Deed in Lieu of Foreclosure or Foreclosure

January 11, 2011

I am behind on the payments and Bank of America is talking about foreclosing and I was wanting to know if I could have a deed in lieu of foreclosure done on the loan so it wouldn't be as bad as a foreclosure on my credit.

Dear Robert,
I am having problems with Bank Of America, because they don't want to refinance or any thing else, and have had major problems with Wilshire, We got behind the end of 2008 and we rented out our home at the beach to save it, and we paid them $16,000 and was sat up on a Forbearance agreement for $1.385 a month with a 10% interest rate. I paid 11 months and on the 12th. month my payment was refused. I had my attorney speak with them and they claimed I had not paid for 6 months and proved I did, and guess what?...My loan was sold to Bank Of America! No paperwork, except a bill saying that I owed over $2,000 each month. listen, and listen good!...No Bank can Foreclose on your home!!!!! know why..they sold it and it turned to (STOCK)! This has NO (promissory note)! The banks are selling our mortages and turning this into 5 times more than what we owe on it.

we used to be with countrywide and the next thing i knew we were with bank of america. our mortgagfe was 1044 and they modified it from 1044 to 1024. waht a laugh. my husband is 48 terminally ill and we have 3 small kids. wer have begged them for over 2 yrs to remodify and they say we have to make them 12 months of 1024 first. we have showed them proof of income and done everything. we had a forclosure sale date may24 2011 and now it is set for june 17 2011. my husband cannot handle this stress any longer but he cannot walk away from this home he built for our family. i have tried emailed callled and begged so many different people and places what can we do to save our home. NO ANSWERS. my husband is on oxygen 24/7 pratically home bound except for when i take him to the dr. there has got to be something out there for people like us. we even applied for extreme home edition, and actually gotten a call from them and they told us they are keeping our file and to send any changes in, but nothing yet. we are lost and fed up. this bank tells us over and over again we can appeal and within 2 weeks we are told they are not even goping to do any paper work on it. thanks for listening.

My home is upside down. I paid 85k for it in 2003 and now the fair market value is at 73K and I still owe 77k. The county never took the streets over from the builder who is now bankrupt, so the county wants each home owner to pay almost 8k to repair and take over maintenance on my subdivision's streets. That makes the value of my home 8k less. I tried selling it for a year with and without a short sale from my bank. No buyers so now do you think I should apply for a deed in lieu. I am only one month behind.

The county is saying that they will give us a deal, a no interest loan that will be paid from the equity of my home when I sell it. 8k is a lot to owe the county, especially if I have no equity on my home. A petition has been passed around for the homeowners to pay the 8k and partake in the repair of the streets but noone is voting on it. As the years go by, the streets are crumbling with us having to place sand bags at the end of our drive way so our cars are able to drive up the big gap dividing the drive way and the street. Homeowner are not paying HOA fees anymore. The HOA stated that there is no committee because no one in my subdivision is being proactive and so the HOA may cut us lose. When they cut us lose, they said there will be no one to pay the streets lights so they will be turned off. The HOA is lacking 40k in HOA fees. This situation I am in is a totally bad investments. Should I proceed in the DIL to get out of this mess?
