PHH's law firm started foreclosure

August 06, 2010

We have a letter from a Law Group stating that the lender has asked the law firm to accelerate the debt and to foreclose its deed of trust loan. We had paperwork to ask for a hardship consideration with PHH when my husband had a serious back injury. We have two payments in cash, and my husband will receive a lump sum retirement soon. I pray (literally) that there is help out there for me. I just need a loan modification with PHH.

I am speaking from experience. Document everything! Record calls, ask for names record how long you waited...Keep a calendar. Save all mail PHH sends you, and get a receipt for every piece of mail you send them. They took our home after agreeing to work with us, and I see my story in all of the others I am reading.
Phh does want to Foreclose! They do want your home! The evidence speaks for itself.
On our FC papers some place named Mortgage Electronic Registration Systems was listed as the one Foreclosing. Now PHH is trying to have the name altered. They are crooks! We had good credit before we got that horrible mortgage.
I have SO much on this company! I am willing to talk to the press or any attorney willing to sue. We have documents to back us up. Now that the dust has settled, I want to see justice served for all who have been hurt by this horrific, evil company.
PHH made a "mistake" at the beginning of our mortgage, that cost us 6k. They said we did not owe a payment for 3 mos, then they waited. After they received our 1st payment (as scheduled), they threatened to FC if we didn't come up with 6k (3 payments). We had to borrow against our 401k to do that. We were then scammed by a place that said they would modify our mortgage. Then 1/2 of our home flooded. We had to borrow another 10k to fix it. We had NO resources left by the time we were scammed. This place that claimed to be working on behalf of the government to modify loans. I can prove all of it. PHH acted like they would help us until the Sheriff delivered the sale notice. They will likely do it to you too. Pray. Pray for God to intervene. We did. He has taken care of us through the whole FC process. He will take care of you and give you wisdom if you ask. What PHH is doing is unspeakable. I believe God will serve justice to PHH. Nothing is more powerful than God answering our prayers!

Here is another angle...Chances are, it is MERS that is suing for FC. It is debatable that they even have legal rights to your home since they are nothing but a servicing company. Have your closing papers looked at by Real Estate attorney. They can find you a "Wrongful Foreclosure" loop hole if there is one. Explore all avenues! Find out your rights in the state you live in.

I am speaking from experience, and from the investigating that I have done on PHH. They have NO intention of modifying your loan! They will string you along, like a lamb to the slaughter, and then they will take your home! PLEASE listen...If you want to keep your home, then you need to fight them. Get a Lawyer that is willing to fight! Legal Aid is another avenue. PHH pretended that they would modify our loan so that we would not fight the FC. They wanted to wait until the last minute (30 days to be exact) and then move in for the kill when I had no time or energy left to fight. They will sucker punch you, and leave you parolized. Be smarter than we were.
I recently found out that my loan was illegal, and I could have kept my home. It is much harder to fight the FC after you have moved out. You have rights! Excersize them! Keep praying! I hope this helps. I just want to see people like us keep their homes. God bless....

We have been working with PHH since August of 2009. We hired a law group that had helped two people at my job Franklin Financial Group. We paid them $2600 (higher because we had a second mortgage). The lawyers told us to stop paying our mortgage because the banks won't help if you are current. By October all of the numbers I had for the attorny did not work. There was one contact that i had who was helping me, Lisette Reyes. By December 24th we received forclosure papers that horrified us because we were going through this process with the bank. Now with no lawyer we have been calling PHH and they always say that they have everything and that we should just wait. Needless to say then we get a letter from them saying that we are missing information.The same informations that we already sent. The last straw was getting a letter saying we were denied because of lack of information. After callling the company and being on hold for 45min we were told that they have the information and don't know why were were sent that letter. This is so frustrating I dont' know what else to do. We did not choose PHH we applied for our loan with USAA and I guess they sold it to PHH. I don't want to lose my house.

You are not alone. We were scammed by a similar company that promised modification, and delivered us into foreclosure. This company mayor may not be the same scam artists. They were going by the name National Home Loan Assistance program when they scammed us, and several others. They were the "scam artists". The name Reyes was involved as well. Make sure you file a report with the Attorney General, and smear their names on the Rip Off Report web site. They will go to jail eventually.
As far as PHH goes, document EVERYTHING!!! ANything they tell you on the phone means SQUAT! Make them put it in writing! It sucks, but that is all that will help you. File a complaint with the BBB for their poor business practices. PHH will eventually be paying on a class action suit, but honestly they will probably Foreclose unless you can legally stop them. I am looking into suing them, and I have a really good attorney. I am hoping he will do a class action suit. Even though a class action suit is a longer process with less individual pay out, it would bring more justice to those greedy pricks. In the mean time pray! I truly hope you can keep your home. i am a young homeowner and by reading the comments above, its like exactly what is happening to me. i do not understand some of the terminology, etc....can anyone PLEASE explain to me, i am single and my home is all i have. what was the wonderful opinion? just on their lack of ethics??? or is it something, some action i need to take. how do you get to this blog? and what is their ROI dept...i got transferred to them, it rang twice and then a voice came on and said "good bye". i would appreciate anything. thank you

Unfortunately, they do all they can not to help, proceed with the foreclosure and the paperwork is only to buy them time to do this, it seems like. The same is happening right now with us.

You must realize that PHH is a mortgage servicing company and not your lender. It can only forward documents to your investor and hope they will modify your loan just like you. If you cannot afford a home you gotta short sell it and rent a house! And watch what you spend! It is easy to crib and tough to get work done.

Really? You have nothing better to do than to prey on people who are losing (or have lost) their homes? Your lack of information is only matched by your lack of human compassion. Remember what omes before a fall "Well Wisher."
To all the other victims of PHH: Keep on fighting for your homes! The mortgage indusrty as a whole has screwed up on just about everything. Find out how they screwed yours up, and look for a lawyer to help you. Keep praying for justice. PHH will get what they deserve.
PHH recently foreclosed on a couple in Ar who was current on all of their payments! They DO lie, and treat their customers badly. If they are not a "Mortgage ompany" then they have truly misrepresented themselves.

PHH Mortgage took over the bank's mortgage dept that carried our mortgage in 2005. Although we filed bankruptcy - that same year, we affirmed our home and continued making payments. They have falsified all credit records stating on the reports - that our home is in bankruptcy with a 0 balance. If this is the case - where is all the monies going that we continue paying? I don't think they even own a clear title, which may be why they are foreclosing on so many rather than modifying. They lost a case similar due to not having a clear title. We are getting ready to send info to the NJ district attorney - since that is their home headquarters. If enough of us complain to that office perhaps a file will be brought out into the open. PHH doesn't care about their mortgages at all.

Its a funny thing - i am sitting here reading about you all complaining about PHH and how wrong they are, etc. There is an easy solution - if you make your payments, you don't have to worry about any lender foreclosing. i am so tired of hearing people blaming lenders instead of taking personal responsibility. you get yourself in a mess and feel that is a bank's responsibility to get you out of it or help. They have no obligation to do so. Next time - don't use a bank if they are so abusive. Why should any business care about you? It doesn't sound like any of you are prize customers and worth retaining. you have options - dont use the big bad banks and if you do, meet your obligation and pay your bills ... or keep complaining ... because that is doing SO much for you ...
