Can anyone help us with Taylor Bean and Whitaker, we need it
I work for the Federal Government; In traveling with my job, I asked a family member to pay my bills while I was away, so that payments wouldn't be late. Sadly, they weren't paying the bills but I didn't find out until it was too late. I've sent payments in to TB&W, trying to bring my mortgage current, but they sent them back - they won't allow me to bring the account current. I paid $196,000 for my home, they want me to pay $203,000 to keep it. I've contacted VA via phone and email. They promised to help but nothing is been done. We've contacted TB&W, as they asked us to and the attorney's office. We were led to believe that we would be allowed to pay what we currently have toward our mortgage (which is current expect for the month of May) but received a letter today, telling us they were going to list our home for foreclosure sale on June 3, 2008. The letter also stated that partial payments would not be allowed. That TB&W doesn't "trust us to ever pay our mortgage on time." We're new to Georgia; this is our first home. We don't want to lose it. We are good Christian people. We believe a miracle will occur - but we're scared to death.

I will never pay it.I purchased my home for $230k when it appraised for $235k. Now it's worth $133k. Because I only put $25k down we had to pay mortgage insurance for 1 year, then 2 years and now because the home value loss to equity it will never be discontinued. theres another $100 per month in those greedy peoples pockets.
That's what the meaning of predatory lending is......mortgage companies who give people loans that they cant afford (convincing them they can)and then foreclosing on them. Hey you wanna use TBW, thats cool, but if you think that theres a chance YOU might default, better keep shopping.

Mike, don't know your story well, it depends, you might want to get private advice besides a trustee, he might want you to sell to collect a huge fee...not sure, but maybe you should try NACA or another activist agency.

It turns out that TB&W had used my escrow money and purchased a blanket hazard insurance for my property. This is very frustrating because I've fax them my master insurance already (3 Times and also email them with attachment of the insurance plan) but they refuse to recognize that I already have my own insurance. I own a town house, not a single house so my unit was covered by a master insurance plan.
I'm very frustrated with them trying to resolve this issue. Any help or advice would be appreciated.

I believe most of us are in the same boat, except it doesn't flood in Arizona. I have an email into TB&W asking who the carrier is for this Hazard/Flood insurance and why do I have it if my homeowner's policy covers hazard.
I also got charged additional money (through their handy time payment plan,)because they miscalculated my escrow funds and have to make it up.
So from starting out at $1.300 per month it is now over $1,600.
We made all 2+ years of payments on time and was never allowed to discontinue the MGIC Mortgage Insurance premiums at $90 per month. I guess it will come down to TB&W getting paid from that insurance when we default because we can't keep this up. The aggravating part is we made the mortgage insurance payments and our credit will be trashed anyway.
By the way Dave M. It is HUD or FHA that requires certain properties when to be found on title as a flood zone. So... to have flood insurance once again NOT the lender.
Now, with that said. You all need to remember why ALL companies are around. TO MAKE MONEY!!! What a concept! I don't know about all of you, I don't work for free EVER!!!! I also take it all of your car companies or any other creditor are bastards for repossessing your car because you didn't make that payment either?

I feel there is no need to deceive anyone as we are here to share TB&W information and experiences. repoman may not use his/her real name, but seems to be one of these and it is hoped like me & others contributes positively. I have offered: TB&W will recind late charge fees if you are right/just and are persistent and that their customers are not alone, such as angry and frustraited's dilemma in that escrow money was used for hazard/flood insurance without our knowledge.
Checking with MCFCD (MCFLOOD), I do not live in a flood plain or pathway. Nor do I have an FHA or HUD loan. I am disputing the Hazard/Flood insurance now. It is something TB&W tacked on in the 2nd year of our mortgage. I found repoman's information logical and worth checking out. The combined $300 increase per month is my concern. I can't afford it even though I took increased taxes in the future years into planning and consideration when we purchased.
It is almost Christmas and time to reflect on the year and the challenges and gifts we have been given.

I would not trust Taylor Bean for anything they make alot of promises that they do not keep. I am sure you are getting ripped off somewhere. Has your house payment changed? It is normal for most of your payment to go to interest. Just beware. I would recommend to everyone to refinance with someone else. Good luck to you.

I hate to tell you, but they're a joke. All they do is take down all your mo. income, mo. bills etc and fwd (sometimes) to TBW. I've called them on 2 different occasions, the first time TBW "said" they did'nt receive anything from HOPE NOW. the second time, was just as unhelpful. TBW has there own financial work sheet that you fill out, along with a hardship letter. Anybody know if this law that is trying to be passed that will lower mort. rates to 4%. Is it for the people who need it, or is it for future buyers who are already getting a great deal from our misfortunes...foreclosure sales are a big portion of the Realtors listings these days.
I recently called TB&W to let them know that my husband’s job is cutting their hours and if this continues we will not be able to make the whole payment on March 2009…And the customer serv. Rep. asked me if I was working and I told him that I wasn’t because I have 2 kids and 1 baby at home….and he told me if I have ever consider childcare…so, I told him that my mom used to take care of my children while I was working, but she had a silence stroke, so I had to quit my job…..and childcare will not work for me, because I will have to give my whole check to them and I wouldn’t have enough cushion to help my hubby with the mortgage payment or gas for my car to go to work back and for….But he kept telling me to look for another job…and I told him that my husband is looking for a part time at the airport, but so far, he has not receive any response….and he kept asking me how about you….
And that gave me the feeling that he did not care about what I was trying to tell him…..Like having 3 little children at home was not a concern to him…….
So, he told me that i will have to way 6 to 8 weeks for a response, but he will not guarantee me that I was going to be help…..So now that i have read all your comments, I am getting very depressed…..I really want to keep the house…I need a place to live for my babies…..:(
It's very sad to know that TBW don't care about people's situation and they will not work with you to help you keep the house....It's a very stressful situation and my 6 years old can sense all that....She is worry that we might not have a place to stay....We already cut down in food.....and now our dryer broke down...What a joke!!!.....Thanks

I auto pay my mortgage payment every month and have not ever had a problem until I got my year end statement. On that statement showed charges for property insurance for last year and this year which makes my account about $6,000 deficient. My payment jumped up $500 a month!! I already and have always had property insurance through my condo association which I have proof (and they have received proof). I have been calling them continuously for the last few days and get nothing but "All circuits are busy". I am a single mother on a fixed income and it they don't correct the charges I am going to lose my condo! I am scared! What I am going to do is research about this and get all of the information and I am going to go to the local news here in Tampa. What I am getting from the post here and even admitted by an x-employee is that they are fraudulent in there charges and they should be accused accordingly! i have done nothing wrong and I am suffering because of it!!
AFS is not TBW and has no relationship at all with them. This is only an information site to try and help people.

needless to say they didn't and I am still 2 months behind and it is only making my credit worse.

I called TBW's 800 number and I either get a recording the number has been disconnected or a busy signal. (888) 225-2164.. The only way I got thru was calling the long distance number 352-671-0250.
I found the automatic payment number on TBW's website. BillMatrix Phone Check System:
1-866-680-5509. That is the direct line to pay the mortgage instead of dealing with TB&W's phone bank.
It appears to me TB&W doesn't like to talk to customers. I called various times and the hold time is consistently 58 minutes. Its like they have an automatic hold. And make you wait 58 minutes before you can talk to a real person.
I asked about the Mortgage Assistance Program and got blown off. I am having SOME problems making my mortgage payment and I bust my butt every month to make it within 30 days. They refuse to work with me. I am not in foreclosure, but my hours got cut with my job. I am going without groceries and doing my best to make sure TBW is paid. I am on a Debt Management Plan with my credit card debt. I have a high Debt to income ratio.. But TBW says they won't help me. They tell me they have enough people to deal with who are foreclosure or pre-foreclosure than worry about my situtaion.. The problem is my fault. I got into this financial situation on my own.. but if there is federal help available to lower my payment or rate for at least a few months till I can get my hours back again.. TBW should work with me. Afterall, they are receiving tarp money to help people.
As far as my hours being cut, not my fault.. But The hours are coming back and then some.
I don't want to take too much advantage of the system. My wife and I are still full time employed, we have insurance, and there are people in much worse shape than us. Right now I view my financial situation as a short term problem. Its funny TBW won't give me the time of day to work out a short term solution and make me current so I am not 25-26 to 30 days late.
I am appalled that this administration has not stopped these bottom feeders to prison.I campaigned for Obama .I am a republican but the attorney I work for convinced me that Obama would be the answer.Should I regret that decision?It's only been a few months.I have asked for a deed in lieu of foreclosure but have not gotten a response in 5 weeks.!!!!!!

If you have an FHA loan contact the fha people and explain to them, if you can afford the payments but just got behind from some reason then they will contact TBW if your are denied a modification.
Also, if you are served forclosure papers from a court then please write the court a letter with all copies of what you have sent TBW and a list of all phone calls ect. This way the judge will not grant the foreclosure until TBW or their lawyers have to respond to your "response" to the judge. Also, write the same letter to the lawyers that they hire and include a page that says you are disputing this legal action! It will hold off the legal eagles for a little while also while they have to contact TBW to get more information.
We have not made a payment since September 2008 but have been calling them and sending everything that they have asked for since September 2008 when we realized we could not make the payments.
This is what I have been doing, we were told the modification was denied, but we just resubmitted the financial papers showing a few revisions (got rid of a debt) and now we are waiting again....we were told it could be as much as 10 weeks before they get to the new financial papers that we submitted. I realize that most of this is probably a futile effort but I'm putting them into the position to have to work it for all I can get!
I too cannot get anyone to answer my calls or return calls..always on hold for over 45 minutes for every single phone call I make to this company!
One email was returned as undeliverable, but all others were received. I even received an auto response that I would be contacted in 24 hours. I was contacted almost IMMEDIATELY.

We have been trying to "work" with TBW since October when my husbands job went down. So far we have sent them every paper they have asked for, every paycheck stub..ect...Our HUD couselor even sent them everything twice! (they said they never received it!) After months and months of being on hold for over an hour, and being told to just be patient because they are back logged, guess what? We got papers served last week that we are being foreclosed on. They never told us this, they just contacted their lawyer and said to file. I'm so upset, mad, ect. After all this time of asking for loan modification they do this to us.

It is now May 1st and we STILL have not heard any good news. Every single phone call gets the same answer "no one is assigned the case yet". I recently got a job and we submitted my paychecks but who knows if that will help at all? Probably will push it off another few months. I wanted to comment on the people who had the insurance and tax payments problems..we also went thru that mess and the insurance that they put on our home was 2,000....AFTER our insurance lady faxed our papers to them 3 times! Our assesor told us that TBW is the only company that she knows of that does the taxes in a different way than all the other banks. Since we have not been able to get a modification yet or make payments I'm figuring our insurance will have to be paid out of our pockets (which we can do) but it's just the crazyness of all this! I need to call them again today....it's been a week, but I know what the answer will be AGAIN!
3 Weeks ago an "Amy" told me to list the property for 90 days to see if we could short sale it. I listed it with a Remax Agent and I have had 3-5 showings a day. Last Saturday, April 25, 2009, I recieved a letter from a Boston attorney indicating that the foreclosure sale is on May 29th. I called the attorney AND Amy four times thus far for clarification. My realtor has also called three times. I just don't get it....if they are understaffed....I'LL TAKE A JOB! I'm so exhausted with dealing with them....

Very interesting that TBW would contact me NOW. When I submitted a loan modification solution through NACA, nobody responded and finally rejected the solution. TBW RESPONSE:
I am not in the Loss Mit Department so I can only comment on the options that we have her in this department. We have only been doing the interventions for about 8 months now. Prior to creating this department I worked with the Origination center as a loan officer. I am still considered to be an originator but it is a little different. As an originator on the other side I would tell some that calls in that we could not help them if they are delinquent. On this side as originator it is my job to make contact with customer that have gone through the Loss Mitigation process and been denied. We have most of the same guidelines as a normal refinance but because it is not normal circumstances we have look at it differently, which opens doors that can be accessed by Loss Mitigation. All we can do is try and if you have income the possibilities are there despite your scores.

I think TB&W are scrambling to get all the money in that they can before the Congressional Investigation starts. Anyone have any other news on that? When it's going to start? Who filed it?
I have also been told that we don't need to file a class action lawsuit....we need to file a "jointer" federal lawsuit. I'm not sure if that's the right term or not. Sandy is the one that told me about it.
The difference between the 2 is that in a class action lawsuit you have to have 200 or more people to even file it if it's not contained in just one state. Only 40 needed if in one state. The case is looked at as a whole and ruled on as a whole and you can't add additional people to it once it's filed.
In a "jointer" (again not sure of the term) there is NO MINIMUM amount of people needed to file and the cases are looked at and ruled on on and individual basis also..new people can be added at any time after it's been filed.
So we need to turn our attention away from a class action lawsuit as the Attorney's are the only ones that win in those.
We will not be able to find an Attorney who will take the case "pro bono".
My attorney has admitted that he is a small lawyer in a small town...but he was willing to take on our (my tb&w issues) case. I'm not sure how far he's willing to go with it...but he's mentioned class action as well.
I will find out more from him today as we go over TB&W's latest effort to screw us over.
What I would like is a complete list of names so we know how many people would like to get involved....SO EMAIL ME OR JOIN THE FORUM BY CLICKING ON MY NAME PEOPLE...let's get this ball rolling.

I would call Hud even if you dont have a FHA loan. Try to get a hold of a local branch of hud but usually they make you deal with the 1-800 number. I too had problems in the middle of escrow and took me some time but I eventually was able through the 1-800 hud number to leave a message and they called me right back and had TBW pay me money at closing. Then they later screwed up again and yes their customer service is a joke. So I called HUD again and that got their attention again. Even if you cant speak to someone at HUD, call a TBW contact and say you got their number/name from HUD. It perks them up. HUD hates TBW, they told me of all the problems they have, wish they would post that on their website for us tax payers who support HUD to have that knowledge. Government's true purpose is to protect the rights of the people. I know its easier said than done but it can be done. I did it! Just don't be afraid to be one hell of a pesky B***
The other federal lawsuit that Sandy mentioned (jointer?)is completely different and has NO MINIMUM amount of people that have to be gathered to file...people CAN be added after it's filed...and it's looked at and ruled on on an individual basis. Each persons file is ruled on accordingly. I'm not sure if it has the same requirements as the class action as to everyone having to have ONE common factor though as I haven't been able to find any information on it.
I have been in contact with a lady that says she has found an Attorney in California that is interested and is already involved in a case against Countrywide and Bank of America but he says he would like to talk to peoples Attorney's and would need to find that "hook" that unites us all and against which we can file. I will get more information on this Attorney and pass along the info.

44 Count Indictment Returned Against Warren
Christopher Jared Warren, 26, Folsom, California, and Scott Edward Cavell, 27, Sacramento, California, were indicted on 44 counts of wire fraud, money laundering, passport fraud, and aggravated identity theft, related to the theft of more than $7 million from a mortgage lender and the purchase of millions of dollars of gold that Warren took to Lebanon.
The indictment alleges that Warren and Cavell used their Sacramento mortgage brokerage, Triduanum Financial Inc. to steal more than $7,000,000 during a two-month period, from December 2008 through January 2009. The indictment describes how Warren and Cavell misrepresented many facts to lender Taylor, Bean, and Whitaker Mortgage Corp. ("TB&W") of Ocala, Florida, in order to make Triduanum qualify as a "correspondent lender" with TB&W. As a correspondent lender, Triduanum had authority to approve mortgage loans by "locking" loans and then selling them to TB&W, the "sponsor" lender. Triduanum was responsible for verifying the accuracy of the loans and for complying with money laundering laws.
The indictment describes how Warren and Cavell, using Triduanum, approved mortgages, but instead of funding the mortgages and recording the deeds, the two simply stole the money TB&W wired from banks in New York and Alabama to River City Bank accounts that Warren and Cavell controlled. Altogether, they stole more than $7,000,000 from 28 wire transfers.

They told me that I needed to call my own Attorney Generals Office and speak to someone in the State, County and Local Consumer Protection Dept, which I did. They did tell me that my complaint had been filed and I would hear something back from them within 15 business days. They told me to call back next week to check on it and definately call back if I hadn't heard from anyone within the 15 business days.
I decided to go one step further today and called my Congressmen who happens to reside here in our town. His wife teaches at my children's school. I wasn't able to speak to him directly today, but was put in contact with one of his aides that took all my information and assured me that it's definately going to be looked into. We spoke for quite a long time. By the way Wanda....they DO read the rip off reports....he actually read me some of one of your posts.

HUD can't really do anything except for give you phone #'s to foreclosure help agencies, which TB&W aren't willing to cooperate with (at least in our case 2 seperate ones...no results). TB&W will drag it out to the point where they literally force you into foreclosure just as they have done to myself and many others. Go to rip off report and share your story. Contact any government officials that you can. TB&W isn't going to fix this for us. They are going to have to be forced to fix it.

Looks like TBW (That is Farkas/Bowman) may be eligible for TARP funds. So while they cash in on funds from the taxpayers (you and me), they foreclose on the very taxpayers homes that they are getting TARP funds from.
I jsut hope after we get straight with our mortgage we can get away from TB&W. They are useless. My MIL's sister has been trying for months to get a modification and TB&W has no idea what they are doing... Good luck.. A lady named Heather Bell did ours at Sparta she was very nice...

On a funny note;;;;; TBW told my husband that our home was up for sheriffs sale in mid august...THIS WAS BEFORE THE PAPERS WERE EVEN SEEN BY THE JUDGE!!! Where do they get thier information??? This has been so frustrating! So now we have to see what their legal team decides to do...drop it or pursue it according to the court order.
Don't give in people when the papers are filed! Your judge does not have to grant the foreclosure..We are proof!
i have called hope hotline, fha hud, nj mediation i have gotten teh same respinse from all these hot lines, that you must be in forclosure with a docket number to be considered for help. they told me my lender is the only one that can modify the loan, but it doesnt help when i cant get someone on the phone... this is a night mare,,,,
About the troll from Ocala Fl who commented "we should find jobs". Sounds like one of the Customer Service Reps I talked to a few weeks ago. Most of us want to pay TB&W in good faith. Some of us just need a helping hand during a tough period of time. We do intend to pay back every single penny we owe. It is sad these Bozos are taking Tarp money, and aren't doing anything to help their customers. It seems they want to do everything in their power to foreclose on FHA insured loans.
argh!! I put $60K down on my home. I lost my bigger income due to economy woes, now I work for Walmart-onlty decent job in town, and earn $1900 a month. My monthly mortage is $1500. They better get me a mod soon or they can have another foreclosure~ they give me a runaround, promise every week to call me back or email me ---never do! One rep even told me to stop paying my mortgage to "get attention"!! Great loophole advise, huh? I dont like TBW.

I'm shocked and distraught over all the complaints out there about TB&W and pray for every last one of us. If this has even just begun happening to you DON'T WAIT! SEEK REPRESENTATION IMMEDIATELY! & TRY YOUR DAMDEST TO WASH YOUR HANDS OF TB&W. Don't even waste your time trying to call them. Even if you work something out you'll be forclosed on or your home auctioned before they even process anything not to mention how much further you'll fall behind on payments waiting for them to process anything.
i have called HOPE hotline, FHA, HUD, NJ mediation, making hoem affordable, and bottom line they all say the same thing unless your in foreclosure we cant help you, BUT if I do go into foreclosure IT WILL BE TOO LATE...so, i have written to the BBB, NJ dept of banking, the FL dept of banking, to FHA, HUD, the congressman, the whitehouse, US Dept of justice, RESPA, And also the Dept of consumer services in FL. I wrote a long letter detailing the poor customer service that we are all familiar with concerning TB&W. I submitted to various elected officials and government agencies. The Florida Office of Financial Regulation responded and directed me to submit my complaint to the Illinois Department of Financial and Professional Regulation. (Attn: Consumer Affairs, Division of Banking, Suite 1900, 122 S. Michigan, Chicago, IL 60603). The explaination is because my property is located in Illinois, jurisdiction falls to the state where the mortgaged property is located, not where TB&W is based.
Also, the Office of Illinois Attorney General Lisa Madigan responded and asked me to submit more documentation (tax returns, correspondence, bank statements ...) for review, so citizen's advocate there can determine if my dispute lends itself to mediation. through the Attorney General. I'm submitting that package this week.

The Illinois Department of Financial and Professional Regulation was among the parties I wrote to concerning Taylor, Bean & Whitaker's seemingly intentional mishandling of my modification application.
I received a copy of the July 14 letter that was also sent to Victoria Hanegan (no title) of TB&W. In it, Virginia Calvin, the Consumer Services Administrator for the department's Division of Banking, writes that a response from TB&W is required "to determine your compliance to rules of license in this transaction."
The Department is requiring that the mortgage company "send a letter directly to the consumer that responds to all issues of the complaint by Aug. 4, 2009. The response should be signed, written on official company letterhead, and the writer clearly identified. TB&W also must send that same letter to the department's consumer services section by the same date with supporting documentation.
"Your response will be accepted only if all is submitted as requested above. Failure to completely adhere to the requests of this notice by the above due date may prompt the following: A fine of $50 for each day the response is late, a noncompliance notation to our records, and/or the scheduling of a special examination at your company's expense."
A letter with some teeth in it is at least some payback for all the hours wasted while on eternal hold on TB&W's phone system. I've also got the Illinois attorney general looking into this matter as well after that office asked me to submit more information about my experience with this company. Pile on the letters about this rogue company by writing to your state's attorney general and to the office that regulates financial institutions. Some offices may respond that they do not have jurisdiction but if they get a flood of mail, that volume may wake up somebody in state government or somewhere to hold TB&W's feet to the fire.

those loans/modifications/special breavances that were aproved, were forwarded to bank of america. it will task 2-3 weeks before you get any paperwork from them. those loans that were IN PROCESS but not completed are on hold.

I wouldnt send anyone any money. If it was me. YOu wouldnt have any clue as to where its going.. If the feds are running TB&W we should get a letter saying that they have control and yes to send your payments.. I would not just send money to a known fraudulent company... but thats just me...
In my opinion, TB&W isn't "officially" a known fraudulent company. TB&W was shut down because of suspicion of fraud. To my knowledge, no charges have yet been filed, and you are innocent until proven guilty. (Although They appear Guilty as hell.)
They problem is by the time they are proven guilty they could have took off to Mexico on a casino trip with our loan payments.
But I would think this isn't a good time to be skipping loan payments. There might be enough snafoos with this transition and as long as we show, we are clearly attempting to send them a payment.. Then we are the victim and not them.

Taylor Bean & Whitaker Mortgage Corp. shut down Wednesday, two days after its offices were raided by federal agents.
The Ocala, Fla.-based lender, which hoped to infuse Colonial BancGroup Inc. with $300 million before the deal went sour, closed its doors today after it failed to reverse the Federal Housing Administration’s orders to cease making FHA-backed loans, according to a written statement.
“Regrettably, TBW will not be able to close or fund any mortgage loans currently pending in its pipeline,” the statement said. “TBW is cooperating with each of the agencies with respect to its servicing operations and expects to continue to service mortgage loans as it restructures its business in the wake if these events.”
According to the Wall Street Journal’s report on Tuesday, Taylor Bean failed to submit a required annual financial report and to disclose to the FHA “certain irregular transactions that raised concerns of fraud.”
Two days ago, Florida offices of both Taylor Bean and Colonial were raided by federal agents, which executed search warrants ordered by the Special Inspector General for the bank bailout program known as TARP.
The two offices, which included Colonial’s Mortgage Warehouse Lending Division in Orlando, worked closely together on a deal to prop up the bank with $300 million in capital in order for it to receive $550 million from TARP. Colonial's office is still open.
However, plans fell through last week because bank regulators did not approve the transaction before the planned close date of July 31. Without the capital, Colonial said its survival is “doubtful,” according to its recent earnings report.
I also read several rumors that TB&W, (either the CEO or the company iteself) also has owns several restaurants around the Ocala area. It is rumored that Tarp money may have been used to keep the Restaurants in business.. At which I believe that would be money laundering. Although I can't confirm that rumor. If anyone has any further information let me know.. Just interesting how fast these house of cards fell.

I think I will wait as long as I can to snail mail my payment. Send payment around the 20th using Priority Mail with delivery confirmation. Maybe if I hold out as long as I can with payments, perhaps I can get information who my new servicer is and a new address or instant payment instructions.
Just wanted to let everyone know it appears our instant payment options are no longer working. You might be out of luck if you wait until the last day of the month to do a telephone pay and find it doesn't work. Better to plan accordingly.
What type of loan do you have? FHA or conventional? Also at what point do you get an error? I can go all the way until the submit page with no errors and I have a convention loan backed by Freddie Mac. I know that the FHA loans are supposed to be taken over by Bank of America (BoA), but no mention has been made of the conventional loans. I intend to overnight my payment to them at the last possible moment. That way I will have a receipt showing that payment was sent. You can bet that even though TBW is out of business that someone will still be taking payments. Even with the shutdown, TBW still has "essential" personnel according to the local papers. I'm sure those roles are to keep some aspects of the company still alive like payment processing.

WASHINGTON | Billions of dollars the government is spending to help financially pressed homeowners avert foreclosure are passing through - and enriching - companies accused of preying on the people they're supposed to help, an Associated Press investigation has found.
The companies, known as mortgage servicers, are middlemen who collect monthly payments from homeowners and funnel the money to the banks or investors who hold the loans. As the only link between borrowers and lenders, they're in the best position to rework the terms of loans under the government's $50 billion mortgage-modification program. The servicers are paid by the government if the changes keep homeowners from falling behind on payments for at least three months.
But the industry has a checkered history. The AP found that at least 30 servicers have been accused in lawsuits of harassing borrowers, imposing illegal fees and charging for unnecessary insurance policies. More recently, the companies also have been criticized for not helping homeowners quickly enough - delays that lead to more fees for homeowners and profits for servicers.
The biggest players in the servicing industry - Bank of America, Wells Fargo & Co., JPMorgan Chase & Co. and Citigroup Inc. - all face litigation, some of which has led to settlements with homeowners. All will receive federal money to modify loans.
But the industry's smaller players, which specialize in servicing riskier subprime loans and loans already in default, face harsher accusations that they systematically abused borrowers.
"The irony is, in essence, the government is paying servicers to do their job, which is to do loan modifications where appropriate," said Kurt Eggert, a law professor at Chapman University in Orange, Calif. "And that's not a part of their job they were good at."
The government says it has no choice because the servicers are the only link between borrowers and the investors who indirectly own their mortgages through securities.

Decided to “google” search TBW --- Feds did a search warrant and closed the company’s doors!!!!
Did the Feds do due diligence to protect the legitimate customers…..absolutely NOT!!!!!!!!!! By law not suppose to hinder legitimate business!!!!!!!!!!! Do they care about the employees (with families & bills) and the customers affected -----OBVIOUSLY NOT!!!!!! Have to ask how many people (innocent TBW employees they put in hardship!!!!)….while they drive in their pretty cars and go to their homes and family with a pay check! Guess they are helping the overall economy and humanity. If they truly “cared” they would have taken these things into consideration!!!!!!!!!!!!!!!!!!!
One article states that Bank of America will be taking over….and to make the payment s to them. Questions? How were they selected? Who owns BofA??? The Feds or another country (China---maybe???) As far as I know.. No charges have yet been filed. It is not known if they found anything incriminating when the feds searched the company.
Bank of America probably had the contract to provide a back up service for FHA loans a long time ago. I have contacted BOA, and it sounds like they are being more cooperative to work with all of us. I am not expecting a miracle, but this looks much more positive than TB&W. Nothing can be worse than my experience with TB&W.
BTW.. China has other easier ways to take over this country than buy up foreclosed homes.
Also call HUD in your area. I am sure they are well aware of the saga. Call BOA but have a back up with HUD.
I have been calling the numbers I have for TB&W every day and keep getting a busy signal. I have also sent faxes. The silence is deafening. I think I can get this home sold if I can just communicate with someone at the friggin bank. In the meantime, the offer on the house expires in a week. My client is going to be so far behind on payments soon that Foreclosure proceedings will be imminent. If foreclosure occurs, it will most certainly be due to the fault of the bank, not my client.

A New Hampshire cancer survivor who nearly lost his home four months ago due to "immoral" practices of his mortgage company now claims he's left "in the dark" after the same company was shuttering by federal agencies due to possible fraud.
Taylor, Bean and Whitaker, of Ocala, Fla., the nation's 12th largest home-loan company, was suspended on Aug. 4 by the Federal Housing Administration (FHA) for failing to submit a required annual financial report and misrepresenting that there were no unresolved issues with its independent auditor.
"They never even had the gall to let their customers know what was going on," Angelo Kontarinis told FOXNews. "We've tried to get through to them and no one is answering. We've just been making our payments as we agreed to, but we're in the dark now, as are they rest of their customers."
FHA Commissioner David Stevens said the "FHA won't tolerate irresponsible lending practices," and suspended the massive mortgage company's business, effective immediately.
"We were also troubled that the company not only failed to disclose it was a target of a multi-state examination and a separate action by the Commonwealth of Kentucky, but then falsely certified that it had not been sanctioned by any state," said Stevens.
One week later, Kontarinis, of Exeter, N.H., still has no answers about the status of his loan.
He is no stranger to trouble with Taylor, Bean and Whitaker. In early 2007, the adjunct professor at the New Hampshire Institute of Art was diagnosed with kidney cancer. Unable to continue working, the 40-year-old father of three then fell behind on his mortgage payments last fall and contacted the mortgage company to refinance their three-bedroom, $265,000 home.
Kontarinis was told nothing could be done until he and his wife, Melissa, fell three months behind. Five months later, after "constant rude comments" from employees at Taylor, Bean and Whitaker, Kontarinis received an attorney's notice in late April indicating their home would be auctioned on May 8.
An innocent e-mail Kontarinis sent to Kidney-Onc, a discussion list for relatives, researchers and physicians of kidney cancer patients, explaining his situation led to "literally thousands" of good Samaritans determined to keep the Kontarinis' in their home.
After incessant calls to the company by those individuals, including one inquiry from Democratic Sen. Jeanne Shaheen, a caseworker at Taylor, Bean and Whitaker called Kontarinis and restructured his mortgage over the phone, lowering the interest rate by one-third.
That six-month agreement was made in May. What will happen come October, when he is required to refinance, is anyone's guess, Kontarinis said.
"We're hoping to restructure our mortgage permanently with whomever takes over," he said. "We're hoping a better, non-corrupt organization takes over that will be fair to work with."
Kontarinis said he does feel a measure of validation seeing the end of a corporation that gave his family so much heartache.
"We've always said they were a corrupt, immoral organization," he said. "But I do feel bad for their employees, who will be out of a job. But these are the same people who called us names on the phone for months."
Attempts to reach representatives at Taylor, Bean and Whitaker were unsuccessful Friday.
For now, Kontarinis, who said he's feeling healthy prior to additional treatment scheduled for this fall, is focused on which finance company will takeover his mortgage. A mortgage attorney advised him to continue making payments nevertheless.
"We're just waiting to see what will happen next," he said. "It's anyone's guess."

Apparently they have counselors who assist people in getting loan modifications done:
When you go to the HUD website there are various credit consumer counseling services. These companies are funded by the government. They transfer you to a counselor and they will help you talk to your lender. They take your financial info., make a budget for you, give you names of non-profit lawyers, and are available though the whole loan mod process. We even called on three way once. As far as helpful, they look at the facts and try to gear you in the right direction. It is a great resource if you are trying to get your loan modified. I do not know anyone that has been approved and they probably wouldn't be trying to find help on this blog like we are if they were approved...I'm assuming.
My recommendation: contact a real estate agent and short sell the house if you haven't lost it already. They have to accept the selling price and you can walk away with dignity and not have to file Chapter 13. Unfortunately, you lose the house, but it's better than losing your credit.

I STILL have had no communication with ANYONE from TB&W, in spite of my repeated attempts to call them. All I have gotten is a perpetual busy signal with no opportunity to even leave a message. Their fax machine apparently DOES work. I've faxed them repeatedly with no response. I faxed the same letter 30 times over the weekend and plan to give a copy of my phone records to my real estate client to substanciate my efforts.
Yesterday I contacted B of A to see if they had any record of my client's mortgage yet. They do not.
Meanwhile, the agent representing the buyer called me yesterday afternoon to tell me her client was withdrawing their offer on the home because they don't want to wait any longer.
We lost a potential sale and it is the BANK'S FAULT! My client may be going into foreclosure now because of the bank's incompetence.
I don't know if my client has any recourse or not, but I'm looking into it. I'm PISSED!
My department actually insured the FHA loans that TBW serviced (Government Insuring-G.I.).
G.I. was contracted out and is currently recieving funds from Gennie Mae through TBW to cover pay roll.
Management chose 15 individuals to stay back and finish working the over 6,000 Gennie Mae loans that were already serviced by TBW and need to be insured.
Truthfull though-I witnessed it myself-they arent working-just milking it until Gennie Mae pulls the plug - so if any one out there has an FHA loan serviced by TBW please look into it before even trying to refi as I guarantee you they are NOT getting them insured like they should be. Bob Sarr told us-he doesnt give a "sh*t" what happens now and to just "look" busy when Gennie Mae walks by. This is the reason I chose to terminate that contract-I fear that is illegal and not to mention completely immoral and there is no dignity in "milking" a pay check.
The reality of the entire situation is THIS-manager Bob Sarr threatened several employees for even speaking of the fraudulant ativities taking place in his department.
Those that spoke up about it were asked to transfer departments immediately-sadly- those that could'nt transfer were ran out via a bully system set in place by supervisors and managers or fired for simple irrelevent reasons.
When the department recieved an incomplete loan or one that did not meet HUD's requirements employees were asked to "TAKE IT OUT TO LUNCH" by Bob Sarr himself.
In a nutshell that meant that certain individuals could manipulate numbers/signatures, etc. on bank statements, underwriter docs-whatever they had to do to get the loan insured.
Myself and 3 other employees were treated w. little to no respect for over a year because BOB SARR knew what he was doing was wrong but had no real reason to let us go.
I asked him on several occasions if that was really going on and he neither confirmed nor denied it but simply called me into the cafeteria and literally told me that he has the authority to make sure I never work for TBW again and that if I make "waves" to rest assure that they wouldn't be bigger than his own "waves".
I am a single mother of 3 kids and could not afford to lose my job. I tried on several occasions to get out of my department but was never even offered an interview.
A manager friend of mine told me that Bob Sarr pulled her outside after i requested a transfer to her department and told her not to hire me because i am "trouble"-obviously he had no idea that she and I already knew one another. At the end of the day HER manager said she did not want to get involved with whatever Bob and myself had going on because it would bring problems to her department.
Come to find out HR wasnt even getting my applications or transfer requests-YES a transfer is completely at the mercy of your manager.
I am sad that this happened-people left the office that sad Wednesday confused and scared. I saw some very strong women who were the only ones still employed in their household leave the building SOBBING and not sure how they would make it.
True enough the FBI came in for one thing but google TBW and you will read article after article with fraudulant complaints from previous employees/customers.
Bob Sarr and his mistress-Kimberly Korpela felt that they could use the job as their play ground. They are two average people with a lot of personal/professional drama on their hands and to add to it they were both working late to forge documents to meet FHA guidelines themselves.
Kimberly and Bob both bullied people and worked together to make people's lives as miserable as they could from 9-5 mon-fri.
After she tried to run him and his WIFE over with her car he was fired for not showing up to work...then re-hired-she was asked to change departments, etc.
This is what i have had to live with for the last year of my life. Dealing with Bob's personal drama and watching my dept go to hell in a hand bag. When he would get upset at her we would all suffer.
After so much tension and torture in my life day after day-i am just so angry to see that they are both still are allowed to collect a pay check at TBW but i am not. All of my work was lagite and i never missed a single day my entire 4 years i worked for the company.How are these two still reportig to work 2 weeks after the other 90% of the company was let go?
I hope Bob and Kim are investigated and put in jail along with the rest of them who were doing fradulant actities.
I hope they take away his DE and no longer allow Bob or those that worked along side of him to work in the industry ever again.
Thanks for listening. I know this sounds more like a complaint session than something that can offer anyone assistance-and yea maybe it is-but I feel like it needed to be said. I have had to deal with so much just to put food in my kids' mouthes this past year and was simply just scared to lose my job.
The only thing i can do now is be thankful for my health and the fact that i have a beautiful family to fight for and to just know that what is down has to eventually come back up.
You should take your story to the Attorney General and FDIC if you have not already.
You would likely never see any financial gain from it but your story might contribute to helping some people get their loans modified before they lose their homes. Dunno, but it's worth a shot.

Former TB&W employee, its nice to know someone works there that has a conscience. The customer service reps were terrible to me. Things happen for a reason, and I am sure God has other plans for you.. You may not have a job, but it appears Bob Sarr will be going down with the Titanic when it finally sinks.

Additional concerns of consumers relate to extra charges levied by the company. As reported by Ocwen: "Ocwen does charge a $10.00 fee to produce a payoff statement and a $20.00 one-time fax fee if the customer requests this delivery method. Ocwen does not charge any fees for early payoff of a customer's loan except as provided for in the terms and conditions of their Note and Mortgage". As of April 19, 2004, received copy of Notice from Office of Thrift Supervision United States Department of the Treasury. In part the notice advised of a Supervisory Agreement between Ocwen Federal Banks and Office of Thrift Supervision. The company agrees to take steps to: Improve its mortgage loan servicing practices, including its dealings with consumers whose loans are serviced by the Bank and to enhance its compliance with applicable laws and regulations, including but not limited to the Real Estate Settlement Procedures Act (RESPA), the Fair Debt Collection Practices Act, and the Fair Credit Reporting Act. Ocwen is my new servicer and when I called them the rep was able to tell me what was my monthly payment, escrow balance, original amount of the loan and the outstanding balance. (Not surprisingly Ocwen did not have any data regarding my two previous modification applications with TB&W but we all know what that company did with that paperwork-- nothing). This week, I also received a welcome letter from Ocwen. I'd check with all the servicers, pare down the list. Ifd if any of those other servicers has your account info, I'd report RoundPoint to your local Attorney's General Office.
When I called Bank of America they told me that they were getting all of their loans; but they could not produce a new note nor did they record it in our local clerks office.

Remember that you still have to pay your August, September, and October mortgages. Yes they may waive the late fees, but you still have to pay them by October or at least November by the latest. So if your payment is $2500/mo, that means you will need to pay $7500 in October. Hopefully one has been saving that money otherwise you will wind up going behind on your payments.
While the new mortgage company will eventually have to update the records with the local clerks office, that may take some time. You can't wait months waiting for that to happen and not pay your mortgage otherwise you will be reported as late.
Note that I'm saying this for just FHA loans with Bank of America and current Freddie Mac loans with Cenlar. The rest (though I have had loans with Ocwen in the past) I would try to get more information before giving them my payment.
I am going to be behind for a little while. I just had to pay my 2nd installment of property taxes, and my house insurance out of pocket. My escrow is no place to be found.. Bank of America told me to not pay these out of pocket otherwise my escrow account will get severely screwed up.. I decided I am not going to let my house insurance cancel That is not an option. Especially at that time BOA wasn't 100% certain they are the company that is servicing my loan. At that time they could not even produce an account number or could verify that I was in the system. Those additional expenses exceed a house payment. I am shaking in my boots right now thinking I am going to have several house payments due at once. Bank Of America said they will give us 60 days to get caught
up.. But 60 days from when?
I asked about a modification. I was immediately connected to a loan modification specialist. They took my information over the phone, and told me to fax in my paystubs for the last 30 days with a hardship letter. I would say my hold time was minimal, and it sounded as if my circumstances qualified me for a loan mod. They seemed very nice to me. They told me it would take 30 to 90 days to reach a decision.
I am fairly confident that Bank of America is now the holder of my mortgage. I am in the system, I have an account number, I am able to log in online. It appears I have escrow there.. The bottom line is everything appears rolling. Wish me luck.. Taylor, Bean, and Whitter who told me I should get my groceries free from the food pantry can go to hell.
I can get in touche w/ BofA but not Cenlar . The info has already been sent to the state attornies office.

Even though I have a Freddie Mac loan and my account is current, I ended up with Ocwen rather than Cenlar. The Notice of Assignment letter I received from Taylor Bean mentioned a TB&W loan number which made me suspicious because it was not my actual loan number. Turns out it’s my new account number with Ocwen.
Since then I’m enrolled in Ocwen’s system, my escrow balance has transferred over, and I received another letter from Ocwen regarding payment options. I’ll have to admit that the call center experience with Ocwen is 1,000 percent better than TB&W’s dismal customer service. The call holding time is much shorter and the Bombay call center reps are very courteous and spend as much time as I need with them to answer my questions.
Yet here is why I’m sensing shades of TB&W. On Monday, Aug. 24, I asked for a loan modification package. The rep took information such as income and expenses that instant over the phone and then directed me to the Web site to download an application packet. However the Web site was down. No matter. He assured me that I would receive by email an attachment with the application packet. He added that I must complete and send in the application so it can be assigned a negotiator (that takes 2 days) and then the entire process (which takes about 90 days) can begin. The email should arrive in 48 hours.
Wednesday came, no email. I go to the Website, enter my username and password, then click on application download button. The Website takes me right back to the field asking me for my username and password again. Sounds familiar? Occasionally, a box pops up asking me if the download was successful. I click no. But the box pops up again and again. So I called customer service. After a wait of just about 15 minutes thankfully, I get another friendly rep who apologizes and says Ocwen will send another email to me within 48 hours. He mentioned something about my application needing a different form since my loan was with Freddie Mac and the TBW loans Ocwen took over were mostly Ginnie Maes.
So Friday arrives and still no email. Once again I have same experience with the Web site. I call customer service and get a real person in less than 10 minutes. I’m not furious but I pointedly explained to the rep that my experience with Ocwen is on par with my former mortgage service which was shut down by the federal government and is now facing criminal prosecution. Plus, President Obama announced this modification assistance program back in February, so I can’t see any reasonable explanation for delay because Ocwen claims it doesn’t have the papers for a Freddie Mac loan. Plus Ocwen, like TB&W, might have a profit motive to see me foreclose judging by their Web page or repo properties. So I demanded we have a race. Fax, mail and email the packet and let’s see which one gets here first. Well, by the end of the day there was no fax or email.
I understand there is a transition going here, but I have a problem with Ocwen wanting my September payment while being incapable of sending me a simple application. I hope my experience is an anomaly and other TBW/Ocwen customers are having a better experience. But my bullshit detectors are at high alert after my runaround with TBW. It’s been six months and two applications since I’ve tried to get something rolling on the modification front. Ocwen previously has been warned by the Office of Thrift Supervision to improve its customer service. If I don’t see anything by midweek, I’ll be writing letters of complaint again to the relevant regulatory agencies, states attorneys and the like and I’ll be kicking and screaming the whole way.

As if Taylor, Bean & Whitaker Mortgage Corporation’s troubles don’t run deep enough, a federal complaint newly alleges that a former employee bilked the bankrupt mortgage lender out of at least $1.6 million by devising a fraudulent bank scheme that went unnoticed over the past year.
Victor Cedeno, a former loss mitigation negotiator in Taylor Bean’s Loan Resolution Management Department, “fraudulently endorsed checks intended for his employer and deposited those checks into an account that he controlled,” according to a criminal complaint filed earlier this week in U.S. District Court in Orlando.
The scheme allegedly began July 16, 2008, when Cedeno opened an account at a Navy Federal Credit Union branch in Winter Park under the name, “Tailor Bean W.” The name “Tailor Whitaker” was listed as primary account holder.
Cedeno allegedly deposited checks made out to Taylor, Bean & Whitaker into this account from July 17, 2008, until as recently as Aug. 10 of this year, according to an affidavit filed by a U.S. Secret Service agent assigned to investigate fraud cases.
A total 58 checks worth $1.6 million were allegedly funneled into the “Tailor Bean W.” account.
That was just one step in a series of fraudulent transactions, according to the affidavit.
Cedeno then allegedly transferred $227,782 out of the Tailor Bean W. account into a personal account at Navy Federal Credit Union on three separate instances between March and June of this year. The personal account also listed as a joint account holder a woman by the name of Genesis Valdez.
Between this same time period, $227,782 was wire-transferred into a separate escrow account at SunTrust Bank held under Veldez’s name, set up to look like the account of a business.
On Aug. 14, states the affidavit, Veldez attempted to wire transfer $320,954 out of that escrow account to Venezuela.
Taylor Bean, the nation’s 12th-largest home mortgage lender, filed for Chapter 11 bankruptcy protection Monday in U.S. District Court in Jacksonville. It abruptly laid off nearly 2,000 employees Aug. 5 after ceasing its main lending operations following suspension by the Federal Housing Administration from issuing FHA-insured loans. Ginnie Mae and Freddie Mac also suspended the company as an approved seller and/or servicer.
Cedeno, who worked for the Ocala-based company from January 2008 until his firing date of Aug. 13, 2009, was responsible for resolving short sale losses for the mortgage company. He came into direct contact with realtors, investors and lenders, according to a court affidavit.
At no time was Cedeno authorized to “cash, deposit, or negotiate any checks intended for Taylor, Bean Whitaker,” according to the complaint, but somehow came into possession of checks made payable to the company.
“He somehow positioned himself where the checks would come to him, or through a cohort,” said James Glendinning, assistant Special Agent in Charge of the U.S. Secret Service Orlando Field Office.
The U.S. Secret Service will investigate cases of computer fraud, bank fraud, access device fraud and false identification.
A branch manager at the Orlando Navy Federal Credit Union became suspicious of the transactions after noticing that a check made payable to Taylor, Bean & Whitaker was different than the name on the depository account, “Tailor Bean W.” A senior investigator at the credit union next contacted the U.S. Secret Service on Aug. 12.
Cedeno reportedly managed to commit the bank fraud by approving home sales at 90 percent of the mortgaged value of properties, while Taylor Bean believed he was approving sales at 80 percent of the mortgaged value.
After intercepting the payoff checks, made out for 90 percent of the mortgaged value of these homes, Cedeno would then deposit the checks into the Tailor Bean W. account. He then allegedly transferred an amount equal to only 80 percent of the value into Veldez’s SunTrust account, retaining the extra 10 percent.
From the SunTrust account, Cedeno or Veldez would then issue a check to Taylor Bean for 80 percent of the homes’ mortgage value.
“[Veldez] had that name in the account of a business, to make it look legit. It looked like it came from a title company, and looked like it came from [Cedeno’s] paperwork,” Glindinning said.
As of Thursday afternoon, authorities were not able to locate Cedeno, a resident of Winter Garden.
Glindinning said he not aware of any link between Cedeno’s alleged fraudulent activity and a current FBI inquiry into any alleged fraudulent practices at Taylor Bean.
“Right now, a nexus between Mr. Cedeno and the current investigation into TBW has not been established,” he said.
This woman at the law firm said "no, that's only the mortgages in Florida" "Indiana laws are different"...what kind of a fool does she think I am....what kind of a fool is she!!!???
Who would think that all other mortgages in the whole USA are not affected by this...she thinks I fell for it and will pay them anyways that's the gig.
We have not heard from anyone yet (we have FHA but were told it was not serviced by Freddie or Ginny so I'm real confused).
Restructuring guru, new board members join TBW salvage team

Bruce Layman, a principal of XRoads Solutions Group, and Bill Maloney, a partner with Tatum LLC, are running former mortgage giant Taylor Bean & Whitaker as directors, while Neil F. Luria, a managing director with Navigant Capital Advisors, is serving as chief restructuring officer.
All three have experience in corporate restructuring and bankruptcy. Each declined to comment this week about their plans for battered Taylor Bean, but the new directors certainly will have much to consider.
TBW sought Chapter 11 bankruptcy protection earlier this week. It is not clear whether it will restructure or liquidate.
Here's a look at these three key men. The information comes from official biographies that their employers have assembled:
Bill Maloney: Maloney, a court-approved Chapter 11 trustee in Florida's Middle District, has been with Tatum in St. Petersburg for the past 10 years. He has served as a chief executive officer, chief financial officer and chief restructuring officer of a number of distressed companies, and has brought several companies through bankruptcy.
Before working for Tatum, Maloney held senior financial and operating jobs with portfolio companies of private equity firms Dyson Kissner Moran (NEOAX), Freeman & Spogli (EnviroSource) and Chilmark Partners (Indesco International).
Maloney held executive financial positions at Chiquita Brands and Paramount Communications, formerly Gulf and Western Industries. He was a senior manager at PricewaterhouseCoopers. He is a certified valuation analyst, past member of the Florida Institute of Certified Public Accountants Board of Governors, and is a licensed certified public accountant in Florida and New York.
Maloney, who holds a degree from Seton Hall University, completed the Wharton School (University of Pennsylvania) Executive Strategic Planning program.
Bruce Layman: Layman is a new principal at XRoads, also known as XRoads LLC, a consulting firm that specializes in working with distressed companies and representatives of debtors and creditors.
XRoads was founded in 1997 and is based in Irvine, Calif. with offices in New York, Houston, Dallas and Kansas City, Mo.
Layman, who lives in Naples, has 24 years experience in the corporate restructuring field. He headed the U.S. corporate restructuring group of a major Canadian Bank and has served on the board of directors of a number of firms.
He has experience in restaurants, entertainment, manufacturing, telecommunications and real estate, among other industries. He holds a bachelor of commerce degree from Queens University in Kingston, Ontario, Canada.
Maloney and Layman appointed Luria as TBW's restructuring officer.
Neil F. Luria: Luria holds a bachelor of science degree from The Wharton School at the University of Pennsylvania and a law degree from Boston University School of Law. He is a certified insolvency and structuring adviser.
Luria is a managing director with Navigant Capital Advisors, the corporate finance practice group of Navigant Consulting Inc. in Cleveland. He has worked for Navigant's predecessor, Casas Benjamin & White LLC, and is a member of the Ohio Bar.
"I am in Ocala all the time," Luria said.
Luria specializes in capital restructuring and operation support. He has overseen the disposition of more than 100 business units.
Before joining Navigant, he was president of BMJ Medical Management Inc., which operates ambulatory surgery centers. Prior to BMJ, he worked at Jones Day Reavis & Pogue, a private law firm.
compensation: According to court records, Luria and Edward Casas, Navigant's senior managing director who will have general oversight responsibilities, will be paid $250,000 a month. NCA will serve as financial advisor to TBW and oversee the restructuring process. In addition, support staff will be paid hourly rates ranging from $95 to $875.
Freddie Mac has not updated notes on TBW. One part is interesting as it looks like even Freddie Mac realizes that the changeover hasn't been smooth.
What should I do if I received a welcome letter from Cenlar FSB and RoundPoint Mortgage Company?
Until further notice, if you received a welcome letter from both Cenlar and RoundPoint, you should begin making your mortgage payments to Cenlar as directed in its welcome letter. If you have questions about the servicing of your mortgage, please contact Cenlar directly.
If you closed when or after TB&W's assets were frozen, they may not be able to fund the transaction for a while. When did you close?
We retained an attorney in April 09 and he's been dealing with the mess since...lifting a huge weight off of our shoulders.
We filed for an extension which was granted when tb&w foreclosed on us less than a week after agreeing to and accepting a payment for a repayment plan...which was set up to avoid the foreclosure filing in which they also never applied the payment to our account, but we had proof that they received.
Imagine that....that tb&w would take our payment...then foreclose on us.
They (tb&w) filed for an extension after receiving the over 100 pages of documentation from our attorney listing well over 20 different laws that they have broken concerning our account with them. Hadn't received anything from them in response...then all this happens.
Just today received papers stating that BOA is the new servicer.
Will have to get with attorney and see what's going on as it's been a while since we've "talked".

My loan has been taken over by Cenlar but I was enrolled in an equity accelerator program by a 3rd party. They would deduct weekly and deposit it into a TBW custodial account, at years end I would have just over one months payment added to principle and my mortgage would be reduced from 30 to 22 years.
There is only one problem! This account is frozen by the FDIC and im already late on my 1st payment to Cenlar which by the way, sent me a letter 5 days before it was due). I will not pay out a dime to this new cenlar whom does not answer the phone I may say, until my money becomes un frozen.
What does a rescission mean to the borrower?
When the homeowner has successfully rescinded a mortgage transaction, he is obligated to tender the loan proceeds, or the fair market value of any property received. The tender obligation is the net amount owed after voiding all finance charges, interest, and other charges, and after crediting all prior payments directly to principal. These reductions can dramatically lower the principal amount, especially if the interest rate or fees were high, or if substantial payments have been made. However, it should be noted that the homeowner may have to come up with a large amount of money to fulfill his tender obligation. The homeowner must present a realistic tender plan to the Court if he wants to prevail in his rescission action. Some tender options include refinancing with a more affordable lender, obtaining a reverse mortgage (only for elderly homeowners), or selling the home.
Please enlighten us if you have different information, but this seems to be the case in general.
well yesterday i received my "WELCOME" letter from Bank of america. it was 2 letters of INTENT to FORCLOSE... apparently the special forbearance i had with taylor bean, was not carried over to BOA...i called BOA, over the phone they took my information, and said i qualify for a modification. now i have to wait for the paperwork in the mail. LETS SEE what happens...

I am a realtor who WAS representing a seller in a scenario that evolved into a "short-sale" situation just as the crap was hitting the fan with TB&W. We lost the sale, and the seller let the listing expire intentionally. They are going to let the bank (Uh, WHICH bank?) have the home back to put where the sun doesn't shine. Sad situation....
Slow responses from ANY lender has hindered homeowners in a short-sale situation. Because of slow bank response on offers most people in a short-sale situation eventually lose their home. Most buyers won't wait the 30 to 90 days just to even get a response to their offer. Short sales can take many months to close.
TB&W's failure compounded this factor for my client. The real pisser is that we HAD an offer but there was NO ONE to present it to!
Talk to an accountant or call the IRS office. You shouldn't seek advice from anonymous posters on a message board.
I don't know how many of you this will help, but I have to file a claim to get my escrow back. The information did not seem readily available. You won't get anywhere talking to TBW. Hope that helps at least some folks, the people who are waiting for stuff like escrow etc.
The lady in charge of construction loans was very good at returning my calls the next business day. After 2 calls waiting few days in between no return call!
My contractor NEEDS this money and I feel horrible.
I just hope my property taxes and insurance will be paid!

My issue now is I am trying to do streamlne refinance with BOA for a better interest rate. This is a VA loan. I filled out my application about a month ago, I have been in contact with BOA in regards to the refi in a postive, moving forward way up until today when they advised me of a "policy" that states they can not refinace any TBW loans?? I said I am now a BOA customer, I qualify for the refi, but you wont do it because I had originally went with TBW? Does this make any sense? Anyone else having the issue or has anyone had a TBW and refinaced with BOA since August 2009?
TB&W, was charging me pmi insurnace that my loan was opt out not to have...some special they were running at the time..anyway they have taken 2400 from us and now i am fighting with cenlar(OMG they are horrible to deal with!) to get the pmi dropped. Have no idea where to even start or who to contact!

I think we all have a legal obligation to ask. They are our creditors.
I was just wondering if anyone tried and received any sort of response? Its been 14 months and the loan is still not recorded at the court house. I am paying my loan, but I am unemployed. Even if BOA lost some of the paperwork in the shuffle, it might be eaiser to request a modification if they can't produce the note.
