I am in foreclosure with BAC
My mortgage is in my name only. However, my husband is the one who works. He has been laid off for 6 mths. (My husband has filed for unemployment years ago, before we were married. I have tried to stay in close contact with BAC, I always asked if I was in danger of foreclosure and was told at one time I was in pre-foreclosure, but it had been stopped. I was told to continue paying what I could and keep in contact; that I'd be fine. I was surprised when a partial payment was sent back to me. When I called to find out why, I found out I was in foreclosure. I have no idea what to do.

Assuming that in the declining market you home may not be worth what you currently owe, if you list your home and your realtor is communicating with your lender that they are working through a short sale, then it is possible to delay the foreclosure process.
Most lenders will forestall foreclosure in favor of negotiating a short sale.
