Misunderstanding with America's Servicing Company (ASC)

April 19, 2010

We were put on a loan modification plan, and American Servicing Company and I had a misunderstanding in December and I had asked that they postpone a payment, they neglected to do so and taken the funds and it made my account in the negative 2 months in a row. I have sent in a payment as the loan modification officer told me to do. Then i have a written notice that they will have started foreclosure proceedings. I need help!!!!

I have been dealing with ASC since July,2009 and I am still fighting with them. I applied for the HAMP program due to a major paycut, then was out of work on disability for 3 months. My payment was 834.00, but I paid my taxes and insurance separate. I paid my school taxes in Decemeber,2008 but not my city/county taxes due to the pay cut, so I was waiting for income tax refund. In Feb.,2009 is when I went on short term disability. That is when a got a letter from ASC saying my house note had gone up to over 1500.00 a month due to delinquent taxes. Number one I had until June to pay, instead I had to send ASC almost 4000.00 to get my note down to almost 1100.00. The kicker is they did not pay the tax until June. When the modification plan came out, I applied as soon as I could. I was put on a trial period for 3 months at 850.95. After the 3 month period ran out, I called and was told I was still being reviewed and to continue making the same payment. I called every month,and was told the same. March 2010----- I got a letter, certified no less saying it was an acceleration on my loan. I called immediately and ASC told me to trash it. I asked them when was
the decision going to be made, I was then informed that I did not qualify for HAMP, but they were looking at in house modifications. I got another acceleration letter the first of April, this time when I called, I spoke to Angela Lovejoy. She said she was a processor and would help me. She also told me that my payments were over 1200.00 a month. I freaked, the reason being was they paid my homeowners insurance at the end of March, but no one told me, and I had been paying it. She went over the financial worksheet again and we agreed to a payment, not what I wanted, but I wanted this to be over, so I agreed to 1043.00. She said that the delinquet payments would be at the end of the loan and extended the loan for 10 years at 5% interest. I verified again that this was not another trial, she said no, this was the actual final mortgage agreement. On Apri 15th I got another letter, this one was a special forebearance agreement, that stated for 4 months I agreed to pay 1046.65 and that ampount would be put toward my delinquent amount. That is not what I was told and I have talked to over fifteen people since then and of course, I can not be connected to Angela Lovejoy. So at this point, I don't have a clue where I stand.

To make a long story short, after modification, payment only went down $62.00 when I was told payment would be $550.00 at 5%. I owed $78,000.00 and was told no money would be added to arrears ($78,000.00 owed on home) When payment was due, I was told I owed $94,000.00 and payment was $770.00 a month. I have contacted them about my loan mod papers that I signed for $78,000.00 that I never received in mail. I also paid my homeowners payment in full for the year out of my own pocket and they can't seem to see this on their computer. Got different stories about loan amount from different people. Something seems fishy, like they know they screwed up and probably committed fraud and nobody will talk to me about this problem. How and why can a company get away with treating people this way when they need help the most. Something needs to be done. I had to leave my home after 38 years. Do they care? No. Does the president care? No. If he did, he would read some of these emails and maybe help the "AMERICAN" people. I wanted people to know this ongoing problem with ASC.

This is the wrost mortgage company. All they do is toss you around. They have cause my checking account to be in the negative a few times. I had to close my entire account out. I been in the HAMP program for over a year now, and they still have no answer.
