I think my house was already foreclosed on, ASC said we abandoned it but we are right here

February 25, 2009

Nov. 08' I was in contact with the mortgage company and we agreed to do the Loan Modification thru them. They sent a package to me I filled it out along with the hardship letter. I got a letter thanking me for "contacting them and working out a plan thru them" in December I was in a waiting period when just after the 6th of January 2009 a man showed up at my door step saying the house was foreclosed and I was being evicted. I called the bank and was told the same thing. Then I got a tax form from the bank stating that I abandoned the property. My wife was on the internet not that long ago and found our house for sale on a foreclosure website on AOL. I never received any letters stating that my house was foreclosed so I was SHOCKED to know of this information. Thank you for your time and attention to this situation.

Hey assholes! asc is costing a client of mine tons of money. By sitting on a restoration check. I think I should sue them for the money. what a bunch of dumb asses. Had we not dryed out their freiking house they would have nothing.

As far as I am concern ASC is unscrupulous. From last November, they promised to modify my loan, and they have asked for income and expenditure statements, hardship letter and pay stubs which was sent to them, and they promised to get back to me by February 18, 2009. To date they have not, and on the 3th of March I was served with foreclosure papers from the courts. Everytime I called ASC I have been giving information that they will send email to the negotiator, Nadia Nah, and have her contact me, to date I have not heard one word from her. When I receive the Summons regarding foreclosure from the court I called ASC I was told by a representative (Fran) of ASC that I should ignore the Summons. I have call several times after that and was told different stories by every representatives of ASC.

I am of the opinion that ASC does not want to negotiate with mortgagors they are bent on foreclosure without informing the mortgagors, while the mortgagors are awaiting modification.

People get an attorney they will know how to negotiate with your bank. ASC is a loan servicing company for Wells Fargo! You all need man power behind you!

I have been trying to do some type of loan workout for the past 4 months and I get nothing but the run-around from ASC. They are terrible and ridiculous to try and deal with. They ask for all this paperwork then tell you they never got it so they need more paperwork. I do not think they are interested in helping people keep their homes.

I have been trying to get a loan modification for a family member who's house is about to be foreclosed next week. I am not sure whether ASC will give it to them or not since they have not paid their mortgage since 2007, does anyone know a negotiator that we can contact?

ASC is a freaking joke.Don't know why any bank like USBank, Wells Fargo, whatever you want to call them would want these jerks handling their accounts. ASC has caused me more headaches and money that now they have to suck some costs due to their incompetence. Yes, they have tried to foreclose on me saying they did not receive my payments (80/20) when they are mailed in the same envelope and they show they got the small loan and not the big one. How stupid on their part. It has cost me my attorney fees but it is worth it to see them eat all the cost they say I owed (late fees, their attorney fees and all the other stuff they say you owe them). Their attorney told them they had no grounds for foreclosure, Their law firm went through several lawyers who would not take the case and now they are wanting to settle. I have been very persistent with these creeps and now I am winning. My attorney has been very persistent with them as well. I owe him a bunch but he is willing to work on a workout with him. Call it a bailout against the jerks. Good luck all

I also am having trouble w/ ASC! Over 4 months now and have gotten no where. They don't want to help you because they can make more money if you just let the house go. Everything I read says that the banks don't want your house they want to help find an agreeable solution. This is a total farce. They are making money hand over fist, first by the shading business & lending practices and now by taking bail out money and not helping anyone… even if you do qualify. I was told about a dozen different times that I do qualified for the Hope for Homeowners (H4H) act, only to find out another dozen times upon follow up calls that I don't qualify. After dealing with every department they have and being told they don't have my paperwork (after previous calls which confirmed they did indeed have my paperwork). I have called every week for status updates only to be informed that I need to send in something different or that my file was being send for evaluation and approval (after being formerly approved and speaking to many different managers on the subject). The last time I called to follow up on the status, I was informed that my file had been closed because they didn't have my earning statements - which by the way they did have because I sent them at least 4 times and was told that they scanned then and saved in the computer as a PDF! A phone call or letter stating this would have been nice before they closed my file.

They even went so far to send me a letter stating that my pre-for closure file had been closed per my request. HUH??? Pre-foreclosure file???? I was apply for help to keep my house! I would certainly never volunteer to have a file opened to begin the foreclosure process on my house! I bought my house in 2004 at the height of the market. Since then my house has lost more than half of it's value. I have negative equity and can not refi. I have never missed and payment and have never been late. I am interest only and am schedule to adjust in a few years. I figured that with how much trouble it is, maybe they will come up with a solution before 2012. It's either hire a lawyer or let my house go. At this point I almost feel like just walking away. It's not worth the stress. I have temporarily given up until congress or someone can shine a light on them and expose them for the frauds they are. Perhaps a class action lawsuit would be in order.

Has anyone been successful in doing a loan modification or getting any help with them? One Anyone hired a lawyer and had a favorable outcome?

Amy, Yes I have hired and attorney and been very successful. ASC is a joke. I hope everyone in this mess can have the outcome I have had. It was stressful at times but it is worth it to stick to ASC for once. I am also going after them to pay my attorney fees. I was told to call ACORN as well.

Unfortunatly, Wells Fargo will NOT work with any homeowners. They want to "FORECLOSE", they make more money by reselling your home. My husband and I are Real Estate Agents here in Las Vegas and we've tried to get them to work with us and we get they exact same song and dance. We all need to file a multi million dollar class action lawsuit to stop them from making any more money off of this nightmare they caused. Why should they be allowed to continue benefitting from this mess. They receive Billions in BAILOUT MONEY off of us the Homeowners and yet they lie and promise but never fulfill anything they say. Do not pay them any money for what they are calling a "FOREBEARANCE". In 3 to 6 months they will just Foreclose on you anyway. You can send in all the Hardship letters and pay stubs you want they already have their statements ready to put you off for another few months while there planning on your foreclosure.

We are currently moving from our home since ASC would not work with me at all. It started when I noticed the market declining the summer of 2007. I wanted to refi, but had a ridiculous pre-payment penalty of about $45,000! (I triple checked...the amount is correct.) I called to see if ASC would waive the penalty so I could refi early before my rate adjusted. They said no, so when my pre-payment penalty time was up, I had negative equity and couldn't refi. In March 2008, my payment went up by $500/mo. I again tried to get them to negotiate a deal. They refused. Finally in June 2008, I lost my job and decided ASC can have my piece of crap house. We received a notice in December 2008 that our house was in forclosure. Our house went up for auction April 1, 2009 (happy April fools day). My advice is, go ahead and try to work with them if you have a professional helping. If not, then just live in your house, save your money and don't fill up your credit cards trying to keep current on your mortgage. There are many homes for rent, as well as apartment complexes offering great deals and move-in specials.

hi asc has just foreclosed on my house and i was in the middle of a loan modification when they sent me a letter 4 days before the sale date i called asc and they told me not to send anything in because it was too late then i called again two days before the sale date and they told me to hurry and sent my paper work in and they never got it to a negoiator anf foreclosed on my house i went to the place of the auction and an auction never took place and when i called that day they told me that my house was sold to the beneficiary which is the bank ASC is a joke and want to rip us off.

BEWARE IF YOUR LOAN IS WITH ASC
I was going through a loan modification received a letter 4 weeks ago after months and months of waiting for a verdict that it was denied. In the meantime I get a knock at my door a week ago, It's an agent offering me cash for keys stating that the house is no longer mine. She stated my home was sold in May at a Power Sale. I never received notice either by the mail man or
anyone else regarding a court date. If i was denied mid July why was my house sold in May??? The rep also advised that it would be a waste of money to have retained an attorney. When I was denied I called and told a rep that I prefferred a short sale or deed in lieu. It never really mattered according to the cash for keys agent my house had been sold during the loan modification review. I am angered that I was not advised of a court date so I could have at least gone to say something. How can your house be sold when you are never advised of a court date,while attempting to modify I am at a loss.
After finding this website I find comfort in knowing I am not alone. I want this company to pay for what they have done. THEY ARE CROOKS
Luckily I found a decent home to move into and a landlord that is willing to see beyond my tarnished credit score. The irony is the landlord picked up a foreclosed home and I will be the renter. I don't mine though my landlord seems to be a decent and caring person. How many people regret sending ASC Western Union payments whenever they asked for them> Making it seem like they were actually willing to help us.

ASC SHAME ON YOU HOW DOES YOUR LOSS MITIGATION WORKERS SLEEP AT NIGHT?
I heard Citibank is helping there borrowers in need.
There new CEO us to be with Wells Fargo and said on National TV last week Wells Fargo is helping less than 4 percent. Where as CITIBANK had a 90 percent success rate. She stated an I quote "Even one foreclosure is one too many".

I thought ASC was working with me, maybe I'm being blind sided??? I notified them in Dec 08 that I saw trouble in the future and maybe was able to pay until Feb 09. They sent the modification papers and said they'd look at them. Well, when I called in Feb to let them know I wouldn't be able to make my pymt. They didn't know anything about my mod papers I sent in in Dec !! I was told by one ASC person that I had to miss a pymt before they'd look at my papers, others said no, that wasn't the case. Well, evidently is it. So, I stopped making my payments in Feb. 09 to to unemployment. I cannot make the pymt, so what is there to modify?? They finally got back to me on July 6th and told me no modification possible. I went through a whole senario with the guy and told him how I didn't want to take the 3 mo forbarance just yet, I needed to wait as long as possible to enact it. Well, he didn't listen to one thing I said. He put me into the 3 month forebarance THAT DAY!! After telling me that he'd send me the papers for it and I could sign & send in when I needed too. So today I came out of the 3 mo forebarance period. NOW WHAT??? I called ASC 2 weeks ago and they told me (even though the money situation hadn't changed) to resubmit all the modification papers again, all updated and my sob letter redone etc. and they'd take a look at it again, "things may have changed on our end" she said. So I did, I faxed them in, now I'm waiting .... I want to sell, since I have equity building with the prices of homes in San Diego on the rise again. Mine has gone up almost $50K since Jan 09. I keep telling them that I want to stay in my home so they will work with me and give me time to bail on them. But that is starting to look grim with all of your comments that I am reading. ASC told me several times that they don't want my home, but you all say differently. We have been trying to fix up our house (needs some TLC like paint, carpets cleaned, too much stuff in home, back yard needs some work)so we can put on market to sell. I just hope they don't pull the rug out from under me like so many of you have had done. They also told me that they would let me know LONG in advance when house would go to auction and I would get notices posted to my door prior advising of the situation. Does Calif have different (more strict) rules on the foreclosure process or am I just being hopeful that ASC isn't going to screw me over?? Anyone in CA having problems with ASC? Love to hear from you or others. Thanks, if I do get screwed over, I'll join the lawsuit you all are talking about.

ASC Has done two loan mod. for me so far ,and neather one has gon through. Saying that I did not send all my paper work to them.Well I made copy's of every I sent them.So they said let's do this again.Well the very samehas happen again.Now I have got paper's back from ASC they say don't make apayement for two mo. we are going to lower my intrest rate ,but thy are adding my two mo. payement to the end of my loan and they are uping my principl. nice peoplethey are nothing but a bunchof blood sucker's,and alot worse.The american way scrue your fello man F--- ASC

I've been trying to work with this company ASC on a modification for about 2 years now,the first one did whent thru and I agree to the payments but it turns out that when I sent my first payment on June I was very happy, but at the end of June I recieved A letter from ASC saying that I owed them $300.00 dollars on top of the mortgage payment. When I call ASC to find out whats the deal! one of their so call experts told me not to worry to just keep paying what I was told. Next thing you know my house is in the market for sale and that one of their ASC layers was holding the deed of my house!
I really hate the way this company does their bussiness. I truly believe they want the house even if they said that they want to work with me.
So I hire a lawyer hopefully with this I can stick it to them.

I too had the pleasure of dealing with ASC. After my arm adjusted my payments increased by over 600.00. This was July 2007. They sent people to my home when I was at work by October 2007 to dump anti freeze down my drains (winterizing the plumbing). I had no choice but to pack up my 3 children and move. It took an additional year to short sale with them. I'm all for any class action that should arise. We bailed them out but they REFUSE time and time again to help any consumers keep their homes.

How about this one: I have a loan with ASC, and was 3 months behind in my payments. They came to inspect the property but I wasn't home so they put a big sticker on the door saying the home is abandoned. I called them and said it wasn't. The next week they came again and broke into my house, disconnected all the water pipes, and gas lines, they rooted through all my personal belongings, threw stuff all over the floor, and stole (I think) a package from my front porch. I called and asked them how much to bring the loan current. I sent them a check for the amount they stated, but got another late notice 2 weeks later. I think it is lawyer time! Has anyone had this happen to them also? Let me know.
