Chase just approved our Partial Claim

February 25, 2009

We just got approved for 6 months partial claim. Should I take it? I don't know anything about it? What does a Partial Claim actually do and when do I need to pay it back?

Tom, I'm not positive about your "partial claim," but from my understanding, your loan probably has a PMI (Private Mortgage Insurance) that you're paying because when you took out the loan, it was more than 80% LTV. When a borrower is in default, your Lender can ask the PMI to contribute a sum of money to the Lender in order to bring the loan current and avoid foreclosure. In the event that foreclosure does take place, then your Lender would make its claim on the PMI insurer for any losses incurred. That's why the PMI insurer has an interets in kicking up a couple of dollars to help keep you out of foreclosure. Anything paid is usually placed as a second lien or mortgage on the property to be paid back if/when the property is sold. Hope this is helpful.

My mortgage with Chase is 30 year fixed with $170,000 balance owed. My house is now worth less than $120,000 and my income has dropped due to layoff - I have been paying the mortgage from savings but am almost wiped out. I applied for loan mod from them and am waiting to hear, but cannot make any more payments. If I let them foreclose can they come after me for the difference? Also, is there any way to trade properties with a foreclosure they might have for sale?

My husband and I are 4 months behind on our mortgage with Chase. We applied for a modification but we were declined because we have a VA loan. The Goverment requires us to make 12 full months of payments before we can be eligible for a loan modifcation. The bank asked that we go with a forbearance and pay 1467.00 for the next 3 months. Then they would consider a modification bringing our payments down to about 911.00/month. My husband and I pay 400 dollars less then 1467.00 as it is with our regular loan payment and we cannot afford that, how can we make the 1467.00 for the next three months? My job loss really hit us hard and we are at a loss. I have been trying to call Chase and talk to the lady handling the case but she is never avaliable, when I try to leave her messages her mailbox is full. They did not even send us a letter about the modification being declined I had to call them day after day after day. It took them almost 5 months to tell me that the VA requires 12 full months after the preapproved loan modification went through. I don't understand why they could not tell me this from day one of the modification proceddings. They also refused payment during the process so my husband and I are behind by 5 months now. I need help trying to avoid forclosure and make the 1467.00, but no one at the bank is reachable. I try everyday to reach the lady handling this case and the others there tell me she is the only one that can speak to me about it. So day after day I try. Please let me know if there is anything else my husband and I can do......

my husband and i have both been unemployed for at least 6 months, i have been current on our house payment although they raised it $1000.00 i have nothing more that i can sell our house is not worth anything anymore, i started 5 months ago with the loan modification process, once they shredded all my paperwork because they couldn't find all the papers. Then they sent it to another dept and once again lost it, now i have been turned down because being unemployed is not a hardship. why is it that they want us to fail i call once wk to see if they will help but they say there is nothing they can do....why wouldn't they want at least partial payments then no payment at all

Just got a forclosure summons even though we have a reciept from chase with the payment that brought us current. How is this possible?????

We have a mortgage from Wamu/Chase, We applied for a loan modification in May 09, after months of calling and making our payments it was suggested to us by a rep that we were current..he kept saying this everytime I asked him why they wouldn't help us, so we missed 3 payments and it put us in a different catagory and low and behold we got our loan mod, they lowered it by half and put us on a 3 month program...after 3 months they will they will go over it all again and if nothing has changed then they will make it permanent. It was mentioned a few times from the bank about being current...

It will be longer than 3 months and this is only your trial period payment plan not a loan mod and they could come back and deny it and you will be already down any difference between your normal payment and the trial period payment amount and they could still foreclose. Chase did this for us and I called and they told me that it could take approximately 9 months for a final decision but keep on top of your new payment amounts for sure to get that approval. By the way, can you believe Chase helped us with our first mortgage and then our 2nd lien holder which is Wachovia denied us and I tried telling them we could not make it back in March 09'. They denied us and we received the denial letter the day after the one handling our loan mod request had just asked us for some more updated paystubs?? Go figure how that can happen in that way. It's all a front and they have the bailout money to keep. Anyway, we were told that the 2nd would not foreclose but we were told wrong because they filed a foreclosure without the proper notification to us around Thanksgiving with a sale date of 1/5/10 and forced us to file bankruptcy to protect our home and used the Dec Chase payment to pay our lawyer for the bankruptcy but does not matter because ourlawyer says the bankruptcy voids the loan mod trail period out and we go back to the original payments with Chase and that does not help us at all because that is a $500 a month increase and I was layed off 9/2/09 and no luck with a new job yet. We will be paycheck to paycheck and strapped to even try and make it. Lots of peanut butter sandwiches and no cable, and maybe no internet at home either:( SEE HOW WE ALL ARE REALLY STUCK BETWEEN A ROCK AND A HARD PLACE AND NO WHERE TO TURN AND OBAMA'S IDEAS ARE NOT HELPING LIKE THEY WERE SET UP TO DO)THE BANKS HAVE US BY THE YOU KNOW WHATS!! NOW WE STILL MAY HAVE A HOUSE WE CAN NO LONGER AFFORD EVEN AFTER RUINING OUR CREDIT TO STOP THE FORECLOSURE.

I feel your pain, all of you. I was fortunate enough to find a company that is legitimate. Now I know that the banks the news and government say we shouldn’t go to any company that charges, that the banks will modify your loans for free. Well, how many of us on here have had our loans modified by the banks?

A lot have lost their homes, and lot more still will unless you do what’s necessary to save your homes from the banks. I went through what most of you have, I was there. Then I was referred.

I know I would have lost it to Wachovia if it wasn’t for him and the rest of the people who work there. Got me caught up on my mortgage 1st & 2nd, lowered my interested rate & payment.

Before anyone else on here loses their homes you need to give them a call. Don’t be afraid of hiring a loan modification company, be afraid of the banks, they are the ones who are taking our homes!

I know they get the job done. News and TV made me afraid to even consider a loan modification company because they are all scams and my lender will do it for free (wrong). There hasn't been not one story about a good company and when I tried to contact my local news channel they told me that my success story wasn't news (What!)

So, I am making it my mission to spread the word on this GREAT company!
