We need some hlep to avoid a foreclosure on our record
April 03, 2008
We made a re-payment arrangement. After making the first payment, I called and told them I would not be able to make these payments. I asked for a modification, and was denied. I made the second payment, but was late, and they returned it. Soon after, we received a notification that they were foreclosing. I filled out a mitigation form, with a letter of hardship, but have not heard back. Our home is for sale.

We have our 2nd mortgage with EMC, actually EMC hold both but Wells Fargo "Services our 1st, when we originally purchased the house they did an 80/20 split purchase. but anyway we are behind on both mortgages, our 2nd with EMC is 5 mths behind, to the tune of about $1100.00 we called EMC and ask what our options were, the rep. told us what to send in for a Loan Mod. so we did... after about 3 days we called to check in, and were told by a normal EMC rep. not a Loss Mitigation rep. that we had been denied, she said, "You would never have gotten the Loan Mod. you need to pay 3 mths. payments first." if we had the money for 3 mths. payments we wouldn't need the Mod. We ask her to transfer us to Loss Mitigation and she refused to do so, she said they couldn't tell me anything she hadn't already told me, we haven't received any notice we were denied, NOTHING! So I again told her to transfer me to Loss Mit., she refused again, so I hung up and called the phone number for Loss Mitigation I have, but no one answered the phone. I called a few times since and have not been able to speak to anyone in EMC's Loss Mitigation department. I talked to a EMC Rep. in collections this morning July 10, and she stated they wanted us to make 1 mths. payment on Friday. We told them that was not possible, but if they would give us until the 25th then we could make the 1mth. the rep. said that was fine. but still no answers about our Loan Mod. paperwork we submitted.. still haven't been able to speak to the actual EMC Loss Mit. Dept. This is ridiculous.. all we want to do is get back on track, and make our monthly payments since we now have the means to do so.
