Can I get a repayment plan?

August 13, 2009

We would like to stay in our home and try to get current on what we owe to America's Servicing Company. Can I get a repayment plan or forbearance?

I am currently in the same situation. This is going to be a long and aggravating process but its your only hope. You first need to apply for a loan modification. They will request that you fax in a hardship letter, proof of income, and a financial statement listing all your bills. If they will do it over the phone I reccomend that. I will be so much quicker. They tend to loose faxes or claim they never recieve them. So if you have to fax, make sure you follow up to make sure they recieved it. At this point they will put you into a forbearance agreement. Which is where they will request that you make an initial down payment, and then 3 increased payments to follow. It is very important that you make sure you can afford what they are offering before you agree to it or even get off the phone w/them. Once it is in their system they CANNOT change it, you will have to wait for the agreement to break. Once you have completed the agreement and made all pmts and made them ontime. THEY DO NOT ALLOW ANY LATE PMTS!!! You will then have to reaplly for the loan modification. This takes 2 wks for them to assign your file to a negotiator and then another 60 to 90 days for the negotiator to reach a decision. If you are not already in forclosure continue to make your pmts because this process does not put the forclosure on hold. Just an FYI the negotiators are investors that have nothing to do with ASC, ASC does not actually make these decisions it is their investors. This is the 2nd time I have applied for a loan mod, I am currently entering my 2nd round of forbearance agreements. So good luck to you, hope all works out!!
