I need loan modification with First Horizon

April 27, 2010

I entered into a trial loan modification last year and fulfilled all the required payments and provided all necessary financials. I was given a 2nd trial loan modification payment period and fulfilled that one as well, along with updated financials. I was told the second financials were sent out to another company in error and that my case had not been assigned a reviewer in First Horizon's office. I received a certified letter telling me i had a foreclosure sale date next month! I have had a stable job for the past year and a half. I can afford to make the adjusted payments. I want to keep my home and have done everything asked! I have an interest rate of 7.25%. All I wanted was a fixed loan at a lower interest rate. PLEASE HELP MY FAMILY.

I have been with First Horizon for years, been in my house for 11 yrs without one late payment ever. I am divorced and I am the sole income in the house.

In August 2009, I was proactive in contacting First Horizon for help with a loan mod as the small company I was working for was going under. All but 5 employees were laid off, and those of us left had to take huge pay cuts. I could no longer afford my payment. I jumped ship to another employer (I felt extremely lucky to even have the luxury) but my salary is now half what I used to make! At least I still have a job, right? I told them I would only be able to make another payment or two at the current amount and would need help asap. I filled out all the paperwork, meticulously sent every single piece of paperwork they required and sent it back in immediately. Nothing! Called back numerous times... Nothing! I made a partial payment and THEN I heard from them, basically telling me they do not accept partial payments and not to send any further partial payments!

In October 2009, I was finally able to get someone to answer the phone only to be told the file hadn't been looked at yet, to call back in two weeks.

In November 2009, I finally got someone again who told me the file had been transferred to First American, a third party company taking over the loan modifications and I would need to resubmit my entire package again. I filled everything out and sent everything again! After a several days, I called First American and was told the file had not been looked at yet, to call back in a couple weeks.

In December 2009, I called First American again to see what in the world was going on (in the meantime my perfect 850 credit score was going down the drain a little more each month with each reported late payment, thanks First Horizon!) and was told that they had tried numerous times to get a hold of me and, get this... read back a phone number I'd had 10 years ago!! Are you kidding me? How it is possible that with the paperwork I filled out and all my calls to them (and each time they ask for your name, address, phone number, etc) all they had on record was a 10-yr old phone number?? I asked how they can have my phone numbers on the first page of the file, did they even open up the file? and all they can do is call some old number in the dusty archives?? I bet they had to look pretty hard to dig that number up! Anyhow, even IF they couldn't call me, where was an email, or a notice in the mail, anything? They had no answer, and that was beside the point, because they couldn't get a hold of me, they closed my file and gave it back to First Horizon! I was in absolute tears out of sheer frustration!

I called First Horizon immediately and they told me the file had not been closed, had not been transferred back and they could not help me, so I would need to call First American back. So, I called First American again, and was again told there was nothing more they could do, First Horizon now had the file. I escalated to a First American supervisor who finally told me they actually still did have the file, but I was missing a pay stub (which had been sent) so the file was closed. I called back the next day and spoke to a different supervisor to ask which document was missing, they said they were only missing a W2 (which had been sent). I called back a third time to ask which document was missing, and I was then told they were missing a tax return (which had been sent)!! Can anyone say LIARS? Regardless, because they were missing a document somewhere of some kind, the file had been closed and I would have to work with First Horizon again. WHAT A JOKE!

On December 23, 2009, two days before Christmas, I was sent a certified letter that the Notice of Default had been filed... how very nice of them!

In January 2010, I escalated to a First Horizon manager who told me that First American "didn't know what they were doing" and they "were having all kinds of problems with them." She was looking at my file and it was totally complete, there never had been anything missing but unfortunately due to their error, the file had been closed and there was nothing they could do about it. I would need to fill everything out and start all over. In tears once again!

I gave up...

I put my beloved house on the market as a short sale in early February 2010 and received 8 offers within the first week, two all cash! I thought surely an all cash offer would grab someone's attention at First Horizon and perhaps light a fire to finally end my nightmare... Nothing!

The all cash offer walked away a couple months later, tired of waiting for any signs of life. My back up offer walked away. On my third backup, now into May... Absolutely nothing!

What do these people do all day long beside think of lies to tell callers? Anything? My credit is totally and completely ruined, and I sit here every day just wondering when someone, anyone, will actually touch my file. First Horizon does not care about anyone, they do not care about helping, they do not care about getting $250k cash, or even the offer that was $10k above the current market rate, they want my house for themselves apparently.... More power to 'em!

FIRST HORIZON SHOULD BE ASHAMED OF THEMSELVES!

Wow. This is really scary to read. I have been waiting since 10/09 for FHHLC to do my modification. I have provided everything as required as well.

Yesterday my atty called to tell me that my modification was denied. When I called FHHLC, they said I had to reapply because they terminated their contract w/ the servicer (1st american).

I'm not sure what is going on but I am not going to do a quick sale or anything else. I want to keep my house and I will fight them tooth and nail to do so!!

Let's all get together and sue FHHLC!! They are uncaring unprofessional swindlers. I have had enough! The American consumer should not be at the mercy of these theifs. What happened to the governments promise to help us??

Greg - that may be what it is going to take! Maybe even a Facebook page to start which would reach millions of others.

I am now "waiting" going on 2 months for the infamous "modification" package they keep saying they (FHHLC) and Metlife are sending me. Instead, I get a loss mitigation letter.

I just wanted to let all you know that you are better off moving out of the property and letting it get foreclosed. I work in the First Horizon Loss Mitigation department and I will tell you that maybe 5% of the people that apply get there loan modified. Also dont bother trying to speak with a supervisor when you call in. Trust me they dont want to speak with you, they have better things to do and could care less if you lose your house. If you ask for a supervisor we will let you know that we will have one give you a call back, which they never do. Also if you try to fax in more than 30 pages we will throw your work out package away. Hope this helps...next time maybe you will purchase a home that you can afford.

Well gee Tiffany, what about those of us that COULD afford our homes when we bought them? Oh yeah, it is our fault the economy tanked, jobs were lost, our savings and retirements were lost or used to make mortgage payments.

This should help with the class action suit. Maybe you can even testify to the fact that FHHLC threw documents in the trash.

Just to let people know...First Horizon's Home Modification Program is a SHAM
Our problems first began in May of 2009.We fell behind 2 payments then on the third month my wife and I sent in 1 payment plus the late charges.Instead of accepting it First Horizon sent the payment back and with it a letter stating they wanted the whole 3 months worth plus late charges.
My wife contacted First Horizon and unknown to us they were in the process of being aqquired by a Tennessee Lender known as MetLife.During this time we applied for the Home Modification Program even asked if we could apply for the "Repayment Program" but we were denied.
While this was all going on First Horizon A.K.A First Tennessee A.K.A MetLife.sold our loan to yet another Mortage Broker.
What the kicker was a First Horizon representative by the name of " Ann" did not disclose any of the loan especially the Private Mortage Insurance which shot our payment to almost 1,000.00 a month instead of 31% of income.
Now according to the New Lenders records and note First Horizon never botherd to work with us as per Federal Law.But here's the real kicker because of First Horizon did too us.We have to come up with 25% of the back owed with NO GAruntee no garuntee that we will get to keep our house.Plus the problem is we don't have the collatteral to back the loan.Our house is no longer worth what it was 2 years ago due to the drop in the job market plus the other foreclosure's in our area.
Bottom line is this....Beware of First Horizon Aka First Tennessee Aka Metlife.Instead of workin with the clientale they will sale your loan and put you off stating" We are in the Process of reveiwing your loan and attempting to find a program that is best suited for you".Then in the meantime your payments compound and add up to where you might lose your home.
Thanks First Horizon aka First Tennessee aka MetLife....We hope you're sleeping well at night and eating well!!.

For everyone in a loan modification instance, don't worry. First Horizon / Met Life sold these things off regardless of your conditions. I.E. we purchased in April 2006, never missed ONE payment, always paid on time. PERFECT credit risk. We got sold off in the large sale transaction, and off we went with everyone. In modification, never in modification, no matter - Met Life dumped us.

So I had to send in a crapload of paperork for IBM LBPS like I was refinancin. What a pain in the @ss. Even if you've been a perfect payor (granted my circumstances have been more fortuitious than some of yours, and I wish you well and luck in keeping your hourses) this kind of garbage still happens.

What lender can you actually TRUST anymore?
