I want to avoid foreclosure

October 20, 2009

We are in foreclosure - we were just turned down for a loan modification. We have talked to credit counselors twice. Our original loan was with Taylor,Bean and Whitaker who went out of business while they were supposed to be in the process of a loan modification for us then our paperwork was handed over to Bank of America. I want to avoid foreclosure.

That's tough. I know from experience that Bank of America is one of the most difficult lenders to modify with. It's a hope and a prayer with them. The only thing you can do now is sue bank of america in court if you find the loan was fraudulent to begin with, or if you were a vitum of predatory lending when you got the loan. You can find out with a thourogh forensic loan audit if that was the case and that will identify the violations which took place and give an attorney all the ammo they need to take them to court and win.

I had my loan with T B AND W and it is now with Okwin. I waited and waited with no response from T B and W about a modification and now Okwin is foreclosing on me has T B and W hurt so many people with no place to turn.

I have now lost a buyer because Bank of America couldn't their act together. Three months ago I applied for a short sale and now they say I didn't send in all my forms. I have sent every form three times. When I called to ask when we could get a negotiator, because my buyer was threatening to bail, they said 48 hours. Well, it's been three weeks, the buyer bailed and I'm going to have to foreclose. Isn't there a class action suit somewhere for people like me?

I don't know about a class action suit. You should look into a civil action suit so that you can get the settlement instead of having to split the settlement with a large group of people.

I had my mortgage with TB&W and we went thru the entire closing procedure to refinance our mortgage to a lower interest rate. We signed all the papers and everything and now bank of america says that the entire thing is void and I don't qualify for a refinance with them and now I have received a notice of intent to accelerate. I don't know what to do.

I feel your pain, all of you. I was fortunate enough to find a company that is legitimate. Now I know that the banks the news and government say we shouldn’t go to any company that charges, that the banks will modify your loans for free. Well, how many of us on here have had our loans modified by the banks?

A lot have lost their homes, and lot more still will unless you do what’s necessary to save your homes from the banks. I went through what most of you have, I was there. Then I was referred.

I know I would have lost it to Wachovia if it wasn’t for him and the rest of the people who work there. Got me caught up on my mortgage 1st & 2nd, lowered my interested rate & payment.

Before anyone else on here loses their homes you need to give them a call. Don’t be afraid of hiring a loan modification company, be afraid of the banks, they are the ones who are taking our homes!

I know they get the job done. News and TV made me afraid to even consider a loan modification company because they are all scams and my lender will do it for free (wrong). There hasn't been not one story about a good company and when I tried to contact my local news channel they told me that my success story wasn't news (What!)

So, I am making it my mission to spread the word on this GREAT company!

I am in the middle of a divorce and allowed my wife to keep the house with the understanding that she would pay the mortgage. She has defaulted on payment for almost 2 years. The house is in foreclosure and she was just served with a notice to get out within 30 days. Is there anyway for me to modify the loan at this point? Can I have her sign over the deed now and save my house?

We refinanced through TBW and 4 days later they went under. AOB tried for six months to foreclose on our first mortgage which we closed on. We were due 600$ from the closing and never got it. Also my insurance which was supposed to come out of my escrow account hasn't been paid. Anf to top it all off they are saying we are 4,000$ behind even though we never missed a payment!
