I need a Loan Modification
i have been in repayment plan now and I'm still behind. EMC is willing to do a loan modification on my loan. I haven't made my payment this month which will make me miss my plan. I'm scared they are going to start foreclosure proceedings.

I don't know where to turn for help with EMC
Back in Aug of last year is where we started having problems that was my last full payment to EMC. I called them in OCT to work with them and we set up a partial payment plan, which I have been on since. They have been automatically deducting from my account since then on the 16th of every month.

We can't refinance so I guess we will just lose the home
The present loan is an 8.8 arm that will mature in Aug. 2009. we have had a loss of income of about $800. per month as of Sept. of 2008 and have been struggling to make the payments. we have tried to refinance many times but have be turned down every time. up until Dec.

Is there anyhting we can do if EMC wants mroe on a payment plan than we can afford
we have tried to work with EMC and they have put us on payments in 6 month plans but the amount is way too high and they will not reduce or refinance.

Why does it take so long to get an answer from EMC
I contacted EMC Modification Department in January 2008 about ARM increase due to take effect in March 2008 and that there would be no way I could make the new payments.I was told by EMC Modification Agent Cory/Tamara that Modification paperwork would be sent to me in 2-3 business days.
is the 3rd time a charm for them to foreclose
3rd time to threating with foreclosure. We were not able to move into the house as per our contract and they have refused to fix the fire alarms. I had a heart attack in March and was in the hospital at the start of April.

Is there a better way with EMC
have been talking to the mortgage company and they still want us to pay $2273 a month which is way too high. We would like to get back into our house but are now sure how we can meet the mortgage company's demands of $1500 down and $2273 a month.

We need some hlep to avoid a foreclosure on our record
We made a re-payment arrangement. After making the first payment, I called and told them I would not be able to make these payments. I asked for a modification, and was denied. I made the second payment, but was late, and they returned it.

I did not receive the Loan Modification documents... EMC foreclosed on me
Back in October 2007 the first mortgage holder started the modification process. They said it would take up to 90 days. In December the second mortgage holder grew tired of waiting for us to hear from the first. They set a foreclosure sale date.

Ch 13 Bankruptcy did not stop the foreclosure
The past die amount was included in the arrearage in my Chapter 13 plan. I will explain my situation.
I filed Chapter 13 in July of 2005 because my husband lost his job and we fell 3 months behind on our mortgage.
