Countrywide will not accept a Deed-in-lieu of foreclosure because our house is rented

I have had numerous phone calls with Countrywide during 2008 to restructure the loan...they would not do it because we were current. At 69 years old I have lost my job and my wife's is in jeopardy so we have now missed 2 payments (we have/had over a 800 credit rating) The property is a Miami Condo (we live in California) that has been for sale for three years and it is now listed for $185,000-$100,000 under the loan amount. Countrywide will not accept a deed in lieu of as we have a renter... we are now negotiating with the renter to leave.
