I have received a notice of default from Wachovia
We are in a notice of default at this point and we really need help on what we should do.My wife and I are the only two working at the moment and my parents receive social security income.

I need a Loan Modification but they have deinied me
Originally missed Nov and Dec 2007 payments, worked out a fee of $2975.00 to be paid in February, I made that payment. Thought mortgage company took loan modification app at that time over the phone but apparently that was not the case. Made March payment but mortgage co.

I don't want to go bankrupt and I can't afford the house
I can't explain in this forum how I got so far in debt, so I bring home $2600.00 a month and my bills to pay are $3400.00. I would like info on "Deed in Leu" I can not borrow any more money from my mom, however I can move in with her. My credit is now shot, 518 score in the past year.

I have never had a foreclosure or bankruptcy on my credit... I want it to stay that way
I have two mortgages with Emc which combined add up to 525. I am currently on a payment plan with the 1st one, The interest rate on the first one is 7plus and $420 and the second one $105 which is more than 12%.

Should I give my house back to them?
I lost my job 07/01/07 and have been applying but unable to find a new job. I have liquidated my savings and more to pay mortgage. Adjustable Rate goes up soon, and no jobs are in site for me. I just made the last payment I can, I have no more $. I also have a car lease and credit card bills.
