I thought the bankruptcy was going to help me avoid foreclosure????

February 12, 2009

I filed Bankruptcy in April, My mortgage was placed in the bankruptcy department at Citi Mortgage. I receive a letter stating that they will file motion through the court to be release on Tuesday Feb. 10th to file foreclosure. I am now behind in my my mortgage four months. Today I sent 1400.00 towards payments which has depleted my funds.How can I stop the foreclosure on my home?

Even if you file for bankruptcy Chapter 7, you still have to make your monthly mortgage payments. It affords some protection from foreclosure until the bankruptcy has been discharged

We.ve been fighting Citmortgage for about 3 years it all startd when we fell behind and filed chapter 7 we worked to get a home modification loan only to be approved in verbal and written form and then when we went to make a payment we were told that the loan modification was denied. we made modification payments for 10 months until we went to make a payment and citi mortgage told us they could not except any more payments. we are about 20,000 behind now because of this and our house is supposed to sell next week. but, today we filed chapter 13 in hopes of something. we went through a credit councelor and did not get anywhere we and the councelor got a lot of lies, we then hired a lawyer to help us get a modification and they to could not get citi mortgage to budge, now we are here filing chapter 13 the only thing we are behind on is the mortgage, is chapter 13 gonna help get our payment lowered any when we were making the modification payments these payments we could afford and were made on time. I have 3 children to think about too this is there home to and we are fighting to the end, i refuse to let citi mortgage win,sorry A CLASS ACTION LAWSUIT IS WHAT SHOULD HAPPEN TO THEM
