short sale or deed in lieu of foreclsoure with bank of america

My wife and I need to get out of this home, primarily because we can no longer keep spending thousands of $$ in waste. The day we moved in we had problems financially. Not much, but some. We have done everything we know in terms of correction, and we simply need out, especially since my wife is not working full time anymore, since we have a 9 month old son. If we can do a short sale or the Deed in Lieu of foreclosure with Bank of America, that would be great. Our credit is totally solid, and I don't want to have to walk from the property without trying this first. Thank you.

I am currently living in a 1000 sq ft home with my husband and 4 kids. I was paying over $1000/month with an interest rate of 9.4%. I tried to refinance my home in may and it apprasied at 62,000 when 4 years it appraised at 110,000. I have my mortgage with Bank Of America and I put my house up for sale over 30 days with no luck I don't want to have a foreclosure on my credit is a Deed in Lieu realistically any different from a foreclosure? I am currently 30 days behind because Bank of America would not even consider allowing me to do a short sale without being behind in my payments I am at a lose and need some solid advice on what to do I live in Tennessee and I am not sure what the law is in my state.
My house is in forclosure with Bank of America & they keep tell me I need to come up with Homeowner Insurance & Im getting fines for needed to Mow the grass. I need help to get them to finish the forclosure so that I can be out from under this house. I have put the house in bankruptcy & it has dicharged 11/15/2010
