Need help with Wachovia
May 03, 2010
Mortgage is currently $13k in arrears due to advise from Wachovia. Attempted Loan Modification nine times and something ALWAYS prevented the process from continuing. Last process was two weeks ago. Now Wachovia is starting foreclosure process. Would like to roll balance into loan, move to a fixed 30 year and lower APR. Can you help with Wachovia?

Believe it or not we have been battling Wachovia for over a year and probably actually closer to 2 years trying to get them to assist us and you are right when you say something always prevents the process from continuing. I wrote my congressman and he went to the administration that oversees banks and how they do banking business and it took a while and then when i got the answer that Wachovia gave them,, it was all a lie! They filed for a foreclosure as my second mortgage lienholder not my first which i was on a trial loan modification with at the time and forced us into bankruptcy. Now in bankruptcy they are requesting the whole loan due and payable immediately and even the judge said they cannot do that and has my lawyer filing something against them and they have to answer to. They are impossible to work with but i would go ahead and write your congressman (you can do this by email because i did)and tell him to notify the comptroller of currency so the more of these that are on record will red flag this bank!
I provided updated mod packages 5 times, one a month for 6 months. They requested bank statments from me on April 6 and I faxed them in and they were received on Ampril 8, 2010. I came home on May 5th to find out they had forclosed on my home the day before. No notice, no loan denial. So I called and they told me it was because they didnt get bank statments in a timely manner, I called the trustee and they told me that the sell was requested on April 5, 2010, so it clearly was not because of the bank statments. I have been in my home for 18 years, I wasnt even behind when I started this whole modification ordeal and now they took my home and Im at a loss as to what I should do.. I have two renters and what about them and do I have to pay back their deposit?? I am in complete shock.
