What happens to a Renter during and after foreclosure?
I am a lodger with a rental agreement with the owner of a house in Palm Desert, CA. I rent a room in back with access to the inside kitchen and bathroom. I am a single dad on public assistance with my two children. The owner of the house just informed me verbally that they haven't paid their mortgage, the bank is foreclosing, and we've all got to get out of here immediately.
Don't I have to be served legal notice of eviction? I doubt I can get out in time. What is my legal standing when the bank shows up? Do they have to abide by my rental agreement with my landlord, even though he's out of here? Any chance of negotiating with them to continue renting the room in back? If this were an apartment building and the owner failed to give proper notice to the tenants, would the cops still throw them out?
