They have not contacted me, do you think they will forget about it?

Come April we will owe four payments to the mortgage company. my wife is currently the only one employed. my question is i have a settlement coming in April i was just wandering if they will take my home before the end of April,even though they have not contacted me about foreclosure.

On May 20, 2009 I received loan documentation for the Making your home affordable program from Pauline. My situation was that I was current on my mortgage and had never made any payments late however I was constantly be denied for refinancing options to lower my payment through other financial institutions. I submitted the application and provided all of the documentation to the SunTrust Loss Mitigation department and was approve to start the trial payment process. The process began on June 1 with all payment to be made by the first until the final payment on September 1, 2009 which at that time I would receive further information in regards to the program. ALL payments were made on time, however in September I received a check from SunTrust made payable to me that referenced misapplication reversal payment (made copies of the check) and I returned it via regular mail to Pauline and called to follow up with her in three to four days to make sure that she received the check. She confirmed receipt of the check however she was uncertain of what to do with the check; she promised to call me back with her findings. Well she never followed up with me so I ended up weekly contacting them to confirm receipt of the payment, it wasn't until the last two weeks of September when I spoke with a representative that the payment was found and I was told that the payment was applied to the October payment and everything was fine and I wasn’t due again until Nov 2. I asked her to make sure that this was concrete information that she was providing me because my financial situation was not going to allow for two payments down the road, she confirmed. Every month I would call because I wanted to make sure that there was nothing else that I needed to do, I then received the Making Homes Affordable pack and to return this information signed and notarized if I wished to be considered for this program and have my loan modified. I returned the documents and every since that information was sent and dated October 9, 2009 I have not received anything else in the mail in regards to the modification of my loan. I did call every single month because I opened every single piece of mailing from SunTrust and called to follow up after every statement because the statement were reporting very high payment amounts each and every time I was told to be patient that the loan had not been finalized yet and those statements were going to appear that way until it was finalized, again agents from Loss Mitigation reported CURRENT STATUS. I started to receive late payment calls after my November payment and immediately called back but because the calls were coming from the collections area, one hand was not talking to the other and I was referred back to the Loss Mitigation department again they confirmed that the payments were current. I spoke with another rep on 11/19/09 she confirmed that a payment was applied incorrectly but assured that an email was being sent to fulfillment to correct the issues and for information to be submitted to the credit bureau where mind you these incorrect reporting from SunTrust have resulted in a 747 credit score to a now 627 credit score. Several more calls totaling 7 calls in December, Dec 7, Dec 10, Dec 11 which noticed that there was an L stop that was not removed from my trial payments causing misapplied payments, she sent an email to fulfillment and I was promised a supervisor call back (1 non response to supervisor request), Dec 17 spoke with them again, told status was fine, Dec 22 called to check status of the fulfillment request told to give them time to complete it. January bought about more issues my payment was made as all others were on time and now SunTrust is still reporting me past due 30 days. I again requested a supervisor call back, sent an email to them (2 non response to return call), and left several messages for them with no return calls. I called on 1/11 or 12 and requested that a supervisor please get back to me they didn't return the 1/15/10 call (3 non response call. And so on and so on 4 more calls in January. My last call was 1/28/10 were I spoke with somebody who was at least able to tell me that the check that was mailed to me was mailed to me in error and that that check was misapplied and mailed to me in September but that it was SunTrust error and the check shouldn't have been mailed to me. I was explained that this was a contribution payment, mind you I have not seen any documents since October and when I asked him to explain what this contribution payment was he couldn't tell me what it was but that it was not applied to my October payment as I was told from them at the end of September. I have explained to 14 different representatives the same story about this check and it possible being the problem but again was told not to worry I was current. So now, because of SunTrust error and lack of communication to me they are now asking a person that came to them with financial problems to make two payments in February, I do not feel that this is right, I have done everything in my power to uphold my part which was to make my payments on time, which again by the way were never late from the beginning to now partially ruined credit. I contacted (Green Path) through HOPE today and spent 3 hours on the phone ½ day off of work to try to rectify this problem and still SunTrust continues to admitted that check that I returned to them was sent in error but are not trying to do anything to fix the problem but get more money out of me for January that was already paid. I talked to a company that deals with playing a liaison between the banks and government programs has never heard anything about a contribution payment. I have spent countless hours from Sept-Jan to trying to make sure that I was doing everything required of me trying to save money and reduce my rate has caused me mental anguish. We were told that I would receive a call from them, but he could not tell me when. Please step in to help, I am a single mother and I was only trying to help to avoid payment default down the road because of my financial situation but in the process they have wrecked my credit and are now requesting additional money which was an internal error and if communication was made to me at that time I could have made October payment as I had constantly made payment in the past. I have also filed a complaint with the FTC as well as a call into SunTrust supposed customer complaint line official and formal complaint filed with them on 1/29 still waiting on a response to this complaint supposedly escalated to upper management. I have since received a letter from the Executive office of SunTrust requesting a repayment plan which to me is not justice, also they have not sent me a letter in regard to the 2/2010 reporting to Equifax for the derogatory reporting that has dramatically effected my credit scoring from a 756 in 2009 to a 600. I was promised by the executive office that this was not reported but that it would be reviewed and I would receive a letter in the mail to supply to the credit agency. I can supply the credit report upon your request. What I want as a resolution to the problem caused by SunTrust is for them forgive this payment, not me repaying it and to restore my credit by fixing the February issue that executive office is stating that they did not report me but Equifax had to receive it from someone and I have proof.
OMG WOW this is like deja vu as Bank of America has done this same almost exact to the letter thing to me!! We were on auto pay draft and they missed 1 but we never found out till way later but ya the simplest solution to ours as well was just move this pmt to the end of the loan, and continue the auto draft pmts like nothing happend----- they refused so now we sit at bad score due to their reporting, and like u the economy and our budget extremely tight and this mess up by them took us from bein on time every time to having to pay near 30 days late because of the reverse snowball effect it had. Budget is still tight but if they would of just fixed their messed up thing, we could still be making that 7% interest rate pmt, now due to them we can't even get refinanced to a lower interest rate, to lower the pmt, to free up a bit of money each month in that tight budget for more savings and more fixingup on the house - guess we could just let it fall apart and desrepair and leave but ur right been there too long to let my equity go







From what I have researched about this issue if you go into foreclosure it looks they will auction off your house in 3 months. I am dealing with this right now, I just found out we are in foreclosure and they did not contact me either.
