We were with CITI for 4 years. No late pays; perfect record. Due to loss of income, we filed a bankruptcy. CITI sold our loan to Midland. We received a letter from Midland stating end of CITI, when they would last collect our auto pay mortgage, and when Midland would take over. 27 days later, no one has taken our payment. I called Midland 7 days into their ownership of our loan. Was told it would be deducted 13 days later. It wasn't so I called again, and again. After multiple attempts w/Customer Service, I was told our payment was not late and we'd have to pay $35 late fee + to do by phone there was a fee, to express pay there is a fee. We were told to mail it + the late fee. I refuse to do this! We own no late fee. We have black and white that says Dec 2 Midland assumes. Our payment was due to come out Dec 1 and that was CITI still. So, contacted our attorney and guess what - the reaffirmation we recently signed can be rescinded! Our attorney has faxed Midland to now tell them "keep the house". Seriously, after my experience yesterday, then reading all the posts last night...I believe there is no way anyone in their right mind would try to fight and keep a house financed by them. My impression is that this is some type of major scan at play and no one in our government seems to be doing anything and they clearly have been notified by hundreds. This scares the hell out of me, so I'll be a little old renter and the dream of home ownership can be cast aside. Unbelievable what has happened to ethics and morals all around!

They bought my mortgage from Citi Mortgage after my bankruptcy was discharged almost 2 years ago. I have never got a human on the phone and their customer service dept says to call back during business hours when I AM calling during business hours. Luckily we decided to let the house go into foreclosure as since it was discharged in my Bankruptcy they can't legally collect anything from me. :) So They can have this house...but I'm stripping it first! ;) Peace out Midland!

It should be noted that there's...other laws...one can use for things here. Lawyers and this pack of thieves call it "leverage", but by any other name, it's extortion. Any threat to your reputation or well being that is used to coerce your signing a document, paying money out, etc. that you would otherwise not willing do or be compelled by law or enforceable agreement is in violation of 18 USC 875 if it's done by phone, email, etc. or 18 USC 876 if it's done by postal mail. It's a felony worth up to two years in Club Fed for the parties involved and damages any position they might have.

They have been extremely difficult to deal with and they have submitted false information to our bankruptcy court to win a release of stay. This included reversing two payments in an effort to show we were behind. We have proof that every check had cleared.

Going over 2003 probate papers found deceased father had a CD serviced by Midfirst or Midland Bank that I thought was closed. Contacted the bank & got total run around. Just got letter from their escrow dept. asking for death certificate and house loan info. Gee whiz, how stupid these people are or perhaps their coming across that way hoping you'll give up and go away. I sent a letter to the original issuer bank of the CD today and hope they are willing to help. Midfirst: incompetence, lack of quality customer service and evading or helping the answers the customer needs help with. If this is the best Oklahoma can do they're in sad shape.

I love this home and hate to lose it but after losing my job 3 years ago and my salary cut in half and with allot of health issues and mussing work, we are just not making it..I would like to try to start over and keep the house and try to sell it on MY terms

February, 2008,we sued Midland Mortgage (Cause No. 08CV0102)Galveston, Tx, and (2010) MidFirst Bank(Cause No. 09-4159, Civil Rights Deprivation) & for violating our 2000 discharge order. MidFirst bought the FHA/HUD mortgage debt in 2005, Midland services the debt to date, still in our names. Our then attorney stole us out, I mean sold us out. We are Pro Se now in 2 suits against both Mortgage Co,and their Counsel, Steven Leyh, both cases are on Appeal at the 14th Court of Appeals and the 5th Circuit Court of Appeals. We are being forced/coerced by Judge Wayne Mallia, to sign Midland's, ambigious settlement agreement and mutual release that we never saw and accept their $40,000. The debt has been sold and re-sold for over 10 years. Google "ZOMBIE DEBT REFUSE TO DIE" and "PRINCE ELLA GREEN. FTC refuse to step in, no agency has been willing to help, even though we both are disabled/almost 60. The Judge would not allow the case to go to trial. We have refused to sign the illegal settlement agreement, it includes the discharged debt all over again. Our lives has been threaten if we don't sign and we may even go to jail/fine. This is a crime, unheard of, a Chapter 13, discharged FHA/HUD Mortgage debt, that refuse to die!!!, it is now 2010.

My husband was laid off and only worked 10 months in two years because of the economy. We called the mortgage company to ask if they could lower our payment. They put us on an unemployment forbearance program for three months and the lady we spoke with said not to pay or it would affect us getting help. She said our options would be to put the amount on the back of the loan, get a loan from FHA to make payments current, or modify the loan to include the late payments. When my husband went back to work they told us we still did not make enough for them to work with us. Mind you, we were never late until they told us to hold payments in order to receive help. Now they want it all up front. I would never give this company to anyone as a great place to deal with. They put you in a corner and then you have no way out. Did I mention they had us sign a repayment agreement before they could discuss our options, so no matter what, they have us in a corner.

this is a terrible bank, i am in the process of foreclosure. they are heartless and they are the only bank not trying to help with modifications at all, they tell you to submit paperwork and they turn around and tell you that if you are behind you need to come out with $ to pay your delinquent amount. if not the modification is not good, they tried to raise my mortgage payment instead of lower it. is ridiculous!

Before all this happen to my husband we tried to refinance and was told they no longer refinance loans in the DC/MD/VA area. My questions was if you can't provide a service to us in this area why don't you sell the loan and let us get someone closer to home to help us. My husband was laid off from work after 31 years of services, when the President came out with this program we start calling Midland to help. First we were told there is no help for FHA all the way to Dec. 2009. Then in Jan. 2010 I called all changed and they could help those with FHA loans and they told me to get the information offline and information told to us was to get all these papers in orders and send to them. This was done with a letter form my husband's job stating when he was laid off and why. Never got a call nor an e-mail back to say anything, I kept calling they kept giving me the run around to speak with someone. The last person I got told me that we were not qualified because we haven't been late and I need to get a job making more money. I thought the purpose of doing this was to lower payment especially for those folks who loss jobs. I can afford to make the payment alone now but for some reason they keep saying no. Our government need to step in and find out why some mortgage company are acting like this with their clients. I thought they got money from the government for helping people, this company is it needs to be taken away, because I know it must be far and in between who they have help since this program has started. Yes we do need to get together and sue this company.

I would love to get a class action law suit against this company. I have been in the mortgage industry for 15 years and I have never.... Also my note states priority of acceptance of payment in order to avoid default is as follows: Interest, Escrow then principle and before i was ever late I contacted them spoke at length regarding situation, explained home was vacant previous tenants left and repairs were needed, explained that the escrow account had a little over the 1st 1/2 of tax bill not due for another 4 1/2 months and if they accepted the I/O payment of $666.66 then I could rent home now since I had already had offers for $800 meaning the additional funds could be for escrow which would have provided about $227 less the tax bill which I could pay with renters deposit. Long story short they told me what to send and then I waited it was 1 day passed the 30 day window so now 1st late ever so I call since no answer yet and they tell me i do not qualify due to home vacant so I state I need to waive escrows then since this gives me the ability to rent home so they tell me I must request and it gets denied! It is my choice to escrow and if I have made on time payments since February 2006- April 2009 only 1 day passed the 30 day late due to their instructions and they deny me!!! Then I was told get a warm body in home then we can assist even if no rent income, so that is what I did and then they almost denied me (see below letter I sent them). Since then I had to evict this tenant which took from Sept to Dec due too money and court schedule and the whole Bull---- system that gives losers who do not pay rent over and over more rights than us who are trying to pay and always have in the past Tenant has garnishment currently and already evicted again! Now I get a modification after a 3 month trial which they made due on the 1st lease gives tenants until 5th so I had to struggle to make that work and then was told in April payment due for the original payment June 1 all late payments forgiven, I get paperwork 4 weeks later and it shows they have made my 5 year interest only loan ending February 2011 for 666.66 to 718 i/o until February 2016 they gave me a whole new I/O loan when I was going to be finally paying towards Principle and not only that added to principle escrow short gage of $1979 not correct and interest $6666.60 (10 months payment) ? only missed 8 but if they are forgiving them why adding to loan plus increasing term plus increasing payment just lowering escrow to make total same which will not work and not just that this is the 2nd group of docs sent to me INCORRECT!!!! I have pd 43 $38,000 and now they have changed the loan as if I am starting all over making it not worth holding on to in order to sell and not foreclose so i am left with no other choice than to possibly bankrupt. The modification will not assist in lower payments assist in selling and the difference they say they are forgiving yet added to loan rt will be taxed as I found out on 2nd that decreased from $30,000 to $16000 and for which I received a tax form showing that if I only payoff this amount (in August 2010 per mod this is payoff) then the difference is considered income so the total loan payoff will be way higher than value ever was let alone now. I know that this company has broken many laws I just simply do not have the money for an attorney. This whole thing has hurt me beyond just losing a home but my lively hood since I am in the finance industry this has ruined credit and now hiring is difficult. If they would have 1st not lied to me when I contacted then before late regarding vacancy I would have waived escrows (no late payments ever can not deny me so they say or so I know you should be able to waive escrows after as long as I have had loan) which would have rented home right away to good tenants with a management company that was handling it all! I did not want to accept offer knowing I could not pay difference and chance renters getting put on the streets--so please HELP as soon I will need to do something still unemployed and last benefit check next week and since mod not less than but the same rent received will cover but late on 2ND and now with new terms (which not signed yet docs keep coming in wrong) no chance to sell without losing there and tax time better off bankrupting wish that was not the case. HELP!!!!! And now to mention I have received incorrect docs twice and 1st mod payment due June 1 which until I receive not only correct docs but explanation as to why new 5 year i/o term and where figures came from as well as agreement to allow waiving of escrows since only owe actually $53 true bills vs collected amount which is also an issue where did the 5 months I pd go they state mods are calculated differently yet can not explain. Well I am in industry and I calculated the facts!!! I would love to have the funds to hire an attorney to sue them for they caused this on me I provided options being that I do this or did this for a living which they caused hardship when not allowing as the note stated or then allowing escrows which are not funds to them and i am responsible for they just hold them then after only 2-3 months late filing for foreclosure so those fees have and I believe continue to accrue since they state until this paperwork which they can not get correct is signed received and 1st payment made which means basically i have to trust their word giving them all that they ask for yet I have to wait and see that they deliver what they say when they can not even get it in writ ting correct nor explain any on it!!! I stated this in a letter to Midland *Disrespectful Statements- My comments regarding statement, not made before now out of respect!* "Why did you not sell or rent home for more"- are u in today's world, do you think I have not tried all of this, values decreased making selling not an option unless I wish to pay to sell and rent is steadily decreasing, we are in a renters/buyers market (if you won't someone else will) which resulted in having to finally give in and accept anything in order to save home due to the fact Midland would not assist me earlier with figures so I would have had an amount to work with! "Why don't you get a job" - I have been seeking employment and have had many interviews but as it is apparent the field and position I have 15 years invested in jobs are if even existent very limited and very unpredictable. For example I have been contacted for interviews from career builder, monster, etc and even though I apply to what seems like 20 different openings they are the same job but through different staffing agencies and then after interviewing with staffing agent the company requesting placement puts a freeze on hiring or shuts down, I found all the applications were for 3 companies Suntrust, bank of America and Taylor, Bean & Whitaker. I was made an offer from Taylor, Bean & Whitaker which immediately following was shut down by the FBI and I have interviewed twice with Suntrust and Bank of America after which they either laid employees off or hired less qualified less experienced individuals so before you make accusations and judge someone know your facts!! "Why don't you get a job paying more"- As stated above salary earned over past 10-15 years is no longer being offered and if I were to go into an entirely different field I would earn even less!

I contacted 3 lenders requesting for eligibility of refinancing my home. The lenders indicated that it would be possible with the exception Midland Mortgage Co. having reported my account in default for the last 12 months every month on my credit report . Back in February I had mentioned that I had disputed this with the credit companies. In attempts of getting this corrected Midland Mortgage Co. And South & Association. have caused me more damage than I had expected. Therefore I'm sure you are aware of the provisions in the Fair Debt Collection Practices Act (FDCPA), and I am requesting that Midland Mortgage Co. Correct this false information. To refresh Midland Mortgage Co. Memory on what constitutes legal validation; I gave them a list of the required documentation: • Complete payment history, the requirement of which has been established to prove that these payments were made 10-15 days in advance. I'm sure you know, under FDCPA Section 809 (b), Midland Mortgage Co. And South & Association P.C. are not allowed to pursue reporting an inaccurate debt if it is not validated. They should be made aware that in TWYLA BOATLEY, Plaintiff, vs. DIEM CORPORATION, No. CIV 03-0762 UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA, 2004, the courts ruled that reporting a collection account indeed is considered collection activity. And § 602. Congressional findings and statement of purpose [15 U.S.C. § 1681] (a) Accuracy and fairness of credit reporting. (4) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer's right to privacy. (b) Reasonable procedures. It is the purpose of this title to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this title. While I prefer not to litigate, I will use the courts as needed to enforce my rights under the FDCPA I look forward to an uneventful resolution of this matter. I think I also need A Forensic Loan Document Review is a complete investigation of your original loan documents to identify any fraud and locate all the violations of your federally protected consumer rights. Truth In Lending Auditor do complete investigation financial and legal department to look for solutions of Fraud or lenders Fraud.

It seems unbelievable how a mortgage company can ask it employees to go to church on Saturday and Sunday, ask forgiveness than on Monday go back to taking advantage of them until Friday to complete the cycle. I have read all your complaints and cries for help. And this is the only thing I can do at this time. Dinner is over, it is time to give those that you sold the mortgage to a chance to be treated as if you would have them treat you. They did not take anything away from you, so why are you taking it away from them.

The FDCPA applies to personal, family, and household debts, including debts associated with the purchase of a car, for medical care, for retail financing, for first and second mortgages. The act regulates the conduct of debt collectors: any person who regularly collects debts owed to others. This definition includes lawyers who perform debt collection services on a regular basis. Even where money is legitimately owed, a debt collector's conduct is restricted by this law. The FDCPA restricts debt collectors from engaging in conduct including the following: *Contacting a third party who does not owe the debt, such as a relative, neighbor, or your employer. Co-signers to the debt, however, may be contacted by the debt collector; *Threatening to refer your account to an attorney, harm your credit rating, repossession or garnishment, without actual intention of action on the threat. Please note that a debt collector may warn you of an actual impending intention to refer your case to an attorney or to report your debt to a credit agency. What they cannot do is use a false threat to try to intimidate you into paying; * Making repeated telephone calls or telephone calls at unreasonable times. The act defines unreasonable times as contact before 8:00 AM or after 9:00 PM, unless you have given the debt collector permission to contact you during those hours; *Placing telephone calls to an inconvenient place. For example, contacting you at work in violation of a policy by your employer that is known to the debt collector or following a request by you that they not contact you at work; *When placing a telephone call to you at work, informing your employer of the purpose of the call, unless first asked by the employer; *Using obscenity, racial slurs or insults; *Sending letters which appear to have come from a court; *Seeking collection fees or interest charges not permitted by your contract or by state law; *Requesting post-dated checks with the intention to prosecute if they bounce; *Suing in courts far removed from your place of residence; *Making certain false representations in association with efforts to collect the debt, including the false claim that the person contacting you in relation to the debt is an attorney, falsely claiming to have started a lawsuit, using a false name, or using stationery that is designed to look like an official court or government communication; *Using false claims to collect information about the debtor, such as pretending to be conducting a survey; *Threatening you with arrest if you do not pay the debt.

Dear Mortgager and mortgage specialist From Guthrie, OK Not all mortgage companies are evil. I do understand your truth in trying to explain your side. But the truth in this mortgage company's area is not foreclosing. It is the fact that if you have the opportunity To accomplish putting a small savings in your pocket, instead of assuring that the customer is taken care of, and not get caught you would do so. Some do it some do not. Understand that some of these people work as hard as you do to earn a living and pay their payments on time. But because your work colleagues feel the need and temptation to post payments after the due date allows the manager to fund organizational functions and a few dinner out with the company awards dinner. It happens! You quote $58,000 when foreclosure occurs. My question is how much is taken in on late charges, and where does the money get applied? How about a little honesty here.

Having worked for several different mortgage companies, I can tell you this with all honesty: People ALWAYS THINK, "My mortgage company would rather foreclose on my home than keep me in it." THIS IS NOT TRUE!!! The mortgage company sustains an average loss of about $58,000 when foreclosure occurs (TowerGroup study). They are in the business of providing mortgages - not owning or selling homes - and would always prefer to keep you in your home. And if you would make your payments on time, you wouldn't be foreclosed on. Um, duh?

Midland Mortgage Fraud for profit Midland Mortgage Complaint My loan was sold to Midland Mortgage and the nightmare began. Not only was I never Late with a payment they applied late charges to my account every month for the 18 months. I send my payment at least 10 days before my due date. But alas, Midland Mortgage Co. has a neat little "scam" of holding the payment until after the due date and charging me late fees. I figured this out and started having to "waste" my hard earned money sending the payment return registered mail receipt requested. Now my attorney is looking at everything. And no, I have not notified Midland Mortgage Co. that I have an attorney looking at their deceptive practices. They'll find out when it is revealed for the cons they are and I own my house. And let's not even go there as to the disposition and attitude of their employees. Every time you talk to someone you get a different answer. I am not sure what their training is, or lack of, but it. But from what I can see is that they seem to hire people who have absolutely no people skills. They are given a card to read from and the only thing that can be said is "your loan is in default or foreclosure, and you have several options one is we can set you up on a repayment plan". I have to go through 2 or more people just to get one answer, then call back to see if I will get the same answer again. Question: If you pay your payments before the due date, have over $1600 in a suspended account with money they do not know what to do with, and they foreclose on your house what chance are we being given? Midland will tell you they are trying to help you. I have heard lately in the media that banking is doing well on Wall Street, The housing market is has increased. But foreclosure has doubled and we have more repayment plans than Mortgage. I would guess that 8 out of 10 people in the United States are on a repayment plan or have filed bankrupt. So how are all of these people surviving? Midland Mortgage Co and Midfirst Bank have a plan and were not in it other than supplying them with your hard earned money so they can live in their 1.2 million dollar houses and laugh, because=se they think you do not know. Is this the AMERICAN DREAM? If you have a way to do it, get your home mortgage away from Midland before they ruin your credit rating, treat you like crap, and pretend they are God! 1. Pay your payments 5-10 days prior to the due date if you can. 2. Make a copy of the check, Money order, before you send the payment. 3. Send your payment return registered receipt requested (Green Copy) 4. Note when you wrote the (check /money order) the month it is for, check number, account number, date it was cashed, and ask for verification when it was cashed. 5. If the check is sent back from Midland Mortgage Co. Send another same procedure. 6. Keep your own Payment Ledger, attach all the information and give it to your attorney he is not the bad guy. But the one who gets all the crap. If you follow this small list of items you, and your attorney can sleep good at night.

Same story with us. Years of owning our home , paid on time, the mortgage company First Horizon sold us out to these demons. These say they don't get payments, charge fees, put our home in foreclosure. Very, very evil organization. I want to know how to get a class action suit going and whatever else needs to be done to offset this . I want to approach the media fro a start in our state with this story and take it from there. This needs to get taken care of immediately! Hopefully others will go to hi profile media exposure with this dilemma. That and law suits, and much prayer with bring them down.

Will accept payments by mail and delay cashing them; will fail to complete auto withdrawals from accounts on time and will report both of these as your failure to pay on time. Company has no recourse for online or over the phone transactions; all must be done by mail. When requesting payment assistance, Midland will arbitrarily determine whether you are eligible or not based on their consideration--not your actual proof of income.

I was advised by an attorney to ALWAYS send payments with a return receipt. It costs extra but helps protect you from some of the hassle with this company. Also, if a loan is sold to another lender, he said sometimes the seller will deny receiving your payment. Then the buyer demands the same (duplicate)payment and this puts you through a lot of unnecessary grief.

I have never been late with a payment on my account until this past august at which time I had just filed bankruptcy but wanted to keep my house...I had been making my payments over the phone within my grace period ..then I found out my payment which I had made did not go through when I called Midland about it they told me because of the bankruptcy I could no longer make payments over the phone and would need to wire the payment to them..which when I asked how much that would be they told me it would be $25..I said ok until I got to the bank and there was also a $20 fee for the bank to do this also..which I was not told about..well, anyway..now I am being told that I have to pay late fees for all the past payments that I have made due to fact that they were received after the grace period..which I originally was told as long as it was postmarked before the grace period was over it would be fine...now I am being told that this was untrue and that I would have pay all these late charges..I have never had this with the other companies who had my loan, like gmac and rainbow..Also during my bankruptcy my attorney asked for an affirmation to keep my house and Midland never even responded and now say they never received anything..they even told me that they never found anything that even shows I filed a bankruptcy...its all right there in black and white..they are refusing an affirmation..I have never had any problems with my loan until they took over last year...I am living in a home that I pay for every month but who knows if I will ever own it? Its horrible

Originally I had a home loan with First Horizon which was alright. They had a local office so I could make payments there and talk to them about the loan. Then it was sold to MMC. Which my payments were the same but customer service seemed sub par and not having an online payment option just seems silly. Also their website seems like it was made from a high school student with no detailed information about the loan and it's status available. I switched to USAA and have been very happy with their customer service and my new low payment thanks to my amazing 4.375% interest rate. MMC just has sorry customer service ... now I have to get my 1098 from them ... but woohoo surprise surprise no email contact and I am deployed to Afghanistan ... guess I will wait till I get back home to file taxes.

WOW...I have read every post...thought I was the only one in the boat of deception. My 184,000 dollar home loan transferred from GMAC about a year ago. Asked for modification on an FHA Mortgage due to a massive reduction in income. After paperwork submittal to Midland Mortgage...customer service indicated we cant help you until you are late. After late 30 days, customer service indicated we cant help you because you have been late. Customer Service rep indicated there is no help for FHA homeowners. After pleading with the company we were told to send a pleading help letter as I have five young children who eat food from the 99 cent store. They refused to help me even with a steady income as I accepted the reduction of income from my employer due to economy fallout. Midland Mortgage refused to help. So congratulations to the holder of this loan. Bankruptcy filed and entered discharge..will be leaving the house vacant after 5 months of not making a payment to reestablish a stable foundation

My mortgage was sold to Midland Mortgage about two years ago. I have never been late on any payments. Since they have my mortgage the house payment has doubled. I have spent the last two years trying to find out why. I have never gotten a straight answer from them. I had a lawyer when I purchased the home. I had the same lawyer look into why the payments went up. He could only find 300 dollars a year that would cause an increase. I filed paperwork to get my payments where they should be. Two years later I am still paying double. I have a fixed rate FHA loan. I have found that they are impossible to deal with. I was looking to get a loan from a local bank but they refused to sell my mortgage. Now I have to file another lawsuit to get this all straight. This has to be one of the biggest con-jobs I have ever seen. The only way they respond to you is if they are forced into court.

we retained a mediator about 2 years ago to help us with Midland. What Midland did was raise our monthly payment and tacked on 20k to our original loan. We paid 67k for the house over 13 years ago and now we owe a little more than 77k. We were taken advantage of by both the mediator and Midland but at that time I thought we had no other choice. Attn: Midland Mortgage does not own your loan. It is just a servicing company. Any changes in your payment are likely due to an escrow shortage, which usually has to do with your local taxes. Take it up with them. Midland cannot do anything outside of what your original loan states, so it is up to you to read your loan or have someone explain it to you if you are so ignorant that you signed it without understanding it! Do not expect a mortgage company to make your payments for you. Not only did MMC not accept any 'bank bailout' from the government, they also do not make any money off of the home being foreclosed on or sold because they do not own it, they just sevice it! There is an exception and that is if your loan is through Midfirst Bank, which owns MMC. Look at your paperwork people, it's all there.

If you are whining about Midland not servicing your account correctly: 1) find out what type of loan you have 2) look up servicing guidelines for your loan type 3) check your loan regulations / This will clear up allot of issues. Midland Mortgage is the worst company I have dealt with. They shot my credit down to the 500's. I was behind on my payments and was laid off. They said they would work with me and I could make smaller payments and add the difference on to the end of the note. This was after they raised my payment by almost $300/month with NO explanation. The payment was only lowered by about $100. Mind you I had NO income. They stated that they would be foreclosing so I put the house up for a short sale with a private agent. they gave her 90 days to make a sale but, in the end made her take off the listing after only 60 days. They said I had to be out of the house by the end of May 2009. I was lucky enough to find a nice person who would rent me a duplex. Thank God because I had no where else to go. I am a single mom with no job still! I moved out and after several months and dozens of phone calls to find out what the hell I am supposed to do now I finally received a message from someone. All they said was their name,number and to call them. I returned the call the next day and got a voicemail. This was over 4 months ago. I still have not heard anything form this "professional" company and my house is still sitting vacant and I'm still responsible for whatever happens to it. I bought it for $122,000 in a brand new development and it is not the only one vacant. Whenever I had contact with them in the past, they were rude,didn't know what they were doing or they had also stated that they didn't receive payments. My real estate agent has also not heard from them either. I hope the government sees this company for what they really are...con artists!! I hope that anyone considering using this company reads these blogs and starts running. Don't get stuck in the same place we all are now!!

i am a disabled vet just back from kuwait/iraq. while i was deployed, my wife lost her job and midland mortgage put us on a loan modification. they said the deferred amount would be put on the back of the loan when i got back. i made all payments and they reported me good on my credit report. when i returned they immediately put my loan in foreclosure while i am still covered under SCRA. now i have to hire an attorney and fight them in court. i want to file complaints but don't know who to contact. i plan on going to the news, state attorneys, and the va for help. the military has no one to help. not even jag is able to help. what a joke. Midland has once lost $15,000 of payments sent to them, took them at least two months to find, and now have collected double interest for 4 years while account in chapter 13 ... was court order to apply said 'extra interest' ($5,000) to the principle due and they claim to know nothing of this. The court, my attorney, and myself have sent multiple notices over 5 months and made multiple phones calls to both the customer service and their council WW&R to comply to court order and still nothing, they now have over $6,000 over the last 3 month they claim they haven't received either. The trustee office has records of when the payments were sent. I've had my money deducted straight from my paycheck and it's never been missed in 49 months. My house is now in contract for sale because I WANT FAR FAR AWAY from this mortgage company, any of them at this point while the government is involved with helping them manipulate and rob people. They have over $10,000 of my money they are not reporting at the latest payoff balance. On another note, they've threatened to charge for having less than "A" rating home owners insurance, I have All State!!! After my agent contacted them , they said it was a mailing mistake... bull. They have A LOT OF MISTAKES... Also, customer service..conveniently disconnects the phone call many times when trying to discuss the discrepancies in my account. How convenient for them. .... THEY ARE, I'M SURE, IN VIOLATION OF SOME BUSINESS LAWS... looking into it. God Bless all of you that have to deal with this company. It has burned me on ever wanting to trust a bank ever again.

I have read most of the comments posted here AND heard even more from numerous customers over the years. I have no idea how this company could possibly be in business. Someone must be greasing someone else's palm. That is the way it works, right? Every negative posting here is absolutely true. You must have to pass a "nastiness test" to work at this company. I feel soooo sorry for anyone that finds themselves at the mercy of Midland. My personal opinion is that the company is crooked, their employees are well trained liars, manipulative and abusive. House was in Foreclosure; everything paid to date. Again behind and Midland threatened foreclosure. Told if went 8 months without missing payments, loan could go through refinancing. Interest rate is 10% and all Midland keeps doing is raising the monthly payments. Listing on website they are only refinancing states of AR and OK. What is the problem with all the other states?!? This loan was previously GMAC. After becoming Midland, payments have increased close to $200/month. Apparently, reading the other comments/ratings, President Obama needs to do something about this Mortgage Company. How many comments have to be posted before action is taken?! Awful, awful, awful service. Never had any problems with First Horizon, but when account was sold to Midland, I've had nothing but problems. They received my check for which I have USPS signature confirmation, yet they never processed it. Another check was also sent, but that one is also missing. Strange how this happens now that Midland is servicing my account. To make matters worse, I get served foreclosure papers. Nobody called and no other letters were received indicating there was an issue. I will be filing claims through all legal channels, including the OCC, BBB, and Attorney General and plan to contact an attorney to inquire about recouping the legal fees that I had to pay in order to have the foreclosure dismissed. Utter ridiculousness. Perhaps the media should be included in this as well. With all of the recent credit card legislation going on, perhaps investigation needs to be performed on mortgage practices, specifically those of Midland.

For those claiming that the servicing organization doesn't get the house, no they don't. But the note HOLDER can. Midland Mortgage is merely a front/division for Midfirst Bank. Midland doesn't lose money and until the bubble pop, NEITHER DID Midfirst when they foreclosed. Don't be spreading lies about "money being lost"- talking with people that worked with Countrywide and GMAC, they made money on both ends of the deal. ALWAYS. Midland's no different and if you think $8k being "owed" on two month's payments, one only late and one past due, on a note with a ~$1700 payment is reality or "not following the mortgage papers" you obviously need to quit leaving the acid hits next to the keyboard or quit trying to lie about it all.

I had no problem with them until, after the birth of my 3rd child, my husband did not get up to the house for a couple months. Midland had locked us out. No notice, no warning. We also had our loan sold to Midland Mortgage by GMAC this past December. GMAC had applied our payment in November incorrectly. for some reason they applied half of the regular monthly payment to the principal.This had never happened before and don't know why this happened. When the mortgage loan was taken over by Midland Mortgage they started sending a letter saying we were late and I phoned them immediately and they said it was due to the misapplied money that GMAC had done and they couldn't fix it and of course GMAC couldn't fix it either because Midland had it now. So, even though I had lost my job that month, I sent in the extra $500+ in February along with the regular payment. The payment made it on time and cleared our bank. Now, 4-5 months later we are trying to get a new car and the credit reporting agency shows that we are over 30 days late. When I looked at our bank account the payments have been deducted every month by Midland and when I phoned them they said that the extra money I sent in February was $16.00 short (I had sent the amount that their customer service had given me to pay) and so every month they have been adding on the $40.93 late fee. They wanted me to pay $211.80 this evening in order to clear up our credit rating. I didn't do it because this is highway robbery. We haven't received letters from them and have lived at this same address for the last 8 years. I don't understand how it shows on their website and they are reporting that we are behind, when it is all late fees that we didn't know we were incurring. What a nightmare! They said we should pay this immediately and then send a dispute letter. I am going to file a complaint with the Attorney General for Oklahoma and Delaware. I don't know how they can get by with this in this day and time. I know that if I paid that $200+ something tonight it still wouldn't be cleared up. She told me that if I paid this money now, I would need to phone them tomorrow and tell them how to post it. Hmmmmm.....something seems strange about that too.

Due to my divorce we were required to sell our home. I called and got verbal authorization for the title company to speak with Midland Mortgage about getting the exact pay off amount. I got the verbal authorization and the title company called and Midland Mortgage wouldn't give them the payoff information as they stated they would. Me and my ex wife had to sign a form Asking for this information and even with signing the Midland authorization form they have delayed in getting the information so that the home will go into foreclosure. So I will be contacting the Oklahoma Attorney General, the Texas Attorney general and the BBB to see if they can light a fire under Midland . They are the absolute worst mortgage company ever.

Midland bought our mortage in Dec. 08. First they screwed up our escrow account. It took a million phone calls to work the whole thing out. Now they refuse to pay our home owners insurance. They sent us a letter three days before it's due. The says if they don't pay it within three days we have to take there insurance. That is the most ridiculous thing I've ever heard. My family's house loan was transferred to Midland. My father lost his job, but my mother continued to work although they weren't able to make payments. They dragged on for 2 years on whether they would refinance, my family paid here and there but could not pay the loans which jumped from $700 to almost $1300. Now they say that we do qualify to refinance but that they are only doing it for people that have defaulted no more that a year. What a bunch of dirty scam artists. We are going to be evicted in 15 days, have no place to go, there are 5 people living in the home, one is mentally handicapped. We are trying to see if NACA can help us out. www.naca.com. Meanwhile billionaires get our hard earned money through bailouts that never reach down to us working class folks. Capitalism is showing its true nature.

I answered that due to I am hurt or should I say my whole situation with them which is Midland Mortgage hasn't been pleasant due to the way all of this was handled however I shouldn't say very rude things towards anyone I just hope that they are the type that realize situations occur and no one there was even willing to help or advise me of the options I had and to not even tell me I am denied until a Friday knowing a Sale is on the following Tuesday that is extremely hard the foreclosure manager told me to send my parent to the nursing home ect... Please I don't think he really meant that I hope that was said without thinking first! Also if you haven't even ask why this is like it is how can you even determine honestly if the individual should be denied. I was transferred from GMAC TO MIDLAND NEITHER WOULD HELP AND WHEN I ASKED THEM WHY NO ONE WOULD RETURN MY CALLS I WAS ADVISED THEY DON'T HAVE TO! My mortgage was transferred by GMAC TO Midland since then I am living a nightmare. They seem to never received my payment on time. Whenever I checked their website, the payment is always seating to an non applied funds and was never distributed to the appropriate parties. My escrow was analyzed twice during the same year and I am still paying the same amount. I believe that this company has to go down. I did file a complaint with BBB back in December 2008. But the same practices are still being used by Midland. We need to get a petition going against Midlang.

I have been wanting to modify our loan for the past few months and they wont help u since we have an fha loan, we have to be behind 60 days, we are struggling but making the payments and we get no help, the Presidents plan doesn't qualify for us because we have an FHA loan. They are not willing to work with the customers. midland mortgage is a rip off. i have been waiting for two months to get my insurance check back from them. every time i send them another piece of proof that roof was replaced they say they need something else. took them 2 weeks to find an inspector to come look at my house and three weeks with all the rescheduling and another 3 days to get that paperwork. now they say they have everything it is going take up to 10 days for them to put the check in a envelope i sent them. midland mortgage is crazy. as soon as that check hits my house i'll be refinancing!!!!!!!!

I am not the type of person to say ugly things about anyone because I think we all at sometime or another have bad days or in need of assistance and If I could ever help someone trust me I WOULD. Our loan was transferred to Midland 7/1/05 after Chapter 13 was filed with the prior loan holder. There were no problems which we were aware until the Chapter 13 was discharged then all of a sudden we received notice of a late charge balance over $1000. They claimed the loan was due for May '05 post-petition payment at time of transfer so the payments they received in July '05 thru Oct '05 was applied to a "holding account" and in mid-Oct '05 $5621.32 was reversed from the holding and applied to the May thru Aug '05 post-petition payments leaving a holding balance of $978.24. In the same letter they say no late charges were assessed for May-Sept '05 post-petition payments. WHAT?! They asked for cancelled checks which was provided from the inception of the loan in 2002...which by the way showed we were never late. Finally in settling this, they said they would move our money from a "suspense" account, apply it to the loan if we would pay over $600 which they claim was the amount of the loan that was "late" in '05 and we would be square. They applied that money but we are now, in 2009, receiving late notices again. The customer service rep said we missed a payment in 2005 to send cancelled check copies for them to research. IT'S STARTING ALL OVER AGAIN!!!! BEWARE!

"I've dealt for years with Midland and have read most of the comments on this site; it seems most of the comments come from folks who have not read their mortgage contracts. According to most contracts payments are due on the first day of the month. Payments are late on the second day of the month. However, it is up to the mortgage servicing company to decide at what point to apply a late charge if at all. Midland doesn't apply the late charge until the 17th of the month. That seems more than fair to me. They also have a website where you can check to see if & when a payment posts. Since a person under 18 cannot legally enter into a contract, all mortgagors are assumed to be adults and capable of taking responsibility for their own financial transactions and shouldn't need to have a company babysit them."...what a joke when I read this!!! Are you serious!!! These people added flood insurance to my escrow; and my property is NOT even in a Flood Zone...I have FEMA certification and letter from the Engineering Dept. of the City of Euless...yet they say they have a certification from their ind. surveyor saying that I am..ja, ja, ja what a joke! So from Oklahoma to Texas they can say that my property is in a Flood Zone...oh please!!! Crooks, crooks, crooks...can't wait to see them go bankrupt...!!!

Midland is a scam company. These people are not interested in working out a deal with somebody. Tehy basicaly want to foreclose. First, they are rude and unprofessional! Never return calls;put you on hold for 1 hour plus; never transfer you; then they never resolve your problem. Midland Mortgage really sucks. I am at the point where I say let them take th house and see what they get out of it. Smart idiots. These are really thieves. How can they operate a business in such a way? I split payments with my fiancee and they always send me a letter that they can't post my payment until the recieve the entire payment. What???!!! Then my fiancee goes into his account and he sees his check already cashed and mine too...what a mess!!! Now they hiked up my payment from $1,270 to $1,604.00 What??!!! My mtg was with First Horizon no problem. Once Midland obtained it, they took my mtg pymt, applied it to their outside homeowners insurance, did not pay any insurances I had included in my mortgage with First Horizon, however raised my monthly payment, stating they did not receive from First Horizon the information for my Homeowner insurance company plus the additional disability insurances I paid into. With First Horizon I had no problem. At the end of the day my mortgage was in default because Midland chose to give me a homeowners insurance company of their choice which was double plus my original amount. Once they received the information, they claim they did not pay the company of their choice, but my money for all: Homeowners insurance, disability insurance, flood insurance cannot be found. Now my escrow amount is different and my disability & flood insurance policy are cancelled. Those 2 companies state my policies laspsed and midland told them the payment was not received. I offered to pay them up and deal with Midland, I was told I can't do that. I am left now after all these years without these 2 insurances. Fedup from Delaware>>>>>>>>>>

I have read through all the blogs I am very scared. I lost my job last june and contacted them and from that point on its been nothing but problem after problem, just when they approved me for an assistance program I was waiting to hear back from them and then on my door summons!!!!! That was in Novemember, now its Feb and I have a job now since Jan sent them everything they requested and still no answer. I leave messages almost daily and the lady that is assigned to me never calls me back. They are horrible. I even sent them a 1000 dollars and they destroyed it, never told me just sent a letter. I have a mortgage with Midland, and it is so scary when I read this stuff because they all very similar to my sitiation. We have been trying to work with them for Loan Modifications. They have told us to wire payment, then they lose them, and we have had to fax numerous reprots from our back that we sent them... they are quick to call us, but never return our calls. We just finally got the loan modification and now they are sending us a "Pre-sale Forclosure Notice" These people are terrible to work with. I have been on hold for 50 minutes. I leave daily messages twice a day and no one calls you back. The house went into forcloser, we paid all of the money and attorney fees to get another letter saying it was not in time and sent us back again. We filled out everything on time, I even talked with the owner which was almost impossible to find. He laughted, he was a joke. Reading all of these comments are heartbreaking, how can a company do this........... they have payments from us that they refuse to post. Has anyone had luck with the attorney general?

They just dont want to help us. We were fine with our first house note until our escrow account tripled causing our house note to double. So we were having a hard time paying it and to top it all of my husband lost his job. Over the past two years, both my husband and I have medical issues that affected our jobs. Our loan is guaranteed by the VA. When we saw that we were going to be late with our payment, we notified both Midland and the VA. The VA suggested that we work with Midland. Well, work is not part of their vocabulary. The customer service representative told me that my payments would have to be over six months late and then we could apply for a loan remodification. We notified the VA and the VA's response was "if you get a foreclosure letter, call us." We never got a foreclosure letter (thank goodness) and were able to do a loan modification. Now, we are back on our feet and want to refinance our home. We wanted to buy down the loan and refinance at a lower interest rate. I called Midland in January '09 and was told by a customer service rep. that "Midland is no longer doing refinances in TN!” Ok, fine, I just go apply at another lending institution. Well, guess what? Midland has my credit so messed up, that no one will touch us for six months or more. When you do a loan remodification, the money that you are past due, plus closing cost is added to the back of your loan. So, technically, you aren't late. The money is on the back end, right? In addition, the loan remodification makes your payments higher! Our payments were already high, that’s why we were getting behind, duh! Take if from me, the loan remodification says good things on the front end, but it ends up costing (your credit) in the end. So, for now, I have to bite the bit and wait. In six months, I'll put this company and their nightmares behind me! Good riddance!

My loan was sold to them from Horizon in July. I got laid off in Noveber 2008 and have repeatly asked Midlands for help and they refused because I didnt make enough money. I also have an insurance to repair my roof due to a storm and it is made out to them and me. I am so upset with them because I am almost 4 behind on my mortgage, that I am sending them the 6200.00 from the insurance company to have them take out what I owe and see if they will send my the difference so I can get my repaired

This is an inept company. Their customer service is incapable of completing the simplest task and will tell you anything to get you off the phone. I have faxed the same data twice, yet they have no record of receiving the faxes. Their method is to let the faxes accumulate all day and then someone (a monkey?) distributes them at the end of the day. No accountability whatsoever. From all these comments it is hard to believe they are still in business. What will it take before a state attorney general or a Federal prosecutor puts them out of business?

I cannot believe they "helped" me after I had problems with my house payment....well, they sent me a year end statement today, and they say I owe them $3,000.00 more than I owed them in October 2007. They did not even post my April payment, and their phones are conveniently not working. I hope there is a class action suit against these bandits, because that's why our country is in the financial shape it's in. Yet the banks are getting federal buy outs to rip us off even more. My mortgage was also "sold" over to Midland from my original mortgage company, I did not know until it was a done deal. I am telling everyone about this piece of crap company, and I CANNOT WAIT until I see them on the news, in bankruptcy with the CFO in jail.

When asked what Midland was doing to help homeowners in this current economic crisis, was told, 'nothing until you're 90 days past due'. So called 'customer service' wouldn't even tell me what the plan was after being 90 days past due. Perhaps the loan goes into default and foreclosure, and you have to come up with 90,000 dollars to keep your home!! Way to go Midland!!

This company is terrible. I called ahead to make sure I turned everything in with my check to avoid delays. That was on Dec 12th. On Monday it will be a full 30 days with no funds being issued. Filed a complaint with Texas Department of Insurance. They are required to send funds within 10 days of having all the required documents. Its TDI code 557. File your complaints because if you show proof that they had no reason to hold your money, they will have to start paying 10% intrest on the money from the day they received it. They can also be held accountable in civil court from State of Texas. File on them.

A month ago Midland Mortgage send us our yearly escrow statement, showing that we owed DOUBLE the tax amount. We caught the error and had our county treasurer fax them a copy of our actual tax amount. Three phone calls later and they are just now stating that they never received such a fax and that we will need to send the information again. We are switching to a local mortgage company right away.

This company is really very frightening and it seems like it is time for the consumers to band together and file a Class Action lawsuit against them. Everything they do is designed to rip off the consumer and it does not stop with foreclosure issues, late payments, fees etc as can be seen by the above emails. Now the latest scam is to require that the insurance companies claim checks are endorsed by them before the consumer can bank them to pay for the repairs. This delays the consumer from a) getting the repairs completed in a timely manner and b) if repairs are completed inconveniences the home owner who has to pay up front for the repairs while they wait for Midland to return the insurance checks in their own sweet time. This I do not believe is legal and I would like to know of other consumers who have experienced the same problem. We need to unite to stop these illegal practices and close down these scam artists. Talks like a duck, walks like a duck... then it's a duck /crook!

They do not offer help for distressed homeowners. They have repayment plans that only seem to put more money in their pockets and leave you worse than before. They do not offer any refinancing or loan modifications that can help homeowners at risk of foreclosure in the current market.

My husband and I have had GMAC mortgage for years and have always paid online. Midland doesn't have that option and they also don't have good customer service. I talked to a Heather in Customer Service and she was rude and almost berating. I explained we preferred paying online. We have never skipped a mortgage payment on our home since we bought it in May of 1996. We have a lot of equity in our home even in this bad housing market. I think this mortgage company wants our duplex in downtown Denver so they can take our equity and pocket it. After reading the horror stories I have read on this site and the lack of professionalism and courtesy on the phone that I have experienced with this company---we are considering selling our duplex---paying off all debts and leaving the USA where I can teach in some foreign country and live without all this greed, lack of ethics, and gross overemphasis on materialism. With the equity we can flat pay for a home we never have to pay a dime for in my Caribbean native land and never have to speak to some greedy mortgage jerk for the rest of my life. Plus no more -6 degree mornings in some icy city. My home shall always be my beautiful husband and my beautiful son and my extended family. Houses unless paid in full and (property taxes and homeowner's insurance are always due anyway). But someone should file a class action suit and if they are stubborn and determined win against all these unethical business practices. To all who have experience problems please remember you are all valuable human beings first and foremost and not some anonymous number in some Midland Mortgage account.

complete criminals. Bought our note opened foreclosure will not disclose the legal note holder. They claim to be the note servicer only. add fees they will not explain. Overcharge. will offer a "work out" but send the docs to sign 72 hours before the sale of your house so you don't have time to have a lawyer look it over or counter offer on your own much less get anything clarified. They have a lawyer in san diego called mccarthy and holthus. They do midland's foreclosures and bear investigating to see if they are involved in the purchasing of any of midland's properties. We are currently checking into anything they are doing that may be illegal and can be prosecuted.

Midland Mortgage is the absolute worst company that I have ever dealt with. For the last two months they have destroyed are checks stating the numeric and written amount do not agree. Since, my wife and I do not have carbon copy checks, I have asked them for proof, which they fail to provide. I have contacted my congressman, the better business bureau and an attorney to try and get a resolution to this problem. Midland has until Dec. 1st to respond to my BBB complaint and hopefully, I will know something tomorrow from the attorney what legal action if any can be taken against these CROOKS. They destroyed my payment for November and when I called to make a payment over the phone, they refused to take payment.

Midland Mortgage company is charging me $428.80 in late fees that are just not correct. I filed chapter 13 bankruptcy and was order to make all payments on time by the trustee and attorney in order to remain under bankruptcy protection. As such, I followed the guidelines set forth by the court. There was a single instance when the numerical amount and legal description did not match; a replacement check was immediately sent to Midland who took nearly a month to process the check. I am now waiting for documentation from Midland to state recorded instances of payments on my account. This is not rocket science. If I was late they would have notified the courts and foreclosed on my house! This is BULL and they thought I would not notice this fee which was hidden on my escrow statement.

We sent them a check and they sent us a letter saying they destroyed that check and would not accept another one until we made a double pmt right away. I have never seen a company do that. Can someone tell me how I can join the class action law suit? My mortgage was transferred five years ago and they have carried and reported me over $5,000 dollars in late fees. I have tried for the past five years to get them to show where these fees came from with no answer except my previous mortgage company transferred these fees to the, However when I ask for proof, they direct me to my previous lender who directs me back to Midland. This is crazy. My house is soon to be paid off, and I will still owe them over $5,000 in late fees. I dealt with First Horizon for 9 years with no problems. My mortgage was sold to Midland Mortgage and in July I made my first mortgage payment to them. I am in my fourth month and extremely exhausted from trying to get my payments posted on time. I have tried various ways to pay so I could get a timeline on how long it takes for my payment to get to Oklahoma City. That was impossible to do because there is no timeline with that company. It's whenever they choose to post it as long as they can get a late fee.

We had our mortgage with First Horizon for 7 years until it was recently sold (July 2008)to Midland. We never had one problem with First Horizon. After Midland assigned us a new account number on July 15th, I sent an ACH form to Midland to change the account to be debited for our automatic payment. The Midland representative assured me the August payment would be paid from the new account. It did not happen. Midland did not handle our ACH account change as they promised and debited the wrong bank account. This negligence caused us to be charged a $30 fee by our bank, and Midland charged us a late fee of $32.68. When checking my bank accounts online, I discovered that they hadn't debited the correct account. I called Midland about the problem, and they said I should send in payment. I sent electronic payment immediately (August 15th). Shortly after making this payment, I received a letter threatening foreclosure on our home. They never acknowledged the electronic payment and said I had to fax them the confirmation from my bank to prove that the payment was made. I have done that, but still do not know if the payment has been posted six weeks after the fact. The next month, they still failed to debit the new account and assessed another month's late fee of $32.68. Midland is the worst company I have ever dealt with. At first I thought it was incompetence, but I have learned that it is total corruption and dishonesty. They are predatory, accept no repsonsibility for their negligent and fraudulent business practices, etc.. They have repeatedly failed to perform their basic responsibilities. After several calls, faxes and letters sent by certified mail, I still have not had any restitution by Midland, just further threats. After the ACH debacle, I mailed the Sept. and Oct. payments by check, certified mail. Both checks were in the same envelope, but only one has been deposited. They received them on Sept. 29, 2008. Today (Oct. 6, 2008)I received another letter stating that my payments may be delayed in being processed until my late fees are paid. Previously, their representative said that Midland would waive the late fees, but they have still failed to meet their obligations. We have sought legal counsel, and will be contacting both the Delaware and Oklahoma Attorney Generals. It is so disgusting that Midland is allowed to perputrate this type of abuse on innocent consumers. Their time of judgment will come. They can be sure of that. What you reap, you WILL sow.

I've dealt for years with Midland and have read most of the comments on this site; it seems most of the comments come from folks who have not read their mortgage contracts. According to most contracts payments are due on the first day of the month. Payments are late on the second day of the month. However, it is up to the mortgage servicing company to decide at what point to apply a late charge if at all. Midland doesn't apply the late charge until the 17th of the month. That seems more than fair to me. They also have a website where you can check to see if & when a payment posts. Since a person under 18 cannot legally enter into a contract, all mortgagors are assumed to be adults and capable of taking responsibility for their own financial transactions and shouldn't need to have a company babysit them.

In the mean time my spouse died and I have almost been foreclosed upon 2 x in 6 years because 1st I did not know they were servicing the loan and had a child with a severe health conditions. I have had a mortgage for 15 years I almost owe the same amount as the original mortgage don't know what those people are doing but it is crazy. This company scares me! My First Horizon mortgage was bought by Midland. I never had a single problem with First Horizon, and have never made a late payment on ANY mortgage, including this one. Lo and Behold, the first payment I make to Midland "disappears" and they charge me a late fee. I had to stop payment on the check and wire-transfer the money. They never made a collection call, sent a letter or anything. The only way I found out was that I was trying to re-fi my other house and they had to do a Verification of Mortgage, at which time they told my broker that my July payment wasn't received yet (it is Mid-August by then). The housing market is crashing and my vacant house, the one that Midland now holds the mortgage on, HAD about $40K in equity. Now it has MAYBE $10K. I have already bought my permanent residence that I will live in for the next 20-30 years so GUESS WHAT MIDLAND! You want it, you got it! I'm not making abother payment and they can kiss my merry white a**!

Yes, we are looking at legal action against MMC. They destroyed our payments and sent us a default letter last month. We were not and are not behind on our payments. In fact they posted a payment and then deducted it twice and never posted it back to our account three years ago. So, we actually are paid ahead by a month because of this. Yet they are still saying we are behind. We have paid late fees for the past three years because they have rolled them into our payments and we didn't realize it. We have had problems with MMC since our loan was sold to them. From what we have read in the last couple of days at this and other web sites, it would not do us any good to attempt to pay off the mortgage. We only have two years remaining on it and could pay it off in about six months. They are showing that we owe hundreds of dollars in late fees when actually they owe us all late fees we have paid them not knowing the situaltion with that extra payment. So we have to take legal action in order to clear our account so we can pay off what we actually owe. They have hit us during a time when unexpected medical issues have really taken us down (not financially but physically and emotionally. We have had enough. Also, looks to me like the positive comments that have been posted here are probably employees of MMC. They are from Oklahoma too. We have a few things to do right now but will be trying to contact others who have had problems because we feel very strongly that the practices of this company must be stopped. We have read too many similar problems from too many homeowners. My suggestion is to contact every government official you can think of and don't give up. Our comments here are minimal as to what we have been through with this company. Also, take a good look at MMC's corporate reports. There has to be justice.

They have 51 suits filed against them for withholding peoples payments, posting them after the cutoff date for being late, returning payments back to people who have paid them. Not recording all payments made and not depositing payments into peoples escrow accounts. My mortgage was with Homeside lending and I had no problem. Then it was sold to Midland Mortgage. As soon as they got the loan they deducted two payments I made to homeside lending. I did not find this out until I went to buy a new car two years later, because I never got a statement or was notified by them. They tried to say that I owed them two months and that my checks bounced but I never sent checks. I pay by money orders and got back the proof that the money orders were cashed. In the end my credit was ruined. And I had to get another mortgage company to get rid of Midland Mortgage and their fraud. I was not about to pay two mortage companies for two months mortgage. Midland claimed they were going to credit me back the two months after I hired a lawyer but I never saw the credits. And they tried to foreclose after I discovered what they did. Good Luck to anyone that has to deal with them.

They won't set up payments online, they won't let us split our payment into two per month, and they automatically withdrew our mortgage pmt today after they told us last week they would not -- we requested that it be stopped -- the bank says there is nothing that can be done -- but they have also heard lots and lots of complaints that are ethical in nature -- Maybe it's time for a class action suit against these folks? We had our mortgage sold to Midland -- why can't we have some say-so in who our mortgages get sold to -- if there were that option, maybe these idiots would straighten up! We have been with Midland for 8 years and have never had a problem with them. If I send the payment in before the 7th of each month the check is posted on the 16th of the month. My suggestion would be to try and work out some type of different payment, a lower interest rate on the loan, a "cease" period of payments. The bottom line is that companies do not EVER want to do foreclosures. The company never gets the "true" value back and they LOSE money on foreclosures.

I’ve experienced the same problems with Midland Mortgage. My original loan was with Irwin Mortgage and sold to Midland 4 years into owing my own home. When Midland took over they refused to send me payment booklets, or notify me of their terms. It took me three months and 15 plus phone calls before I receive my first coupon book. I was informed by their representative that coupon books were a courtesy and they would try to get a booklet out within the next 6 weeks. The problem being my rate also adjusted up and I built up late fees. Their customer service representatives are RUDE and have a serious lack of follow through. Furthermore, I have mailed my monthly payment 15 days before the due date and have found they will hold the check for several weeks before depositing, then charge me late fees. It's kind of funny everyone else is paid ON-TIME. This has happened more than 6 times, which equates to over $700.00 in late fees. Perhaps someone should evaluate their fraudulent accounting practices. The great American dream is to own one’s own home, and Midland’s great dream is to screw you out of it!

I found this site becuase I have suspicions and serious concerns about Midland Mortgage. I don't know which is worse - calling customer service in India or speaking to a Midland rep! My loan was bought out by them against my wishes. I was with Irwin Mortgage and they were AWESOME and never had a problem. I make my payments religiously, have good credit and from day 1 of the transition, they were difficult and RUDE and didn't want to take the time to answer any of my questions. My loan is due to re-set in less than a month and I can't get anyone on the phone and they haven't sent me anything in writing. Im extremely concerned about what will happen.

When I have fallen behind on my payments, they have been willing to work with me. When I divorced, I had to refinance my house or sell it. I called Midland to see if they could refinance it for me and they said that they quit refinancing a month ago. I don't know if this is actually the case or they just didn't want to help me.

I agree with everything i've read about midland mortgage as far as they are a bunch of crooks. The reason they don't process your check, money order, or cashiers check right away is because they want you to have problems. They want you to struggle and barely get by or just go in the hole. It is the only Mortgage i've ever dealt with that won't take half or partial payment to help you get caught up. And i've bought four houses. I could talk about it all day and bring up all the bad points about Midland Mortgage, however what bother me more than Midland is are Gov't allows for business's and company's like these to exist. At what point does this great nation of ours step in and protect the people that built it.

Midland mortgage is another ENRON. Midland Mortgage got my loan from American Home Mortgage about two months ago. In the two months my payments with up and down. I got three coupons books with different payment amounts. I plan on taking Midland to small claims court to recoup my over payments. Something has to be done about Midland. Please write your attorney general, copy the Ok. attorney general. I understand that people need jobs, but how can the employees do so much bad that troubles their own family around the USA. Maybe we can get some of Midland employees to turn on them in court. I am look for people interested in an class action lawsuit.

1st of all the servicer, Midland Mortgage, does not get your house at foreclosure. Money is lost every time a fcl is completed. 2nd do you expect a mortgage company to allow you not to make your payment and just continue to let you live in the house? FHA and VA have rules that the servicer must follow. Take some ownership of you mistakes and if you can not afford the property sell it. If in fact there is equity you should have no problem selling your house and paying off the mortgage company and finding a home within your means.

They are a terrible mortgage company to have to deal with. they never return phone calls, when you do get a hold of someone they are snippy and give you a song and dance excuse why they are taking so much time to process your paperwork. they are not willing to help and we are done trying to get them to cooperate. Take my word for it - don't choose Midland Mortgage as your lender.

i have contacted midland mortgage on several occasions,no one will call back,i have lost one parent in January that plus large health problems and bills,caring for another parent also with health problems,having to change jobs 2 years ago,present job not paying the same and i contacted them about paying half of the mortgage at the beginning of the month and the other half at the end of the month have not heard from them except for a letter about foreclosure,a lot of mortgage companies are now into splitting your payments in half every month,this one is not even responding to me i am trying to save my home.what else am i supposed to do.

Yes,I am dealing with Midland Mortgage,they have very poor customer service. We are behind on our mortgage,they sent us foreclosure notices saying in 30days that if we do not pay the amount that we owe they will foreclose. I contacted them and finally got a hold of someone,saying we do not make enough income for them to qualify for any assistance. Then I have another person tell me we do qualify for assistance but I need to send them $510.93 certified check and then they will be able to tell us what kind of assitance we can get. So I send them a check and call the person back to give them the tracking number of the package. No one returns my phone call,so finally after making several phone calls I get to talk to someone,they tell me that they can't discuss the plan until the check post on their computer. It took them 2weeks to post the check and for them to discuss a payment plan. They could not tell me what exactly the money I sent them was being used for. What is so secerative about the plan. I mean we are trying to save our home,and they act like they don't care. In the end come to find out that the check had posted the very next day after sending it. Very poor customer service,lack of communication,they like playing games with peoples lives. Hopefully the plan they have worked out for us doesn't change because it has before in the past. Also buyers beware when getting a mortgage,you just might get screwed if not careful.

Midland Mortgage has the worst customer service and cares only about how much money they can make. they concentrate on houses that have high equity in them when they buy loans then wait for the owner to have problems so they can foreclose. this company knew ahead of time that i was going to have problems making payments, and promised a workout plan. they neglected to tell me that I was not eligible for fha/hud programs while having a negative cash flow. they never returned my calls for 3 months, once they found out about my inability to pay. then foreclosed on my house without ever sending any type of warning. now that I have a positive cash flow again they have promised to work out a program but want $3000+ up front. how can i come up with that kind of cash when i have had a negative cash flow for 4 months? my house has about $30,000 in equity in it, hmmmm, maybe that is why they never returned my calls and do not want to work out a plan.

Midland Mortgage is run by a pack of thieves who steal everything they can illegally and there is to many people in there pocket. All the attorney generals, representatives for the people are not there for the people they are suppose to represent. Everything I've heard on Midland Mortgage is true and they are getting worse every day because no one will stop them. When I went to officials in OK City, OK they said they never had a complaint on Midland Mortgage. No one will do there job and go after them. They destroy every homeowner they can and will continue to do so until someone in the government does their job. We all need to band together to try and put midland mortgage out of there business of stealing homes and equity. Is there any justice out there????
