Loan Modification with America's Servicing Company

February 04, 2011

No matter how much paperwork I have submitted I cannot seem to get to a loan modification with America's Servicing Company (this has been going on since early 2009). I have had to consider filing for bankruptcy to prevent the foreclosure sale and am at my wits end. I believe I could qualify for a HAMP Program's loan modification but my loan processor will not allow me to get into consideration the program. Please help

I have been going through the loan modification process for almost 2 years now with Americas Servicing Company. The routine is, I call them, they say fax in hardship letter, financial worksheet, tax returns, proof of employment, etc.., and they say they will be contacting me soon. Every time, I end up calling them and going through the same process over and over again and again... They tell me not to send in mortgage payments because it will screw up the modification process. I have received letters about foreclosure from their attorneys, which prompted me to call them. They would tell me to send in all the documents again and that the foreclosure would be stopped. Long story short, my house went in to foreclosure last April in 2010, about every 2 months I end up resending docs in to them and I was just told that my house went to the Sheriffs Sale. I faxed in a letter (another letter) to try and see what I can do to stay in my home, of course, no response! Is there anything I can do at this point to save my home?

I am going through the same thing. I have been trying for months to get a mod. I filed a complaint with the Better Business Bureau and within 24 hours a rep from Wells Fargo presidential office calle me. Naturally, I had to send in all my paperwork again. After a couple of weeks I was told, unsympathatically, that there were no options available to me. Nothing. I asked how much I owed them at this point and she says to me, "Let me check to see if you are in foreclosure yet because if you are, at this point you will have to go through our attorneys." She was ready and willing to hand me off to the wolves without blinking. Fortunately, I am not yet in foreclouse but fastly approaching. At this point, the only thing I can do is Bankruptcy. Not a problem, I've been unemployed since 2009 so it can't hurt my credit any more than it is already. AFC and Wells Fargo are awful.

im in the same boat im going to 26 mo.im gona file a federal law suit and a lis pendence on my home so they can't fouclose on me in till i find out the truth

I have been going through this for 12 months. I applied for it 3 months before my fiance past on march 16, 2010 & applied again soon after he past. I have spoken to over 50 people from all departments and still no help. I've filed for the modification 5 times and each time I applied they tell me they need something else and I’ve giving them everything they have asked for. They have incorrect information concerning my loan they still haven't fixed the situation. They bought the loan from mortgage lenders network back in 2005. We received paperwork in the mail in 2007 stating they had took over our loan. They had removed my fiancé’s name from the loan and they didn't have the correct address, etc. I've been trying to get this information fixed for over five years. In addition, when they purchased the loan from Mortgage Lenders Network we financed a 2001 Black Eclipse on the loan they claim they didn't see the information. Why I bring this up, its because when he passed his father stole the car & broke into my home and stole everything out of it. I've trying to go to court on it but the courts won't have my stuffed returned because I don't have the paperwork, which was stolen also. I requested the paperwork but haven’t received or gotten a call about it. They only call I received about was to use it for assets to help with the mortgage payments. I had already told them the car was stolen. I also contacted wells fargo and haven't gotten any assistance from them. I’ve been handed off the wolves already and they started sending my payments back to me. Why aren't they placing them on my loan payments????? Instead they are placing it in an account that says other. I also tried refinancing with other mortgage companies but they refuse to give them my information. I have contacted Newspapers, News Channels, BBB, etc.

I have been fighting with ASC for 3 years tried Naca, Hud and now I have a lawyer. The mediation Judge sent me to mediation we came to an agreement during the mediation and they sent a different pack to what was agreed. The Mediator didn't write down the terms of the mediation. So I have been fighting it with them in court. Today I had a hearing with the Judge mediator and the bank lawyer and my lawyer and the judge said he needs to think it over and will give me a reply by the end of the day God bless if he decides on my favor I will have won against the most difficult Bank.

Loan modification process can take up to 4 years sometimes. One of my relative has engaged his self in this process and he still is busy dealing with this.

I am in the exact same boat as all of you. I have been trying so hard for this modication for almost years. ASC told me they got all the documents they needed from me and I need to wait 45 days. I have been waiting patiently and anxiously over 45 days and today they called me and told me to resend all the documents. It makes no sense to me but I really don't have a chose but to do the same crap over and over and over for them. I was behind in my mortgage for a year but I am working now for about a year and making my payments for the last 3 months. They told me not to send payments but I don't trust them because that's a setup to have my debts increase and into foreclosure. I am really looking into sueing them too. This is ridiculous!

I have been fightingn with ASC for 3 years hud didnot help,i got a lawyer becouse i was behind 3 payments finally i got modification but they modified the payment that goes to principal before payment for principal was $450.00 now the new payment goes to principal is $150.00 dollars balance and interes the same did not changed.Iam very Upset with ASC.

well it looks like im not alone. I've been trying to do a loan modification with ASC for 3 years now. They always seem to need one more piece of documentation. Or one piece wasnt signed with a current date or some other such nonsense. I"ve been sending them my financials every month but mysteriously they say my paperwork expires every two months.I've had my paperwork at the underwriters a few times now. I was told that once it gets there I only have to wait 3 to 4 weeks for a reply. Months later with obviously no reply my paperwork gets kicked out of their system and I have to start the whole process from the beginning. I know theyre just waiting until I can't be placed in any of the Obama programs then they can kick me out of my home along with my two kids. What a piece of work this company is. But now I'm getting fed up and am making an appointment with my senators office to talk to him. Maybe Senator Reid can get this company to start doing their jobs.Or I'm going to short sale it just so they lose the $110,000 difference it is from my balance to what they can sell it for now. Serves them right.

I have requested a loan modification with ASC since 2009. Keep getting denied due to 2008 they changed my ARM to a fixed rate, but I still was responsible for paying insurance and property tax. Now, thru my hardship they have included the insurance and property tax in the monthly payment. Which now my monthly payments is more than what it was. Now, they keep telling me there was a one time loan modification for the life of the loan. I don't qualify for HAMP, nor the Obama plan. Not sure why they want lower my interest rate since the mortgages is at an all time low?

I have been going through the modification program with ASC for 3 years now, Each time they ask for a document, It is the same document that has been sent to them over and over again, or they say one paper was not signed or dated or the month was written but no day Each time i call over there to find out what the hold up is, i get different information and you never speak to the same person twice, or get to speak to a negotiator. I have gone thru a modication company and they quit on me after 7 months beacuse ASC fustrated them ASC kept asking them for the same documents that had already been faxed.I was on the Obama plan for a year and just last week when i called ASC, i was told the application expired since June and they needed a new application sent out, this is december and i have been faxing them bank statement, pay stubs every 30days and updating worksheet and hardship letter every 60 days and they only just discovered the application expired since June. This is so fustrating, i really want to keep my home. Does ASC really modify loans for anyone. ASC was not my original loan company, it was Freemont investment & loan with a 11.5% intrest rate and variable rate. Freemont sold it to ASC after the first year any my mortgage payment doubled. i did not know any better with the varible rate when i bought the home. This has been a nightmare with ASC. Is there any help out there from this company.

I wish ASC never existed. Their reps are some of the meanest insensitive people I've ever encountered. My mortgage was sold to ASC back in March 2009 from Mortgage Lenders Network as soon as I just got caught up with payments and was steady. Then with ASC my payments went up by$335 a month and I have a fixed rate! I was told because of taxes my rate went up, that's bull#$**. I have made so many attempts and faxes and speaking with evil reps of this company, I was told that "you should know someone who could give you the money to get caught up" or "there's no way your gonna get to keep your house". I wish to God there was someway to get this resolved for all the people who have been a victim with this company. My sheriff's sale is in two weeks and the only difference now is that ASC is too busy to handle things and have now turned accounts over to Wells Fargo. We'll see how this one goes. Three years in March and still nothing, you would think they would be so tired and ready to just fix things with their customers.

I am in the same situation with you guys. Each time I applied for remodification, three months afterwards the America Servicing company will turn me down. They will ask me to reapply again and ask me to send more document. I keep doing this for over two years now without success. At a point I was asked to put the house for "short sale: which I did, some offers sent to them were rejected for being "too low". Eventually the house was put back into foreclosure status. I called to find out why the house was put back into foreclosure status, but was told that the Agent who to sell the house did not comply with their request. Ironically, the company recommended the same Agent for me. I was then surprised to learn from them that the house will go on foreclosure again because of their Agent's non-compliance with their instructions. Presently, I understand my house is back on foreclosure status. But I have been asked to send some documents again, the same type of documents they request for each time. I am just wondering when they will answer my request and remodify the loan to save me from daily agony.

The best advice I have for anyone going through the pure hell and hardship with ASC is to file bankruptcy and a complaint with the Iowa better business bureau www.iowa.bbb.org Filing bankruptcy is one of the greatest solution to saving your home and recover from bad credit.The BBB for ASC is located in IOWA.... please file a complaint the bbb will contact you within 24hrs Dont be afraid to file the complaint or bankruptcy. Millionairs file bankruptcy all the time. I wish all thats going through this agony with ASC the best of luck. And its true ASC is full of crap.
