I need a Short Sale or DIL

October 02, 2009

I really need to stop foreclosure. We have been working with a Realtor since July and Ocwen is refusing to work with us on a Short Sale or Deed in Lieu of Foreclosure. Please Help

I have no advice for you! We're about to go through a short sale ourselves and our mortgage just got sold to OCWEN. Do you have a buyer for your home? if so, that's probably the best way to go is to get a buyer, close the deal, then deal with the difference in debt on the back side.

will ocwen take less then I owe if I can sell the house right now I owe $112.000 I was offered $100.000
Iam behind on my payments so I would like to get of the house before I have to fill bankrupt

In Dec 2009 my house was foreclosed and auctioned off. Prior to that I had 2 offers on the house and one was more than it sold for at auction, but I never got a response from Ocwen on my request for a short sale.
I don't think I should get a foreclosure on my credit when it could have been avoided if they had taken the short sale offers.
Is there any way I can have the foreclosure removed on these grounds?

Hi Thomas,

That sounds like a very unfortunate circumstance, but something that does happen very often.

Unfortunately, there is nothing that can really be done to change what happened.

Were you working with a short sale negotiator as well as a Realtor?

We went throguht eh same thing with Ocwen. Our mortgage was sold to them by Saxon. We were never late on our payments, and in March 2009 we decided to sell the home because we had a nother home in Montana. We had a buyer immediately within 48 hours o fit being listed. They had cash. Our realtor went above and beyond to send Ocwen all of the paperwork they needed and everytime they lost it. Our buyer stuck by us and in July 2009 Ocwen finally approve dthe short sale but the buyer backed out. We got another buyer right away. This time Ocwen wouldn't approve the short sale because they wanted more money. They said home values had risen. They sent their appraiser to a different town and got appraisals for brand new custom homes!! At this point the buyer would not sign the counter and Ocwen wanted us to do it and we told them no. They were asking for too much money and they had just approved a short sale less than 30 days prior. At this point no one woul dlook at the house becasue they wanted too much. Our house was foreclosed on in May 2011. Ocwen will not help you with anythign but foreclosing on your home. do not trust one workd that comes out of thier mouths and keep every document you ever sent to tehm.
