I thought I was on a repayment plan, I find out now that I am being evicted.

May 07, 2008

Hello, I have a loan with ASC and I was in a repayment plan with them that was drawn up on Feb. 25th 2008. I continued making my payments as planned and then I received a phone call from a Realtor telling me that she was in charge of my eviction process and that my home went to auction on April 30th 2008. I had no clue anything had changed in my agreement. Come to find out ASC is saying that I bounced a check on one of the payments in my plan. I had no clue this happened and continued making payments as planned and agreed to. I don't know what to do and we are very confused about what we can do if anything. Please help!

can you have your house auctioned off without any notice. Its even no record of any notice at county records.
after a car accident. i missed time from work. My mortgage co said they could modify my loan. i sent close to $6000,signed the papers at the notary. 3 months passed & when i was about to make my first payment. I got checks from the co for the same amount. i called, & was told they never got the paperwok. they cashed the two checks but returned them. They sent me more paperwork to start over & this paper said to return to their office by 2-14-08. I confirmed they got them this time on the 8th by calling. I called on the 11th to see if i needed to send the money back.they said they needed the papers 7 days before the 11th. I reminded them i was looking at a copy of the letter, it said return by the 14th & was type. At the end they said sorry about the dates on paper, its nothing they could do. The foreclosure offfice said they could, just call and stop it. They made many mistakes but now they tell me that by law i should've got a notice.I didn't. There's no record even at the co office

I too am on a repayment plan. I am almost finished with it. My original deliquincy was $7,000. when i am done with this "repayment plan" i will owe $14,000. It's basic extortion, but according to them, it was the only way i could save my house from foreclosure. They have reported to the credit bureau that i am 180 days late paying my mortgage every month, even though i am on time or before. i have asked them for a letter or printout showing my ontime payments, and theyn say "ok" and i never get it. they are the worst of the worst. PLEASE report them to the BBB. i have. if we get enough people to do this, maybe they'll investigate them. they definitely use unethical practices.

ASC what a bunch of liars! I too was just told they started foreclosure even though I'm under review for a loan mod. I even sent payments in to keep from going 90 days past due and they returned them saying we don't accept payments while under review for a loan mod. then I was now told since I'm over 90 days past due to contact the attorney assign to my case...Guess I'll now get my own attorney too! My advise to anyone is get an attorney don't try to do it yourself as most on this site have done. I read and have been told they dont want your home they want you to keep it but now I believe (although it still makes no sense) they do want my home!

No matter How early you send your payment until that orginal past due balance is paid off it will always be considered 180 past due

I am in a special forebearance plan leading to restructure of my mortgage at ASC. I signed the paper, sent my first check. The contract says on the 4th month that I will owe 12000.00. I was told verbally that if I follow the rules and dont miss any payments or be late, most of that amount will be added to the new loan. I have a contract. Is that contract fraudulent?

The same just happened to me this year. I signed a forbearance agreement and sumbitted monies. They took all but 1/3 of the money, then canceled the agreement behind my back and are now going forward with the foreclosure. How can they get away with this time after time?

I am glad I found this as I was about to call ASC, We had a repayment plan, made a large initial payment followed by another payment, I than called and asked if I could switch the due day from the 2nd of the month to the 14th, they agreed, on the 10th of the next month I recieved a lettert stating they cancelled the agreement because I did not pay in time, when I called they said it was okay and to sent them an outrages payment!! Which we could not afford, so now we are also in a bad position.

My contract clearly says the agreement is not negotiable and you must stick to the payment schedule. No bounced checks, no late payments, no grace. I think they mean it. Has anyone stuck 100 % to the agreement, no changes, no lates, no bounced, and been betrayed?

They did not even give me a chance to complete the forbearance agreement. The first large payment was made in plenty of time (early), then as I was getting ready for the next one, they sent back 1/3 of the monies with no/explanation. Then, when I called to find out why, they said they canceled it. They screwed me out of the money and now are screwing me out of my house with no means of moving. I believe it's called "Fraud."

I am very sorry to hear that. It is unreasonable. I have investigated these things as much as I can and in most cases, I have found that there was some element of their contract that was not followed according to the forebearance agreement; either a late payment, a bounced check, or lawsuit file that might wind up placing a lien on the house ie. another creditor filing a lawsuit.

How many payments did you miss?

I get my loan modification from ASC and my payments went up $650.00 instead lower my payments, They also want e to pay $8,500 at front, I am behind 4 statr 5th months behind because they broke my forbereance agreement. I have $5,000 saved , what cai i do to save my house? I only want a repayment plan because the modification is not working for me.

I too have AMS and are in a forbarence aggrement. So far I have been able to work with AMS and have had no trouble. I am hoping that all that I have read is not going to happen to me.

I decided to get on here and voice my opinion as well about the "shady" business with ASC. I had my locks changed on my condo and that was done because ASC states I was three months behind in mortgage. However; with today being Nov 7,2009, it is not quite late until the 16th. I intended on paying the two months today, but the kicker is that I was away from home to find the locks changed. They stated that they didnt have any records of my homeowners inurance, but I "owned" the condo since 2005, with the same insurance provider. ASC also stated that they were taking interest in their property since it looked like no one lived there! WHAT!..how did they figured that I didnt live there, were they sitting out my door and watching my traffic?.....they also changed the locks and gave the keys to my next door neighbor, for what. Thet apparently told him I was under foreclosure, but I am not. I was a sheriff deputy here in VA for 5.5 years, and have knowledge of the foreclosure process. Therefore; I would have gotten the letter of writ, which instructs the tenant or occupant to vacate the premises and that the eviction process is about to begin. I didnt get any LEGAL notification on anything, they will hear from my lawyer. I am going to jam their ass real good. I am willing to take the hit on the FICO score, all that can be fixed in 2 years or so, but they are going to have to do major repairs on the unit when I am done, promise that. Dont, DONT DO BUSINESS WITH ASC. Someone mentioned on an earlier note to report them to the BBB, and I will as well, we all should.

Again..as I read all of this nonsense... outrageous and downright underhanded business tactics, I ask myself, and all of you out there...WHY IN THE WORLD IS THIS ALLOWED IN AMERICA?????? I am writing my congressmen today...I advise that you do too!!! Are we really going to just let our America fall apart?? Don't we have RIGHTS AS HOMEOWNERS...!!!!

My mortgage is currently held by ASC (not by choice, but rather bought by them). I have been late every month for the past six or seven months, but I am making my payments with the late fee every month. Hours have been cut at work and this is why I have been late. I thought about calling them for "assistance" but I don't fully understand what needs to be done?. I am not behind (all payments made - just later). What kind of assistance could I get and what should I watch out for? If anyone could help explain things to me I would appreciate it. I would hate to have the issues you all are dealing with.

Ok people...this is enough. We have to band together and be heard! Everyone out there needs to write letters..not emails..to our congressmen..our governor..report them to the BBB..and even send a letter to the Obama camp! The get in touch with HOPE NOW (Google it). This has just gone too far.

ASC is the worest mortgage company to work with.We have lived in our home for almost three years.Well last March we file bankruptcy,And throught our attorney we were ask to continue making payments to ASC as plain.Last October ASC sent our attorney a letter stating that we had not made our monthly payments for two months. We had to fax all of our bank statements showing the date that the checks cleared to stop them form foreclosing on our home.We had to pay and extra $458.00 for six months.Well in October we received another letter stateing that we are in foreclosure again this time because we did not make our April and May payment, When they received proof they change to another month.They have change months again.Well in process
of all of this we receive a letter from their attorney Nov 26,2008 stateing that our home was sold on Nov18,2008 and that we needed to vacate the property in 7days this was a shock for me.THIS COMPANY NEEDS TO BE STOPPED

This is outrageous, we also have ASC as our mortgage company but so far we have not had any difficulties. We pay about $600.00 a month for the past four years and we still have about eight more years to go. I need more information about ASC, and how could I find out more about my status with them.

I have the same problems with ASC, is the worst mortgage company in the World, it has to be stopped. My problem start March 2007, when they put another insurance in place saying that I don't have insurance, which is not true, when I sent proof of my insurance I start a repayment plan, they cancel and send me for foreclosure with not reason, finally the modified my loan and my payments went up from $2,600 to $3,250. I accept this but now they said that my scrow is negative in $5,000 I don't now why and again my payments went up from $3,250 to $3,750 which I can't affor it, this happens yesterday when I get my next payment for January 2009.
I need help badly with this company.
Let me know what can i do to keep my house with this tipe of mortgage company.

Wow I was depressed before I read these notices. At least Im having some wine while I read.
I fell behind with my mortgage when I lost my job last year. I called ASC to set up a payment arrangement and followed the arrangement as specified. I received a notice after the arrangement that my loan was current. The next month however I received a letter that I was once again in default. I called and was informed that somehow my review for modification had fallen through the cracks and I would receive notice in the mail as to their decision. I received the decision and this is it.
Keep in mind I am one month past due for $900.00.
ASC wants to add 3000.00 to the principal, I have to pay 2000.00 in interest and heres the best part, they are going to add 10 years to my loan. So in all I will be paying an addl 111,202.00 on a 111900.00 loan for a total of over 220,000.00. I compted my neighborhood before I sent my denial letter to ASC and because Las Vegas was hit so hard, my house is worth $60,000.00. Well this is a no brainer and I will most likely walk away from my home. Ive lived in my home since 1994 and its worth less now then it was when I first bought it. I raised my son in this house and I rescue dogs. Now I have to walk away from all of it and it just kills me. On the other hand, F*** ASC. They can have my house. There is nothing materialistic that is worth peace of mind. I came online to see what I could do to turn them in and I can see that Ill have to wait in line. Class action suit, I say ABSOLUTELY !

We are current mortgage holders of ASC. We are currrently past due almost 2 months. Our account is under review for a loan modification. Today, I rec'd a letter of default and called the default department. The lady says to me can't you make one payment? We are in Fl where the economy has hit us terribly and our small business has suffered. I initiated the loan modification prior to our deliquency and already the harrassing has started with this company. I am starting to think they are blowing smoke with us since they keep giving us the run around on when the load modification will be done. This payment that I am going to make this month will be our last. We just don't have the money and it doesn't appear that we ever will anytime soon. It is a sad state of affairs when you are about to lose everything you worked years to build. Hopefully, for all of us this will all work out and we will take ASC down with victory.

ASC is a complete scam! I have paid every month (2 late payments) for the past 18 months.
I received a notice of foreclosure because my home value had diminished and was required to give them an additional $82,500 to keep my mortgage and home. In this economy, it was impossible to refinance a jumbo mortgage being self-employed.
They set December 1, 08 as sheriff's sale, but said it would be postponed while negotiating a loan modification. On December, 3 08 I received a letter stating that they unable to negotiate and called to find the sheriff's sale occurred as planned with and additional $43,000 in fees tacked on.
They purposely pass you around from department to department to frustrate and confuse you into not getting an attorney involved. This is the biggest mistake you can do. The cost of attorney is a big burden to take on, but unless you study real estate law and know it well, they will always have their way with you.
I hired an attorney and I feel the power has been shifted from being a victim of a criminal enterprise to a fighter and they do not like it one bit. The only defense is a strong offense. They know 99% of the people cave and stick their head in the sand and watch as their home and memories are taken away for one reason.
Get an attorney RIGHT NOW! This company, ASC, is the worst of the worst. They need to be stopped and they have the deep pockets of Wells Fargo to hide them away.
If enough people stand up and file a class action suit, maybe, homeowners have a chance.

Can anyone reccomend a Virginia attourney that has worked for them? The strategy is probably right on money as described above. Punch them in the nose and ask questions later.

I do know that a loan modification with ASC only works if you have sufficient income, but negotiate it with them through an attourney. You should not have to lose your equity dollars or walk away from something that has stored up or potential future value just because the economy is bad. You may not qualify for another loan in many years. Remember, Well Fargo only owns ASC, miscellaneos and unknown investors actually own your loan.

I went to court looking for more time and judge hates these guys! They threw out sale of home and stopped eviction. Get an attorney and get one now...the judges are so swamped, they will do anything to make them negotiate a way to stay in house. If you live in chicago area, I will give you my guys phone number. Do it now!

OH MY GOD!!! I found myself in the same situation as Carl. I was hospitalized and out of work for almost 2 years. I made an agreement with them for 3 months of payments and then a modification. Which was to be paid begining in January. So 2 months of no payments was very helpful. After the third payment I heard NOTHING from them. But of course they cashed all the checks. Bank Checks to be exact. I called was told to wait for a statement in the mail. On January 31st there was a knock at my door from a realtor telling me that she wanted to post a sign to sell my house and take pictures for the website. I have 4 kids work full time and have been through so much with this its is not HEALTHY!!! What happened to the 700 Billion dollar bailout??? They are using it to make up for thier CEO's Bonuses that they need??? How about remembering that we are trying. WE DONT WANT TO LOSE OUR HOMES!!! That is why we called in the first place. SOmeone has to STOP this kind of practice.

ASC is the biggest liars. I have never delt with such rude people in my life. They have no heart. I have been in my home for 15 years, we refinanced about 5 years ago, and now was hit with the adjustable rate. I have begged ASC to work with us, and for 4 months I was on the repayment plan. well after 4 months we got behind on other bills but we were obligated. When I asked about redoing our loan to get it back to where we could afford it, like most mortgage companies out there they are more willing to refinance the loan, because they do not want the houses back. I asked ASC , and they told me unless the government makes them they do not care how many people loose their homes. OMG, how does that person live with the comment that he made, JOSH. Well then we gave them all our financial information, because our income was considerablely less than before, well guess what the repayment went up $400.00. How does that work, less income, more bills but instead of helping they are putting us more in the hole.
I hope that people see our stories and stay away from ASC because I have never delt with such smart mouthed and heartless people before in the customer service field in my life.

I guess we are going to loose our house after all. We have been working with ASC on a loan modification. But, after reading all these posts, I can see we are screwed. We have actually believed ASC is going to help us. Now, after reading all this, we have lost all hope. What is left??

OMG I'm having same trouble with asc they said they
sold my house but i didn't receive any notices either.
This was trying to be modified by FHA. They said they
didn't have any contact with FHA.I've had 2 lawyers working with them before and hope now and now FHA
They want you to get behind so they can foreclose.They are so rude and biggest liars. tell bbb
and attorney general. we need to put this company out of business.

I'm in the middle of a repayment plan...have till May to make payments and then they are telling me they will modify loan and add outstanding balance to end of the loan....but after reading this I am getting a little scared! Should I even bother with them? Has anyone out there ever had a repayment plan honored by ASC???

This company/loan sharks are so out of control. My husband and I got a lawyer after completeing a repayment plan and were told that we didn't qualify for a modification through ASC. I guess we didn't qualify because they refused to take the last payment of the agreement. When I called to see why it wasn't applied they actually said it was there key stroke error when entering the date which I made the payment. So because of there error we didn't qualify for modification. WOW!!!

The next week we retained a lawyer to obtain a modification...here's the kicker we ended up doing a good faith payment plan of $4,100 a month for 3 months and after that was completed we waited another 3 months and were sent a modification that tagged on $46,000 in fees and our payment went up $1,000. which will be impossible for us to pay. We were told by our lawyer in the beginning that our payment would either stay the same or go down a little....I am at a loss for words. UHM...were in shock and going to go to another lawyer for a second opinion and may end up having to sue ASC and walking away from our house. My kids are pissed and I don't know if they will ever trust any lender or bank for that fact. We feel like the lawyer we retained has done nothing and to top it off the mod papers we got specifically state "this proposal is valid for (5)days from the date of this letter." The date on this letter is February 09, 2009. So is this new mod contract even legal?

This totally sucks. I think its time that we rise up and take over Wells Fargo and ASC. The people in Hinkley did it to PG&E why can't we do it.

I think we need to forward these blogs to the SEC. It does appear out of control with ASC. It looks like they scam people for interim payments and later foreclose anyway.

I have submitted twice for my modification, but they keep saying this or that was not received. Or, I missed a short fuse deadline and they had not even told me so.

A consolidated lawyer representing all off us might be the way to go. Have a judge decide weather you stay in your home, not ASC.

Part of this company appears to be in Fort Mill, SC. I have no idea where corporate is. ASC are the managers of these notes. Wells Fargo owns them, but the actual investors (note holders) are other entities. Speaking of note holders, here is something you can try in the interim ...

I would like to get an attorney and sue these bastards. I would rather spend my money on attorney's, instead of paying more on this note that they are likely unwilling to modify. I will research this a little more, but if anyone knows an attorney in ASC's backyard, we need to UNITE and CONQUER!

My story is pretty much the same. Bought my house and the mortgage got resold twice. My payment was $675 and went up to over a $1000 after it adjusted. (I was stupid and didn't pay attention to the details) I got behind one payment and did the repayment plan thing but a year ago Christmas I mailed my payment with plenty of time for it to reach them. It didn't get posted for over 3 weeks. They said I broke my agreement & I said no I didn't. They are dispicable.

I get mail from them every month saying I'm behind two payments but they always include the current due payment. I was paying over the phone but I got sick of talking to them so I've been making it online. What galls me is that you cannot add extra to your payment to pay towards the past due amount. It has to be in full increments. If I had the money to make two full payments I would. So I have just been making on time single payments every month for over a year. I'm going through a Chapter 13 bankruptcy and the house cannot be part of it. I really don't know if it is possible to make ASC happy. After reading all these horrible stories I fear that it is hopeless.

I keep reading folks talking about a class-action lawsuit....but the problem I see with that is the only 'person' that wins in that situation is the lawyer. The defendant gets off easy and the plaintiffs get squat.

Well, here's another one. Our business had a problem with a Medicare glitch last fall. (Medical related business, Medicare's fault). We were unable to make our December payment. We were put on a "modification plan." Now my story may be a bit different than some. We've owned our home for over 8 years, and have never been late on a payment. Our loan was sold to these blood-suckers when we re-finaced 3 years ago. I don't know why we have a sub-prime loan servicer?? Our intrest rate is 5.9%! We never had a sub-prime loan to start. Our original loan was through GMAC. So go figure. Anyway, we made our Janury '09 payment as scheduled. Note: Told that we could only make an electronic check payment over the phone with the "plan". So we make our February payment. No problem...right? WRONG! I get a letter that I've defaulted on my modification agreement because of an NSF payment! WHAT??? I gave the woman my account number TWICE. She repeated it back to me TWICE. So this idiot uses an OLD account number they have on "file", that I used about 2 years ago to make a payment. It's obvious to me that this was deliberately done as to put me in default. The reason I say that is because I have a 1st and 2nd mortgage. The 2nd mortgage payment went to the correct account. But the 1st mortgage payment didn't. You decide. ASC "verbally" admits now, they made the mistake. But all the letters I'm getting, indicate otherwise. When I first called, I was told to call back in 3 days, as my problem was being looked at. I called back, and was told to call the next day, and re-make the payment again. I called as told...and was told my payment would not be accepted. "You're loan is under review." And to make matters worse, everytime I call...I go through the whole process of explaining again. Seems everyone that works there is a frickin idiot! Now my loan is still under "review". I've already recieved a certified letter that I'm in the process of being forclosed on. Then I get another letter stating I owe 6800 dollars by March 31st, and a payment of 1600 is due on April 1st. And that's just for my 1st mortgage! Nothing short of extortion. Then I, out of curiosity, ran a credit report. My credit report states I haven't made a payment this year! Also reported that my balance is over 7K more than it should be. I spoke with an attorney, and he indicates that we're basically screwed! So much for legal advice. I called ASC and asked where the payments I made went?? The woman didn't know. REALLY?? Oops! The supervisor handling my "review" is out of town for a week! Ain't that a frickin coincidence!!
Since we don't have much equity in the house...I'm walking away. We already have another home on an acre of land that's paid for...and not in my name! ...so I'm fortunate not to be homeless! ASC can kiss my ASS! I can live with screwed up credit..my wife's is great. I bet all that work at ASC sleep like babies evry night. I know I will. I hope evrey moron that works there loses their job when the government buys Wells Fargo, and divides it up. Happy Trails ASC!

I bought my home in October 2005 with an adjustable that resets in 2 years. My original payments were $980 and are now $1300 at 9.5%. I fell behind in the summer of 2006. I never did catch up. Every month I pay 30 days late but always send a payment. I pay by telephone monthly. They have offered I do a modification but I have not yet taken advantage of it. Thank God I haven't when I consider what I've been reading on here! My original lender insisted my loan was not subprime but it appears ASC may be subprime? Anyway, it's still a conventional loan and I need to refinance with someone else. Until then I'm stuck with ASC and praying I don't experience what you all have.

Something is seriously wrong here!!! I've been in the loan modification process for 4 months, call every other week, told still under review, then just got the summons that the foreclosure process has started out of the blue. I have a pamphlet from them stating How to avoid foreclosure, which I followed, and they are still moving forward with notification or decision on the loan modification. This is crazy. Something has to happen.

About a year and a half ago, I fell behind on my mortgage, but I found this company worked well with me when I discovered my home was in default. I paid the extortion fees... aka... lawyer's fees, and the messed up part is that I had a modification in place 2 weeks before these morons even sent it to their lawyer, but I still got charged lawyer's fees even though the lawyers did nothing because a payment plan was in place. Anyhow, $6,000 later, and I was back on track. BTW, my house NEVER went into forclosure, but I get charged the fees for it... after reading all of the above.... what are the odds of that? Well, my homeowner's insurance company (American Family) made a unilateral decision to increase my homeowner's insurance annual preimum's by 55% in one year, and never had the audacity to notify me of these outragoous increases. To make a long story short, I hired Farm Bureau to take over my home and auto insurance in Sept 2008. I went to Iraq, and when I get back in Feburary, I get this letter from them that I have no homeowner's insurance. WHAT?? I called Farm Bereau and I'm told that ASC faxed them all my info, State Farm sent them the insurance buinder, but ASC never made the payment they were suposed to that is in escrow. Here's the funny part, ASC has this "default" homeowner's insurance company that, if you read the fine print they eventually ended up sending me, basically states that my home is pretty much only covered if it burns to the ground. No theft, acts of god, ect. And as an added bonus, of course the cost of this is bouble what is average. What a bonus to both companies hu? Well, I get this letter in the mail stating that I now owe them an additional $154 dollar "fee" for letting my homeowners policy lapse. I called ASC, and I admit, I was an asshole because I went from calm to pissed off when this customer service operator told me that in all the account notes, I authorized the change and payment, and she could not figure out why this was not done in the first place. She took notes on this account and I was told that they would get re-in touch with my insurance company "Within 24 hours". Well, 3 weeks later, these morons finally made a phone call. I continue to call, and I'm blown off. So I said fuck it, the last time I called I recorded the conversation. I was then told to call back in 7 days, which I did, and 3 weeks later my "fee" is still under review. Fuck these assholes. I'm taking these tapes and I am filing a complaint with the states of Kansas insurance commisioner's office for fraud, and the BBB. They can tape record for quality assurace, I can tape record to screw then to the wall. I'm going to shove that $154 fee up their ass. Then these assholes added $180 a month onto my monthly mortgage payment because my escrow was supposedily behind... and this for a period of 36 months. Let me do the math here... $180 X 24 = $6,480... that is 2+ years of my annual homeowner's insurance preiums, and my state/ county property taxe's combined. Amd let me get this straight, they have a year's taxes and insurance when the loan starts? Must be nice to screw people like that, and not have to pay them interest on that additional money that we all know they are making intrest on. Nice scam morons. So fuck it, they can now deal with my mountain of documentation, with my tape recordings, and the insurance commisioner's office. BTW, do the research online... last year alone, ASC had 300+ complaints filed on it from the BBB consumers. ASC resolved slightly over 100 of them. Nice stastictis folks. I'll be sure to include that information with my packet to the insurance commisioner's office as well. But I do detect a common theme with all of the above complaints, These people need to be stopped. All I can say is they never should have had the audacity to charge me $154 because some fucking moron can not do a job they are paid by this company to do. Now it's my turn to play their games !!!!

Please all of you that are commenting contact me my parents are going through the same situation and is in the process of sueing these people. We need all of the complaints on them that we can get. I would really apprieciate it my parents hired a lawyer and your resposes can only help thak you so much and good luck to all of you and your fight with these people.

I too have ASC and are in a forbarence aggrement, we made two payment and the third payment which was set to be collected electronicially never went through, they r stating that our bank information was wrong, when we called a day before to verified ,now they're stating that we broke our promise & contact , which that is not the case, and now they are salling r home next month ,we have a lawyer that was working on our case in the beginning with ASC but he too does not return our calls.

I guess I'm in the same situation as all of you. We have been trying to work with asc. They told us about a modification loan program, they requested paperwork which has been sent and faxed and I have proof of when it was sent and that it was received by them, now they tell me that we are in foreclosure because we have not sent the paperwork they requested. I say we find an attorney and file a suit against them. Please feel free to contact me.

I am grateful for all the posts on here. My loan was resold to ASC and I fell behind 2 years ago. Still not caught up. 31 to 89 days late but can't catch up. You have to be 3 months late (90 days) for FC to kick in. I've been fortunate to avoid that but every month I pay by phone and listen to their speech about forbearance, modification, loan assistance, etc. I say thank you for the info, make my usual late monthly payment. They send their forms asking for new financial information on me which I have not filled out. I don't know how I will find a lender to approve me for a refi but I'm looking. No modification with ASC for me. What pisses me off is I was told my conventional loan was not subprime. But I think it was sold to a subprime lender.

GO TO YOUR COURTHOUSE!!!!
Before you file a lawsuit, please go spend some time in your local Courthouse and most will have a "self help" room where you can search for and print out cases that are currently being heard. I searched under MERS and Wells Fargo and US Bank and there are hundreds of them...use the Courts to fight for your homes, the Banks will never help you...they want your house because they LOST THE NOTES in some 60 million loans that the banks ran through MERS and it's paperless registration system...Educate Yourselves!!
