Trial Loan Modification didn't result in permanent Loan Modification

Per Bank of America, we are currently 5 months behind in our mortgage, however, we have been asking for a loan modification for a year and they lowered our monthly payments during their trial loan modification review. This is why we are so behind. We never once didn't pay, we always paid what they were asking for. The minute they denied us for a modification they informed us that we had to pay the back amount. I just received a letter that the next step to avoid foreclosure is a short sale or a deed in lieu of foreclosure. How can I get a loan modification with Bank of America?
