I have a 1st & 2nd mortgage on my home. The 2nd mortgage is up to date. The lender for the 1st mortgage placed us into foreclosure four months ago. We have attempted three time to get a loan modification from the lender. Recently, while supposedly working with us on a modification, the lender allowed the foreclosure sale to proceed and now we have received a notice requesting possession. It sounds like I am in the eviction process. Can I still do bankruptcy? How will this affect my credit?

Gee Terd.... That was some very helpful advice you just gave to someone who is scared and losing their home. I sincerely hope you are never in danger of losing your home because of something you may have had no control over. What a caring and compassionate terd you are (not).
Cheryl.... I don't know if you are still in possesion of your home, but if you are, consider Chapter 13 bankruptcy. It will put a AUTOMATIC STAY on foreclosure, AND it is possible to LIEN STRIP the second mortgage. Talk to a lawyer. He or she can better advise you. I wish you the best.
We are in negotiations with the mortgage company to purchase foreclosed property of a relative. With the eviction date rapidly approaching will this pending sale negociations prolong the eviction date?
What kind of lawyer handles mortgage issues if you get denied home modification loan from your mortgage lender. I would like to challenge my lender's decision of denial for my home modification application. The reason for denial was my contracted income not being reliable and I used this same method of income obtaining a refi from them.
