Had a series of World/Wachovia pick-a-pay loans. They engaged in equity stripping, predatory lending and outright fraud. We contacted a forensic auditor who immediately sent it to an attorney in Granite Bay, CA. Complaint was filed Monday. We are told our case is a classic one. The attorney is cautiously optimistic. Wachovia did not file the foreclosure on our first, but on our second. According to our attorney, this is not legal. Our attorney believes, like many other World to Wachovia loan refinancing, Wachovia did not get to keep the Promissory Note, but they are lost in some unknown warehouse because Wachovia never filed to transfer the P.N. This means they can't foreclose if they cannot produce the P.N. Our attorney thinks this will never see the inside of a courtroom. My advice is if you have a series of ARM loans, see a foreclosure attorney and a forensic auditor. Veritas Loan Audits in Folsom are outstanding. We are entitled, by law, to protection from this type of exploitation. If we all sue them, maybe they will change their ideas about exploiting the poorer communities.

Like many others, I have heard numerous different stories from Wachovia reps. This has only gotten worse since the Wells Fargo takeover (although I was told Wells Fargo does not deal with California mortgage customers). Also, Wells Fargo actually advised us to start missing payments. Unreal!

Same comments referenced regarding submitting information. However, I was told that after a year, the modification I was applying for was no longer available and I would have to come up with half of the outstanding balance. This smacks of fraud!!! Time for an attorney.

Aside from the attorney, the mortgage company was rather nasty. Making comments like maybe you just need to get a job, one lady even questioned whether or not I was a real man, or if I cared about my family because a real man would never put his family through something like this. It was very degrading and unprofessional to mention my personal life at all.

Wachovia has been inconsistent and out right rude. Since November 2008 we have been trying to get wachovia to look into our case as we anticipated losing some of our income and since we were current then they would not listen to us. It actually happened that the loss in income set in and even though we were current till March they still did nothing to assist . We are now three months late and they sent us a pre-forclosure quote. Everytime we call, it is always someone new who wants the same information all over again and we never here from them again.

I asked for modification from November 2008 through February 2009, only to be harassed and declined. I was current in November, but was told they would only help me if I were behind at least 2 months, then I let payments get behind two months and they said they would only help me if i were current. I stopped payments completely for last 4 months, I finally received a letter saying they would negotiate, but when I called the number I was still put through to first level customer service. I will provide what they asked one more time, but that's it. We'll see.

I have never missed a payment with Wachovia or been late, but they do not want to help. I did not conform to their formula (as I was told) for granting a loan modification. Their service is very poor & the branch that was so eager to grant me a mortgage does not even return my calls. I have been told by mortgage brokers that I know that I could qualify for a loan modification, as my loan could change if the interest rate changes on March 2011.

Wachovia continues to tell the loan representative from Modifications LLC that my modification is in review. Meanwhile, I've received two letters in April. One, that I had seven days to provide information for the short sale that I supposedly requested. That buyer/seller signatures were required, as well as HUD 1 documents. I had sent a request for a short sale and didn't have any offers to provide information for. The second letter came on April 26, stating that the bank intended to file a defaut in 30 days. Meanwhile another office continues to ask for documents regarding a loan modification through the company that has been working on my loan modification. It seems that this bank has too many divisions and one is unaware of what the other one is doing. Therefore, I get conflicting information. I am left to feel like I'm being strung along for the purpose of foreclosing on my loan. While I did receive a letter stating I was eligible for a loan modification under their "MAP" program, I never received a letter stating that they declined my loan modification.

We had called Wachovia on 17 occasions to try and work something out prior to missing any payments. Their response was that they could not help until we were at least two payments behind. We are now three payments due and they do not want to provide any assistance, only want to foreclose.

It seems the harder you try the harder they make it for you. You make your payment on time and that is why you can't refinance.

People who are paying their mortgage on time trying to work with them to avoid foreclosure are being treated very poorly. They seem to want my home far more than they want my continued business as a mortgage holder with their lending institution.

wachovia is not very trustworthy and lies to their clients they say one thing and do something else. before the 2 certified letters came about the sale of the house we recieved a notice that our payment would be reduced to 700.51 starting december of 2008 then 4 days later we got the notices that our house will go up for sale in februrary,13,2008 i do not think that that is right or being very honest with people.

In some ways they have been patient and understanding and in others they have been greedy and unwilling to work with us. They are making millions off people like us. They also charge and automatically withdraw $30 for every overdraft of our checking account to the tune of $3000 to $4000 for the year which could be going to our mortgage instead!

I changed my cell number to stop they daily harassment calls. They are the ture definition of 'corporate greed'. The bank with no heart and no conscience. They are preparing for a 2nd round of "World Savings' employee lay-offs. They have 2 law suits filed against them for unlawful practices and the corporation is 'hurting' financially. the lending service i had confused and tricked me into a neg. am. loan.i'm not a lawyer. they said my regular payment was 1,600 per month. they failed to state that it does not include principal or interest. it is impossible for me as a single parent to make a 3,200.00 payment a month.

Amount of my pmt (home equity loan) changes every month, and yet each time I tried to get notice of how much to pay I got the runaround. Even our attorney couldn't get them to start regular notices.

I have an auto loan with Wachovia Dealer Services. I have diligently made all my payments on or before the due date, which has been the 19th of every month, every since I first purchased the vehicle in February of 2007. On or about July 19th of 2007, Wachovia Dealer Services added an extra payment to my auto loan. Also at this time, they began holding my payments till after the due date, apparently in an effort to collect late fees. They have also reported to the credit bureaus that I am a late payer, which reflects negatively on my credit report. I have bank statements showing my payments to Wachovia on this automobile loan to be exactly as I have indicated. I have copies of canceled checks made to Wachovia, that clearly show when the payment was made. Furthermore, I have a letter from Wachovia stating that my August 19th payment (in the form of a personal check) was not paid and returned to them. I have a copy of that particular check showing it was paid and that the date written on the check had been altered. Once again, this was done with obvious intent to obtain a late fee. When I made my September payment on the 17th of that month, it was paid on-line, and I received an electronic confirmation number, which also stated that the payment would be posted within 24 hours. On or about the 29th of September, I received two letters from Wachovia. The first was a "thank you" letter from Wachovia, that indicated my September payment was made on the 26th, which is false. I then received a second letter from Wachovia, that indicated the payment made on the 17th of September couldn't be posted because the account number was wrong. This is also false. I have had several telephone conversations with Wachovia Dealer Services representatives, sent correspondence via fax, and asked to speak with supervisory personnel in an effort to resolve this on-going situation, which they have refused to resolve. I need a strong letter sent to Wachovia, that if this situation is not corrected ASAP I am fully prepared to file civil suit against them, and in addition pursue fraud charges to the fullest extent of the law. I will not pay late fees that I do not owe. I am outraged at this obvious and deliberate fraud attempt and falsification involved due to their altering payment dates, and making false claims that payments were not made on time. I am requesting that all late fees be removed from my account, my account information be corrected to show all my payments made on time, and finally remove all negative reports made to the credit bureaus immediately.
