ASC is very difficult to work with and even harder to get a hold of. They typically will require that you have been with the company for over one year before they will offer a workout. It is nearly impossible to call and talk to the agent in charge of your loan. You will have to call them, leave a message and hope that they call you back.

this loan was bought, and i ended up with ASC. I have been trying to get a loan assumption and modification, at no avail..... 10 months, they did not state they started Foreclose, i found out before i was going to be served... we are now in a wait position.... i get computer generated letters weekly, they all contradicted each other...

Absolutely the worst servicing company known. For the thousands of you that are having problems with ASC such as I am, get a hold of NACA They are consumer advocates for people in trouble with their homes. Wells Fargo is considered a "Predatory Lender". We all have rights.

for the posting stating asc only deals with cases of poor credit-BS! My credit prior to their purchase of my loan was in the high 7 hundreds. Not behind in payments yet but can get zero cooperation to re-fi.ASC is not in business to help people finance and stay in their homes--they are in business to wait for you to fail and take over the property. As far as Wels Fargo--this little side company they have fronting for them is quite the little scam. I only hope investigations prove to be detrimental to the bank. They accepted stimulus money from the government and are backed by Freddie Mac so must eventually participate in re-fi's to people who were "awarded" sub-prime loans. Don't think the realtor and original mortgage company weren't all in on this when you bought your home. What goes around comes around--remember that. Put your faith in God that these people will answer for their crooked business ways and that all of us trying to save our homes will get the appropriate action-finally.

I was told that to modify our loan we had to be 3 months behind and then they sent us into foreclosure while they were trying to modify our loan. After we filed chapter 13 to keep our house they said the process had to begin all over. We have been trying to re modify our loan for 7 months and still have nothing.They charged attorneys fees of 12,000 that is why we had to file chapter 13. All our bills were paid up until they said we had to be 3 months behind and then refused to accept payments on our house. They are crooked and seem to be getting away with it. We did not use this company from the first our loan was sold to this company. I would not recommend them to my worst enemy. i am still fighting them and now have an attorney working on the modification.

This place is a collection agency for Wells Fargo and I'm sure they may handle some sub prime mortgages but I'm offended by the comments that everyone has bad credit because we certainly don't. If you say it's a sub prime company, you must hold a sub prime loan, too. They have never bothered us but we just don't care for them because of your unfounded comments that are unprofessional and inappropriate. Incidentally, the grace period is only extended to those with exceptional credit. And have a little empathy for those less fortunate. Thank you.

ASC is one BIG JOKE One department does not know what the other department is doing. I have an ASC Loan and trying to get a modification. ASC preys on the ignorant. ASC cannot foreclose unless they have offered you a loan modification. That is the new law. Also, if you write a letter to ASC, make sure you write a letter to the office of the president. Ask for this number. If the office of the President does not answer that letter, you can literally nail ASC. They have to respond to all corespondents. Hope this helps.

I have been w/ ASC for at least 3 yrs. My partner lost his job and we weren't able to keep making the payments. Therefore, I contacted ASC about a loan modification and it's almost been a year and the modification is still going through the process. My house did get appraised through ASC for a loan modifation and it appraised at 59k. They are trying to work w/ me to get my loan at this amount. In the mean time my home insurance was due but I didn't have any funds in escrow and ASC still make the payment for it. Yes, it has been almost a year that I have not paid my home or gotten my modification complete but I'm still in my home and my house is not up for foreclosure. The only downfall is that my credit has got a hit due to this. I find myself blessed because my kids still have a home and I am able to feed them and go to work every day. So far I have not had any problems w/ ASC. Hopefully the outcome will be just the same. I'm sorry that you guys have had such a bad experience w/ them. Good Luck!

ASC has been giving me the run around for about 8 months now. I have supplied them with the information they request 3 times and they always say they didn't get it and they don't ever get back to me. The one offer they gave me would have made me pay hight payments than my regular house payment...Thanks for nothing.

I am presently in the waiting for modification mode. I have never been late at a morgage payment. I got a call at work yesterday from ASC asking me what I was going to do about my morgage debt. I couldn't believe what I was hearing. After a few minutes explaining to the person on the phone that this could not be the case, she put me on hold for 10 minutes. When she came back on, she informed me that my morgage payment went to a suspence account where it will sit until the modification goes through. Now I'm concerned about what is going to happen to me. She said it was etirely up to me to send in the morgage payment for May. As it will also go into the suspence account. I think I may be being set-up for late charges and penalties and eventually forclosure.

We were told they would assist us in modifying our loan so that we could keep our house. Now we get a notice that our note has more than doubled. That is not the kind of help that we need. I would not want anyone to go through the stress and constant upset that we have with our mortage company.

THE WORST THE WORST THE WORST, they lie, they tell you one thing and then say that's wrong and they never said it. They charge you for payments you made but they say you didn't. They ignore all requests for modification but instead raise the rates higher and higher and then want to "help" you. My mortgage was sold to them, the worst company ever in the world...they have destroyed my credit and I can't refinance anywhere else.

They are so computerized to ask the same verifying questions each time you call to only do nothing with the information. I received paperwork to make me think my modification was set for my new payment to kick in only for an officer to show up in my upper middle class neighborhood to serve me foreclosure papers. I still to this day have not received a notice in reference to my request for modification. This was not my original lender and I didn't have any contact with them until after I lost hours on my job in July and got behind.

Norfolk WV, I agree with you Hagerstown MD needs to stop and think about what they say. We also did not start our loan with ASC we were sold. Also my husband and I both have over 700 credit scorss. To the poster from Hagerstown, MD: You are SO mistaken in much of what you had to say. I did NOT have a subprime mortgage, nor did I, or do I, have bad credit. My credit score is over 800, I have over 100k in the bank, and my home is worth more today than I bought it for. I did not end up with ASC managing my loan because I was a bad credit risk. My bank went under who previously held my note, and ALL their mortgages were sent over to this company. SO, before you go ranting about how every customer of ASC is a deadbeat, do your homework.

I had lost my job and told them I needed help before my loan reset and there would be no way to pay. Their advice to me was "get to 90 days late and then we can give you options". I did this and they never gave me any options. I had a buyer that was interested in short sale and they forced me into forclosure.

I was always sent to several departments even if I asked for a specific one. If I asked a specific question,ie; why did my monthly rate change if my loan is a fixed rate? I have never received an answer. In my request for a loan modification, I was not offered less interest, a reduced principal,to put outstanding amount at the end of my loan, etc. I was told I could not start to ray again unless approved with a repayment plan. They asked for the same info as the loan modification people; and they tried for 3 months. I DON'T UNDERSTAND. I luckily have an individual that is willing to loan me the outstanding balance to restart my payments but I run the risk of losing a friend. I can't pay a mortgage note and a loan too.

ASC America Servicing Company behaves like a foreclosure only company and not a traditional lender. Originally I signed up with New Century Mortgages they then transferred the subprime loan to ASC without notification. My nightmare started when my loan was sold to ASC from Option One Mortgage. It was the worst two years of my life dealing with ASC. They were very unprofessional. From the very first payment every thing was screwed up and when you finally got someone on the phone they would all tell you something different. We eventually ended up losing our home because we refused to pay them any more money. My suggestion to anyone with a mortgage with them is to refinance or something, but don't trust them with your payments. They didn't even pay my esrcowed taxes and insurance on time. Does anyone know about a class action lawsuit? I'm in

First, there is no one person assigned to any loan until it is approved for a repayment plan or loan modification with the loss mitigation department. ASC is not a lender, so therefore, they did not set your interst rate nor can they change it. ASC does not refinance loans either. If you were stupid enough to sign an Adjustable Mortgage Rate note, you will have to hope some other lender will take another chance on you considering you have already defaulted on the loan you have. Most of these complaints state they had "good credit" before ASC; let me assure you, they did not. ASC is a servicer of sub prime and non prime mortgages. That means the average credit score of these debtors is between the mid 500s to low 600s. This is considered POOR CREDIT. Also, no lender or mortgage servicer is required to provide any type of retention plans. You signed a contract stating you would pay back funds you were given to purchase a piece of property. If you default on that obligation, that property can be taken from you. ASC is not your mother and does not have to "help you out". This is where the real problem is. If you really read these complaints, you can tell these are uneducated people who think everyone owes them something and if something goes wrong, it's also someone else's fault. If your loan is past due and ASC helps you with a forbearance agreement, why do you think it shouldn't be reported to the credit agencies? First there is the Fair Credit Reporting Act which states that a creditor MUST accurately report the status of the loan. It doesn't matter that you might be making payments on the agreement, you're still behind in your payments and it has to be reported that way. Maybe if you could manage your money better and understood what an obligation is, you wouldn't be having any problems making your mortgage payment. Again, if you're loan is being serviced by ASC it's because you are a BAD CREDIT RISK and have proven you do not know how to live on a budget or to prioritize your mortgage payment as being the first thing paid each month. Oh, and one last thing. There is NO GRACE PERIOD IN A MORTGAGE PAYMENT. Your payments are due on the first of the month and are considered in default on the second of the month. You assess a late fee after 15 days but this isn't a grace period. In fact, read your Note. The late fee assessment is explained under the paragraph entitled "Failure to Pay as Required". Stop whining people and grow up. If you can't afford your mortgage, sell your house, work two jobs, do whatever you have to do to keep your home. But stop blaming the servicing company for your problems. TAKE SOME RESPONSIBILITY.

American Servicing company took over our loan from Sebring Capital.We were told that if we made our payments on time,for the first (2)years we stood a very good chance to get off of the A.R.M.mortgage and on to a fixed rate. This has not happened. Instead our rate which was 10.35% has now increased to over 11.375%making our payments over $1,800.00 a month to enclude the property tax.We have a two part loan and both intrest rates are over 11%.We have made every payment within their guide lines, understanding that payments are due on the first of each month and we have until the 16th of the month before we are considered late.We have not missed a payment in (3)years.As of Dec 3rd 2008 the co owner of this loan passed away. This also represents a lost of income.I called ASC on several occassions to ask for help in keeping our home, and all I have gottened is a form letter stating they mat offer me a workout program.I sent several packets with a letter of hardship death certificate pay stubs bank statements financial worksheet with all my bills.I was told a negotiator will look over my account in about 30 to 65 days.I was told it was not in the best intrest of the company to render a workout program for me at this time.I have been through this process at least (4)to (5)times without any resolve.Please understand we had less than perfect credit when got this house.Oh yes! we went through H.M.S. Home Marketing Service who qualified us enough to get our home.We have done every thing we can to keep our home, and we are not going to just give it up.They even offered me to take a short sale can you imagen that!!! A class action suite may raise some eyebrows. someone please help. G Family

If you are having a problem, they will take their good natured time to get back to you. Sometimes it's too late. If they do get back to you and let's say you work out a payment plan with them They set it up with repayments so high you can't make them no matter how hard you try. I know it happened to us. This company is a lair! They do everything in their power to STEAL your house right from underneath our noses! They make it seem like they want to help you but the don't! Well listen people I e-mailed my local and state congressman and reps. I even e-mail the white house. I refuse to just complain about my troubles with this mortgage company I'm taking some action. I talked to someone at Barbara Boxer's office and they gave me an address to send a detailed letter so they can have the Dept. of Treasury investigate them. They will even assign a case worker to my case. I may not be able to get my house back but at least I will expose them. In my area there is a news station that investigates things like this and then they air it during the news I contacted them too. It's call 7 on your side, with ABC. I have to do something if I don't then who will Obama?! He wants to give banks like this one more money! NO WAY!!! I have to at least help others know what this bank did to me..... I think we should all do this in our states and if we make a big enough fuss then we may get something done. I rather try than sit at home and wonder what if........

They paid our taxes late even though we had an impound loan then they tried to tell me I was responsible for the 800.00 they didn't pay the county. They also paid my flood insurance to someone else and when I called them 3way with my flood insurance agent on the phone with us they didn't want to help us. After 3 hours on the phone with them I gave up. They started charging us they're insurance because our agent canceled us after we couldn't afford to re-new it. They are not willing to help out their customers, they are an awful company without any morals! The answers to all the questions is either I have no knowledge of that or I'm not authorized to answer that but yet they won't or "don't" have managers on duty! They denied my payment even though I had it complete, they distroyed my credit and now are trying to evict me and my family out of our home!

It is unbelievable to me to see that people have gone through what I have with ASC. ASC told me on 2 separate times within a year my loan was being modified and to not make any additional payments until we received the new re-mod paperwork. My husband and I listened. We could make our payments but knew that after 2 years we were going to an adjustable rate so we wanted to re-mod our loan. We listened to ASC and NOW I HAVE NO HOME!!!! Even with all the documentation of the re-mod that we had ASC wanted 24k to stop foreclosure and I didn’t have it. I asked if they take 5k but that was not good enough. These people knew what they were doing. I have even called them after the foreclosure to tell them I wanted my home back and that my husband and I both work and are willing to take it back at the price we owed on it…. And nothing.

This is the worst company I have ever made business with! I hired a third party to help me with a loan modification and the first thing that ASC told me to do was to stop making payments towards my mortgage. Shortly after, I received a letter from ASC telling me that they had placed me on a payment plan which basically turned out to be that I had to pay the full amount of what I owed for the couple of months I hadn't paid. What kind of a payment plan is that??? Then I get a letter telling me that they weren't able to process my loan modification because my income is less than my expenses. That's the entire reason why I needed the loan modification. I don't recommend anyone to use their services. I think that they are thieves who are trying to keep other people's property and get people out of their homes. Whenever you try to get in touch with them they suggest things to you like short sales or to just lose your house. They don't give you options to try to salvage your home. They are idiots and I hope somebody audits them for the wrong business transactions they are making!! If someone is willing to write a letter to our congressmen or senators requesting that companies like this do not receive stimulus money PLEASE DO SO. It is not fair that these companies are getting money by the millions while they are stealing from folks who are struggling to make ends meet.

I had them a few years ago, not by choice, they bought my loan. I was behind a payment so i went into a payment plan. as of that date they stopped reporting payments to the credit bureaus so it looked like a missed a payment then didnt make any more payements for the next 18 months, when I refinanced my loan to get away from them. By then my credit had taken a huge dip due to the non reported payments. when i complained they told me for 3 months it would be fixed and never was. They reported my last payment as on time just before the pay off, then they have yet to report to equifax that my loan was paid off in march of 2007. I have called them twice about this newest problem. get a different story every time. If you have a choice do not deal with them, and if they buy your loan, refinance as soon as you are able with someone who doesnt sell them to servicers.

My story is similar to all. We both lost our jobs 2 years ago, Within 3 months I found another with a big payvut. This caused 2/3 of my income gone. I cut out all excess, changed phone companies, etc. all to decrease what money was going out. Like many, I tried a modification. The end results, my interest jumped 3%, and my mortgage doubled! In addition, since july 2007, they have been told by the insurance company that I have structural issues with the house. In January of 08, the insurance company released the funds to ASC. There are STILL refusing til this day to release the funds. In addition, I've received 3 different letters from ASC all within 1 week of each other, one to short sale, one to reinstate the loan, and the 3rd tells me what my new mortgage payment will be, which shows an excess in my escrow account. What the hell is giong on? No one seems to know. You never get the same answer twice. I am now in a position where I can pay this outrgaeous mortgage, not that I feel is right, but they prefer to take this house, leave me stranded. I don't understand the thought process. Actually I think I do: they want their cake AND they want to eat it too!

I work for ASC and I must say that we try our best to help. sometimes we are unable to do so because there is no income. You signed a contract saying *you will pay* no one forced you to place your signature there or to initial it. And if you didn’t read all of your closing documents that’s not our fault. All of our modifications are based on those closing doc IE: the investor guidelines* @@@@key rules@@@@ If the home is already in fcl we do not take funds from you until we are sure you can afford to keep the home. If you are pass due for more then 3 months we have to get you on a plan to help bring account current. All of out plans are designed to bring accounts current* Most of our call centers are inbound which means your never going to get the same rep information is interpretive differently per person. We do not refinance here you have to go to an outside bank to do so.

It is hard to get paper work to them and hard to get paper work back from them. However, if you lost your job that isn't there problem and as a bank they have to look out for getting there money back. There plans are not the best but if you stick to it and stop spending money on worthless junk you can and will make ends meet .Then you don't ever have to speak to them again. The problem here is ppl think that they "HAVE TO HELP" no they don't... this is why you never give money to family or friends... this is why you never go into buis with family or friends... what ASC has with you is a buis relationship were you pay and you get to keep your home. IT is a loan- its up to you to make ends meet to pay it off. Stop all this crying at the end of the day you have to PAY THEM or they get to keep your house. In other words stop trying to live a life that wasn't meant for you. and to top it off they have been around for a long time they can not be doing something illegal as you all want to make it seem. and if they bought Wachovia well that's why its a better buis because you don't hear its going under which for some of us is GREAT news.

After trying to work with this company since last June to avoid a rate increase, do a loan mod., etc. with no luck, I HAVE FINALLY HAD SOME LUCK. This has been a long, hard process and I have exhausted every option only to be told they couldn't help me. I decided what have I got to lose and called ASC one more time and actually spoke to someone named Darnell in Loss Mitigation at 866-248-5719. He was pleasant, helpful and we came to an agreement to avoid accelerating to foreclosure. I wanted to share this with anyone who may need help when it seems there isn't any. We came to a forebearance arrangement where he asked me when I could make another payment. I gave him a date and he said that we agree from that point on to make x amount for a payment on that same day every month for the next three months. If I pay them all on time, my loan automatically goes to review, they send out a terms and conditions letter rewriting the loan into a fixed rate to be determined. My credit report will show a forebearance arrangement and will still report 30 days late until the review in 3 months and the remaining past due balance gets added on to the principal of the loan but it stopped my loan from going to foreclosure at this point. My house has been on the market for 13 months.

All I needed to refinance and get out of my difficult situation was for ASC to waive our prepayment penalty, in 6 months the prepayment penalty would be void, so what is the big deal ASC. However, in six month my credit will be shot from falling behind on the mortgage and I wont be able to finance a piece of gum. Thanks very much people of ASC, nothing like being an American.

My original mortgage was not with ASC. I wish that my mortgage had never been sold to them. I have never worked with such an unscrupulous company. I've tried since January of 2008 to renogotiate or re-modify my mortgage. I've gotten little or no help from the. All their representatives have either pat answers, or it seems they are reading from a script from which they cannot deviate. I've kep records of the multitude of my call to them. Each time they give me different information and phone numbers. They've lost my faxes to them, and not surprisingly they have lost the record of some of my phone calls to them, They send me information which is time sensitive, and send it to me with barely enought time to provide them with the information in the time that they asked for. I've scanned and kep copies of their letters with the date of the letter, and the date on the envelope when it was mailed. Usually there's a six day difference. I've had it with this company, and their unethical ways of doing business.

ASC/Wells Fargo s"suck" They are horrible and are unwilling to help anyone. They are all about money and not trying to help anyone. They bleed you dry and then when they are done, they try everything they can to take your home. If I ever get the chance to switch mortgage companies, I will in a heart beat. They make you sign these stupid forbearance agreements that don't work for anyone and then they refuse to do a modification because they think people have surplus income...In this economy, what are they thinking??? MORONS!!!

Service is terrible and they do not care a thing about customer service. Unable to work with customers to find resolutions on Loans that jumped to 9.5% from 7%. Mortgage is robbery but I can not get my principle down enough to qualify for refinance. Equity is over 20% on today's resale so they have an interest in foreclosing. Please help!!!!

I have been trying to modify my loan with this company for months prior to the rate increase and no one has been helpful. They have been rude and transfered me to different departments (even been hung up on only for asking for help). Do not ever deal with them. They have horrible work ethics and are extremely unprofessional.

I, suprisingly, had a great experience with an ASC rep. Their main # is 800-662-3806, but they transfered me to a Wells Fargo # which was 866-903-1053. I hardly waited at all, and no one harrassed me on the phone! Good luck!

I am having a lot of problem with this company as well. Due to my husband loosing his job we were 1 month behind and they called to tell me that my home was currently in foreclosure and that they would work out a payment arrangement. Well when I got the payment agreement it was 4X my normal mortgage. They were adding over 3,000 worth of fees on top of my mortgage payment of $726.00. I call them to let them know the letter was bogus and they told me that I had to pay it and to sign the agreement and mail it back in. I did not mail the payment arrangement in and they told me if I send in a regular payment they will probably not accept it. THIS COMPANY IS A SCAM and it should be illegal for them to do this to homeowners and we all have to do something PEOPLE. Are we filing a lawsuit against this company. Do we copy these commets and send them to the Attorney Generals office or do we email the WHITE HOUSE. Our sweet leaders are talking about help homeowners if we loose our home who are they helping. I am so sick of how we work for everything and then our homes are sold to someone without us having a say...I AM SO PISSED RIGHT NOW. SO someone needs to take a lead but we all have to be on board.....please respond

When our loan was first bought by ASC we had no issues. In the spring of 2008 we had some unfortunate family problems with my husband losing his job. For months I was the sole provider of our household, and continued to make our monthly mortgage payments. The end of September 2008 I spoke with someone at ASC and explained that I had fallen behind by 1.5 months. The woman on the phone told me I had to be over 3 months in default before they could help me. I was confused, but figured she knew what she was talking about. One month later I called back to get some help. This time the girl told me that I didn't have to wait. She gave me a great deal of information, and said that she would send out something that needed to be signed and returned with documents proving my hardship. I was told to call back in 10 business days if I hadn't received the package. Needless to say the package never arrived. I called back to be told that I was to fax over information and that they do not send any information out. I faxed over the documents need for a loan modifacation in November 2008. Every week I would call back to make sure they had received the information, and were following up on my modifacation. On December 19th the put the loan into foreclosure without properly letting me know. At this point my loan was still with a negotiater for a loan modifacation. Everytime I call these people I get a different story, I can't get anywhere. Now my load mod has been denied and have no real idea of where this leaves me and my family. It seems like this company just wants to take homes leaving people in the street. Avoid ASC if at all possible!!!

You can't talk to the negotiator. You twiddle your thumbs waiting for the answer sometimes you'll get a letter or sometimes just so happens when you call the person thatyou have never talked to has lloked over the notes and says something like oh they looked at your file! I have had no problem with them. I follow my balance with my own computer program every time I make a payment, and their numbers match mine. It may be because I am paying more every month than my monthly payment. I have been paying them for 2 years and probably will pay the loan off in 5 more years. I don't understand all of the complaints. They don't have to work with you. You signed the loan papers. It's not their fault that you can't pay.

I've always received excellent service and I have automatic payments for the monthly mortgage, so, I've never had to deal with any conflicts regarding payments. My service experience has been great.

I received a letter from ASC about wanting to help me suspen foreclosure and modify my payment plan. When I called they told me I needed to pay $3600 in fees, and they were not able to tell me waht my new monthtly payment would look like. Then they said that they could not help me because I had already had a loan modification last month. Very disappointed, all they want is our money. Don't want to help us at all!

My husband and I lost our jobs with the same company due to restructuring. We tried to pay the mortgage and finally decided to rent the property. We did so successfully for one year. After the one year the mortgage readjusted and it did not make financial sense for us to move back in since we were making 1/2 of what we used to make. We attempted for YEARS (2007-2008) to lower our payments with to help. We also attempted to list the property NUMEROUS times at loan price but due to the housing down turn failed. We then enlisted the help of a short sale attorney and recieved several very reasonable offers and ASC refused to accept any of them. Now 2 years later finally we have a date for foreclosure and some sense of closure. This company is horrible they make NO attempt to help people struggling with today economical issues. We were not irresponsible borrowers and did not live above our means. Our circumstnaces took a turn for the worst and this company kept shoveling the dirt to bury us.

I recently came to a HUGE realization. ASC and other mortgage companies are not interested in helping becouse of the government aid(bailout)! More profitable for them to WRITE-OFF forclosures at current HIGH prices, rather than negotiate lower prices with current homeowners. The bigger thier LOSS, the more money they get from the government!!! So, it's more PROFITABLE for them to ALLOW forclosures to accure! WOW!

I had similar issues to others. My loan was sold to ASC. Fell behind on payments due to being a first-year teacher. Rather than working out a plan that was manageable, they put me on a plan with a balloon payment 4 days before Christmas.

America's Servicing Company would rather foreclose than work out a repayment plan that we can actually afford. Their idea of a repayment plan is to double our monthly payment for a while. If we had the money to do that, we wouldn't be having a hard time financially! It's ridiculous and I cannot beleive this company is still in business.

I would like to know if anyone has been successful getting a deed in lieu of foreclosure from ASC. I bought in June 2006, mortgage was sold to ASC and my inflated home value plummeted from 650 K to 300 K in Naples Florida in less than a year after buying. In Florida you can be sued for a deficincy judgement for 10 years and then the debt can be sold for another 10 years to someone else. A deficiency judgement can not be assessed for a deed in lieu of foreclosure. I lost my job and the new job salary is 2/3 of my previous salary.My mortgage/ins/taxes comprise 67% of my take home income.My original mortgage includes a second mortgage on value that no longer exists!Athough we have a fixed interest rate, this is very stressful , and I would rather lose my investment and lose less money by renting rather than pay for a house that will never be worth 650K again. But there is no hope unless we can get a deed in lieu. Any experiences on getting a deed in lieu of foreclosure approved from ASC rather than a foreclosure and deficiency judgement?

Both companies do not care if you plan on repaying the mortgage, they seem more interrested in foreclosing. Although, if you try to work with them all that I have received are lies. Select Portfolio calls all the time, day evening, weekend, holidays, Sundays - very annoying. They were even calling when my loan wasn't in default. It would be nice if the Attorney General would actually take charge and go after companies that conduct business this way.

We had no choice about being assigned to ASC. Our mortgage was sold to them. They don't seem to "play fair" in light of the world economic situation. Last week we received a letter from ASC indicating that our mortgage rate and payment would go up again in January. Their loan modication process and decision, in our case, do not seem to be helpful at all.

We have not experienced anything near what other persons have experienced with ASC. What I don't understand is why they would rather have a mess of vacant houses that probably aren't worth what was borrowed on them. Why not work with people to help them salvage their homes. After all taking less in interest payments is far superior than getting another house just to put it on drydock.

Hi My Nane is Rosa Sanchez My money promblems came 21/2 years ago when I took in my sister's three kids(DCF) I now have my two girls and My nephew only I have since made a payment plan with my lender starting 9/12/08 2536.00 In October I got a Bill for 2100.00 so I sent that in and on 11/8 a reator came to my door to inform me that my home has been sold. I would like the oppertunity to keep my home for my kids sake I mean rents are just as much as a mortage,however my fiannaces has become much more available since my car has been paid off and I don't have credit cards debt or any personal loans. this is the worst company. my loan was sold to asc in 2004. i lost my house this year. they refused to help me at all.i started contacting them in august of 07. i wanted to give myself and asc plenty of time to set me up with a loan modification. i spent hours and hours on the phone with them. after talking to literaly a hundred different people that told me a hundred different things they denied me for any loan modification, refinance, even a re payment plan. they gave me no option. my mortage reset in november of 07 and jumped $1,600.00 MORE overnight. they reviewed my financial worksheet and came up with the reason that we make too much????? and could not do ANYTHING. so we moved out in april of this year. the house did not sell at auction,and in may asc sold the house to a propery management company. we owed asc about 529k, they sold it for 360k. if they would have worked with me they wouldn't have lost anything but some interest. i don't get it. i owe on a second, i have no write offs come tax time, i am spending more on rent than i was on my mortage before it reset. i am at a loss . i hate asc with everything i have. i wonder how many companies such as asc that the government is bailing out. does the government know these companies are doing to help the situation, taking no advise from the president to "work with the home owners." we the people need the bail out, Not horrible companies like this.

They will admit my finances are ok, but the growing arrearage is what's throwing the modification off. Client had hail damage to home. Insurance Company sent check for repairs w/ ASC listed on check. Because home in foreclosure ASC refused to endorse check had client endorse check and sent back to ASC and holding funds Contractor told to send in required paperwork signed and nortarized by both client and Contractor, ASC required complete paperwork to get funds to do repairs. Contractor and client submitted paperwork. ASC has taken 2 months of deciding what to do w/ funds allocated for repairs. Ok'ed repairs and released 1/3 of funds, sent check to client who has disappeared. The check ASC sent out to client lists contractor and client. Contractor can't get ASC to reissue check w/o client even though all paperwork authorizes this. ASC also wants 50% of roof done (You can't re-roof a home only 1/2 way and wait for an inspection - This is MN.) and then will order inspection before releasing another 1/3 check (listing client again - whereabouts unknown) to finish all work. Final check w/ client and contractor listed will be sent to client again. Theses people are nuts, They have no common sense and are very condesending. They have so many insular layers of BS, it is completely insane, not to mention it is insurance fraud for them to cash an insurance company check on a insurance claim and to not pay to have damages to home repaired. Each call to ASC takes about 1 hour and each time the CSR will apoligize for the lies and mistakes of the previous rep. Any request for a return call from a supervisor or a person in a higher position goes unreturned and each request for any type of action is quoted as to take 2-3 days, then 3-5 days then 5-7 days and finally the original request is resubmitted after 2 weeks at which point the process starts over again. No wonder the mortgage industry is in such disarray. I equate this service even lower than HSBC's Customer service that is located in India. ASC's customer service people are Americans and can speak english but they must be required to have a frontal lobotomy. Maybe the United Way can start a foundation to help all these mentally challenged individuals employed at ASC! We should havethe CDC check to see if this might be some sort of contagious disease. I pitty these poor fools! Are they just that F'in Stupid

So, here’s my sad tale about ASC. I wanted to help my son buy a house in March 2006. His credit was poor so the mortgage broker suggested that I get a 2 year arm with a 2 year prepayment penalty mortgage AND after the 2 years get the loan refinanced in my son’s name. Good idea… So early 2008 comes around and the mortgage guy calls telling me that we need to start the process of refinancing in my son’s name. We start the paperwork and when the guy gets the payoff amount, he finds that there is an additional year prepayment penalty! Yes, I signed that at closing even though it was not the loan we discussed. Of course the original mortgage company is out of business but we track down the manager of the funding company (also out of business) and he says that the loan was definitely supposed to have been a 2 yr arm w/ a 2 yr prepayment penalty - not a 3 yr prepayment penalty. So I started calling ASC and they offered absolutely no help - telling me that I signed the paperwork and tough luck. Back to the manager of the funding company, he gets copies of all the closing documents including his handwritten notes to the mortgage company confirming the 2yr/2yr - he sends that to ASC and they still say tough luck. The payment has gone up by almost $600 per month and the kid can’t afford anymore money so Mom (me) gets to pay the extra plus all the taxes and insurance. I can not afford the extra expense - if the creeps at ASC would just refinance the loan to a 30 year at current rates, my son could afford it and ASC could keep the loan. As it is, we are considering letting the house go back to the mortgage company. So many big banks getting bailed out and all I’m asking for is to have a good loan refinanced at current interest rates - without a prepayment penalty of $18,000.00.

I lost my mother in May of 2008. It took weeks for me to actually get through and talk to someone at ASC. He informed me of the paper work that would be needed. After I received and sent the papers to the company, no one returned my phone calls for weeks. Finally I got through to someone who told me the fax number given to me was for the wrong department and the faxed papers were listed on the account as unreadable. When I faxed these papers I also faxed in my own information. But instead of them giving me a courtesy call, they opt to place the account into foreclosure for non-payment. How in the world could that be. No one would give me a bit of information as to what was going to happen to the home, whether I could just take over payments, or if she had insured her account. Now I am in an agreement to pay more that a thousand dollars each month for a total of five months. Because of the company's negligence not my own. All the extra charges are the so called fees to stop foreclosure on the home. As far as getting to my account online, there is no such thing. I have been trying for months. I'm really fed up. At present I have decided to seek legal help. Something with this company is not right.

My property was in foreclosure and went to auction but did not sale(all bids too low) so property resorted or was bought by wells fargo. I was then told that I had nothing else to do with that property. Within a month of the sale's date, I receive a statement from the insurance company that had been assigned to my property stating that I had filed a claim on this property that I did not own anymore. It also stated that the insurance company ok'd the claim in the amount 0f around 25,000 and also stated that it was to be payed to a third party who was to do the repairs on property that I did no longer own or have incurance on. I swear something sounds and is wrong. And how come my insurance wasn't cancelled at the time of the auction sale and any remainder sent to my bank account. I was told that this is a common practice in circumstances such as this. I wonder who sign that ins. claim form? I didn't. you can believe that i'm still checking into this matter....Help!

We had five of our properties sold to ASC. Working with them has been the worst nightmare I have ever faced financially. My credit is ruined because at first they said we owed a payment we did not owe and now we really are behind. They will not talk to you. You cannot get anyone competent on the phone to work with and if you do get a manager, they tell you how horrible you are and they twist your words and use them against you in lawsuits. Best advice: do not try to work with them on your own. You have to get a third party involved to work on your behalf if you have any problem and even then you may not get anywhere with it.

I finally got to a supervisor who said they would put a request in to speed the "reconfiguration" analysis so that I could have my correct monthly payment in a few days and not by the end of the month before it was too late to do anything about the foreclosure. they told me to call back in a couple of days and the system should be updated. of course that's what they told me a few days ago too. so who the hell knows. stay tuned!!! in the meantime, AVOID THEM LIKE THE PLAGUE! Lost my house last year due to ASC refusing to take three short sale offers of $520K, $510K and finally $490K. Owed approx. $580K. Day before foreclosure they called me and told me to send in three docs and they would halt sale so we could finalize short sale and pay them. They are absolutely disgusting. One rep told me to send in docs, which I did, and then the next day she claimed she didn't get them. Called another rep and he said docs were received. Hope they can sleep at night! Because of these people I have devoted myself to trying to help others in same boat. Got one now, they sold her house and she was still in bankruptcy. Looks like a reverse foreclosure to me! This company took over my loan for my rental property. They had hidden property taxes they said i owed and instead of sending my payment to the mortgage they took it for the taxes and charged me a late fee. They in turn jacked my payment up to over $6,000 on a loan of $319,000. they do not call you back and offer no help just let you stress out while they sit back and do nothing. The operators that you get are kids that do not even own a mortgage and have little or no education on these types of lifes problems. This company wants you to end up missing payments before you get any help and then have to walk away from your mortgage. They need to offer people help that have been making their payments and re negotiate the loan to a low fixed interest rate. This infact will lower the mortgage payment and both parties will win. It is sad in these times americans can not get any assistance all you hear is that your loan to value is upside down and you have no equity. oh but they will help if come out of pocket with a sizable amount of cash. This company is very frustrating and should not be servicing loans. They make you feel as though you borrowed from a booky and send thugs to collect when they push up your interest rate and your payment. Why is the better business bureau not helping when there are all these complaints about this company.

I have tried in vain to help my friend who is almost one year behind in his mortgage payments. As an objective observer I have the following statements to make: 1) I have never had a problem (except maybe holding awhile) getting in touch with a customer service representative at ASC. 2) ASC has always been willing to work with my friend (and myself once I was put on the account as a representative for him) to get this resolved. My friend was NOT willing to work with them. He would not give them his phone number and would not call them. 3) ASC has raised his interest rate every 6 months. From other postings on this site, it sounds as if they cannot do this and that it is part of the original mortgage plan -- I don't know. I DO know that he refinanced the home, took the money out of the refinancing and now doesn't care as he has already "gotten" his money out of it. 4) Yes, my friend has NO credit so there is no arguing that he cannot afford this mortgage. 5) I filed a loan modification for him over a year ago which ASC denied (and I would have denied it too) and so a year later he is STILL in this house making no mortgage payments and spending money like he is upper class even though he works as a laborer. 6)I find it very distressing that this country is being financially compromised because people don't pay their bills. MY ADVICE: People, if you trust someone else to tell you that a loan is "ok" without reading your own contract or having a lawyer look it over, you are a fool and need to learn this lesson. AND if you sign a contract KNOWING you cannot make the payments or will be hard pressed to do so, then you are a fool and need to learn this lesson. If you blame others for your predicament, then you are a fool and need to learn this lesson. ADVICE: Get rid of the house (sell it at any price if possible) and LIVE ON A BUDGET BASED ON YOUR SALARY. If you have to live in a tent until you can afford or find an acceptable home, then do it. Why should the honest taxpayer who pays his bills pick up the mess an irresponsible, illiterate or ignorent person has incurred. NO -- nothing is free -- someone pays for it and YOU ARE NOT MY CHARITY OF CHOICE.

Company is VERY difficult to work with, after going thru a period of repayment to catch up with them, we were advised that before we could go back to regular payments, we had 10 days to pay almost $4000 to get back in the program. This amount was never discussed, or presented in any documentation from them. the date that amount was due was on a wednesday, we asked for a 2 day extension, pushing the payment out to a day when both of us were paid, and they advised that was an unreasonable request, and it would not be granted.

Had medical issues and loss of income. Wanted to skip a couple payments and tack it onto the end of the loan. They said they would not do that and if we got three months behind, they would change the loan from interst only to a convential which would raise the payment and would not help. They have a website that says you can make a payment online when you go to make a payment, it doesn't allow you to make a payment nor does it give you options to make a payment by phone. It's bad enough to struggle to keep my home, when you to the people who say they will give options to keep it' they make it hard to pay on the mortgage. My husband & I contact ASC a few weeks ago to renegotiate our mortgage. They said they would send out the paperwork to us to fill out. Well, when it came, it wasn't my information, it was someone from North Carolina's information. I know where she lives, phone number, SSN #, mortgage amount, even how much she makes & how much she pays in bills every month. Still haven't received my own package yet. Called ASC to inform them and they transferred me to about 10 different people, none of whom could answer a question. I filed a complaint with the BBC against them.

On Aug.29,2005 we lost everything in the hurricane and we finially was able to get in touch with ASC and explained to them what had happened and told them we were forced to relocate due to insurance problems with the hurricane and ASC was told directly that we couldn't pay to live in 2 places and we couldn't afford it ASC wouldn't work with us and we told them that we were waiting for a grant and we wanted to pay them "CHRIS " told my husband that they wouldn't take anything less and would rather foreclose it went from a loan of 110,000 to 160,000 we offered 89,000 they are very unsenisitive and rude and if they were in our shoes they would not like it

We send our payments on time, they aren't debited out of our account until after th 15th! That's comepletely ridiculous. I agree that if one has a mortgage serviced through ASC, it's a risky credit situation to begin with. We were NEVER late with our first home's mortgage, so wanted to stay on track with this one, too. As far as many of the previous statements are concerned, I don't know how you can't get in touch with anyone at ASC. If a payment is received just a day late (even though they should have had it registered already), THEY call YOU. Are you avoiding your calls? That's one of the worst things you could do. Stay on top of everything. Answer the phone, log each call with time/date/CSR's name, keep records!

once again, people whining about ASC yet they prove they know nothing about the company. Accusing ASC of inflating an appraisal for your refinance proves you're just uneducated and a high credit risk. ASC is a servicer of loans; not an originator. Therefore, they didn't refinance you. You needed money out of your home because you've overextended your unsecured debt and now can't pay it back. It seems to be a running theme with you. IF YOUR APPRAISAL WAS OVERINFLATED IT'S BECAUSE YOU ARE ATTEMPTING TO OBTAIN MONEY FROM YOUR HOUSE THAT YOU HAVEN'T INVESTED YET. You can't obtain equity when you didn't put any money down. The housing market is in a downturn. If you were stupid enough to attempt refinancing at this time, you deserve what you got. Maybe you should learn to live within your McDonald's income. TOO ALL OF YOU WHINERS.. YOU ARE BEING SERIVCED BY ASC BECAUSE YOU ARE A SUBPRIME OR NON PRIME BORROWER. YOU HAVE HORRIBLE CREDIT AND HAVE DEFAULTED ON YOUR OBLIGATIONS IN THE PAST. My husand has refinaced with ASC an has nothing but problems since and they have sold our house gave us no notice at all about it. Then 3 days ago their was a notice taped to our house that said we have 3 days to quit, and atteched to it was a 30 day notice for us to be out of our home. To get all our thind an leave. What fuck! They have taken half of his retirement to save home. but some how they are going to take our home. Bullshit, How can they do this ? ANd they are going to come to our door in two weeks or so and tell us to walk out of our own home. and then they will change the locks to keep us out. What are we going to do? There are several factual errors in AFS' evaluation of ASC. First, there is no one person assigned to any loan until it is approved for a repayment plan or loan modification with the loss mitigation department. There is also no requirement that the debtor has to have an open account for at least a year before someone will work with them. ASC is not a lender, so therefore, they did not set your interst rate nor can they change it. ASC does not refinance loans either. If you were stupid enough to sign an Adjustable Mortgage Rate note, you will have to hope some other lender will take another chance on you considering you have already defaulted on the loan you have. Most of these complaints state they had "good credit" before ASC; let me assure you, they did not. ASC is a servicer of sub prime and non prime mortgages. That means the average credit score of these debtors is between the mid 500s to low 600s. This is considered POOR CREDIT. Also, no lender or mortgage servicer is required to provide any type of retention plans. You signed a contract stating you would pay back funds you were given to purchase a piece of property. If you default on that obligation, that property can be taken from you. ASC is not your mother and does not have to "help you out". This is where the real problem is. If you really read these complaints, you can tell these are uneducated people who think everyone owes them something and if something goes wrong, it's also someone else's fault. If your loan is past due and ASC helps you with a forbearance agreement, why do you think it shouldn't be reported to the credit agencies? First there is the Fair Credit Reporting Act which states that a creditor MUST accurately report the status of the loan. It doesn't matter that you might be making payments on the agreement, you're still behind in your payments and it has to be reported that way. Maybe if you could manage your money better and understood what an obligation is, you wouldn't be having any problems making your mortgage payment. Again, if you're loan is being serviced by ASC it's because you are a BAD CREDIT RISK and have proven you do not know how to live on a budget or to prioritize your mortgage payment as being the first thing paid each month. Oh, and one last thing. There is NO GRACE PERIOD IN A MORTGAGE PAYMENT. Your payments are due on the first of the month and are considered in default on the second of the month. You assess a late fee after 15 days but this isn't a grace period. In fact, read your Note. The late fee assessment is explained under the paragraph entitled "Failure to Pay as Required". Stop whining people and grow up. If you can't afford your mortgage, sell your house, work two jobs, do whatever you have to do to keep your home. But stop blaming the servicing company for your problems. TAKE SOME RESPONSIBILITY.

ASC Paid our homeowners to a company that only insures homes in a state across the country. So I am left for 7 months waiting on my check to come back from ASC because they paid MY money to the wrong company, and they claim that they cannot pay with out being reimbursed in the first place. In the meantime, I have since had to pay my insurance company directly. Totally ridiculous.

got behind on our payments due to deaths in the family and not working. asc said we could make the payment up by adding to our regular payment and they would not reflect on our credit. we are in the process of refinancing because our interest rate keeps going up, and found out that they reported us 30 days late each month for the past 6 months. also, cant get in touch with anyone. not a good company and will never do business with them again.

We have repeatedly tried to contact them in good faith and tried to resolve the situation in making sure we can make the payments and they never return any calls. We always have to call 3-5 times daily just to get them on the phone. TERRIBLE COMPANY, STAY AWAY FROM THEM, OUR MORTGAGE WAS SOLD TO THEM FROM GMAC AND WE REGRET EVERY MOMENT OF IT.

Maria, SOME of them can be very nice but the fact is behind those nice voices nothing is getting done, I put in for a modification in March just got a letter dated July 11, the auction was to take place in 7/22 and it said I had 10 days to file for an extention, the post office was holding our mail becasuse of the foreclosue and didnt get the letter till the 19th faxed over all the documents they required with in the 10 day period and they still sold my house... but they were very nice about it!

This lender could care less what is happen with the mortgages they have acquired. We will find a way to find out what they have done wrong to get people in over there heads and let them fail. A frustratingly difficult company to deal with – impossible to talk to anyone other than incompetent lowly paid service reps. The terms of our original loan were horrible. After two years, (just after the loan was purchased by ASC), our monthly payments jumped up by 800 per month. This resulted in a monthly payment well outside of what we can handle. The plan was to simply re-finance after two years, but because of the current market, we have been unable to do so. I assumed ASC would be willing to work with us and help put the loan back to where it was for the first two years in terms of interest rate. They would not, and now we are moving into the deed in lieu process. I’m sure ASC will end up loosing out in the end, but they just don’t seem to care, or don’t have the competence or internal structure to avoid it. Frustrating!!

Our loan was sold to ASC in 2003 and the problems began. Long story short, for 4 years they said our payments were late or missed. Fortunately, I had extensive documentation from our bank as well as THEIR OWN PRINTOUT of our account to prove that we were never late and never missed a payment. It took 2 years of phone calls, a huge letter writing campaign and the involvement of our state attorney general to FINALLY get our payment and balance corrected (they continued to try to charge us for 3 months payments). However, they were also directed to correct the reports they had erroneously made to the credit bureaus. We found out when we went to refinance last month that they had not, even though we have letters from them stating that it has been done. Here we go again. But I am NOT giving up or caving in to them - they are going to fix it or I will get every official I can imagine involved. Cannot WAIT to get away from them - worst company ever. Be careful, they can ruin your credit in a heartbeat. I would gladly engage in a class-action lawsuit.

They are very hard to work with at times. Feel they have advised us incorrectly at times and push foreclosure regardless of us asking for help. We keep in constant contact with them, keep them updated on our financial situation when ever there is a change or unforseen circumstance but they say its always up to the investors. I just cannot believe that the investors will sacrafice owners willing to make reasonable payments to stay in the home to foreclosure. I also find it bad that these mortgage companies or investors will negotiate a short sale that brings down the principal but not work with the current owners to bring down the principal to make the home more affordable and FMV. We have asked over and over for a Honest Home Value Loan Modification, but are getting no where and must jump thru lots of hoops that are not financially feasible for us. I do however, get someone each time I call, I am always able to contact them plus I have thier fax number so I also fax them which goes into the documentation. I also demand that each time we speak that the conversation is documented. I tell them I am documenting the conversation as well, take down the date, time, who I spoke to and what the conversation was about. But does this really work to my advantage?

ASC is merely an acronym for the MOB. How this group of crooks are able to purchase loans and administer them is unconsciable. They did not want to work with me at all.I became unemployed and shortly thereafter they almost doubled payment because of the arm we had. I tried to work out a short sale, a deed in lieu of. All to no avail. They had me sending hardship packges over and over to them. They finally said they wouldn't do anything. Make the payments or lose the house I'd been in for 18 years. They then sent me a letter stating that they were going to forclose on Dec. 2ND 2007. In Oct. 07 I sent them a letter stating that I was vacating the home but I had paid the property tax and insurance till the end of Dec 07. It's now May 08 and they still haven't forclosed. Now they just sent me a letter stating that they have put insurance on the house with a payment four times as high as I was paying and want me to pay it. These are total crooks. A from Annapolis, MD - Your comment does not make sense at all. If your loan is in forclosure, you have up until two weeks to make a deal on keeping your home. There is nothing that would keep them from making a deal with you. Trust me, we don't want your home.. If it is within two weeks from the sale date of your home, not even this company you hired can do anything about it. If you cannot commit to what arranements are available to you, that is not ASC's fault. In order to bring your loan out of forclosure, you have to qualify for a payment arrangment or pay the total amount due on your loan, AND all the attorneys fees. If you qualify for an arrangment, you must make a down payment that consists of ALL attorneys fees, and one months mortgage payment. We can't make deals on fees, they MUST be paid as the attorney WILL NOT suspend the forclosure until they've been paid. Same with modifications. Your loan will be suspended if it is in review. If they did not require an INITIAL down payment and the loan is still in active forclosure, or went to forclosure while under review, the forclosure WILL BE suspended if you are coming up on a sale date. I hate to say this as it may sound insensitive, but if you haven't paid your mortgage in 12 months, and cannot afford a down payment to suspend the forclosure, then you can't afford your home anyway and it is in your best interest to get rid of it. If you don't have a 2nd mortgage, you may qualify for a deed in lieu. Deed in lieu is where you give the property back to the bank and it relieves you of ALL financial responsibility, and is A LOT better on your credit report. Otherwise you may want to consider a short sale, where you sell your property for less than what is owed on your loan, and we will write off the rest. Also a lot better on your credit. As for losing payments, I have to say, in the four years I've worked for this company, we've very rarely ever lost someone's payment. If we lose the payments, we don't get the money, so you better believe we're extra careful not to. If you didn't put your acount number on your payment, well that's just not our fault. Make sure you put your loan number on all payments, and also make sure that if you're paying on more than one loan that you send the payments in two separate envolope's. Otherwise they may get posted to the same loan...

ASC put me on a forbearance program after my arm matured as I had fallen behind. Payments went from $2287 to $2840 during the 4 month forbearance program. After the forbearance program, they offered me a loan through GMAC at 9.55% and $3530 per month. Added an additional $16,000 to the end of the loan. Took my payment in January and put it towards escrow instead of applying it to the mortage, without telling me, causing my mortgage to fall further behind.

I feel that we are looking at options to keep ourselves from foreclosing but don't feel they are willing to help. We tried to do a loan modification and they denied us saying it wouldn't be in their best interest to do so. These are vicious animals; they foreclosed on me after I fell behind due to a tornado/flood. They lied and said I "broke the agreement" because I sent in the payment late which is a TOTAL LIE. I want to join a class action suit in New York NOW!!! Please advise how to do this.

I dont understand why my mortgage was sold to another company, I was doing fine with the company i was with,then of course like all the other complaints i have read asc is terrible mortgage company. my intrest rate was at 5.14% and over the last year and a half it has went up to 8.14% i know now that it was a mistake to get on a variable rate but i was coned into taking that risk. and now that the rates are at a all time low they have not contacted me to lower my rate and that should be against the law does any body know who i can contact to see if i have any legal action i can take against this company for not lowering my intrest if they can raise my payment almost 400.00 dollars more a month because they went up they should lower the payment since the rates went down i should be able to fight this i am in the process of losing my home and i have been hurt at work i have'nt work in almost a year because i was injured at work and know they want me to pay almost double my mortgage amount can any body write me and tell me if i have any legal action? thank you

I am also a customer (not a lawyer) of America's Servicing Center (aka ASC) and have been reading on numerous message boards about the same situations over and over with customers of ASC. Such as Incorrect information given, misplaced payments, false information, lies and downright fraud. Many other posters have mentioned an interest in a class action suit, so if you are a client of ASC and are having problems with them please email me (just once) about your situation and what ASC has done or failed to do. Please include the following information: First Initial and Last Name, City & State, When you got the loan with ASC or when they bought it, If you are behind in your payments how many months. And then your story. DO NOT SEND ME ANY PERSONAL INFORMATION such as account numbers or ss#!!! I figure if I can get enough people together I can then (hopefully) find a lawyer to help with a class action suit. I am not guaranteeing anything and I personally cannot provide any type of assistance. I am not a lawyer, I am just in the same situation as many other people. They do not help you at all - My husband lost his job in June 0f 06 and we fell behind - I own a daycare business and called them immediately and worked out a repayment plan - I was paying over a course of a year close to 2300 a month and was still being claimed late on credit reports - Then we went to a special forebearance agreement - which is suppose to suspend your payments or reduce them - However, we had to pay them in order to stay out of foreclosure at down pyt of 3440 and then 3 pyts of 2549/month and at at the end of the 3rd month they would negotiate and work out a loam modification - Well and behold we had paid them in three months over $11,000 doing without food, stress, etc. The loan modification - noone ever called to negotiate - nall they did was make our pyts the same we were paying $2579 with another downpyt of 2579 by May 2008 - Now we can't afford that - this is not helping keeeping our home - other mortgage companies would go down to 6.25% and fix their rate so that they do not lose and we don;t lose - BUT they have to no avail made it easier -the $11,000 we paid did not go to anything except they say court, lawyer fees - We have now been forced to do a short sale and it has broken up my marriage of 25 years in which he has left and I am living in this hell mess with 2 children and a new grandchild with absolutely no idea what we are going to do!!!! They suck and should at least make it feasible to help people for they would make out also in the long run - This has ruined my entire family and everyone is entirely sick now - If a civil action suit is brought against ASC /Wells Fargo please include me in my enail is sheila_terpening@yahoo.com 0 They ruined my family, my business my entire life. I am trying to get a modification since January 08, all I get is the run around, I had to put together a modification package and 300.00 to send and to this day nothing I have not received a phone call, so I call ASC again and they told me I will need to update my request because it been over 30 days. I will keep you posted if anything change and by the way I did update my modification package again as requested. I think this company is out to screw up people life. God will get them.

Our mortgage was financed with Equifirst who sold 80% share to ASC. Our payment's were $711.45 and we paid it with no problems for over a year. My husband had to immediate family deaths with in 2 weeks apart from each other which caused a financial loss for us due to travel expenses. We didn't want to get behind in our mortgage so other bills suffered while we struggled to get back on our feet. There were no available jobs in our area (small town) our homeowners insurance lapsed and our land tax were due, we were going to pay both those with our income tax return, but before we had the option ASC tacked on escrow and raised our payment's to $1051 we called everywhere to refinance and no one would really help us as my husband's credit had suffered due to us letting other bills go in a last ditch effort to save our home. The only company that was trying to help us charged us $450 for an appraisal and then suddenly the guy never called us back. The company says he is no longer employeed there. Yet now they won't return my calls nor send me a copy of appraisal. ASC also works for or is the same as Wells Fargo, the same people who repoed our car. They won't work with you, they won't take escrow off even if you obtain your own homeowner's or offer to repay for the land tax. They instead sent things to their attorney. Now we are told we have to pay entire amount due on loan or entire late balance which they claim is now more than $5000 plus lawyer fees and late charges etc. We feel we may lose our home and no one will help us.

ASC is by far the most frustrating company I have ever dealt with. ASC is currently charging me for insurance even though I already have insurance through HOA. I have sent three faxes to them already with proof of insurance, and NONE of them has been received! An ASC representative told me it takes at least a month to receive a fax, but after 6 months, they still have received nothing. I sincerely believe ASC has caused many people to go into foreclosure, even though they claim to be helping people OUT of foreclosure. ASC is wrong and immoral, they have caused pain to so many people. I sincerely hope this company is eventually sued and its corruption exposed.

I made a repayment plan with ASC in May 2007 and in Jan 2008 they started to decline my payments thru Western Union. Now they show me behind and are foreclosing on my property. ASC IS a a servicing company for Wells fargo. The fidelity company is actually a foreclosure trustee for them. I have been with ASC for 2 years unfortunately, I reported them to BBB in the beginning for not providing a cost free way to get my payment to them and they sort of complied. We are now in foreclosure with them and i get nothing but calls from payment collectors. no matter how many times I ask to have a loan rep call me I get nothing. Good luck one and all, my saga is not ending!

They never sent me anything except the usual mortgage statement. I never received a phone call or letter out of the ordinary and they mailed a foreclosure notice or put it on my tenants door on Friday in Florida. I have a second mortgage but it's for a small amount and was part of the financing with the first mortgage all tied into one.
