Wells Fargo has a prepayment penalty that is keeping us from getting out of the ARM
We had an interest only loan with Wells Fargo that was refinanced 12/2007 into our current 30 yr fixed FHA loan. We have a 2nd as well. Where it went bad for us is when I tried to refinance the interest only before the rate reset and was told of the prepayment penalty.

Do we need to look at selling
We have equity in our home due to paying much of the price in cash when we bought it. Due to a job change, medical bills and the increase in the cost of gasoline, our monthly expenses are just about what we take home in each month. We have been behind on all bills, mortgages included.

1st Mortgage-$363,000 2nd Mortgage- $89,500 SUMMARY • originally purchased as a primary residence in 2004. • refinanced in Aug. 2008 due to a pending personal lawsuit against me (took equity out). • moved to another part of town Oct. 2008.

My sale date is 2 days away
I have a sale date of march 27, 2008. I cannot get anyone of authority at Countrywide. I have been promised a repayment plan but no one returns my calls with authority. I have called 38 times. I have been told there have been several people assigned to my case.

In July of 2007, I paid my mortgage in advance for August and September. I had financial difficulties and was unable to make my October 2007 payment on time.

Do I have the right to demand a loan modification form Homecomings?
I have discussed this loan with homecomings financial for the past 6 months. They have not done anything to help us out. I have always been current with my payment and even with the increases of the ARM. Are payment has gone up to 1,000.00 more a month.

It is very rare we can get a hold of Suntrust to try and work something out
My husband had three surgeries last year and his company fired him. He then got another job and lost that one, also. During that time, we used all of our savings and cashed in all of our 401k's.

I can't comute from Minnesota to Arizona for a job, but I can't sell the house either
I own a home in MN and had to move to AZ last year for a new job. Tried keeping up with mtg by leasing and had bad luck with tenants. Currently being leased and payments have caught up to me. due to market analysis done last Nov. I don't believe I can sell to cover my mtg balances.

Left $200,000/mo job... was that smart
Left $200,000 per month job on May 1, 2007 for new company. More pay, better benefits. Payroll check bounced, many excuses, stayed with new company for several months. Owed $140,000 in back pay. New employer insolvent. Tried to start my own firm, but no cash resources by that time.
