Horrible. They call me ten times a day and say they are recording. I ask them to play the tape back because nothing has changed since an hour ago. With my issue they will not budge even if I pay them all escrow deficiency they will never return me to P&I payment. Forcing escrow payment on me will force me into foreclosure and they know it-they want my equity.

Everyone's best bet is to tell EMC they can work with you, or you can put the house on Craig's List. Ask EMC how easy it will be to get anything back on a house with no faucets, no windows, no Air Conditioning, No Heat, No Pipes, possibly no roof, no doors etc... If you are going to lose the house, you might as well go out with a bang. Some banks will negotiate and even cut a check to the owners to "leave the house as is". You may still have a foreclosure on your credit, but you can still walk away with some cash. Remember, you OWN THE HOME. EMC just has a lien against it. You can punch holes in the roof and walls, sell the Air Conditioner/Heater, water heater, the windows, all the fixtures, probably just short of knocking it down with a bull-dozer (you may need a permit from the county) and there is NOTHING EMC can do because they don't hold the title. They wont work with you? Leave them holding a $40k shell rather than a $200k home. Watch them try and get their money back on that one. Don't think you own the home? Look through your paperwork and you will see the title in there. It's yours. This is one thing the banks DONT want you to realize. Have fun screwing the bank!

We dealt w/EMC-our 1st morgage should be paytowards Principal&interest but all went to interest only. Our escrow went up for 2008. We are doing modifications since the first time we submitted the doucments Fe08. We have not hear anything from EMC rep-I called to follow up, I always received a vague question that they never received few of documents. We re-sent so many times, and I was told again that it was not updated or put into the system, that it takes 48 hrs before they can updated. I called again it says they will updated end of days. All the calls my husband and I made nothing happened.

Since October I tried to straighten out their accounting mess after the 1099s arrived. Then they arrived again this time with the "fuzzy Math". The IRS is not going to buy what they are selling. EMC has repeatedly misplaced payments. Send statements almost every other months showing two month behind so I, like the above speak with at least three different people a day to fix our problems. During all this my husband is suddenly stricken with Congestive Heart Failure and will be needing a loan modification to stay currrent. The requirements are you need to pay your payment for three months without being late. More or less I need to plan disability and let them know which dates we plan on and pay three months ahead. Also, what happened to the isurance they push on you and if you upgrade for about 9 -10 dollars more they cover disability up to 200,000, all of a sudden it can not be located. I am sufferin the stress and cannot sleep tring go over where we went wrong. We are like losing equity in our home as they default, and destroy what will we have when it is settled? The lenders should have been licensed in Colorado back in 1998 when this started. We are going to litigate, do not allow them to beat you. Do not listen to their negative character assasination they know just the buttons to push. I will not allow it to happen again to us and hope my efforts will keep them from hurting anyone else.

Watch out that your local mortgage doesn't get sold off to them....that's how I got to meet them. Never missed a payment. Sold house. EMC continued pulling payments by electronic transfer for 2 months, even after written threat of legal action. Now they want me to request in writing (they don't know to whom or in what format) that they return the money (which can take 90 days). Every CS person has a different story, terminal hold and hang-ups are common. They sent my final escrow check to a completely wrong address...then wired the balance to some unknown location (5k still missing). The whole thing smacks of some carnival scam. I am a Florida Broker and will make sure that my clients for the next 20 years never use this company.

I have been dealing with EMC for a couple years now. I admit that sometimes you get different answers from unexperienced persons. I initially was allowed a deferment on my payments that had fallen behind. Originally I didn't escrow and my payments went up because of the escrow shortage and new escrow. Because of instability in my husband's job and a layoff of my own I was thankful that they granted the deferment. I am now sending in so that I can have my account modified. I received the information and I will check back later to let you know what the outcome is. But so far they have been ok, I guess.

Everyone here as the same story and people that I know that have EMC also have the same exact story. Something does not sound legal about this company. I contact EMC prior to my first adjustment, and increase of $400 a month. When I did not hear anything from them, I called and was told that I did not include my insurance form, which I did, but resent and faxed it anyway. No word from them. Was transferred from person to person and hung up on numourous times. Was told 4 months later that I make enough, have a nice day and hung up. I re applied with the second adjustment of an additional $300 a month. This is insane. I take home $2300 a month and my payment is now $2000. a month. I could not pay anymore. In 7 yrs I have never been late. Does it not make more sense for them to work with good customers than for them to walk away from their homes leaving them abandoned for EMC to TRY and sell ??? And none of the personnel that I have spoken with have shown any kind of professionalizm or seem to know what they are doing. They sound like a bunch of minimum wage paid kids. I have not been able to get a name of any officer of the company to contact. And what could that MOD SQUAD be all about because I have been unsuccessful in getting any kind of help or phone calls or letters and have been asked repeatedly to re-submit all my information. How is it that so many people have the same exact experience with EMC without them being investigated. Something is very wrong here.It is not just because they are so busy when they are clearly dodging people. 2 1/2 yrs ago they tried charging me for late fee's when I made my payments on the first of the month. When I called to complain, the fellow that I spoke with told me "the payments are sent to a location that we do not pick up all the time". What kind of crap is that ????

Well, after all this and trying to get best deal for the bank, it went to Sherrif sale. Now they still have it, and it will most likely not get what I got for it, as the appraisal is much less. I contacted EMC Modification Department in January 2008 about ARM increase due to take effect in March 2008 and that there would be no way I could make the new payments.I was told by EMC Modification Agent Cory/Tamara that Modification paperwork would be sent to me in 2-3 business days. I just needed to fill out the form and provide necessary documents. Then fax completed form to phone number listed on letter. After waiting 10 days, I called EMC and was told by another agent that all she can do is resend letter and I should get that one in 2-3 business days. I called EMC back again after 3 days and was told the same comment. EMC blamed my postal carrier/post office for service. I was told all they could do is regenerate letter and it will take 2-3 business days to get to me.

EMC has not been good to us and refuses to work with us even though they readily admit that if they foreclose, the property will sit vacant for three to four years. They want us to pay a mortage payment that will leave us about $300 a month extra. That is not alot when you have three teenagers. I am unable to refinance property because it will not appraise as high as when I bought it (I would need 45k to closing in order to qualify for a refinance). I Was told by EMC Mod Squad agent Sandrine that Modification paperwork would be sent to me in 2-3 business days. Just fill out form and fax completed form to phone number listed on letter. After waiting 3 days I called EMC and was told by another agent that all she can do is re-send letter and I should get that one in 2-3 business days. Called EMC back again after 3 days and was told the same comment. EMC blamed my postal carrier/post office for service. Was told all they could do is regenerate letter and it will take 2-3 business days to get to me. When I asked if they could fax it to me, I was told they do not send faxes and I would have to wait until Modification letter arrived, then fill out forms and that form will have a fax number to send it to (so they can't send a fax but can recieve them). So I called EMC Mod Squad twice a week from November 25-December 31 and still never got Modification letter! Always getting the same response. Tenant moved out in December 2007 and I could not make January 2008 payment. Again I have been contacting EMC Mod Squad awaiting this Modification letter since November 2007 and have NOT gotten letter! February 2008 payment was not made and the collections calls started (16-18 times a day!!). I hired a realtor for a short sale on March 1, 2008 and THIS IS WHEN THE MODIFICATION LETTER FINEALLY ARRIVED!! Now I am dealing with the Loss Mitigation Department and am getting the "I'm sorry for not getting to your file but my office is inundated with Modification requests and Short Sale requests. I will get to your file as soon as I can. Please be patient." So in the mean time the Collections dept. continues to call, the Loss Mitigation Department continues to ask for the same information OVER & OVER AGAIN and send the "Please be patient" response and it seems the Foreclosure Department will have their way BEFORE any other....

My mtg was sold to emc, soon after purchase. In 1/07 received a letter asking for home ins, which i had already provided, so went ahead and provided again. I do my banking online so i was just making the payments which i thought were the same all this time, to my dismay i started getting harassing calls that i was behind on my mtg. Little did i know that they had added on their own ins which since 2/07, was totaling almost 2grand!!! Because of this i now have a thirty day late on my credit, which was their fault, and when i tried to make payments the best way i could, while trying to get the ins problem rectified, i got another 30 dy late because they don't give you credit for what you have paid unless it's in full. If i could afford their new inflated payment in full I WOULD HAVE MADE IT!!! My regular ins is only 500 a yr!!! All i can say is that i agree with everyone else, you speak to one person they tell you one thing, go back and your told another. I went from someone who was in control of my bills to playing catchup. I have watched my credit score go from 7's to 3's!! So now even if i wanted to who in their right mind would help me refinance without putting a lot of cash down? they have ruined my life and credit. This is exactly what happened to me. I made all my payments via speed pay and they said i didn't pay even tho i proved it with my bank information, it is a joke

We were victims of the flooding in July 0f 06, are damages were so severe that we received the maximum from fema. not only did we have extensive damage to our home but we also lost a vehicle. We called EMC and requested a two month deferrement. It took several calls, several hours left on ignore and being transferred from department to department. We never not got an answer to our request. Three months later we were served with foreclosure papers. Now they want us to refinance with a 40 year mortgage and putting all fees and late charges at the end of the mortgage. We are 60 years old. Have no intention of signing for a 40 year mortgage with a balance far above the value of the property. Don't ever believe anything anyone at EMC says or offers to do.

EMC randomly stopped sending us a mortgage statement each month. We have several mortgages with them for several properties (not by choice - the mortgages were bought by EMC) so I didn't notice that one went missing for a couple months. They never sent us a 30-day late notice. We got a 60-day late notice with a warning that if we were late again they would start foreclosure proceedings. We immediately addressed the issue, which we feel was primarily their fault. They would not remove the bad mark on our credit rating. As a result, we couldn't not get a loan to refinance and our credit cards universal defaulted us, raising our rates to the highest possible. This company is unscrupulous to say the least.

Property values in my area went down significantly, shortly thereafter, so I'm now stuck with an ARM I can't refinance because the property value is less than the mortgages. Had they just done a subordination agreement using the original appraisal (which was still within their date parameters for acceptance), I could have refinanced and saved myself some money, which would protect their interest in the collateral. Second, EMC set up their online automatic payment withdrawal program last year. I enrolled and their payment records online showed that I had made my payments. However, I found out that their system was not set up to handle all of the numbers in my bank's routing number or my account number. My payments reported as "bounced" on their website almost 30 days after they had been posted, even though according to my bank's records, they had never even been presented. EMC still charged me for returned payment fees and late fees. I had to submit copies of everything in writing to them before they would credit my account, and even that was only after I had to do phone-pays (at a higher cost) to avoid having late payments on my account. While they finally straightened out my account and agreed that the error was theirs, it took two different transactions to get it fixed. I heartily recommend NOT using their online payment system at all, because they assume you are the one who made the mistake, until you send them documentation in writing demonstrating otherwise. Also, if you figure out that the mistake is theirs, don't assume they will correct it on their own. They won't.

I agree...I haven't received much help from EMC either. We are determined to save our house and calculate we have to pay 40,000 to make the 80% max ltv ratio. DON'T GIVE UP NO MATTER WHAT!

Consumer's Original Complaint : The First week of April 2007 I purchased a home located at 1640 Sherbrook Drive, New Haven IN 46774 from Century 21 bradley, Emc Mortgage Corporation. In my offer to purchase it is stated that The plumbing problems with the house must be fixed and all components tested. Duane Wilder ws the agent representing Emc. (dwilder.duane@verizon.net) Rhonda Bandor was my agent.(rhondasuebandor@aol.com). 260-413-1543. The realtors communicated back and forth about the downstairs toilet overflowing and the main basement drain being capped off. The faucets under the sink and the dishwasher also leaked. Duane worked on the house and called a sewer service out to clear roots from the sewer. There was a broken tile on the walk out stairs from the basement, that was not fixed and needed attention. The dishwasher still leaks as well as the garbage disposal. I had to call a plumber to come and fix a leak underneath the bathtub in the lower level family room. I paid for this out of pocket. I filed a complaint with this Bureau several months ago and never got any communication in the mail. On January 8th 2008 Hydrostaticc pressure from the water not going down the drain rather underneath the house caused the water to rise from underneath my home and flood the finished basement 3 inches of water. I took two personal days off work and a weeks vacation to try to save my house. The insurance company will not cover anything because there is no policy for water caused by broken tiles. I have experienced great loss because of this problem including kids toys and clothes electronics. TV's, computer's and accessories, Electical failure of everything in the lower half of my home, including, standing upright freezer, and the list is just endless. I am not totally sure that the corporation is to blame or if Duane wilder is to blame. I just know that it is against the law to flip property in this city and state. By consulting with the neighbors I learned that this house has flooded before. Which would explain why the whole downstairs of the house had been totally replaced and the upper half of the house was just remodeled. My point is that the Realtor knew of several water problems and communicated that with the corporation, and it was understood that these issues would be fixed. Several sewer company's have given estimates anywhere from five to ten thousand dollars for the repair of the tile at the back door. Excavation will be needed. Also a sump pump will need to be installed in case of any other problems. Thye main drain in the basement is capped off and runs to the drain by the back door. This made it impossible to get rid of the 3 inches of water in the basement. I am asking for a cash settlement and or the fix and repair of the items still needing attention. I do not want to have to hire a lawyer to get this settled but is this does not work, My tax check will be used to hire one. EMC and Duane Wilder need to come up with something, so that we do not have to go to court. I have all the signed papers from Duane and EMC corporation , with e-mails and attachments stating that the plumbing issues are fixed which was a lie.

I advised EMC of my pay decrease that would take place months in advance. They basically told me to get a second job. I'm a single mother and already work 60 hours a week until I got hurt. I am currently on sick leave and awaiting surgery in the near future on top of all of this.

My Mtg increased $1,200 mo.for my first adjustment. I made do until I couldn't keep up. I couldn't re-fi due to other circumstances at the time. I was basically robbing Peter (all my bills)to pay Paul(EMC). I finally couldn't do it. I called EMC to see if there was something we can work on due to my increase. I was current at that time and the response I got from them was "sorry, there is nothing we can do for you at this time. You are current on your account. Call us when your account is past due". I never called back.

This company does everything in its power to foreclose on your property. They got my loan from WFHM and I have continually had inflated fees and charges and no real help in my situation. I am almost to the point where I would let them have the house since I am single and don't have kids that need the space. Then they can just try to sell the house in our housing market...

My mtg was sold to emc, soon after purchase. In 1/07 received a letter asking for home ins, which i had already provided, so went ahead and provided again. I do my banking online so i was just making the payments which i thought were the same all this time, to my dismay i started getting harasing calls that i was behind on my mtg. Little did i know that they had added on their own ins which since 2/07, was totaling almost 2grand!!! Because of this i now have a thirty day late on my credit, which was their fault, and when i tried to make payments the best way i could, while trying to get the ins problem rectified, i got another 30 dy late because they don't give you credit for what you have paid unless it's in full. If i could afford their new inflated payment in full I WOULD HAVE MADE IT!!! My regular ins is only 500 a yr!!! All i can say is that i agree with everyone else, you speak to one person they tell you one thing, go back and your told another. I went from someone who was in control of my bills to playing catchup. I have watched my credit score go from 7's to 3's!! So now even if i wanted to who in their right mind would help me refinance without putting a lot of cash down? they have ruined my life and credit.

Because of an undisclosed Yield Spread Premium that was paid to the broker, our interest rates were bumped up at the signing of the docs. EMC's stance is that they just service the loan, but they are wholly owned by Bear Stearns and their faxed communications continue to be stamped with a 'Bear Stearns' ID. Here is our story: In April of ‘06, we had a broker working on getting us a home loan. He originally worked for De Oro Home Loans, and that is the company for which we filled out all the docs. A few weeks later, the broker said that he now works for SLC Mtg, and that he would use all the docs from the previous company. We were told that our interest rate on the 1st loan would be 6.33% fixed and on the 2nd, 8.5% fixed. This is what all of our pre-closing docs say. My credit score was in the 700’s so these rates were well within the normal range. The closing docs were drafted on May 23rd, 2 days before closing, but we did not see them until May 25th…1 ½ hours before the Title Co. closed. I feel that they pushed the signing out intentionally, leaving us no time to find an alternative lender. The interest rates presented to us were 7.5% variable and 10.375% interest only. Since we had to close that day or lose our earnest money, we signed, in spite of how upset I got, as I was brought to tears about the rates. We had to sign ALL of the docs for Bear Stearns at that time, including the loan application and all of their NEW disclosure forms. I dated every form with the current date so there was no confusion in the future as to when we were presented with that information. I was 1 month pregnant, we already had a non-refundable deposit with the movers, and had already given notice to our (2) landlords that we were vacating by months end. Our liquid assets were depleted for the earnest money and deposit and did not have enough left to find last minute housing. We have since paid the neg. equity option to keep our payments as close to what we had planned and now owe close to $15,000 more than when we started. The house is NOW worth more than $100,000 LESS than what we bought it for and while we realize that is our responsibility and want to pay what we owe, we cannot see paying the inflated rates any longer. We stopped paying in July ‘07 because EMC said they couldn’t even talk about modification until we were at least a month behind in payments. Now, of course, receiving foreclosure notices. I have contacted several depts. at EMC, and Bear Stearns, and their solution is to charge us 8.5% on the 1st, which now has a balance of $313,000 instead of $292,000. No offer has been made on the 2nd. We continuously receive collections calls at least once a day and we need someone with a more authority to step in try and get them to honor the rates they disclosed to us. I have all the docs to prove the bait and switch tactic used. My feeling now is that they had the initial euphoria about getting away with bumping the rates and changing the terms (because they had us backed into a corner), now they can deal with the long-term loss in value. Sure, my credit score will suffer for a long time, but it would take longer than that to recoup the loss in value. SHAME ON THEM for treating people like that. Like I said, we signed the docs under duress because we would have had to move into a hotel, and put all of our things in storage until we found other housing. I wouldn’t wish that on anybody.

We came to an agreement with them for repayment. We signed the agreement and faxed it back. They claimed it never came and then Sent a new agreement with a closer start date for repayment. They don't really want you to keep your house. I called tried to rectify the problem but nothing.

EMC requires that you be current or that you have three consecutive payments on time. If I was able to pay on time I would not require a modification of my loan. My interest went from 6.5 to 9.5 in 3 months. My wife and daughter have a long term medical condition not covered by insurance. I can pay without the increase of interest but EMC will not work out a loan modification. They just want to squeeze the last dollar. They even suggest me to get a third job and to eat less.

EMC is not a collection agency. That's how they treat you when you call. They make threats and make no effort to offer customer service. I feel that the customer service representatives are hired without souls. We are people and life happens. They pretty much suck and I would love to help get them out of business.....

Have requested short sale package for months. They always tell me that they have sent it and will send another one bot I never received anything from them. Then they try to foreclose my houses. Everytime I called them they said they had to transfer me to another department then I was disconnected. They are very devious and unethical. Beware!!

EMC obtained our loan from WFHM, now our payments went up nearly $600 per month, and they constantly call my place of employment for payments that are not due yet, or payments that have been made, however "must not have been posted in our system yet" - direct quote from EMC personnel However when we try to contact them about our account, it is a 30-45 minute phone ordeal with no less than 3 deparment transfers and we do not get our questions answered.

We fell behind in our mortgage payments to EMC after my husband unexpectedly lost his job. EMC has given me the run around and has never been helpful in setting up a lower payment for a few months, which they suggested initially. They say we don't make enough for a modification of our loan. WELL ISN'T THAT THE PROBLEM WE ARE TRYING TO FIX?!!?!? That's why we need a lower payment for a few months!! They don't get it and are not friendly about it.

EMC Mortgage does not seem to want to work with us to make payment arrangements to keep us from falling into foreclosure. We are disabled and they don't seem to have any special programs for people on disability Social Security. They call daily to question us about when we can pay the payment and we never can because we are on such a limited income.

little to no response on any/all faxes-phone calls-letters/according to them they are too busy-deed in lei paperwork on desk for over 3 months(they said)offered me several options over phone, but they never followed up.i would submit for deed in lei, they would have it done as short sale??? then back to deed. then short sale.. they never seemed to have it right. they kept encouraging us to just let it run its course. not real help keeping home offered.

They let my payments set and then charged late fees then set up escrow which I did not have. Now they want to foreclose because my payment did not take care of escrow WHICH I DID NOT HAVE ON LOAN.
