My husband lost his job and we were already behind on the mortgage with Midland

February 16, 2009

My husband lost his job due to the fact is was self employed and the contract is over. So we are currently behind on our mortgage and the home is being foreclosed on. I was wondering if we filed bankruptcy if it would save our home now that my husband has a new job. and if we could renegotiate our loan.

We have the same problem.Only that we own Midland Attorney and court fees.Every time we get the money together to pay they have new fees for us.And they do not take down payments.Now ,our House get sold.And we are not able to do anything about it.

Im having the same problems with midland. I have been in constant contact with them for 6 months paid attourney fees and am no further ahead than I was when I first contacted them. Getting nothing but a runnaround but they insist they wantto help.

our lender is midland mortgage they denied us a short sale and want to do a foclosure and state of indiana they can garnish your wages does anyone one know if they will actually do this because we can varily make it now and if he retires can they take his retirement if we go that route

I have been making payments every month to Midland Mortgage.However all of a sudden I started noticing that it took a long lenghth of time for them to cash our checks monthly.
Also I noticed that some months then the checks would not go through., and the funds were in our bank.
Finally I figured out that someone was stealing money out of our account little bits at a time.

We sent a letter from our bank to Midland telling them waht had been happening.They ignored the letter and still charged us fees.
Whenever I would be told that our check wasn't clearing I would right away send them another amount to cover the costs and our mortgage payment.
I am sooo frustrated because they have us three months behind and I don't know why????help!!!

my problem with Midland Mortgage started with me falling behind nov and dec of 08. When tax season came around in 09, i owed a total of 2500 to get caught up. I did an ACH transaction with them. For some reason the money never came out of my account. I called several times to Midland, and they said that my account was okay they had the money. I told them this was not registering on my bank acct.. They said wait a little more and it should come out. Then all of a sudden they send me a letter saying I am behind four months. I called them up immediately, and they said as did the letter that the ACH transaction didn't go thru, and I still owe the late balance plus another months payment. Both me and my husband were not together and both of us out of job. Therefore, i was living off of the money from tax refund. by the time i found out what had happened, I didn't have the correct amount owed or even half at the time. She still said i could send in money(1700) to keep the ball rolling. and next month i would send in my payment as normal. that payment was returned, and some how or another i didn't get that and from then on out all payments were behind, not enough,or split up to pay fees. I was told to send in information for one of their programs, which i did, and then they wanted more information, and then the info i gave them needed a credit report from one of my financial providers helping us out if it were over a specific amount. all in all the list got longer the tasks weren't done to their time scale and here comes the attorney fees and foreclosure, and finally a program that fit our needs (an unemployment program-partial payment)plus 1,800 in legal fees. so now my grand total to be paid is 7300 dollars when at the beginning should have been nothing if the people checking the status of my file had just referred me to the same department i started the transaction with. They didn't check, they run under the guise of don't ask the right question, you'll get no right or helpful answers.After hearing these stories it makes me question why me or you and not hundreds more are somewhat being bamboozled by this company. should we all just get a class action lawsuit going?
someone tell me what to do before i am pushed into signing there agreement for payment.
