ASC will not take my payments anymore, why are they so difficult

I was paying on the 10th of every month via Western Union and ASC is now declining my payments and are foreclosing on my property. I have tried multiple lenders to refinance and have not had any luck. I am running out of time. I can't believe ASC can do this to a family

I am also a customer (not a lawyer) of America's Servicing Center (aka ASC) and have been reading on numerous message boards about the same situations over and over with customers of ASC. Such as Incorrect information given, misplaced payments, false information, lies and downright fraud.
I to am with ASC and I am also having problems. I bought my home in 2006, my loan was sold to ASC about 2 months into my loan. I have been trying to work with ASC to have my loan modified because my mortgage has gone up 400.00. I was trying to refi but the housing market is terrible and I couldn't refi for two year prior because I had a pre-penlty of 15,000. I've had my house since 2/2006 and have NEVER been late again NEVER been late. When my mortgage went up 400.00 I called ASC and told them that I couldn't afford the extra all I asked was to have my payment remain the same if they could. They told me to fill out a financial statement itemizing my bills so they can see if I qualify for a loan modification. I did, and with the amount it came up that I was in a negative by 500. So they denied my application because they said i was to much in the hole and I told them that is why I needed the modification. So they told me to redo the financial statement I did, and they denied me again. They said the reason why I was denied for the loan modification is they didn't think I could afford to pay my loan. I told them that is why I needed my loan modified, If you didn't think I could pay the new amount how do you think I will pay the $400 extra, and its going up again in 6 months. Now they are telling me to reapply. My mortgage has still been on time but I am running out of money. I have about another month and I account will be empty. I am paying 2506. and only 134. is actually going to the principle and 2400 is going to interest. I know this has to be illegal please tell me what I can do.

I was in a forebearance plan, sent the wrong amt, contacted them to advice them ($134 short)told them I would wire it, the rep said no that I broke the agreement and to wait for them contact me. Never heard from them I kept calling just about every 2-3 days, then kept telling me it was being reviewed and was assigned to a negogiator who would contact me, no contact made then I receive a new loan modification with a pmt due the following day, contacted them was told nothing can be done, I explained them this was not fair to me as a homeowner/consumer, that I was given false information. They indicated they would email to him to contact me, now await a call, which I assume I will not get in time, for then notified me that there a sale date set. I am so frustrated and stressed of losing my home which I have lived in for 20 years.

Ok where to begin. Back in November of 2007 I started to fall behind on my mortgage payment, I was able to pay a good portion of it at first but not the whole amount, and well that’s when the fun started. I called them to make some arrangements for future payments and they told me that they could not accept partial payments and that the money was put into some accounts holding. For the next few months I tried to get the mortgage caught up but was falling further behind. So in Feb. of 08 my wife and me decided to go through a consumer counseling company and let me tell you they have been great, they got me caught up completely with CIT who is my first mortgage holder but not with ASC. ASC of course would not accept any payments, every payment that was sent to them was rejected three total. And they told me that they had to have the full amount, that they would not accept partial payments. Well CCC tried on numerous occasions to contact them with no success and when they did get a hold of them they said they couldn't talk to them because they had to have an authorization form from me to talk to them. So CCC had me sign a copy and they faxed them that copy. After a week or so they contacted them and they said that they never received the document so they re-faxed it again. Well 2 weeks went by at this time and I haven't heard anything from CCC so I contacted them and they said that they never called them back. So for another week they tried to talk to them leaving messages after messages but never getting a return call, around the last of March beginning of April they got a hold of them again and they said that they still never received the authorization paper from CCC so they re-faxed them another copy. and for 2 weeks or so they tried to get a hold of them with absolutely no luck and at the end of April maybe beginning of may they were able to talk again and they still said they never received the authorization paper so when they re-faxed it again ASC told them that the form was not good enough because it was over 90 days old. Well CCC informed them that they have been faxing that form since Feb. and they claimed they never got it. But they wouldn't budge and said that they still needed and updated form, so they had me sign another form and this time they talk to their manager and that person gave us another fax number that would expedite that form. So after another 2 weeks of phone tag they said they never got the fax at either number. So they resent it again at both numbers. well in June we finally did a 3 way with their manager and we talked about why they haven't received these forms, well now here's the kicker, the manager informed us both that they got all the authorization forms but they were apparently filled out incorrectly. One form didn't have the account number in it, another they said it didn't have my middle initial on the form another they didn't have my SSN number wasn't on it so they could match it up with my account. So we talk to their manager and she said go ahead and re-fax the information again at 3 different fax numbers and they would do a rush job on the form so they could talk to CCC about some repayment plan. After around 2 weeks they claimed they never got the form. Needless to say that CCC had $5000 for them ready to give to them to get me on this repayment plan but since they couldn't work with them they had no choice but to remove them from my repayment list and send me back the money. I had no choice but to hire an attorney and from what I understand from him their pulling the same crap with him as well.
I HATE HATE HATE this company. Our mortgage was sold to them a few years ago and it's been nothing but aggravation,constant rate adjustments with payment amounts too unbelievable to even fathom.They've been unwilling to reduce our payment amount despite our requesting them to & our working with a credit repair company.I hope this company goes down and goes down hard.I would advise anyone whos even considering getting a loan with these scumbags to NOT DO IT!!!!!!!It'll be one of the worst financial mistakes of your life.
Ive just read all of the above about ASC and IM about to go mad. We have just discovered on our first call to them, what we are in for. We know that we will be in a crazy position about 3 years from now and are just trying to establish dialogue. Weve already hit a brick wall on our first call. They cant tell us who our lender actually is. They are just a managemnt company. They wont give us any names of agents taking calls for future refernce. ect ect ect.

This is for hamlet yarijanian or anyone else that can answer. We have gone through similiar problems with ASC. My question is, what do you look for to see if you are a victim of predatory lending? My loan was sold to them by Freemont Inv.
I was dealing with my county in Florida for taxes. I proved to Florida I had filed homestead, and it was going to save me roughly $600.00. The tax office had acknowled my problem as I showed all documentation required and met all criteria. The tax office even had me listed on their website as "homestead". ASC stepped in without telling me and paid the tax bill and billed me for the next twelve months. When I went to the tax office, they had told me that the bill had already been settled and there was no problem now. Now ASC has bought me an insurance policy that I already had. When my insurance broker tried to show proof that I already had coverage, ASC has continually refused to deal with them, even though I have continually authorized them to deal with my broker. My insurance broker has stated that it is the most unprofessional organization he has ever dealt with. Oh by the way, the policy ASC sold me is double the cost of my current policy I am making payments on. I hate ASC. They have contacted me twice today so far, and yesterday, and the day before...the good new is, it's almost the weekend and maybe they will take two days off from harrassing me on their crooked business transactions.
We have owned our home since 1996, we made a mistake of refinancing in 2004 and then Jan, 2005 ASC took over our loan, we started at almost 1700.00 a month, we had never been late ever before until our mortgage started to adjust about two years ago and we start to fall behind. I have shed tears over and over to their customer service on trying to get help. I had even mailed Governor Gibbons about my problem. They will not accept any payments from me as well not unless $3600 (forbearance agreement), they froze my interest rate at 9.5 at 2400.00 when they knew at 2400 I was already struggling. When they view my financial statements they tell me to cut my groceries expenses to 400.00, my gas expenses to 350.00.
I already have my two bedrooms rented out to strangers just to make 2300.00. ASC have no mercy, their customer service especially the day shift are horrible, they can make you feel so small, and so horrible that I cry each time I talk to them. I decided at this point I can rent for $1100.00 and they want me to pay $3600, do they think that my 1300 square feet home is a castle. Simply horrible, so yes please I want to joint a class action against them too.

My home was on foreclosure, I stopped the foreclosure to buy further time. If ASC would have worked with many a couple months back, it would have simplified my ability of being on time with my payments. My payments adjusted I was truthful to the company in needing some help with the interest rate and they made me feel every time as is they could replace me without a problem. As if I had no importance other than or move on. I had my mortgage sold to them about two years ago. I only asked to have faith in my ability to make things work on my end, to have an opportunity, at this point I only try to live and fight another day with my hands tied.
This is incredible, my loan was sold from Freemont to ASC within my first 4 months of owning my home. This year things got tough and I have been up and down and around the bend with ASC, finally I got them to remodify my loan with a fixed intrest rate, however the payment is still out of my budget. I think they agreed to remodify right when Wells Fargo was going under. I DO NOT!!!!! DO NOT!!!!! Recommend this company to anyone, if their is a class action suite I am soooooo on board, they and their employees (who lie, cheat, and scam for them)should be stopped.
I am a very dissatified customer of their preditory practices. I was envolved in a major motorcycle accident in 2006 and got politically pushed out of my Job in 2006 also lost a Brother due to cancer so 2006 was a very difficult year for me. Due to this I fell one month behind before this I was never late on my mortgage and ASC refused to work with me on any request that I may have asked to be done. I will be happy to see a class action suit out in against ASC.
I made a telephone payment to bring my loan with ASC current at the end of november. Even though I was behind, they said the payment I made brought my account current. My next payment was due Dec 1, 2008. I use two seperate accounts to pay them. I read them the numbers from my personal account. They drew from my other account overdrawing it and adding lots of fees of course. I've been on the phone 5 times with them trying to resolve the matter. They said they are going to "pull the recording" and never do. A couple days after this happened, I sent in a payment in the mail from the account I originally intended to use, as they told me to do. A week and half later, I called to make sure they recieved the payment because it had not cleared. They said my loan was in foreclosure and that even if they recieved my payment they would send it back. They are doubling the amount of money I owe them to reinstate my loan. They are demanding $5,500. At the end of last week, I paid an attorney $500 to try and negotiate with them. He's going to do so but how long is that going to take Im wondering? He went over bankruptcy options with me which I dont need or want to do....but of course attorneys get $2000 for bankruptcies so its a win win for them, even if they drag their feet on negotiating with the lender. All they have to do is fill out some paperwork...it's just plumbing for them....stuff they have paralegals do. Now ASC is willing to negotiate with me but I'm afraid to pay them any money, because I don't have anything in writting saying they will stop the foreclosure if I do. Then I could be out big time!!!!!!
Well I am so glad I found this website and read all your postings. I thought I was the only one having trouble with this horrible company. I have to admit like everyone else I am having financial problems, and have been sending money to ASC but I can't figure out for the life of me where my money is going. The stories about this company all seem the same. I too just received a foreclosure notice in the mail, but also called them to talk about Loan Modification. The person I spoke to could barely speak English and was RUDE!!!! She actually told me I had no business owning a home!!! BARACK OBAMA where are you when we ALL need you. I agree.. class action suit !!!!!!!!!! Times are tough for everyone and I for one feel very badly that I cannot pay my bills on time. I get up and work 6 days a week so it is not like I am sitting on my butt doing nothing. WE CONSUMERS need help from this vicious company!!!!
WOW _ I wasnt shocked by these however my poor 75 year old dad and 65 year old mother are dealing with these total morons. HOw they can even treat people the way they do and sleep well at night is beyond me. It is not the employee's business what is going on in people's lives...they need to be treated with respect. Some JERK told my mom to get a part time job on top of her full time job - my dad is now disabled..I was so angry just to hear that people (so called americans) are talking to customers like that???? OMG!!!! it makes me want to tell her to walk away and screw them w/the money - she is trying SO HARD to keep that house..she just wants a lower interest rate!!! she doesnt even want their stinking money!! uggg - signed - frustrated in colorado!

GMAC mortgage company transfered my loan to ASC. We were offered a settlement in the amount of 5000$. However something doesn't sit right with my husband and I concerning this company. After talking to the representative an email was sent with the agreement details. We requested a letter in wrighting, but never received one. The 1-800 number that we have doesnt work and no one ever answers the direct line we have. We have questions and cant get answers. Is this a legitiment company? Is ASC the same comapny as American Servicing Group?
I missed two payments due to lack of work. They denied loan modifications 3 times and now they are sending me letters saying that I owed them over $ 10,000 when my payments is only $ 2401.24 a month. They are thieves !!!!
I told them that if they foreclose my property I would take every penny I invested in the property and will cut the house down to the floor level with a chain saw and I will concrete every toilet and sink in the house. I WILL DO IT !

This is so sad I thought I was alone with this company, I called them a few months after I got laid off when my savings was at the end, I asked if they could excuse my payment for a month since I have good credit and have been on time every month over the years and before that with my other home for 12 years. she was very rude and short she said they have no program like that all money due has to be paid they are not a lender but a collector....! this was before my payment was due let me remind you, after it was late I called again and same thing rude and short and the answer was no .. so now I am almost 5 months behind and still laid off, my wife works but don't make enough to cover the payment $2600 a month and pay bills and food..you can't modify with your unemployment...!!

ASC are liars and thieves and pretty much the lowest scumbags on earth!We applied for a modification and it took 3 months for them to say no,all that time we tried making payments and they said no you dont make payments while in modification,well we get a letter saying we are denied a lower interest rate and mail us 8000.00 we mailed the money they mailed it back to us saying its in a law offices hands(harmon) and to pay them-called them 4 times last week(answering machine) left messages and still no call back! I am calling an attorney tomorrow morning after reading all the crap these people have done and if it takes losing my house and working 3 jobs to pay a lawyer I will do so to pay back these bastards!!!!
I am not surprised at all the bad on here about ASC.....My family and I just recently moved to an apartment due to these butts! We had them paying our tax bill and buying us insurance and denying us payment options which in turn caused us to file bankrupsy not once but twice! Still the paperwork we recived from them prior to our forecloser stated we hadnt made a payment since 2006 so I want to know where the 15,000 that the trustee sent to them???
My husband and I fell behind last year. We recieved a statement from ASC stating the total owed by July 31, 2008. We paid the arrears and the current amount before 08/01/2008. Imagine to our surprise that they state we are one month behind. We sent a copy of the bank statement and still to this date, 03/2009, they consider us late and the late fees add up to
over 2k at this point. Where can we go to or speak to regarding this matter? ASC are bullies and refuse to address this matter other than adding more fees. ASC is a terrible company. We pay our mortgage and it goes into a suspense account? We have had 4 modifications that keeps asking us for unbeleivable amounts of money. We tell them go to the suspense account? This has been going on for 14 months. They call everyday asking for money, ruined our credit and they have our money. No 1088 this year for interest we paid? This has caused my 59 yr old husband to have a tiple bypass last week and almost lost him over a house!! Run don't walk from this company. Oh by the way, we have an account with the Comptroller, have talked to the Atty Gen and I can't tell you how many tv stations I have wrote to. No one for some reason is willing to take this company on.So we all suffer every day.
ASC has also destroyed us. They are pushing us to work out a forbearance plan for 3 months and on the 4th have a $11,000.00 balloon payment added to our loan if we are approved for a loan modification. I just don't believe it...my husband and I got behind on payments in Sept of 2008 and have a valid reason, but they could careless. My husband and I are considering hiring an attorney and if they can't help us get any answers fr. ASC we are heavily considering filing Chapter 7 to get ASC out of lives. THEY ARE AWFUL AND I HOPE THEY GET THEIR PAYBACK....we are willing to join any law suit against these money hungry devils. God Bless each of you...we understand.
My elderly parents are also going thru modification with ASC...I saw the last few posts about how awful they are and that people want to walk away so that ASC will suffer. I want that more than anyone, they treated my mom horribly on the phone - they were less than people for things they said - BUT this in mind - please know that ASC will not lose money if we walk away - its not ASC that holds your note. It is a private holder like WELLS FARGO...ASC is simply a mortgage servicing corporation - they service the loans for their clients (wells fargo) its hard to find out who actually has your loan - but if you call them and demand to see the note - they must show it and prove who has it. As seen on the news , it can also delay your foreclosure because it generally takes them a couple months to produce it. I thought I would pass on that my mom had no luck with ASC - so she went to HOPE and they have her application and are trying to work with her - somethin you might want to try - she also just figured that wells fargo was her note holder and called them direct and actually did get some very NICE people instead of the rude, almost criminally insane people at ASC. It hurts to read what so many people are going through. However, as Sheila stated, you will have a better chance of speaking to people with hearts if you call Wells fargo directly.
When I have questions about my mortgage, I go directly to Wells Fargo. Fortunately, I have not encountered the bad behavior from ASC employees.

Since January I have been trying to work out some type of modification with ASC. I did everything they asked, copies of paystubs, listings of expenses and hardship letter. We are behind because my husband lost his job and we used our savings. ASC said they would help but they have referred us to FCL and I received a letter today stating that I do not qualify for a modification. This is after several no's over the phone but we still want to help. Oh, well I am another statistic in this mess of an economy and ASC/Wells Fargo denying assistance. I think what bothers me is when I hear about friends in which IndyMac, B of A and others have helped with loan reductions/modifications. It just makes me wonder about ASC/Wells.
I thought I was the only one having trouble. My payments went from 1500 to 2400. I called the company to say that I just couldn't pay the increase and tried to set something up but they just tell me if I can't pay the 2400 then they won't accept anything. we are probably going to get foreclosed on and it's crazy because we WANT to make payments. our house can't sell for what we paid for it due to the economy so we can't refinance. This seems really wrong to do this to people who are trying to do the right thing but are in a financial situation that won't allow us to pay these balloon payments. I'm all for a lawsuit
ASC is a monster. We have a loan with them and are no longer able to make the payment. We contacted ASC to make a lower payment until we could sell and they told me there was nothing they could do. After the house sat on the market for aboout 6 months we started taking about a short sale. We got an offer on the house very very close to what we owed and the bank took so long processing the paper work that the buyer found another house. I think they want to foreclosure!
Wow! So many people suffering under the hand of ASC! My situation is that I am now 3 months behind because of less income. I have 2 mortgages ASC carries the larger one for $1,400. I have applied for modification with Manhattan Mortgage Co. since the end of 2008, now is April, almost May and I haven't received this. So now every other week someone is coming to take pictures of the house saying they are from WellsFargo. I sent a payment to ASC they sent it back saying they only accept certified cheques. They have referred me to their lawyers who are sending me certified mail. Idealy, I would like them to modify my mortgage and work out something for me to keep my house as they say I'm in a foreclosure process or something to that effect. I now have a little more income and I don't know at this point if they are really going to do the modification or foreclose on me because everytime I try to speak to someone it's always a different story. God Bless everyone of us dealing with the company. Our story goes much the same as the rest on this board. sold to ASC after new century went under and have been behinde with ASC from day 1! They said they didn't get the money from new century, then it was not credited to our account correctly, etc. so we did our 1st loan mod. that was 3 mos into being with ASC and only 7 months after buying our home. Since then problems every month. Refused payments, late fees on late fees, and we are currently 18 months behind (ASC will NOT accept payment while you are filing a chapter 13 and WILL continue to foreclose!) ASC has two payment of our sitting in a suspense account some where for the last 20 months. "can't deduct that from what you owe mam we demand $15,0064.78 in full today to correct you errors" I wish I did have that kind of money just laying around to get these jerks off my back but...I just know once I solve this problem with them it will be something else. I hope ASC goes down HARD and never recovers! If there is a class action lawsuit out there I want in!
I am not sure I can add anything other than what has been said. I am going through a divorce and they have hit me with over $25,000 to re-instate my loan, that they told me I could make partial payments on in order to not go into foreclosure. I made partial pymt at the first of the month and the remainder by the 15th, they consindered this past due, did not notify me and for the next few months I did the same. Only when I recieved a certified letter from an atty did I realize there was a sale date for my home. They simply took my money and placed it in a non-interest bearing account, just there, no reason, just left it there and then stated I was behind. I have attempted MANY times to communicate with them. I see so many comments, obviously we are not writing to the correct people. There must be SOMEONE out there who can help ALL these people. I am in on any class action suit out there. This is the most horrible company I have ever dealt with. Why doesn't the federal government get involved with this type of out and out deception by a mortgage company. There are so many people being effected by this, I do not understand why NO ONE can help. I have the same issue as many with the taxes and HO insurance, they have just taken upon themselves to escrow these funds, I had both covered until they decided they would pay them out of my pymt, which is out of this world high. Oh well, unless a regulatory agency will get involved, we are all just simply 'out of luck'. So much for the 'average' American trying to make it in the world.
here is an update to my sept 08 comment. it has been 18 months and i lost my home. i faught with them, hired a lawyer i even went through hope and they won. they got my home. if you get to far behind in you mortgage with these people i am sorry to say you will lose your home. also if you think hope will help think again. they flat out told me that ASC didn't have to work with them. also they were more enthusiastic about helping me with a short sale than trying to help me save my home. So my advice, if you can pay all late fees and past dues all at once then do it. if you can't then be prepared to move cause they will not help you save your home. good luck.
Wow!! after reading the complaints I totally understand, no mater what your situation is they DONT CARE so I propose to all of you that are in this hard ship. If we could get everyone that has their morgage w/ASC don't send them a pmt for 2 months that will make them talk
Okay, I SEE I am in the same situation as everyone else. I thought it was just me. I have been having problems with ASC every since they got my loan. The people who help me the most NACA. I am getting ready to contact them again. ASC is scamming and conning. We all can't be wrong and ASC all right. There is a problem with this mortgage company. I have been in and out of foreclosure with them for years. They have modified my loan and then acted as if there was not modification. They tacked on an escrow and pmi which were neither in my modification. Tell them Akua Jackson suggested you contact them. ASC modified my loan back in August of 2008. I am contacting NACA to let them know that ASC, a year later are still trying to foreclose on my house. They want me to do a short-sale. A short sale is a foreclose but it will only hurt your credit for 3 years. Personally, I do not know what there is to talk about. They need to learn how to manage their company. I really think the right hand of their company does not know what the left hand is doing. As a result we are all getting scr??#. We are all feeling their mess ups and screw ups.
Would be onterested in a class action suit against wells fargo and ASC as they are definitely a curuporganization and I see signs of rackateering on their part. They must be held accountable...
I have posted a comment before on this site, and yet I continue to have issues with ASC. I thought the economic recovery program was to "encourage" banking and mortgage institutions to modify and re-finance existing loans as to not have millions of families lose their homes? With all of these comments over and over, I guess my question is who reads them, besides those of us who write. Obviously nothing is getting done just "telling" our stories, maybe we should send this link of complaints to the federal recovery act and see what they say? We can not all be over exagerating. This is crazy, someone needs to step in and help all of us.
The only thing I can surmise from the business practices of ASC is to conclude that the business the mob went legit on is banking. Only now they get to write the laws, buy the politicians required to pass legislation that makes the consummer a virtual monitary slave to them. They buy and sell your house to the extent that a retired schoolteacher in Norway is holding a now worthless instrument, that she was forced to write off and try to find a job at Burger King..This is what happens in an UNREGULATED free market. ASC is according to ASC ( Asubsidiary of Wells Fargo, in case you were not aware) only a servicer for SOME investors, but try and find out who these investors are. How do I know if they are wanting to collect funds that have been written off with the help of the FED. I am begining to think that capitalizm (which I once admired has been taken over by a corporate criminall element who will not be happy untill we come down to a new world order in which I am a sharecropper and THEY are the whips.....I am seeking legal advice and supporting the NRA and the ACLU to see how many layers does this enterprise has.....

When my mortgage went up 3200.00 I called ASC and told them that I couldn't afford the extra all I asked was to have my payment remain the same if they could. They told me to fill out a financial statement itemizing my bills so they can see if I qualify for a loan modification. I did, so they denied my application for stupid reasons. So they told me to redo the financial statement I did, and they denied me again. They said the reason why I was denied for the loan modification is they didn't think I could afford to pay my loan. I told them that is why I needed my loan modified, If you didn't think I could pay the new amount how do you think I will pay the $310 extra, and its going up again in 6 months. Now they are telling me to reapply. My mortgage was on time, but them they apply surcharges, lates fees, insurance payments despite we have our own insurance and hiden fees that I don't know where they come front, I am paying $3.236.oo and only 134. is actually going to the principle and 2400 is going to interest. I know this has to be illegal please tell me what I can do. I also was informed that I have a predatory loan, And Weichert knew the situation, but the Weichert loan officer used wrong information altered the numbers by the time promising us that we were qualified. Between ASC and Weichert ruined our lifes and they stole our little savings of years. Weichter also committed fraud with my interest.

I was also in the same situation with ASC, My first post was April 25, 2008, kept sending in financial statements trying to get my loan modified and they kept denying me. I went through a company called NACA. I started with NACA about 3 months ago and ASC has modified my loan. I was in an adjustable rate and it first adjusted to 10.07% my payment started at 2500 and went to 3100. After I went though NACA, ASC did modified my loan to a 4.75% fixed rate with a new payment of 1667. so my advice is keep on them and contact NACA don't give up and don't let them take your house that you work so hard for.
ASC was my mortgage company. They increased my payments by $250. I couldn't pay it and fell way behind in my payments. They wouldn't take any partial payments from me. They said it had to be all or nothing. They wouldn't budge at all. They forclosed on my home. A few months later I got a letter from them. They had lowered my payment back down $200! Morons didn't know what they were doing, they already had my house!
I have been going through a lot of nothing with these people. I had a year from hell in 2006 with a major Motorcycle Accident with my girl having major head trauma and losing a brother from cancer and politically getting kicked from my job it has just been a night mare. I had fell behind on my mortgage not because of missed payments but because of taxes which are now in escrow and they had paid the taxes and added on all these late fees and other fees and I had filed with them for a loan modification and they had went up on my loan instead of down now they have gone to the point of not even wanting to except my payment and telling me that I am in Foreclosure and I don't understand how this can be fair bisness practice when I am calling to make my payment and they are refusing it. Please can someone help me with this matter I don't see how they have the right to take the house I have been paying for and throw me and my children out when they are the one's refusing payment they are nasty hateful people and something needs to be done quickly with them.
ACS foreclosed on me and by doing so they breached the mortgage contract and violated the "Fair Debt Collection Act." as well. I requested my loan history to see all the applications of payments transactions posted on my account for the last year of 2009 and they refused to provide. Under the "Fair Debt Collection Act." I have the right to the information I requested . They breached the mortgage contract because there is no true default on the mortgage payments. According to the mortgage contract or the "Deed of Trust" they can foreclose only if there is a default. I have always paid the mortgage on time either in full or according to ACS terms under loan modification plans during two trial periods pending disposition of the applications. The amount I owe are the discounts of the trial periods and now they want me to pay all the discounts at once called it default and moved on with foreclosure. ACS violated Fair Debt Collection Act by not providing the information I requested on my loan and foreclosed without default just to get the money back from the trial periods discounts for which they agreed upon, especially that I was current with my mortgage pmts when I applied for loan mod. They are good to pay for all the damaged they created and fined for breaching of mortgage contract.

My husband and I have completed the 3 month trial period in February 2010 and received the final modification agreement paperwork on March 10th. We were dealing with ASC/Wells Fargo and after reading so many complaints I was a little surprised since we have had no issues with them. We called them at the end of November when we fell behind in our payments and they asked us a some questions on our financial situation and sent us out a HAMP packet. We filled it out ASAP and sent it back with all information requested. We called about 3 times during the whole process and was assured everything was good and they had all required paperwork from us.
I was a little stressed out after making the third trial payment and not hearing anything so I was researching things online about the process. This is where I found out about the NPV test and whether or not it would be wise for them to foreclose or give a modification. You input your information and it will say whether you pass or fail for a loan modification. In my case it would have cost them $93,000 to foreclose on my home and with a loan modification they would have made $43,000 so I passed the NPV test and a few days later is when I received the package from UPS.
My terms are first five years 2% interest, year 6 3%, year 7 4% and 8-34 5%. My loan was extended from 26 years to 34 but dropped my payment from $2482 a month to $1403.70. During my trial period my payment was $1302.00 but they needed to add in the shortage of escrow and interest from the months that I was behind before the trial started which is why it was slightly increased. This back amount is extended over the first 5 years of the loan. After you sign your paperwork and send it back DO NOT expect to have it sent back to you after they sign it, that won't happen. I know it states it on the paperwork but that's why they tell you to make a copy. It can also take up to 2 months to start receiving updated statements.
They also look at debt/income ratio and would like you to be at no more than 50% after the modification to grant a permanent one. This also varies by lender and is not set in stone. From all that I have read though if you fail the NPV test you will not get a modification since it would be more cost effective for them to foreclose. I hope this helps with some questions and realize that some modifications are being permanently approved. FYI my husband and I did the paperwork on our own and didn't spend money to have this done. They are looking for a certain figure at the end and I am not sure what that figure is but they definitely do not want a deficit. Good luck and any other questions I will be glad to answer. 26mos triing for a mod they say i qualifiy but they say the computer will not allow them to modify my loan i have muliple investers i went to US BANK NA they looked up my loan they said to get help becouse my loan has problems ASC lies they are not being honest im going to file a fedreal law suit for modification fraud i think this is they only why to find the turth they will not tell me who they are collecting for is if my note real has a pmt due i belive that my note was paid off by a bail out, i belive they have insurence that will pay them if they fourclose but not if they modify if anyone can help let me know.

This process takes up to 30 days. I read that when your with a private investor, they could be over seas or in another country! Check out Mers, google it. This tell us about the mortgage pool and that investors can sue the servicer for modifying these loans because they are stipulated when they were purchased by the investor. So, private investors are not a good thing. I will know if I was granted a mod on 12/19/11.

Boo Hoo!!! You borrow money you have to pay it back. No where in any of your original loan notes does it state if you get in trouble and cannot pay you will get help. No, it says legal action will be taken upto and including foreclosure. Just like a car note, if you miss payments they come and get it.
