would be to have at least 500 people to start but 1,000 would be better. Based on the millions of Americans in this fight currently along with the tens of millions of American Homeowners who are directly affected by the foreclosure crisis, we should be able to gather enough support to have a positive impact

This terrible situation has gone on too long. Many American families have lost their homes to foreclosure or are in the process of doing so – in many cases this does not have to happen. The Obama Administration and Congress has not done all they can to save families and real estate values in our country. We can no longer sit idly by and watch this happen to good people. This mess is also hurting every homeowner in America and the media ignores the situation. Two years is long enough – we must take some kind of action now. It is time to Walk Like The Egyptians. I hope you agree and will join the effort – We Need Change Now!!!

Chase isn't helping with loan modification

My husband was laid off in August 2009 and again in May 2010. Applied for a forbearance agreement in Oct 2009, made three on-time payments. Was told by Chase not to make payments for three months afterwords. Applied for a loan modification in May 2010, was denied in Nov 2010 for insufficient income. Because Chase took so long to deny my claim I am now 14 months behind and owe $16,000. My husband just got another job and we can now afford our payments again. I would like to work out a repayment plan forbearance with Chase. I received a letter today stating that I owe $16,000. I cannot pay $16,000. Please help.

No matter how much paperwork I have submitted I cannot seem to get to a loan modification with America's Servicing Company (this has been going on since early 2009). I have had to consider filing for bankruptcy to prevent the foreclosure sale and am at my wits end. I believe I could qualify for a HAMP Program's loan modification but my loan processor will not allow me to get into consideration the program. Please help

Ocwen told me to miss payments

My loan was sold to Ocwen from Saxon Mortgage in November 2009. I was not behind on my payments until then. The new company has a different pay on date and I am paid once per month on the 15th. That makes all my payments late and I incur late fees every month that compound monthly. Ocwen is not willing to work with me on the due date and the loan modification department has asked me to send numerous pay stubs and forms by fax. I never hear any results and when I call they continually put me off or ask for more pay stubs. They are operating from a calling center in India. I had two different representatives to tell me not to make my payments during the loan modification process and that has gotten me even further behind. I know they are scamming to get possession of my home. I have just today doubled up on my monthly payment and now am 1 month late with $559.62 worth of late fees and charges. HELP!!

Avoid Foreclosure with Chase

November 7, 2010 My mortgage was with CHASE Home Finance LLC. I love my home and planned on living here until the day that I die. I had made all of my payments on time and was not behind when I first applied for the making homes affordable program. I first applied for the making homes affordable program in July 2009 after the sudden death of my Mother whom I was taking care of for many years. I knew that making ends meet was going to be rough for a while and thought that Obama’s program sounded perfect. I sent application and ALL necessary paperwork via priority mail on July 27, 2009. On July 30, 2009 I called CHASE I was told they had received my paperwork and everything was in order and being forwarded to the department for review. On August 4, 2009 I phoned CHASE again and was told that my case was being processed and reviewed and that I will get approval in 30-60 days. On September 25, 2009 I received a default letter and called chase immediately to find out what was going on. I was told that I needed to re-send everything because several documents went missing. That same day I faxed all paperwork again and received phone confirmation to verify they had received my fax and had all necessary paperwork. I was told the paperwork was being forwarded to department for review and to expect an approval letter within 30-60 days. On October 13 I received a forbearance plan agreement for someone located in Tennessee! It had my name on it but had a different loan number and not my address!! I immediately call CHASE and asked what was going on. They couldn’t explain how and why I was mailed someone else’s paperwork and told me that I would have to re-send everything again. I was not happy about this but re-sent everything once again. Again I received phone confirmation that all necessary paperwork was received and being forwarded for review. On November 3, 2009 I called CHASE to find out what was going on. I was told that there was no record in computer of my documents being sent for review. I didn’t not understand how this could be true! I explained my situation and did not get any explanation as to how this could happen. I was told that if I wanted to keep my home I would have to re-apply and re-send all necessary documents. So I did. I sent everything by fax. I received phone confirmation that documents were received and being forwarded for review. On December 10, 2009 I had to re-send everything for the 5th time. This time I updated my financials, wrote another hardship letter, sent newer bank statements etc. Again I received phone confirmation that everything needed was received… I was told that CHASE was aware of problems dealing with customer paperwork and was working to improve their program overall. On January 11, 2010 I still had not received any paperwork from CHASE and was in constant worry so I called CHASE. This time I spoke to a nasty lady named Judy who told me that the only documents that they had received were from last July, that they had sent me several requests for further documentation and had not received necessary paperwork from me so foreclosure on my home had started and a sale date of 5/10/10!!!!!!!!! I was flabbergasted to say the least. I attempted to tell her that her records were wrong and told her how many times I re-sent paperwork, who I spoke to since July, and that I never once received ANY kind of paperwork from them. She told me that there was nothing left for me to do - that I had lost my house and that was that!! In tears I begged her to help me. She put me on hold for over 10 minutes and when she returned she said that she got special approval for a forbearance plan - the only way that I could save my home. She hurriedly explained the plan to me and said that once I signed and returned the agreement the auction/sale would be postponed/cancelled and my home out of foreclosure. I received the paperwork and immediately signed, faxed and mailed to back to Chase. I made each payment early by western union. I called after sending payments to make sure they got each payment, to check the status of my home, and ask when I would receive further information. Each time I was told that payment was received, I was in no danger of loosing my home, my home was not in foreclosure, there was no auction date set, and I should get further information in the mail before final payment due date. On April 10, 2010 I phoned to find out why I had not received further instructions, to ask whether or not I should keep making payments, and to check the status of my application for modification. I was told that everything was in order, not to continue with payments, that I had completed payments for forbearance plan, not to worry, and wait for further instructions. On May 10, 2010 I called and was told that my case had been scratched, that there was NO record of my forbearance plan agreement, no record of my payments, no record of my applications and documents for modification program, and that they DIDN’T know that I wanted to keep my home.!!! Once again I was in shock to say the least. I asked to speak with the manager and put on hold for over 10 minutes. The next person claimed to be the manager but was very unprofessional and non-chalet. He told me that I would have to re-send everything and once they received everything my case would be re-opened, sent for review, putting foreclosure on hold. I re-sent everything on May 11, 2010. I phoned chase after faxing documents and spoke to Robert. He told me that my foreclosure was on hold and said that his computer was showing all previous paperwork and all notes dating back to July 2009. He summarized what he was seeing on his computer, we went over all of my paperwork and financials and said that I was approved for The Making Homes Affordable Program. He acknowledged the fact that Chase has major problems helping customers with this program and told me in about 1 month there would be one person in charge of my case instead of numerous departments. He assured me that I was not loosing my home and in no danger of foreclosure or sale. On May 28, 2010 I called again concerned cause I had not heard anything from Chase and in constant worry. I was told my home was NOT in foreclosure, they were still reviewing my case, and that all documents were intact. I was assured that as long as my case was active/in review foreclosure proceedings could not go forth. On June 2, 2010 I phoned Chase to find out that a Ms. Brown was assigned to handle my case. I spoke to Johnny who told me that my paperwork was intact and still being reviewed. Foreclosure was postponed/on hold. Ms. Brown was unavailable so I left a voice mail for her. On June 29, 2010 I still hadn’t heard from Ms. Brown or Chase so I called and left another message for Ms. Brown. I immediately called again this time speaking to Johnny again who said that there seems to be some missing documents and that I would need to re-send everything. This was the 9th time I had faxed all necessary documents. On July 2, 2010 I called, spoke to Johnny again because Ms. Brown was unavailable, and got confirmation of documents received and was assured that they had everything needed. Johnny said he was going to hand deliver paperwork for review, not to worry, foreclosure on hold and auction date postponed. On July 23, 2010 my case was still in review, don’t worry, not in foreclosure, and will receive approval in mail within 30 days. Each and every time I spoke to a representative at Chase I made it perfectly clear that I wanted to keep my home and would do whatever necessary to keep my home. Time and time again I was told different stories about their mishandling of paperwork and continued to re-send any and all documents they required. Time and time again Chase has lied to me. Time and time again Chase assured me that I didn’t have anything to worry about - that I was in NO danger of loosing my home. On August 13, 2010 Notice taped on front door, dated August 11, 2010, stating that Fannie Mae now owns my home!!!!! I immediately call Chase and they would not tell me a single thing!! They said that I would have to call their lawyer for information. I phoned their lawyer and they told me that the case was handed back top chase and to call them. I called chase back and they wouldn’t help me. They would not give me any information whatsoever. They told me that it was my fault I lost my home and was my responsibility to call to find out the status of my home. They said no notice would have been given or mailed to me anyhow. I should have known. They also told me that they had no affiliation with the attorney they told me to contact. They told me the attorney could give me further information. I again called Shapiro law firm and was told the case was handed back to chase. No one would help me and tell me what the heck was going on!! I didn’t know what to do - I didn’t know where to go for help I tried to get help from several programs, foundations, counselors but as soon as I told them about the notice taped to my front door they said that there was nothing they could do to help me. I spoke to the founder of the Foundation for Hope who told me that he could help me as long as no trustees deed upon sale papers were filed with recorder. I went downtown on August 18, 2010 and there were no foreclosure papers and no auction/notice of trustee‘s sale papers filed. So I joined their foundation, paying membership, solely because they said they would be my advocates and handle everything. On September 14, 2010, more than a month after sale date, I received paperwork from law firm and included was copies of papers recorded on September 9, 2010. The Foundation for Hope informed me that they couldn’t help me after all (paying $600) for nothing. The gave me a referral to a FHA counselor who supposedly is well known in the state of CA for reversing sales, getting original modifications, and lower interest rates for a flat fee of $4000.00 This sounds great although I cannot afford this kind of money with no guarantee. She would not consider reducing her fee and wanted payment in full before reviewing my case. Her back account was also with CHASE!! I have made several written and verbal requests to Chase and Fannie Mae for someone to review my files because I know that Chase made numerous errors. If someone would review my files they would see that I was and am a perfect candidate for the Making Homes Affordable Program or other programs. I have always made my payments on time and applied for modification to help get us through some difficult times. I have contacted Fannie Mae numerous times to try to find an alternative to eviction and they have not responded. I do not understand why they would rather have an empty house when we could be paying them for this house. The past year has been a complete nightmare! I have been in constant worry/panic because of Chase on top of trying to cope with the sudden death of my Mother. I truly believe that I lost my home illegally! I know that documents were mishandled. I believe Chase didn’t follow guidelines set forth by President Obama. I think that the lawyer for Chase and Fannie Mae may have violated laws. I believe that once Chase assigned 1 person to take my case we were simply signed off without knowledge and review of file history. I know that Chase violated forbearance plan agreement. I have been treated unfairly! I love my home and do not want to move. I am a single mother of 2 small children. I have lived in my home for almost 10 years. My children love this home. We have nowhere to go and no family to help us. On November 3, 2010 I went to my eviction court and asked the judge to please help me! He said that it was out of his jurisdiction and postponed my hearing until the 22nd of November. I am supposed to be out by the 12th of November leaving my property in broom-swept condition in order to receive $1,000.00. I do not know if we still have to be out by the 12th .

Does Bank of America give loan modification?

In the last year we have had many unexpected events that have caused us to get behind. We have tried to work things out with Bank of America but the more we pay the more they ask for and we never get current. The events include my husbands mom being in icu for 5 weeks, the birth of a child, and his hours getting cut drastically at work. We are now a two income family and can afford our current payment but not more. The bank said they could allow us to pay an extra $700 monthly for five months but my husband only brings home 1800 monthly and I bring home 1500 so we could no pay daycare or utilities and food if we did this. They call it a forbearance, but we need a loan modification where they spread the amount we are behind over the life of the loan, or add months to the end of the loan.

Chase won't give Loan Modification

We have been trying for MONTHS to get a loan modification from Chase Home Finance. We have sent in document after document after document and then they want something else. I think they are deliberately thwarting our every effort to get a workout plan. They will not send it to the underwriter (Freddie Mac) they say until they have all required paperwork. I just sent in another batch of paperwork they requested and there's something NEW again. During all this time we paid what they asked us to pay and on time until they put it into active foreclosure in December and now they refuse to take any payments. I am at my wits end and need serious help. Thank you.

GMAC won't give Partial Claim

I have sent all required paper work to GMAC & received a letter stating I was denied because "We service your loan on behalf of an investor or group of investors that have not given us authority to modify your loan under the program requested." I requested a special forbearance or partial claim & GMAC still insisted they needed permission. Why was I not informed at closing that I would have conditions placed on my FHA loan if I need permission from someone else? Is this not a government backed loan? Is this not something offered to help people who had extra expenses from a family death, and medical issues? Cost that were unseen. I still would like to find out how to get a special forbearance or partial claim started immediately. It took GMAC over 30 days to give me an answer on my request for their loss mitigation. I have a FHA 30 year fixed mortgage that was refinanced in December 2009 at 5.85%.

Chase isn't helping

We are a military family. We have been trying to work out a better loan with Chase (formerly Washington Mutual) for the past 2 years. In the process our bank was taken over by another bank. We were in the midst of loan modification and even had terms. We were current with our loan and told to have our loan taken off automatic payments. Then we were passed around to people. They acted like they were trying to help us. Then they became rude and condescending and eventually shoved our loan off onto the "3 month trial period" of paying a loan. We were told to take our loan off of automatic payments in Feb 2009 and then all of sudden after months and months of being told we had a modification and given terms we were paying a 3 month trial mortgage payment for those who couldn't pay their loans. Which really doesn't make sense to me. We have all the paperwork that told us to take our loan off automatic payment. In my mind I can't think anything other than we were set up for failure. I remember crying and trying to figure out where to pay our mortgage to after becoming suspicious of not having official paper work from Chase for our supposed modification with terms in May of 2009. I have to say that we would have never ever encountered this mess if my husband wasn't deployed to Iraq. He was given orders and we rented out our house. When he was in Iraq in Oct 2008 he saw that underwater houses could receive more favorable rates. He then called WaMu (now Chase) and one of their representatives that works for military overseas deployed soldiers at Chase told my husband that everything was going to be okay and that she would take care of everything. That has hardly been the case. We have been forced into a short sale and have tried to sell unsuccessfully since January 2010 until now. I think Chase does not know who owns the loan and does not have the proper documents and is now forcing us into a foreclosure. We have had 3 short sale companies/attorney's working for us and still nothing. My husband even had access to a short sale commander that details what's going on with his short sale. The latest entry in the log is it is now in active foreclosure. They sent the foreclosure documents to my in laws' house after we have repeatedly changed our address to our now current overseas duty in Europe. But still the chaos and confusion continues. On the foreclosure documents it has the wrong information and has me listed on the loan and also Chase has wrongly filed a notice of default again with wrong and incorrect information. I am praying and want a resolution. My husband and I have always tried to do the right thing. Chase also reported the loan as late 6 months after saying there was no credit reporting as it was in forbearance as they were working on the terms for our modification.

GMAC refused my loan modification without giving a reason

I tried working with GMAC at first, asking for the principal reduction of the mortgage balance(Like most people, I’m up side down in property value approx. $106.000). I also asked for a mortgage loan modification; again, nothing happened. I only got as far as being put on a three month trial period loan modification program. After making all of the agreed upon loan modification payments as requested (of approx. $1,300 per month), I was informed that I didn't qualify. No reason was given as to why, even though I maintained as a matter of record, that I met all the criteria (several months behind in payments, apparent hardship verification, adequate and stable employment verification, and also under the 31% marginal threshold in income required by the government.) When I asked for a logical or even reasonable explanation for my denial and became somewhat frustrated at being given the run-around, I was told that I was argumentative and combatant and subsequently they refused to discuss the matter any further. Then they started foreclosure. Last but not least and as my right, I requested to be given the mortgage note holder contact information so that I might contact them personally. I wrote to them, but to-date, have heard nothing in response to my loan modification request.

Forbearance with Beneficial

Was unemployed for 6 months. Have been trying to keep up on bills but has not been possible. Next month will start earning my manager salary and will hopefully start to catch up. But Beneficial says they need lump sum of $12,000+ or foreclosure. Beneficial will not work with us unless we can pay this amount in 30-60 days. I can afford a forbearance but can't come up with that much money up front. Please advise what our options are at this point.

Help get loan modification with Citi Mortgage

I was told to fill out hardship package for a loan modification. The loan is behind from helping family members and a few unforeseen repairs. I have had the same job for 24 years making $70,000/yr. No one will help guide me in the right direction and the lawyer is working quickly on foreclosure. Citi Mortgage seems to be giving me the run around at times and had reassured me till last week that if we were in loss mitigation the foreclosure would be held up. But last week the person said that it did not stop anything. Extremely frustrated like everyone I guess and feel since this is FHA with insurance they could care less. I purchased the house in 2008 which was sold to Citi Mortgage approx. 6/2009. Please help. Even though I pray for resolution daily I'm losing faith.

Help with Loan Modification

I have entered the Loan Modification program of HAMP Program with Bank of America on 07/10/2010. On November 21st they decided I don't qualify because I don't have enough income. And of course I didn't have because i gave birth to my baby boy on June 15, 2010. Since last month I started working again I think I have enough income. Talked to them on December 14 and they said I should re apply for the HAMP Program for loan modification and that they will send the package to do it again. They never sent anything. When I started the trial loan modification program they told me to pay $774.99 each month every month on the 1st - which I did - so basically I am not late with the payment, I just sent what they told me. But they say now I have lots of late fee charges. This month I paid the full amount $994.40 on the 6. Please help. Thank you.

Forbearance to avoid foreclosure with Indymac

I have been talking to Indymac about a repayment plan/forbearance, but I always get different responses on the repayment plan. I am 3 months back now 4 because they mailed me back my last payment and I just received a letter from them dated 12/21/2010 if I don't respond in 30 days of this letter they will initiate foreclosure procedure. They are asking me to pay $14,200.00 within 10 days and 2600.00 for the next 5 months, that's way more then what I owe. I need help getting a forbearance to avoid foreclosure with Indymac.
