We got served with Foreclosure papers, Bankruptcy did not help

We just got served today by a server. My bankruptcy attorney in Madison said it is discharged in Ch 7 after I left the ch 13 relief of stay and never reaffirmed the debt. How long can we stay? I'd like to keep the house if I could get a fresh start with affordable payment.

do to my husband lossing his second job and trying to help my daugther in college i fell behind in my mortage i called everhomes to see if they can help me. they send me a home modification letter i filled out still i dident get any help. i turn to someone who garenteed me that i would not lose my home. then told me i would have to file for chapter 13 when i filed chapter 13 my new payment went to 3000.00 doller there is now way that i can afford that payment. if i could of made such payment i would of never had to fall behind to begin with. please help me save my home i have written searl o f letters and no help my lawyer just discharge my bankuptcy so now i am waiting for everhomes to help. or for them to tell me when i have to move.
This letter concerns Ever home Mortgage. My loan was transferred to Ever home mortgage about three years ago and everything was good. I was paying my mortgage on time and someone that was living with me paid the taxes. The person that was living with me left and I was unable to pay the taxes without help. I faxed Ever home Mortgage and asked for help with the taxes which they complied. Now here is the problem:
Ever home Mortgage put $20,000 in an escrow account to pay the taxes and insurance, by the way I never asked for the insurance to be in escrow. When I received my new payment from Ever home Mortgage the payment went for $1460.04 to $3906.38 per month. They added an extra $2446.34 per month to cover the escrow, which made my mortgage payment unaffordable. I contacted Ever home Mortgage and asked about the making home affordable program. I stated that I needed to be put in the modification program or to add the $20,000 to the end of my mortgage and let me pay the principle, interest and taxes which would have been about $2500 per month which I can afford. They asked me to fill out a financial statement which I did. They put me on three month forbearance until they complete my application for the modification. I paid $2312.60 per month for the three months ending in April 2010. I have not heard from them as to whether or not I have been accepted into the program. My loan is Fannie Mae. I recently received three phone calls stating I was going into foreclosure due to the lack of payments. I asked what about the modification and was told that they are still working on the file, but in the meantime I was about to be foreclosed on in June 2010. I contacted HUD and they tried to speak with the customer service department to find out what is happening with my modification and was told the same story, that they are working on my file and that my trial period ended and I have to pay the full mortgage or face foreclosure.
I have complied with what they are asking me to do and I can afford the mortgage just not the extra $2446. 34 that was to cover the escrow.
I am beginning to think that they are in the business to take homes or I am being discriminated against because I am a single black female.
If you have any suggestions as to how to get this company to help me, please let me know. I have custody of my two grandchildren and need my home. I have a good job and make decent salary.

OMG, my situation is almost identical. Please email me at your convenience. I am currently waiting for them to see what if anything can be done and have a foreclosure date set for next Friday!!! I too was on a 6 month forbearance agreement and it ended in March, I was told in April that I had to pay ALL of the money or it would go into foreclosure, I was told NOT to send any payments b/c it would be returned they need ALL or nothing, received ltr of foreclosure in May...this is crazy!
I am at the end now. They have given me a 6 month period where the work out passed and they never modified. The forbearance was paid on time. Nothing got worked out! My auction date has passed and been extended by their attourney to cover their actions before they proceed with sale. It is all fraud, all lies and I am in the same boat. Mine has sunk my HUD counselor could do nothing. I am in your boat!
