I have stopped the Sherrif's Sale 4 times, they are after my equity

February 13, 2009

Had 4 stays of sheriff sale. Never have correct figures. Where ordered by court 3 times to produce figures. Ex: $17000.00 for home owners insurance. $11,000.00 for flood insurance. I paid homeowners $4000.00 and flood was $360 per year. Their attorney in court before the judge, says the bank wants the house, because there's plenty of equity.

I need help fast in order to stop eviction with Notice To Vacate within five(5) days from today,

How can I delay this with an appeal?

I lost foreclosure case but the bank that claims to own my note does not have original, and they were a failed bank 4months before they opened the foreclosure complaint, and did not have assignment til after the case was opened

What can I do to stop this sheriffs sale when the bank was a failed bank that opened the foreclosure case, did not have assignment til after case was opened , and admitted they do not have the original promissory note either, and they were not the original lender. My sheriffs sale is in seven days, help

I was getting behind my bills due to losing a part time job. I used my retirement money. In desperation, I search the interenet and was contacted by a law office from California. I paid them $1500 to assist. They advised me no to pay the mortgage. They stated that I will start paying as if I was not behind. That was six months ago. Apparently the Bank/Mortgage did not accept an now my house is in forclosure. Apparently I make too much money to be in this situation. I don't know what else I can do to save the home. My bills are pailing off since the Income I bring home is less that what is going out. HELP!!
I only bring home $1500 every other week and the mortgage is $1550. Other reach over $1000

Emigrant Mortgage is stealing my home as well!! When I bought my house at the end of 2006 I put 145,000 down. In June of 2008 I called them and told them I was not going to be able to make my full payment. I asked them to work with me and they refused! They told me to make my payment or they were going to take my house! After falling behind 3 months I went to Neighbor Works for a loan modification. They told me not to make any payments and to save as much as I can so when the modification goes through I'll have some money to put down. Well the modification never happened and I'm 2 years behind and Emigrant is going to STEAL my home on the 25th of July!! I asked if they could do something with the equity I have in the house & they said no! It seems all they want to do is steal my home & then resell it to some other victim!! I called the NYS Banking Authority and they told me there wasn't much they could do because Emigrant is privately owned!! IS THERE NO HOPE!?!?!?

I am currently suing Emigrant Mortgage. In Jan 09 we asked for a modifacation and told they wouldnt consider it until we were 3 months behind. So we got three months behind and submitted modification papers. Three months later they came back and told us due to a clause in our mortgage we didnt qualify! They should have known this before they let us get behind. I have come to realize it is all part of their plan. We were hot with almost $45k in interest for those 4 months. We hires a firm at $1500 and they finally came forward with a mod after placing a foreclosure against us. The mod required us to give up our rights to ever file a BK and to never go after them for discrepancies in Truth in Lending. That was a red flag for me so by luck I came across an attorney who had won a lawsuit against Emigrant for doing the same exact thing. Yes you can win against them! it is now going on three years, 1 1/2 years since we hired this new attorney and after months in the lower courts it is being kicked up to a higher court. WE have faith that this will work out. We are looking for others that have had a similiar situation to help make our case stronger, while at the same time we might be able to help you. THe more people we can find that have had a similiar situation the better chance we have of beatimng them. Please contact me if you are interested in stopping Emigrant Mortgage from stealing anymore property!!

found site today. we were behind 2 months, Emigrant refused to take any more payments. Put us in default and got charged $128 interest/day. Lawyer for Emigrant lied in Court proceedings about Emigrant does not have to follow Obama plan because they did not take any money under TARP ( Treasury Bailout). Found out they did and were the only bank that never paid the government back. Mortgage papers were falsely stated but it was actually a High-Equity Certified. Bank of New York State dept cant help but they are under the Office of Thrift Supervision or Comptroller of Currency.
lost in lower court for trivial reasons and now sent to referee. looking for a lawyer to vacate the judgment and put back on trial calendar. have to go to Appellate. Emigrant is all over as being a ripoff because it underwrites mortgages in a manner that makes it legal for them to put in default and not accept any payments.
I found out that they violated about as much one can of the Truth-in-lending Act and RESPA(Real Estate Settlement Procedures Act.
Passionate enough to start a Class-Action proceedings.
