I thought the Loan Modification was supposed to help our situation... it didn't

March 02, 2009

We were in a Chapter 13 and converted it into a Chapter 7. We have been trying to work on a loan modification with our mortgage company but the modification is too high and the interest rate is high. I thought the modifications were supposed to lower the interest rate and payment so you would be able to avoid foreclosure and keep your home but instead our mortgage company is the exact opposite. The new mortgage payment that they want is 1058.00 at 11.75 fixed plus they want a down payment of 1277.06 by March 15th. I don't understand how this is supposed to help save our home when the payments have almost tippled.

hello,
we are now 6 months behind on our mortgage payment. I have been negotiating with my bank since october of last year to see whether we could get any type of modification from them. I received a letter from my bank saying that we do not qalify due to our monthly expense is more than net income. We would like to keep our home. We feel that chapter 7 is our last resort. But my concern is: our mortgage loan is fixed for 5 years and that will become variable on 2011. If we decide to file chapter 7 now, what happens when we need to refinance our home two years from now, how are we going to qualify for a new loan with a bankruptcy history on our record? Please advise....

Hi, we are going through a similar situation as yours, we are 7 months behind on mortgage pymt. we've been negotiationg for a load mod since December but they denied stating monthly expense is more than income. We are also thinking of filing for chapter 7, and we are due to refinance in October this year. They are suggesting we do a short sale, but we did so much improvements in the house that it's very hard to let go. please let me know if you get an advice. Thanks.

We were two month behind on our adjustable rate payment when I tried to get them to modify our loan and all they did was give me the run-around! I couldn’t believe it when the guy on the phone actually said that my family shouldn’t eat so much because then we would spend less on groceries and would have more money to make our mortgage payment! What a jerk! He also said we should get a cheaper car and a bunch of other stuff that was really rude. Come to find out the loan modification they were going to give us was a just Forbearance Agreement and all it was going to do was add the payments we were behind on to the back of my loan. Since our interest rate was going to stay the same, this would actually make my payment go up! THAT’S what got me into this mess in the first place! My payments are too high! This whole thing was keeping me up at night worrying about what was going to happen to us. I told my friend at work about this and she said I should call the loan modification company that got her loan modified down to 3.75% fixed interest rate! I decided to call them, and in about 45 days they got my interest rate down to 4.35% and it’s a fixed rate too! have been trying to get a modification loan with ocwen our mortgage co. We live on s.s. very limited budget. This co. keeps giving me the run around. Can anyone out there help us ? I'm at my wits end. I love my home, it took me so long to get it!!! Please, Please help!! sick at heart!

Perdi mi empleo en Marzo de 2008, como la cia dio un aviso contacte con Ocwen y les hice saber la situacion ya que prometieron ayuda bueno el caso es que me pedia prueba de empleo, .. si estoy pidiendo ayuda porque me quede sin empleo en primer lugar , yo rente dos habitaciones en mi casa para cubrir property tax y un mortage reducido si es que ellos hacian algo pero no fue asi, pague a un grupo que promete intervenir a tu favor y la respuesta de ocwen fue que no trabajaban con terceras personas solo con el cliente y se negaron a dar informacion
bueno entonces llego el plan de Obama y me enviaron el paquete por email, no correo regular, a veces no abri mi correos por semanas suerte que esperaba noticias de mi hija y lo revisaba mas seguido, me pregunto si no estan supuesto a enviar esa informacion por air mail?? para no hacer el cuento largo, ya gaste todos mi ahorros, tengo un empleo pero no tan bien renumerado como el anterior , asi que sigo necesitando la modificacion, pero ocwen ahora me dice que faltan documentos pero no me dicen cual falta, una grabacion me dice que han intentado comunicarse comnigo pero si pudieron enviar el paquete por eamil, porque no envian tambien esa informacion, el caso es que por ningun medio he obtenido esa informacion, el representante que logre atrapar , no sabe de que se trata, me pasaron a otra que sabia menos y despues me dieron un numero de telefono donde sale una grabacion en un ingles imposible, , yo no lo escribo bien pero si lo entiendo , leo y me hago entender
final de la noticia , no se que hacer y nadie sabe nada, he decidido pagar un abogado aunque tenga que vender los muebles mejor casa vacia que en la calle, para algunos bancos la modificacion es una mentira, solo una forma de darte esperanzas para sacarte todo el dinero posible y cuando ya no puedan exprimirte mas, quedarte con tu propiedad , es una verguenza, me pregunto que hacen con el dinero que le han dado para ayudarnos?? tambien se pagaran bonos gigantescos??

We are having the same problem as most people. EMC/Cahse will not work with us. Obama's plan seems good but some mortgage companies do not care. Need help,if anyone knows of someone who can help please post a comment.
