Saxon refuses to take my payement and they are foreclosing

May 05, 2008

The foreclosure was filed just last week about 5 days ago... I don't want to loose this house... the reason for falling behind is two fold.. the refinancing into a fixed rate was not disclosed to me as being $400 dollars higher then we where paying until it was too late just over a year ago.. and September my son was admitted into the hospital and we've been forced to pay everyone since we did not have the cash. This is turned into a mess when I tried working with them in September and I still could not make those payments. I would really like to refinance the house but no one will touch us now. They have also refused payment from two checks that I currently have. I don't know how many more have been refused... having just found out about it. thank you!

Saxon mortgage sucks bad. I went with them a few years back and I regret it to this day. I got an arm to save my home. The key word being adjustable, up and down with the prime rate. Those bastards have only raised my interest rate. The prime id 5.5 and I am now paying 11 and just got a letter telling me its going up again. Something should be done about companys like this.

I have saxon and my home is also in forclosure. I began a process for a loan modification in June. Since then they lost my paper work 3 times, assigned me to a work out person that was promoted and does not even do loan modifications anymore and now I am still waiting. My house will be getting a sale date soon and my name should be smeared in the local paper as well. These people are criminals. What can we do though?

I started with Saxon back in July, well i kept calling and calling and they said they did not have my paper work I had a ARM rate increased. I thought Saxon would help me i just got the run around. One rep said once my paper work was received it will take 15 business days, well i called and called and on Sept 25 my paper work was assigned to a Nelson Williams who would not answer his phone nor return phone calls. After calling for weeks and months Saxon told me my house was in forclosure so i call Nelson of course he did not answer i lefted a very upseting message for him because i've been trying to get an answer from Saxon for months and what he came up with is that i send them all the money i have saved up and then pay my regular house payment and in March the amount that i'm behind will be due in March and them i can modify my load. Well i was so upset and depressed that i sign the papers and fax them to them. Well after the Zoloft kicked in i said to myself that's not helping me. I'm still paying the high mortgage i can't afford. Now i have to gave them this money i left messages with Nelson Williams and talk to other reps and they said if i don't pay them they will forclose on my house. I have contacted NACA and they have come up with i very good payment and they need to send it off to Saxon to approve. I just don't have the time because Saxon dragged they feet now they are rushing me. Want should i do.

I was told last nightfriday 11-14-08 that the 1888 325 3502 loan modifcation number is just a intake # (saxon mtg SERVICING side) and could take 45 days for them to look over our 'faxed' paperwork to see if we are elegible for modification then it goes to their loan origionator dept saxon home mtg 877 967 2966 to rewright our loans if approved per our servicing info. If you recieve The 682 647 4000 as I do 4 times a day it IS a BOGUS automated saxon?computer phone number that serves no perpose.It tells us to call them. I got the call 1 hour after speaking to a so called saxon rep. Saxon will not give you a assigned person to speak to till my certified letter time runs its course 11-27-08. (so then they can start adding the fees I suppose WE IN MS CAN BE FORCLOSED ON FASTER THAN OTHER STATES AND THEY KNOW THAT! COMPLAIN EN mass to FCC about this nussance computer reminder call. I will be tonight or monday for sure. Publiccommision too?this is Harrasment!! LETS ALL GET TOGETHER my fellow mississippians NOW there arent enough complaints to our state for their preditoral lending . Contact the rural legal services mine area is outta Oxford ms. I hope that they will see me.I called HOPE 2 weeks ago still waiting for call back .the legal service is state/university of MS learn/teaching from cases. IF WE CAN HOLD A PRESIDENTAL DEBATE in OXFORD WHY CANT OUR FUTURE LAWYERS of MS FIX THIS HUGE PROBLEM FOR OUR FELLOW CITIZENS THAT HAVE BEEN BAMBOOZELED BY THE preditory Saxon like lenders that buy the mtgs from the 'SOUTH POINT MORTAGE COMPANYS'and others in the state that origionated these loans. the interest rates charged on us are so high just cause we are poor or have medical bills ETC. I mentioned that we need a blog for us all to connect on live!He said he would look in to it.He has the exact same problems as you and I. call him if you dont believe me!there are over 11,000 complaints so far as we have found. We have to band together--all states!!All complaints to our to our attorney generals congress etc and maybe even go to washington in person. We payed our mortgage regularly and were on an Arms, fixed for 2 years. We were going to refinance in October of 2008, as the Arms would off the fixed interest. Last Decmber of 2007, still paying in timely fashion, but we were on year late in our property taxes. In oregon you can go up to 3 years late, and then if you pay one year, you keep your house. We were planning on paying the prop taxes at the time of refinancing, this october. But in December of 2007, without our approval, Saxon paid 6000 dollars in prop taxes and added it to our monthly mortgage. This turned our $2200 mortgage into a $2900 mortgage. We told them we could afford that. We sent them the regular $2200 and they returned it. They did that each moth and finally we were months behind in mortgage that they wouldn't accept. They started foreclosure. We tried to negotiate and never heard back. They had us fill and send a negotiating package 4 times over 4 months. Whenever I called they said that someone from resolutions would call back and I never heard back. Finally, a couple of months ago, we got a notice of intent to sell on December 1st of 2008. Again I tried to call and negotiate and was repeatedly told I'd be called back, to no avail. They told me to ask for an extension and negotiation 72 hours before the sale date. But yesterda, 9 days before the ssale date, they called and told me my "loan modication was rejected" They also said I cold file an application for other options such as "short sale", "Deed in Lieu", and "money for key". BUT they also said it wold take at least 10 days to get into their system, and the sale of the property is supposed to be in 9 days. The first notice of sale I got was from Saxon, but the last one, 2 weeks ago, was from Deutsch Bank. I am truly at a loss and don't know how to prevent my family to be evicted in 2 weeks, during the Christmas Holidays.

My morgage was sold to Saxxon a year ago and I have made every payment, but last July they started billing me for taxes and Insurance that are paid for by me and now have screwed up my credit showing that I have 2 30 day past due payments. Now I am laied off from work longer than I was told I would be I call Saxxon 2 weeks before my next payment was due to work out my lack of funds to make a full payment for November and I was told "Sir Saxxon does not take partial payments and if you send in a partial payment then Saxxon will return the money to you and start forclosures on your home. I am researching on the Law in Michigan Refusal of a payment is legal grounds for a debt. The law use to states if a lender refuses a payment of any kind. meaning returns the payment not hold on to the check you are no longer responcable for that debt. I need to validate this. I just recieved a call from Saxxon Teling me that if I do not make a payment in the next 4 days they will start to forclose on my house. I went with a local bank "Benificial" and they seem to want to help me out offering me 5.8% fixed and working out a plan to pay my house off early using Bi-weekly payments. I feel we should all get together and form a class action law suite agenst Saxxon for Illegle pratices.

SAXON pulled a fast one with me, too. The refused to accept payment and mailed checks BACK to me! Then they foreclosed, and 10 days later had all my belongings hauled to the dump! They suck.

I understand where everyone is coming from. My husband and I have been fighting with Saxon Mortgage since early 2008. After falling behind on my loan we wrote and faxed them a letter of hardship. I explained in the letter the reason for falling behind and asked to to be able to send them $600 for the next two months to be able to catch up our loan. At the time we were paying just over $900. I made 3 weeks of payments in the amount of $600 and then started to receive letters from Western Union stating that Saxon was returning our payments. I ended up contacting and paying a lawyer because at that point no one wanted to talk with my husband or myself. Finally in July of 08 after my home was put into forecloser and our names made the local newspapers for all the wrong reasons we were able to come up with a repayment plan that we really could not afford but had to make it work to save our home. We were to put $7000 down which is what I had mananged to save since they were not taking my payments and then pay $1411 each month for 6 months. In Sept. we went through 2 hurricanes and missed my payment date by 9 days. I called the day I was making my payment (western Union) and spoke to Bertha she said that we broke our contract and would need to be put on a repayment plan again for another 6 months. Today I called to let them know that I would be sending my payment this week and a nice young lady told me that I had a 11 day grace period !!! I asked to speak to the forecloser dept and was lucky to speak to Bertha again. I explained that I wanted to discuss my Sept payment with her and she stated that she could not speak on payments made that far back. Once I was able to speak I explained what the young lady had told me and she said that it was not 11 days but rather than 10 days. Nonetheless my Sept payment should have been made on 9/11 but was made on 9/20 (9 days later) and they put me in yet another repayment plan that was and is still almost $1600 a month and will not be completed until March of 09. At which time my payment has now raised because of the ARM to over $1000. They are killing people. Any suggestions would be greatly appreciated.

Saxon is the worse! They don't care about people all they care about is money. They have lost my paper work twice and now tell me, after telling me NOT to send payments until the paper work is reviewed all this time, that my house is due to go to auction as of 2/17/09! I think a Class Action Lawsuit is what needs to happen to Saxon! Any takers?

Saxon has been saying we were approved for a loan modification, the paperwork has not been sent- 4 months later and now on their website it says we are in foreclosure but when you call customer service says it is not in foreclosure

My Husband and I have been fighting with Saxon Mortgage Services since May of 2008 and they have turned us down for a loan modification 3 times now and the last reason is they say we make and excess of $6000.00 per month and do not need it. My business was robbed last year of almost $100,000.00 in inventory and we can bearly make ends meet. With this hardship I hoped they could help, we love our home and want to keet it but they want to steal it. I am in for a class action Law Suit. I have demanded they give me the original note we signed when we got our loan, will see if they can come up with it. One letter says Deutsche Bank is our lender so I have also sent them a letter of demand. I will pay who I owe but need my loan modified. They can not ever tell you the truth and it is a circle that will never end.

ok i'm on my 3rd loan mod the last mod Saxon inputted my finincal info incorrectly, so i had to refax. My house is up for sale on April 27, 2009. I just don't know what to do

We were two month behind on our adjustable rate payment when I tried to get Litton to modify our loan and all they did was give me the run-around! I couldn’t believe it when the guy on the phone actually said that my family shouldn’t eat so much because then we would spend less on groceries and would have more money to make our mortgage payment! What a jerk! He also said we should get a cheaper car and a bunch of other stuff that was really rude. Come to find out the loan modification they were going to give us was a just Forbearance Agreement and all it was going to do was add the payments we were behind on to the back of my loan. Since our interest rate was going to stay the same, this would actually make my payment go up! THAT’S what got me into this mess in the first place! My payments are too high! This whole thing was keeping me up at night worrying about what was going to happen to us. I told my friend at work about this and she said I should call the loan modification company that got her loan modified down to 3.75% fixed interest rate! I decided to call them, and in about 45 days they got my interest rate down to 4.35% and it’s a fixed rate too! The company is First American Financial Group and we are really happy with what they did for us. The website is, w. w. w. TheLoanModFacts . com. They owe us money for a hurricane repair we made many months ago. We have written
down the date, name of who we spoke to, what we were told on each call and will make
it known later in the week.

Does anyone know how to get someone at Saxon mtg. to respond??? I am trying to pay them money and I need a pay-off figure and I can't get anyone to fax a letter with the information I need. I even sent emails with a receipt, once they opened it I would get their personal names.....which I did. Still I can't them to respond even using their first and last names. Help!!!
