First you wait about an hour to talk to anyone, then they ask for all this information, then say they cannot help you, transfer you and the call does not go through. You then call back and start all over again. When you do get through, some are nice and others are not. Some are willing to talk and others just tell you to pay and that it is.

After three years of dealing with similar complaints as I have read on this panel, as a last ditch effort, worked with Hope Now to act as a liaison with Homecomings for possible "work out" solutions; Homecomings never responded. One month ago, I called to ask the status of their decision, and was told that my house is scheduled for foreclosure on 10/7/08; to date I have received no notice of foreclosure; from my research, I was under the impression I had to receive a 21 day notice prior to foreclosure, which I haven't. Due to the incompetence of the people in charge of our home situation, I cannot wait until the last minute to be told I'm on the street, and am in the process of moving to a rental house at the end of September. Also received a notice about insurance because they had information that the house was vacant -- the house is not vacant. I will be glad to be finally through with this rollercoaster; it is a shame that incompetent people will affect my credit rating for the next seven to 10 years. I have joined a class action lawsuit -- the entire process has just been horrible and too lengthy to even put into words, but I have personally be involved with each and every one of the complaints on this panel.

If you thought their service sucked before, read this: The Dallas Business Journal reports today that 87 jobs will be cut at Homecomings Financial LLC's Dallas servicing office in the wake of ResCap's announcement to cease the wholesale operations. Referencing a letter to the Texas Workforce Commission, the article states "the loan servicing company says its plant on the 14,000 block of Quorum Drive is closing. Layoffs will begin on Sept. 19 and be completed by Nov. 14." We were under the impression just wholesale was being shutdown. Looks like this means the whole enchilada. Our call to their media relations office to confirm was not returned. (After we posted this update, spokesperson Jeannine Bruin called us back. The servicing center on Quorum Drive supported Homecomings' wholesale operations. The main servicing center for GMAC Mortgage, Homecomings and Ditech located on Haskell in Dallas remains in operation

Tried to refinance with governmnt loan program. They denied us so long that our credit score went up to high to meet program standards. This company never resolves anything by phone calls or as a mattr of fact neiher in writing unless it is to their benefit. Now we are facing extra charges on our insurance saying we were not covered when we were. when will all this s... end.

Homecomings Financial has been a nightmare for us! There are numerous secret/hidden charges and fees applied to our loan and when we call for explanation, we're treated rudely and forced to be on hold for inordinate periods of time. There are numerous departments that seem to not communicate with each other in several different states. The customer service agents rarely have updated information and often times experience equipment failure. We attempted to be pro-active in notifying our lender when we began having financial difficulties due to job loss, but they seemed to be more interested in what they can get as opposed to having compassion for their customers and working to remedy the situation. Our experience is that we would NEVER recommend their services to ANYONE! We want out!!!

We have an adjustable rate mortage and each time our payment has changed we received a letter in the mail with a certain amount.Then when the monthly statement came the amount would be different.I called several times to ask what options we had because we were falling behind on our house payment and the man I spoke with told me that whatever I do we can only make an adjustment to the loan once. They wouldn't even let me speak to someone about re-financing the house. I feel sorry for others that are in the same situation that I am in with a mortgage company that does little to help when you make an effort to make things right with them.

They give you information that is inaccurate, and when you call to speak with someone else. The next person tell you something completely different. They want to keep their customers in default to obtain more money from you. These people are the biggest crooks, I have ever known.... I pray that God helps everyone that is having trouble with HC and other companies like them. I pray that everyone that is in foreclosure is helped by the grace of God, and that He turns everyone's situation around.....

They kept telling me they were going to send us a workout form to see where we had to go to work out a payment schedule for past due owed and we never recieved it and we are now facing foreclosure plus every time we have called its talking to some other agent constantly and having to explain our circumstances that got us behind in the first place which is annoying and ridiculus.

Update - 2008-06-20: Homecomings is hunkering down with branch consolidations and lay offs. From a 2008-06-17 memo sent to employees: After thorough research and consideration, we have determined that it will be necessary to consolidate the Cherry Hill, Petaluma, and Charlotte facilities by moving selected operations to our Dallas, Ft. Washington, and Minneapolis locations. The Cherry Hill facility will close on October 4, 2008 and the Petaluma facility will close on October 31, 2008. Charlotte will close on September 5, 2008. Approximately 337 associates in Cherry Hill, 62 associates in Petaluma, and 71 associates in Charlotte will be impacted by these changes. Ninety-six positions will be eliminated and 374 associates will be offered positions at alternative sites. A tipster told us there remain about 80 people in the Bellevue office. "Account managers laid off... is about 8," the source wrote. "There will be more to come in this branch in the next 30 days if it [stays] open at all."

Rescap has inched steadily closer to bankruptcy since our last update, as recent news suggests. Bloomberg reports today that GMAC "may keep the mortgage unit afloat long enough to find a buyer or break it up." Yesterday, Rescap announced an offering to exchange $14 billion of notes to extend maturies between 2010 and 2015 for "as little as 80 cents on the dollar," Bloomberg reported. "To finance the debt restructuring, ResCap is seeking a new $3.5 billion credit line from its parent GMAC," the article notes. Rescap admits even this may not be enough in it's Q1 8-K filing with the SEC: "There is a significant risk that we will not be able to meet our debt service obligations, be unable to meet certain financial covenants in our credit facilities, and be in a negative liquidity position in June 2008." Rescap (Residential Capital, LLC) is a wholly owned subsidiary of GMAC, LLC (which is owned by General Motors Corp. and Cerberus Capital Management L.P.). Rescap subsidiaries at risk of BK or being dumped include Ditech, GMAC Bank, GMAC Mortgage, and Homecomings Financial.

my husband & i both lost our jobs right after we refinanced with homecomings. i tried calling them several times with no response. when we were 4 months behind i finally get to talk with someone they demanded that we pay all back payments, we did not have the money to do so they refused to take any payments they started foreclosure i filed a chapter 13 to stop the sale of our house they sold it anyway and now i cant get any answers of why they violated the state laws of bankrupcy

Homecomings purchased our mortgage of ($140,000.00 from our original Mortgage Company, of course with no notice to us. After Homecomings took over the mortgage the disaster began. Beginning in 2006, our payments were either not recorded or returned (there were late payments before the foreclosure but all were made up and all of the fees were paid), Homecomings filed for foreclosure. During the foreclosure process Homecomings raised the interest rate. The home went up for Sheriff’s Sale and a home appraised at approximately $170,000.00 one year prior, Homecomings Financial purchased for around $87,000.00. During this time I contacted Stephen Dupont, president of GMAC , (Homecomings parent co.) and sent proof of payments made (see Exhibit A). During the foreclosure, Homecomings sent a letter to my home insurance company stating no one was living in the residence (see Exhibit C and D). They also sent a box truck to our home. When I answered the door I was handed a (Exhibit B) cash for keys settlement agreement and when I asked the two gentlemen what the truck was for they stated "to move your personal items out of the home", I told them to leave the property. At that point Homecomings was willing to make a deal. Of course by this time our credit was completely ruined and we could not obtain any other financing. Homecomings representative Gary Neuman sent us an offer to resale the home to us for $130,000.00 at an interest rate of $9.875 with no closing cost, or we could get other financing or take $3,000.00 to move out of home (with of course no mention on debt we would have towards foreclosure). In response an email was sent to explaining our misgivings that we could really afford such a high payments due to a high interest rate. A second letter was sent by Mr. Neumann giving us no option but to sign the new loan paperwork (Exhibit E). In October 2007, Mr. Neumann was contacted and told we were having a hard time making the monthly payments at which time he sent me a work out package. This was filled out and sent back to Mr. Neumann at which time Mr. Neumann sent us a letter stating the home is no longer affordable (Exhibit F). The income had not changed during the time of their offer or signing the paperwork. Since then I have Homecomings representatives come to the door and hand me an envelope with a note stating to phone Homecomings. When I do phone Homecomings, I inform whichever customer service representative that answers the phone that this phone conversation will be recorded by me and they hang up the phone. To date they have filed a Complaint for Foreclosure and I have filed the Answer Attached in response to that complaint. From the Ohio Revised Code : The definition of a "predatory loan" contains one of four features described in Part II infra. Briefly stated, these features are: an "overpriced loan" (a loan containing interest rates, fees or closing costs that are higher than they should be in light of the borrower’s credit and net income), an "unaffordable loan," a refinance of a mortgage loan providing no net economic benefit to the borrower, or a loan containing a myriad of other exploitive terms that the borrower does not comprehend. Homecomings admitted in the letter attached as Ex. D that the loan was not affordable to us. For the past 3 years I have been contacting the Ohio Dept. of Commerce, the Ohio Governor, Ohio Senator Brown’s office, the Ohio Attorney General and every other politician I could think to contact. Each dept. seems to push me off to the next dept. which always leads to no where in the end. When I have contacted private Attorney’s I am told the situation is to involved to contact another Attorney. The stress of the situation has increased my MS exacerbation. This mortgage company has broken the law several times and I can get no one to do anything about it.

Horrible, horrible customer service. Wait HOURS to get in a complete conversation. 45 minutes just to talk to a human, then usually end up being cut off OR hung up on. Occasionally (twice) do I talk to a rep who treats me with respect.

The worst day of my life is when Homecomings took over my home loan. I hope with all the jobs being eliminated at Homecomings that the idiots that work there end up in foreclosure and have to deal with crappy service like they give. Serves them right for being so incompetent and down right rude. I have been watching their business slowly sink and while I realize it is not due to poor service, (because if it was they would have been out of business a long long time ago), but rather the housing market as a whole I still am waiting and watching for Homecomings aka ResCap to fold. I will dance in the streets on that day.

Over the past six months, my account has been systematically forced into delinquency by the predatory servicing practices of Homecomings Financial. These events are well documented and plainly indicate a deliberate effort by Homecomings to expedite the foreclosure of my home. CASE IN POINT: My online account is routinely unavailable- usually on or around my payment date- which prevents me from using their electronic system. Billing information is inaccurate or out of date and any attempt I make to bring my account current is counteracted by such tactics as delaying or reversing payments, applying them retroactively to cover those they've delayed or reversed and refusing payments that would cure the default. Also well documented are my repeated attempts to get assistance through their fictitious Loss Mitigation process- a calculated series of roadblocks erected to create a paper trail for the company while keeping me from recourse by making it appear as if I'm unresponsive to their contrived outreach efforts. CASE IN POINT: They continually send letters requesting that I call to discuss my options, schedule meetings or fax information but when I do, I'm referred to someone who's on vacation, my call is dropped during transfer, appointments are no longer available or my fax is never received. Their methods are transparent and though I find it unbelievable that a company would victimize it's customers so ruthlessly, the facts speak for themselves. There are hundreds of complaints on the internet and in the courts from similarly situated individuals who's experiences establish a pattern of abuse by Homecomings that insures the company's profits at the expense of the borrower. I have filed complaints with the FTC, the Attorney General, the BBB and various other regulatory agencies and I urge anyone who has, or suspects they have been victimized by this company to follow suit. I don't know if we can save our homes but perhaps we can prevent further harm by demanding that Homecomings take responsibility for their devastating actions and address the situation appropriately.

We have tried to talk with them on several occasions to modify our loan to reduce pmts. No help. They gave us an option to skip a pmt but them increased our mo. pmt to $1686. for 3 mos. when they knew we couldn't make the $1402. pmt.We escrow ins.&tax so when Hurricane Isabel hit us, we found out they had not paid our insurance. We were without ins. for sev. mos before we could get it straight. They took no responsibility in error nor did our agent. we filed complaint to NC Atty. Gen. office and Nothing has ever been done. On numerous occasions we call to make a pmt and the people cannot understand english. In Dec. 2007 we felt our acct had been compromised when they tried to draft our mtg. pmt. on 3 different dates when we had authorized one.

I am just like a few of you. I am dealing with them now they are holding a ck that would catch my payments up totally but instead of appling that money they have sent 1 bank ck back and they are holding the rest. They have sent me to a loan modification team and I have alot of equity built up in my home but poor credit so no one wants to refince us, I am stuck!!!!!!!!

I am not sure if this will help, but I came across a class action suite in the make with an attorney that is against HC for all the FEES that they charge. The attorney is Sprenger & Lang and the PH# 612-486-1806 and ask for Lynn. HC can never expain where these fees are coming from HMMMM????

I have tried to work with them and they are determined to take my house. I know they want it because I have a lot of equity in it. I know other people with no equity in their house with the same mortgage company and they are doing back flips to try to keep them in their homes.

I have tried to contacted my mortgage company since Nov. 2007, w/concerns of future foreclosure TO see what they can help us with. They were VERY RUDE & UNPROFFESIONAL, I got the impression that they did me the favor & I need to do what EVER I have to do to "rectify" the issue!! In all honesty, now after calling them 4 times with NO RESULTS, I could care less is we FORECLOSE on our home, since NO REAL option/assistance was provided!

Before my ARM started going up I tried to refinance with them and they kept delaying the refinance until I got behind on my payments. Once I was behind they told me my credit was too bad to refinance. So here I am now with a 13.5 percent ARM that I cannot afford.

I posted on here on July 10, 2007. I thought once that fiasco was solved that we'd be on the straight and narrow here on out with Homecomings. That dream lasted not quite 9 months. After getting our horrible situation resolved last June, we have made our monthly payments in full, on time each month for 8 months, cash via Western Union because that's pretty much the only way to prove to them that we make our payments if there is ever a problem. We didn't receive a March '08 statement, and when I called several times in February '08 to try to verify that they received and posted our February payment, I got a recording that said "Due to technical difficulties, Homecomings Financial cannot take your call. We apologize for the inconvenience." On Feb. 26, we finally got through to a live person and mysteriously, they held our Feb. payment (and did not post it) for absolutely no reason, and no explanation as to why they did so. Also mysteriously and conveniently for them, they never mailed us a March statement so we had no idea they held the payment to begin with. Also, they have tacked on a mysterious $596 in "fees" supposedly from "last year" with our foreclosure proceedings mess. Funny that not a word has been said, not a notation on any of our last 8 statements about owing any fees whatsoever. We contacted the attorneys that Homecomings used in last year's foreclosure proceedings and they said our case was closed in June '06 and that there have been no further fees charged to them. Where Homecomings is coming up with these supposed attorney's fees is a big fat mystery because the attorneys have not been charged by Homecomings, nor have the attorneys done anything regarding our account. PLEASE BEWARE OF HOMECOMINGS FINANCIAL'S DISHONEST AND FRAUDULENT PRACTICES. They do this time and again to unsuspecting people paying good on their mortgages. Their customer service is abhorrent- no one will tell you anything, they won't tell you where the fees came from, they won't send you a statement, they won't send you anything in writing to show you where these supposed fees are coming from. BEWARE AND PAY ATTENTION MONTHLY AND VERIFY WITH THEM EVERY TIME YOU MAKE A PAYMENT. Otherwise you won't know they are holding payments until it is too late. Well, this time we are contacting an attorney and they will definitely hear from our attorney. They will not get away with it this time because we are not stupid customers like they think we are and we will not fork over a dime to them until they can tell us where these fees came from and prove it in writing.

They will not work with you. I called then several time to seeing if there was any help out their for people who's interest rate whrer are going up. Every time they would say their is nothing they can do for me. My interest rate is at 12% and it started out at 6%.

Homecomings purchased an insurance policy on my account when another insurance was current. They will not fix their error and now applying my principal and interest payments to that account.

They never respond properly. CSR do not have accurate information. I have called them every day I get off work since December of 2007. With no return calls. And now it is 02/08 and they are foreclosing on my home I have lived in for 10 years.

I too had issue with HC when they first bought our loan. My payment had gone to the old company and took time to catch up with HC. I didnt have any idea we were now behind with them until the next payment came due and the bill showed 2 payments plus fees. I tried to arrange a plan to keep this from causing damage to our credit until it was resolved. That took many calls and time. Then they failed to tell me they would hold partial payments and my money was tied up in some "holding" account. Now my credit started being affected as my payments were showing 60 days late. FINALLY I had all of the payments made for the 90 day arrangement but we were still nailed with LATE FEES and in the end they reported my mortgage as 90 days late, 60 and 30 for the three payments we had made. So the arrangement didnt seem to make any difference in the end.... We still came out in a BAD way credit wise.

Homecomings are rude and unorganized.They transfer you to several people and no one has the answers to your questions.I mailed a payment and I accidentally made the check out for 7 cents less than the required amount and they were going to increase my rate for being late. I went through a lot to have it changed back for a lousy 7 cents. They said I didn't send in the total payment. They jumped my 5.9%interest rate up to 18%. I have excellent credit and now I send every payment certified or mail to assure that they do get it.I believe we should have a say as to who owns our mortgage. Homecomings has bought my mortgage on two occasions and there is not a thing that I can do about it.

Were sold into this company, nothing was explained to us on what would happen when the arm adjusted. Now we have no choice other than to SELL/ we are agreeable with that.The mortgage company calls us for our payment weeks before it is even due. They even call us on Sundays. WE think that is just WRONG.

We have continuously tried to get our loan refinanced or restructured to avoid the situation we are currently in, but we were never past due enough in order to be considered. Now, we are in foreclosure and they won't even return our phone calls to discuss different possibilities.
