I don't know where to turn for help with EMC

March 12, 2009

Back in Aug of last year is where we started having problems that was my last full payment to EMC. I called them in OCT to work with them and we set up a partial payment plan, which I have been on since. They have been automatically deducting from my account since then on the 16th of every month. In Jan the deducted on the 23rd and then in Feb they didn't take it out. I called them on the 23rd and was on hold for over 1/2 hour then my cell phone went dead. I called the next day and was on hold for a hour. I called the next day and the same thing. I called the following week and could not speak to anyone. I finally got in touch with someone on March 9th only to be told that my house went into foreclosure on March 2nd. I am devastated by this since I have been working with them continually. My husband researched them last night only to find out that the story and what I was going through was exactly the same as others have gone through with them and they are doing things illegally. I need to speak with someone. My husband is contacting lawyers today and I am reaching out to you guys. We need to find out as much as we can and what to do.

This doesn't make any sense. They can't just foreclose on you while you're on a repayment agreement plan. Granted, you're still technically delinquent on your loan during the repayment plan, but they can't just up and foreclose on you. Are you sure that your payment plan didn't end in Jan and you "thought" it carried over into Feb? Because if so then they would have been expecting your full regular mortgage payment on Feb 1 along with any $ you owed them; that $ being the difference between your full mortgage payment and the amount of whatever payment plan amount you agreed on (i.e., $2,000 regular mortgage minus $1,500 payment plan amount = $500 / month x however months you were on the plan).

Made payments on my loan as stated in Bankruptcy but as of the last statement from EMC they have not given me credit for payments made!

I am a victim of predatory lending, requested loan motification for 1 1/2 year-mishandled and tried to refinancing, Recommend a "Mortgage Company" I am through EMC/Chase and they suck!!! No help...What programs are available for consumers employed, excellent credit and trying to secure a Fixed Rate?
