My 2nd says they are going to foreclose, what laws to they have to abide by?
My first mortgage isn't really the issue. It is my 2nd one that has made my credit a mess. Before this I had excellent credit. The house is up for sale but the 2nd mortgage company is threating foreclosure and auction.

I have been tying to deal with Countrywide on my own... got nowhere
I've been trying to deal with Countrywide on my own in hopes of having my loan re-modified. They don't seem to want to help. I can never get pass customer service in order to speak with some one in the U.S. My rate changed in May and since then I have struggled to keep up with the payments.

PHH will not accept the partial payments
I was making partial payments ($401 per week) and PHH was not applying the payments the hold them and send them back 5-6 weeks later.

We have 30 days, should we file for bankruptcy?
One of the first things we need to ascertain in this case is what will happen in 30 days. If there is a sale date within 30 days that is one thing, but if they're just starting the foreclosure process there is plenty of time.
