I have been calling and calling Saxon... still no response

April 15, 2008

I have been calling my mortgage company on a weekly basis. I have been told to be patient my loan is being worked out. This loan has been in process for over 5 months. I am told I will get a phone call withing 48 hours, and they do not call me back. I received a letter of default, and a phone call for foreclosure. The foreclosure was post postponed 30 days since they have not finished working out my loan. I now have 2 weeks, and they still are not calling me back.

I would be leery about that. I was always told when you think you are going to be late to contact your lender. Our loan was sold to Saxon in Nov 2007. In Dec we knew we were going to be late so we called to work it out that our loan payments could be lowered. We started the loan resolution program with them. We were told that it would take 5 business days to not call that the woman named Amanda would get back with us. We waited nothing. We started calling daily and still nothing. Every day we could not get a hold of her. We would call every hour on the hour still nothing. Finally we asked to speak to a supervisor and they were so rude and nasty. At that point we were now going on 2 months late. Finally on March 19th I spoke with this Amanda lady. We were told we did not qualify that we were 1200 debt ratio in the negative and that now our loan was in pre-foreclosure and that we now had to come up with 4 months going on 5 months of mortgage. I told her we had filed our taxes and will be getting back a large portion could she extend that time and we could work something out? She gave us 45 days. The very next day it went into foreclosure and that weekend we were served with foreclosure papers. I was in complete shock. I called crying and the woman Rose with the Foreclosure department said ok. Here is what we are going to do. When your check comes in next week how much is it for? I told her 6 grand. She said Western Union that money in call with a confirmation number and we can work out the difference. The money came in before we sent it I called to verify if that was the right thing and that i wanted some sort of proof sent to me that they would stop all foreclosure proceedings. The woman was so rude. She had proceeded to spell out Foreclosure to me. And said are you kidding me. You now owe 8 grand do you think that if you send in 6 that makes it ok? I could not believe how this woman was talking to me. She went on to say that we should not have fallen behind in the first place and now we risk losing a 206 thousand dollar home over 8 thousand dollars????? I was speechless. Needless to say i gave her my piece of mind then hung up. We contacted the Ohio Department of Commerace and the Ohio Attorney Generals office and hopefully meeting with an Attorney on Wed. Please what ever you do DO NOT BELIEVE a word they say unless it is in writing. They will let time lapse and tell you they are working on it but really they are working on foreclosing on your home. We were told not to make our payments that all the late payments would be tied to the end of our loan or stretched out into even payments until we caught up. Now look what happened. What ever you do call and call and call even if you have to harass them like they do us to get some answers and always get things in writing. What they are doing is wrong and they show a solid pattern of doing this to other people such as you and I.

I am going throught the same thing since April. I sent in 179 pages to them and they where supposed to call me in 15 days. I only hear from them to ask for the payment. Everytime I ask them about my house and if they can lower my payments or anything for me at this time. They said they have not assigned it to anyone yet. I was told the last person I talked to they will call me on the 18th, that is when someone will have my paperwork. Now I call 23rd, and aks about it again and they said no one has been assigned to it yet. And if we sent the missing papers to them. I said I did not knwo what was missing. I have sent in 179 pages and they where in their.I said to the girl well when where you all going to call me and tell me they where missing. She sid on they do not call you to tell you that.I said is there anyone I can talk to? She said no there is not. The one lady I talked to about a month ago told me that when you are late for 4 months then it goes into Pre-Forclosure. She was really helpful and nicest person I have talked to. So now I again have to fax all the info again. I am sure I will probably have a letter at the last minute sent to me also one of these days. I guess I will just sit here and enjoy this house while I still have it. I have not read anything good about these people at all. So I guess I will just think of the worst to happen. And start packing. They can not sell this house for anything because I owe more then it is worth at this time. So good luck to them. I think I will win at the end. Atleast I must think like that so I do not upset myself over people like this.
