What to do now...

March 24, 2008

Our house was sold back to the bank at a sheriff's auction. We did not find out that this was scheduled to happen until a friend who attends these auctions told us it was scheduled. I then contacted the attorney who told me to contact the bank to postpone. I also scheduled an appt to file Chapter 13. The bank never got back with me about the postponement. I sent them a fax stating that I was filing Ch 13 and asked them to postpone the auction so that we could get everything processed and to them. (My husband was laid off~this is why we are in this situation~but now income is good and we want to keep our house) They would not postpone the auction~it went back to them. I have written letters and sent them to everyone that has anything to do with this issue. (Bank, foreclosure dept at bank, 2 attorneys, and the sheriff) I have asked to be able to refinance, rent, or at least have time to find a place to go for our family of 5. No responses from anyone. So, last week, I sent copies of everything to the judge asking for him to allow us more time. Again, no response. Yesterday, there was a notice left on the door that said we would be locked out on Monday. We still have NOWHERE to go. I have called and searched and driven, there is nothing that is large enough for out family. We still want to keep our house, in any way possible, if there is one feasible. But the more dire situation is the eviction on Monday. There is no way to pack and move by then. We have three children and a large house that is full.

Hello. I was wondering what happened with your situation? Im in that exact situation as we speak? my bank is accredited and I have an attorney as well. I got the letter on my door this morning....please advise asap. any advice is appreciated!!

This is just terrible!!! And the banks have no reason to even negotiate with this family as long as big government is giving them our tax $$$ to bail them out. Who bails out the little guys? The president passed a new FHA loan program to help people like you, that was to roll out beginning 10/01/08, but I have checked with several mortgage people, and they still don't have the guidlines in place yet. From what I understand of the new program, they will give you an FHA loan for 90% of homes "Current" value, and bank has to agree to eat the difference, and it is not contingetnt on your current credit score. The main catch is, you can only own 1 property period. Click on my name below for more info.

So I found out they want to Foreclose and stated in May 2010 I hadn't paid in 14 months. They waited til now to do it? The lawfirm Zielke and Shapiro in Bunrsville, MN, told me they would check first and then file, well they didn't. So now I am out 43k so far, and they want the house too. I need an attorney asap.

Oh and this is HSBC, they are fraud from the get go. I wanted just to be credited now, I am suing for everything. Sick of being harassed by them. They need to be shut down. I have filed complaints OCC, FDIC and the Attorney General of MN and The IRS, becuase I lost out on taxes too.
