How do I negotiate with GMAC
May 07, 2008
I filed bankruptcy (chapter 7) last year. Currently My wife and trustee own the house. We are selling the house. however we got very low offer from buyer. My wife did not agree to sell the house. Now she wants to keep it. To do this. We need to refinance or negotiate to current mortgage lender for repayment plan or some kind of help to catch up the monthly payment. My question is: How should I negotiate to mortgage lender ? Do I need attorney ? Any possibility to reduce out standing interest amount ? Please contact me as soon as possible.

I have been trying to work with you(GMAC financial) SINCE SEPT 2008,But to no availe. I want to stay in my house, have been here 35 yrs or more and I am at wits end.We are a farm and have many animals that will be in desert,I don't care for myself but for them, they do not understand.Have tried to communicate but no one listens. Can anyone help??
Will GMAC negotiate on an auto loan or return ? How do I approach them ?
GMAC is using the ploy (diversion) of looking like they are working with you because while they are keeping you in limbo, they are receiving Govt. money to fulfill the requirement of "trying to work out an arrangement." The fact is that they have no intention of working with you using "insufficient income" as the reason. They use a 31% of gross calculation but it is based on the original loan payment, not a negotiate modification. They lie, cheat, steal, attempt to intimidate, and generally misrepresent themselves for that good old "Obama Money."

How do you get GMAC to work with you? Yes I did get as far as stoping the foreclosure however I did that on my own but had hired a miragitor to help me get the payments but based on what I had already set up myself was I able to stop foreclosure. In the mean time they are still reciving my money and haven't owned up to this is something I has stoped by myself. Now I still have not had payments lowered I have paid them 900.00 dollars and they send one message requesting some information like the letter of hardship and pay stubs and bankstatements and of course the money but they have never got anything done in the begining so based on what I had done by getting them to stop foreclosure where do I go from here to get payments lowered. It may be that I am not explaining myself clear so I totally understand if you aren't able to respond to this question.
Thanks, Sherry
