Wells Fargo said the investor does not allow Loan Modifications... is that right?

I make my mortgage payments to Countrywide. I have tried to request a loan modification. They say "the investor does not allow modifications to this loan". Countrywide is ONLY servicing the loan...Wells Fargo is the investor. I am requesting to modifiy the loan into a fixed rate with affordable payments.

Option One is my servicer, and they are telling me the same thing about Wells Fargo. However I called Wells Fargo collection Dept and they said that they do Modify loans for their clients....whats the dif?
I have an 80/20 loan both with ASC, I have been trying to work out a loan modification for the 1st mortgage which is adjusting every six months. The 1st time we were rejected because they said we did not make enough money to pay our mortgage, then my husband and I received small raises, so we tried again. Again rejected stated we made to much money. We have never been late, but we are struggling like others to just pay our mortgage. We have lost so much equity in our house we cannot refinance. We have called everyone and cannot get help! Now I am wasting my time with them for one more rejection. We do not know where to turn just so we can keep our house and not give up our 1st born to do that. ha,ha, ASC is no help to us!!
The same happened to us! We have an 80/20 loan with Wells Fargo since the 1/08 I have been trying to get a loan modification. The first time we were approved over the phone then received a letter saying they denied the loan modification because we did not earn enough money but we could sign over our interest in the house to the investor.We did not. Then a few months later they wanted us to try again with same numbers and waited the 6-8 weeks and I finally called to check and they told me we were denied again because we make TOO MUCH money!! Then we received a letter from them wanting us to sign our interest in the house to the investor. Our payment went from $3680.00 in 4/07 to $5600.00 in 4/08(this includes the adjustments of the ARM,tax escrow that they paid they collect for last year ,this year and next year,last year was already paid??? and late fees). So I call for help and they ask every time I call why the delinquency, I tell them about our payment skyrocketing and there is silence on their end. We can't sell, we can't refi,we don't want to walk away. So we make our payment late every month we love our home and want to stay. I just want a fair mortgage what are we supposed to do???
I called Asc again when I was told that there is an adjustable rate department that can help us. Well that is a lie, I called them and of course it is the same dept. that I tried to get a modification from them several times. I spoke with a girl on the phone and she of course wanted to do our finances agian and I told her they were crazy because they have turned us down three times and what makes them think I could qualify now. Like before I told her we just want a fixed rate nothing more just so we don't increase every six months. She then said we have to do the paper work again so they can see if we qualify to pay a fixed rate. Of course I Was even madder because she said just because we pay ontime doesn't mean we qualify, they have to make sure that we can support a fixed rate. By then I was so mad I said I pay now at a high rate but you don't think I could pay a lower rate. She then said they have to make sure I am not borrowing the money to pay. I then proceded to get more ____off and said they are crooks and I am not doing this then Of course she said I got myself into this by not reading my documents and of course I told her I like everyone else was lied to and told don't worry you can refinance before your rate adjusts. Ha this is a big Lie!! I am so frusturated and just want to stay in my home.!!! We need help to do this!!

In January of this year, we contacted our mortgage company, Wells Fargo in an attempt to lower our monthly mortgage payment via a loan modification. At that point our loan was current & up to date.
They first told us to freeze our payments & that a mod could not be approved if we made any payments within the 90 day period that our application was being processed. When I asked why, I was told that the loan had to be in default for a modification to be approved & that the past due amount would be applied back to the principal, therefore stretching out the terms of the loan, thus a modification.
They said to fax a profit & loss statement, along with proof of income/bank statements, & a hardship letter.
2 days later I faxed over 27 pages to their loss mitigation department & after several attempts, they finally confirmed that it was received. I inquired again about why we should freeze our payments, and was told the same thing & advised to call every couple of weeks to ‘check in'. I did this for 3 months & they continued to tell me the same thing-the application was being processed, to still not make a payment.
Finally, 3 months later, I received 2 letters from Wells Fargo.
1. The first one said ‘unfortunately' our application for a loan modification was ‘denied' & the decision was based on us not being able to ‘come to an agreement', continuing on, that there may be other options, but in our case there were ‘no other options'.
2. The other letter was a statement reflecting a balance of $17,000 due immediately, and if payment was not received in less than 2 weeks, ‘foreclosure proceedings will begin'.
I called wells fargo & was disconnected 3 different times after explaining my story. Finally, I spoke to a rep that informed me the reason for our request being denied was 'missing information'. Apparently they ‘left a message' requesting more ‘current documentation' the same day they denied our application.
I check the answering machine daily-they never left a message
They take 90 days to ‘process' our application & then decide on the 89th day that the information is out of date?
The representative advised me of the following 3 options;
1. Pay the delinquent balance of $17,000 in full.
2. Request a re-payment plan, which would require me to pay $8,000 up front & the rest I could pay off in addition to my monthly payment-actually making it higher
3. Re-apply for the modification, HOWEVER-the house will be in foreclosure, but they would ‘freeze the force sale' while my request was in review.
I asked if I could have a couple of hours to get all of the money together into 1 account & call back. Apparently there was 'no call back number', but the rep could call me back at 4:00 that day.
I never received a call back that afternoon, BUT I GOT AN UNEXPECTED VISITOR—to my surprise, I found a woman taking pictures of the property. I approached her only to find that she was a representative of Wells Fargo conducting a ‘property inspection'. This is when I started to realize that something was definetly going on.
The following business day, I called the loss mitigation department, explaining that I never received the call & that I wanted to pay the balance in full. This is when I was informed that they (Wells Fargo) were unable to accept a payment from me at that time. I tried escalating it to a manager, and no one was available. I tried calling several different Wells Fargo Mortgage Phone numbers, trying to pay but every time I was re-directed to the Loss Mitigation Dept.
It was at that point I decided to hire a lawyer & since that time,Wells Fargo:
Continued to refuse payment from us (they return our checks back to us via US Mail).
Sent men in black suits to our property on 3 occasions, asking who occupies the house, what the condition of the interior is like, taking pictures, walking along the property lines, not answering any of our questions.
Forced us to re-apply a total of 5 times for the modification & requested updated documentation 17 times (this includes profit/loss, bank statements, taxes, w-2, and so much more). Everyone of the 17 times I had to re-submit the information, they would claim that they did ‘not' receive our faxes the first 3 or 4 times, making us wait 3 days each time for them to ‘process' –all in an effort to string us along while they were buying time, as our property was scheduled for ‘public auction’ on September 17th.
In the past, prior to applying for a loan mod, If a payment wasn't received 2 days BEFORE our due date, they would call three times a day, demanding payment. I did not received one call from them since the day I called & requested our loan be modified.
Wells Fargo has violated RESPA LAWS by completely ruining our credit, making it impossible for us to be able to re-finance. This has changed the terms on all of our other accounts, raising our interest rates, decreasing the available balance & affecting our credit significantly. My husband had a credit score of 875 last year. Now he is in the very low 600's.
On September 1st, two weeks before the public auction date, they told my lawyer that they had received all of the paperwork & they were waiting for our application to be assigned to an agent. I couldn’t count the amount of times I had read that same statement from different people in the same situation. This is not a coincidence, and neither is the fact that there are over a hundred other families across the country that have stories that are identical to mine.

We have a home mortgage with ASC. If they are so hard to work with...why are they allowed to continue this? What rights do WE have? My husband has been making our payments on time, every month for years now. He has a loss of income due to poor sales..he is commission paid with little salary. He works for an Auto Dealership selling auto parts. We can hardly get by, paycheck to paycheck. We have been trying to get this company,ASC, to help us. Differ a payment or two..or mod. the loan. No help at all..they told him maybe he should get a second job!!!! How rude..this is a 56 year old man. He works full time...hard at it too! They implied that if we were in default we might get more help!!! Why should it have to come to that???? Help us out here!!!!
I RECEIVED a letter stating "formal notice loan modification approved" along with the loan modification legal document in January 2008. I had my employer (attorney) look it over, I signed it, faxed it back to Wells Fargo since they supplied a fax coversheet and I always DHL delivery the original document (again Wells Fargo supplied the envelope).

In July 2008 I called to see why I wasn't recieving monthly statements yet. Wow, they informed me that my .. now get this ... loan modification was not approved. No matter how many times I sent the letter of approval and legal document they still say I'm not approved. It went into investigation adn I was told they were investigating why the loan modification WAS NOT COMPLETED ON THEIR END. Ok, I bought that thinking all would be good. Susupiciously after the call about the monthly statement I received a denial letter dated "JUNE 2008. Mind you I made the call in July!
then I finally started getting monthly statement WITH ARREARAGES. I called I faxed I even certified mail a big packet of all documents recieved and sent since inquiring about loan modification to Wells Fargo legal department. No suprise to me, nobody in that department had the courtesy to even acknowldge receipt of it. I do know they recieved it, I got that green card showing who signed for it back from the post office.
In October I sent in my new payment amount as I have done faithfully since April when it was to start. Well, now Wells Fargo has started sending my payments back as "insufficient amount" for an excuse.
Hey Wells Fargo....BBB, Banking Commission and our Attorney General are on this case now! See you in court! By the Way Wells Fargo....when did you assign the loan to US Bank as Trustee? THATS ILLEGAL and here in our court system Judges aren't letting you going to avoid facing the music that easily! YOU GONNA SETTLE UP IWTH ME! The one with sleepless nights, anxiety, depression, emotional distress caused by you. Didn't know that the subprime loan mess had phase two...dupe people into thinking they're gonna be paying less thru loan modification adn you not applying payments in an attempt to steal our homes!

I have been going through the same, exact ordeal for over a year now with Wells Fargo and seem have been denied on several occasions for various reasons and have once even received an approval letter for a modification and made two of three payments and was going to be two days late on the third payment and they refused my payment plan and aid I had to reapply. I reapplied for a loan modification and have been waiting for the magic 90 day period...checking in once a week with the loan modification department as instructed and continuously being told the loan had not been reviewed by the negotiator only to receive a phone call stating that my house was going to be sold on the 14th of November, this Friday. I never received any mail indicating the sale, nor was anything left at my residence. The only correspondence I received was a letter on Tuesday the 11th stating that the loan modification had been denied because of "differences between the two parties". I just want to know how I can save my house, being that my credit has taken a huge hit and I never wanted to lose my "American Dream" in the first place. I don't understand how banks and predatory lenders can get away with this behavior and have no reprocussions.
Have any of you tried to contact your Senators about how Wells Fargo is treating you?
Here is what we need to do..join the class action lawsuit(see above re:Anya Burnham comment). Write, dont email, congressmen, governor,anyone that will read it. Maybe 20/20 or 60 minutes would be interested to here about all this. The mortgage crisis is a top story these days..of course, something should be done right now to stop underhanded business dealings such as this. Wells Fargo/ASC needs to be held accountable just like they expect us to be.
My mortgage was on a 2/28 I called Wells fargo after receiving a letter stating that I was "preapprove" for a modification an all I had to do was call..sounding familiar? Well after faxing my information 6x they finally said that they had everything that they needed to start the process and I should call back in a week, I followed those instructions to the letter and spoke with a CSR only to find out that I should be recieving a letter any day now denying my modification because they didn't recieve my financial worksheet! I explain to the lady that I fax to the number that was given to me she said that my faxes were being sent to the wrong dept and that they were probably being discard(what happen to the call that was assuring me that they receieve all of my paper work and that it was being processed). My modification started back in early august and I have been getting the run around ever since, I called today and finally it was assigned to a someone in the negotitation dept after 5 months of this terror. After questioning why it was taking so long I was told the longer it takes the better it is for me, although by the grace of GOD I'm not behind it is very hard to make the payments on time befor the modification process if it was a day late I would be hearing from Wells Fargo now nothing I sent the payments in and wait. My thoughts and prayers go out to everyone in this situation we are not rich pay checks stay the same but everything else seems to go up whether we can make it with what we have or not.
Happy that you are not behind. However, cover your butt, in writing fax it and mail it, ask for an accounting of payments. I did this only to find that my payments were in suspense and they were taking unnecessary fees from my payments (i.e. inspection - this is to have someone come by the house to make sure someone is living here even though we answer Yes its my address, yes I live here" another charge was some administrative fees and such). If you have these charges IMMEDIATELY contact your Attorney General, send all correspondence to and from Wells Fargo...dont' hesistate, do it now. I'm a paralegal and my boss was wow'd by what I've been going threw. Good Luck, keep us updated...I'm waiting for my day in court..already got a letter from foreclosure attorney, sent my paperwork showing modification and proof of all payments. They're trying to say I was denied...then what the heck was the formal approval letter and the modification loan document I sign? Wells Fargo is a piece of work indeed

Countrywide services my loan they told me that Wells fargo was My investor and that they do not do loan modifacations so my modifications was denied the people at countrywide told more then once that they (wells fargo) never do loan mods and they are horriable for them to deal with, but there is nothing they can do.
My home is in foreclosure .. Wells FArgo has turned me down for loan modification. But after resubmitting financials I'm in review again. During all this time I hired a schame company that took 1500.00 dollars and did nothing to help me. Wells Fargo told me not to make any payments during the 1st review process so now I'm further behind. What do I do .. help.

When I left my employment with WFM in 2005 I took all my money with me! I refinanced my home as well. What I saw happening scared the crap out of me. I will not do business with them ever again. It appears WF set up Americas Servicing Co. to glean even more money from those who obviously couldn't afford a mortgage in the first place. I'm one of the lucky ones, so far.
what ppl do not realize is in reference to ASC that is a servicing side of wells...AND ITS A NON PRIME servicer...which means you didnt have the credit to get a gvt loan...And yes a private investor has the right to deny a mod...review per the occ is to be done within 30-45 days...but when you ppl call in every 2-3 days wanting to talk to your nego that slows us down.....we will call you when the investor lets us know...ANOTHER THING ...we are the go between with the investor not with you......
Well I received yet another check back from wells fargo without a letter of explaination and this time it was more than my payment itself LOL. Under seperate cover I recieved a letter on the same day as the check stating "unable to come to a workout plan" for me. I contacted them, and they don't have a clue. They even told me a foreclosure by sale date was scheduled for this september 2009. Heres' the funny part.........I WAS NEVER SERVED FORECLOSURE SUIT PAPERS. So I contacted their foreclosure attorney who stated he thought my case was closed since I did provide proof of the modification and proof of all my payments showing that I am current. He was dumbfounded and asked that I send a copy of the letter and check to him so he can call his contact at Wells Fargo.
ITS WELLS FARGO IDIOTS, they haven't a clue, there is absolutely no inter-office/department communication!

yes an investor can deny a modification .even wells fargo.. as with the collections dept saying yes they do modify loans and then loss mit saying that investor does not allow them. collections get training in just that collecting the money loss mit is trained in rention of the loans and with each particular set of guidelines the loans have per each investor . i know because i work there

I have also heard from Indymac bank our loan servicer (Wells Fargo Investor)That we do not qualify for a loan modification because Wells Fargo does not offer it to us at this time.

No luck with my loan modification even though I recieved a letter stating I was approved and the actual legal loan modification docutment was signed and returned. I just wrote requesting an accounting of my payments showing how they were applied. I just got the heads up from someone with a mirrored situation as mine that he wrote requesting who actually owed his loan.....wish him luck people, he has a trial date on the 27th.

We were two month behind on our adjustable rate payment when I tried to get them to modify our loan and all they did was give me the run-around! I couldn’t believe it when the guy on the phone actually said that my family shouldn’t eat so much because then we would spend less on groceries and would have more money to make our mortgage payment! What a jerk! He also said we should get a cheaper car and a bunch of other stuff that was really rude. Come to find out the loan modification they were going to give us was a just Forbearance Agreement and all it was going to do was add the payments we were behind on to the back of my loan. Since our interest rate was going to stay the same, this would actually make my payment go up! THAT’S what got me into this mess in the first place! My payments are too high! This whole thing was keeping me up at night worrying about what was going to happen to us. I told my friend at work about this and she said I should call the loan modification company that got her loan modified down to 3.75% fixed interest rate! I decided to call them, and in about 45 days they got my interest rate down to 4.35% and it’s a fixed rate too! The company is First American Financial Group and we are really happy with what they did for us. The website is, w. w. w. TheLoanModFacts . com. Hello everyone, I recently got my loan modified through Wells Fargo after more than 18 months. I was denied twice before finally approved, I was a little worried after reading so many different stories that loans were modified an paper work was sent back in only to find out they were full of sh**. When I spoke with someone she was very nice letting me know to make sure whatever I do don't get more than 3 payments behind I thanked her for her kindness, but in so many cases now adays we just can't help that. However I'm making my first modified loan paymt tomorrow I was at an adjustable 10% and now i'm at a 8% fix I didn't go through a modification firm, it took a lot of persistants, weight loss, and stress! I recieved my letter and now I'm starting to rec'v my monthly mortgage statments again after not rec'vg them for more than 7 months or more. Please keep trying keep records of who you spoke with, and the time you may need this. Good Luck to you all and God Bless!!!!
Well I'm finally getting some action. After WFs foreclosure attorney told me that according to his contact at WF that my payments were current in accord with my loan modification (recieved sent in then told months later after making new payments that it was denied) I requested an accounting of my payments. I recieved it only to find fees were still being taken out and balance of payments in suspension for the whole period of Sept 2007 to the PRESENT. I forward the accounting to our attorney general....now WF is writing back to the attorney general.
Im sticking this out, I continue to make my new payments each month. I received two checks back, one I attempted to return but was issued another in its place. WF claims I was sent three, thank goodness I send every mailing to them certified return receipt..this is just proof of their incompetence, mismanagement of our monies and the lack of interdepartment communication within their own company.
WF seeks to have me go through the whole process of financial documentation to be approved for a new loan modification........hell no I'm not going to do that! I have the approval letter and loan modification document I sent back to them in their DHL prepaid envelope.....reciept from envelope proves that too!
I wish they would just go ahead and attempted foreclosure on me...I want to answer that complaint with a cross complaint that will make their heads spin!

However we first need to comfirm that (my full name) that she can send the three previously returned payments, as these would be needeed bring her loan current through June 2009."
Lesson to all: if they return checks don't cash them!
Being a paralegal I knew to keep these checks. Well I did attempt to return one marked "VOID" to the reconciliation department that sent it to me to begin with. So I sent back two original checks along with a copy of the Priority, Delivery Confirmation" letter I sent the first check back attached to.
Wells Fargo should get my mailing by Monday, I requested an accounting showing all my payments brought current with all embezzled fees reversed, correct my credit reports showing only ONE payment missed in 2007 (can you imagine fighting with a company this long!) and that my Loan Modification be recorded on land records with the original, fully executed, recorded document returned to me!
What do you think.....should I hold my breathe? LOL

If by then its still not fixed my court battle is on with the idiots. Here we go again, another department of WFHM (Executive Communications) that doesn't answer phones. My packet was delivered June 3, 2009 (delivery confirmation requested), I called two days ago (June 15, 2009) and got a recording "due to overwhelming calls in this mortgage crisis period", left a message and havent heard back from the person of contact.
Maybe she's having a hard time trying to fix the wrong all other departments created with my account.
Its funny, just when one believes someone at this company just might have an ounce of knowledge it goes full circle again with the non-communication. Wells Fargo, when will you ever get your act together, when will you utilize some of our hard earned dollars to invest on a server all departments can use?

I guess I'll have to wait another week to not hear from WFHM. I covered my butt again, I faxed Executive Communicate at WFHM outlining the receipt of my packet, my follow up call, the lack of their return call and my call to them today only to again get voice mail. I also asked about why one department tells me one thing and another states something different when calling. Executive Communication's stated it could be "lack of training" and I was assured that my concerns were being directed to each department. Supposedly they all review payment history on the same server....so why would one department say I'm current and another say I haven't made payments and yet another say I'm in the arrears?
My suggestion to everyone is PUT EVERYTHING IN WRITING, IF YOU GET A LETTER FROM FICTICIOUS MORTGAGE COMPANIES, immediate call the 800 number, ask for name and employee code and write notes on the original letter. Then follow up in writing to the address on that letter reiterating who you talked to and their employee code and what transpired in that call.
For those of you who have not already done so.....PUT IN A COMPLAINT WITH YOUR ATTORNEY GENERAL - MORTGAGE COMPLAINTS DEPARTMENT. After doign so and getting a file number from them make sure you CC: every letter recieved with the notes on them with an outline of what you are experiencing.

Well heres my update once again. I recieved a letter stating my Loan Modification has been completed and that I would recieve monthly statements and instructions as to where my payments are to be sent.
Much to my lack of surprise, no instructions and the monthly statements recieved so far show 19K and 17,000.00 in arrearages.
The saga continues.....even Executive Communications at WFHM can't seem to get things right!

my mortgage is with GMAC the lender servicing my loan. They said that wellsfargo is the investor and they will not modify my loan! what can I do

Hey Hyacinth......write your attorney general....Wells Fargo just dicks people around...THEY DO MODIFY LOANS ... I got an approval but then they sent a letter denying. I have been fighting this battle since 2007 .. as soon as the attorney general got involve things started to happen

If you want to say "pay your bills" please contact me and I'll give you my loan number...YOU WILL SEE THAT I PAY EVERY MONTH and that I WAS SENT THE LOAN MODIFICATION WITH THE APPROVAL LETTER. I followed the instructions to a T after my employer, an Attorney (yes I'm a paralegal, I'm not stupid) looked it over for me. Even Wells Fargo's foreclosure attorney Hunt Leibert said according to their contact at Wells Fargo I was current in accord with my Loan Modification document but WELLS FARGO ACCOUNTING DOES NOT REFLECT THAT.....take that to your BA education!

When I refinanced into my own name to keep the house I was still married to the fool, not yet divorced, rate was about to go variable..........I knew to refinance before that rate went variable. I never took money in my pocket, I never did refincance after refinance cause I"M CHEAP, corporate america doesn't get my money, I keep my costs down to enjoy a financial stress free life. I am sending a copy of the this websites posting, be aware that any site you enter information on saves copies of all postings, even after deletion and/or expiration. I read all your stories and my heart breaks so much for all of you. My husband and I are in an Active Foreclosure and Reinstatement with a total amount of $9,236.63 I have the $6,793.75 on my mortage due and they DO NOT want my payments, instead they would rather put us in foreclosure. And I am so confused. Why would you just not take the total mortgage payments then go through all this work. NOW where am I suppose to come up with 4,000.00 in 30 days? And I don't qualify for remodification loans, its in the works, again. I don't even want a lower payment I just want to pay what I owe and move on.
Laura....keep everything with Wells Fargo in writing. Contact your attorney general immediately and let them know whats going on. I finally got mine all current and its been a fight since 2007. Make sure you make notes on every letter recieved from Wells Fargo, who you talked wth, employee code and short story/sentences of what transpired.
Do not cash or deposit the returned checks, keep the money in the account. If I didn't have the checks to return I would have had to start the process all over again.

Executive Communications Department told me they reversed all the bad reportings, that was almost 2 months ago, once again, another lie. So now my attorney general can help me with this problem. And the banking commissioner, might as well get another party involved. I'm putting in a small claims for the $4,500 cash for clunker incentive I couldn't use because of this. Yup, I'm stuck with m 87 Olds gas guzzler because I have no credit worthiness due to WELLS FARGO HOME MORTGAGE

LAURA- ask them for a forebearance agreement, see if the refuse that too. They should at least work with you on that, little larger payments till arrearages are done. It buys time to work out loan modification but do get a letter out to your attorney general with any proof of whats going on ... fast
Well I finally am brought current but get this!...my credit report will show the payment WFHM told me not to send in as "they have no proof that their representative told me not to send it in" Well thanx to this blog I have evidence...we all can't be lying. Can't wait to see what executive communications comes up with as excuse once our Attorney General sees a print out........complete printout of this blog site highlighting the words "I was told not to send payment" One other stupid thing they're trying to pull now....in a letter from WFHM I read that Wells Fargo did sign the Loan Modification yet I get a copy with just my signature, I'm not sitting down doing nothing... I want to see a FULLY EXECUTED Loan Modification like I requested. Still trying to get proof that they sent it for recording on Land Records (yes, Loan Modifications need to be recorded) MY TURN TO HARRASS CORPORATE AMERICA!
