Suntrust won't work with my Attorney

December 24, 2009

I am on a forbearance agreement with my lender who is Suntrust. I have a law firm working on a loan modification but they are not doing to good for me. I have paid them money and that's why I got behind on the last 2 month since October I was only 1 and half months behind before I started with the law firm and I could not pay both Suntrust and the law firm at the same time, they said that they would be able to help me and now they are telling me that Suntrust wont budge to do a loan mod and I just got a call from the guy at Suntrust he left me a message saying that he is going to start the foreclosure as of tomorrow because I have not made a payment I want to start paying them with my next paycheck. I will allow them to take the money out of my account automatically but the past due amount is too much for me to handle its about $10,000. I will be going to court for my fiance he is out of work hurt and has no income at all but he is getting SSD. We go to court to settle the case that may take a month to go through though he is owed a couple years of money for waiting to get on the SSD. I will be able to afford the payments until that happens but I need them to be willing to work this out with me and I would love for them to put the past due amount in the back end of the mortgage with a partial claim and I will keep up with the payments. I know that there is help out there. My law firm told me that they would get back to me but I am not sure on what to do. I just want to get this worked out. Should I call Suntrust back or should I let the law firm call them back. I want to call them but I don't want to mess anything up that my law firm might be doing. I have 2 children and I lived in my house for 10 years I cant go through this I worked too hard for my home and losing it is not an option.

I would not trust the law firm to save your house. These law firms are totally scamming people and telling them if they pay the law firm they will save your house but then they dont. Because unless you called or sent an authorization form for the mortgage bank to discuss your loan with the law firm they wont say a thing to them about your loan. Our loan was in my husbands name and they wouldnt talk to me unless he wrote them and authorized me as a contact to discuss it. But you are eligble for a loan modification as long as you are 3 months behind and have a job. We went through the same thing when my husbands business significantly lost income SunTrust finally gave us a loan modification 2 days before auction. We applied for it in May and they finally granted it in Aug. They drug their feet for 4 months after I called every 10 days and they said they hadnt gotten around to us yet. Same answer every 10 days. Assuring us everytime they had our documents and where not going to forclose as long as we were in mitagation. There is a new program for FHA loans if thats what you have. FHA borrowers who are experiencing difficulty making their mortgage payments should contact their loan servicer to determine if they qualify for the FHA-Home Affordable Modification Program.

Demand to be considered for the loan and tell them your auction date..... If the person you are talking to is getting you nowhere then demand to talk to the supervisior... Dont let them steamroll you and tell you there is nothing they can do. Its BS! Good Luck and God Bless Liz

Why would you pay an attorney and then try to work your own mod, if the attorney cannot answer you then fire them and get help from somebody that knows what they are doing
