I can't do this alone.

December 24, 2009

Bank of America told us we were in a Modification gave us the negotiator's name and when they expected it to close. We received a letter from Bank of America's Attorney stating a sale date. Bank of America postponed the sale. They told us for 30 days I got paperwork from the Attorney that postponed for 5 days. Bank of America stopped the sale. Said we were in loan modification and were pre-approved for a 31% modification. I received an advertisement from an attorney wanting to file an injunction for us he had gotten our name off of public record that our house was to be sold. I called Bank of America and asked them they said we were in modification and there was no sale date. But if I could get Bank of America to send an email they would stop the sale. I worked for 3 days to get them to send a email the the Lawyer. I can't do this alone.

In the past week I have been contacted by at least two homeowners whose properties have been foreclosed in early January while they were fully engaged in loan modfication process. One of them had a fully approved forebearance agreement sent by B of A. I have learned that this type of wrongful foreclosure is very common recently as the right hand does not know what the left hand is doing. As a real estate attorney authorized by the homeowner, I have contacted B of A and explained what has transpired. So far, it appears that the Bank if working with us to fix the problem. However, I don't think the Bank has adddressed this problem by designating a special task dept.

Thank is EXACTLY what happened to me also, BOA was working with me or at least said they were and their attorneys pushed the foreclosure thro8ugh even knowing that I was in a modification with BOA and the judge granted a "judgment of default" without ever even giving me a chance to speak! I am so PISSED and I am going to be contacting my State Senators on this BS. Is there any way to "appeal" or reopen a "judgment of default" in Wisconsin??? Now the court records show a "confirmation of sale date" in court for APril 7th, 2010. I need help NOW to stop this! What can I do??????

Doug, I recommend that you find a local attorney who can handle this real estate debacle to stop the sale date if you cannot do this alone. You need to explain that the Bank needs to continue working with you until a final decision on your loan mod is made.

I feel your pain, all of you. I was fortunate enough to find a company that is legitimate. Now I know that the banks the news and government say we shouldn’t go to any company that charges, that the banks will modify your loans for free. Well, how many of us on here have had our loans modified by the banks?

A lot have lost their homes, and lot more still will unless you do what’s necessary to save your homes from the banks. I went through what most of you have, I was there. Then I was referred.

I know I would have lost it to Wachovia if it wasn’t for him and the rest of the people who work there. Got me caught up on my mortgage 1st & 2nd, lowered my interested rate & payment.

Before anyone else on here loses their homes you need to give them a call. Don’t be afraid of hiring a loan modification company, be afraid of the banks, they are the ones who are taking our homes!

I know they get the job done. News and TV made me afraid to even consider a loan modification company because they are all scams and my lender will do it for free (wrong). There hasn't been not one story about a good company and when I tried to contact my local news channel they told me that my success story wasn't news (What!)

So, I am making it my mission to spread the word on this GREAT company!

Regarding using loan modification companies find one that knows the math. You are paying for them to get the numbers right they figure out your assets and liabilities (Income to Debt Ratio) and compute how much qualifying income you need. The regular consumer does not know the formula unless you were probably a lender.

I wanted to add a little more about my situation with the foreclosure on my house. The WHOLE REASON my house is foreclosure is that I am part of the "Midwest Floods" (our county was declared a federal disaster area after over 22" of rain in just a couple days) and my house was totally destroyed by major flood damage and then the toxic mold that completely "engulfed" and "consumed" my entore house. It is now posted my the county health department as "unfit for human occumpancy". The City Housing Inspector has informed me that the house "must be demolished" but they are "holding off on doing so because I would get the bill which could run around $40,000.00+". What the major problem with Bank of America is is that they just don't seem to "get it" that yes, the priciple is $150,000 BUT the value of the property is only about $52,000.00 due to the costs of demolition & landfill fees which detract from the value of JUST the land value. BOA fails to recognize that THEY will be totally "stuck" with a HUGE LIABILITY due to the health hazzards and also the bill for $40,000+ from the city after they demolish the house. I really need help NOW in stopping the "confirmation of sale" which is set for April 7th, 2010. I have talked to a couple of attorneys locally and they all seem to say "just let it go, why are you trying to hang on to it???" I recently had THREE spinal surgeries after a severe spine injury at work in the last THREE MONTHS and am now paralyzed in my left leg. I HAVE TO STOP THIS FORECLOSURE IMMEDIATELY so that I can concentrate on hopefully walking again and then be able to AT LEAST get the last few things out of my house that MIGHT be still salvagable. I just need time and BOA isn't understanding at all that I am NOT part of the "mortgage meltdown".. I AM A DISASTER VICTIM.
