I did what Suntrust said now they refuse to help me

March 19, 2008

My mortgage is through SunTrust. I provided a hardship letter along with doctors' letters, after my son's accident. I was off work without pay to care for him. Then my former company merged and our pay schedules were off, causing me to lose a week's worth of pay. All this was provided to SunTrust. They requested that I fill out some forms and fax back to them. They 'said' they would help me out any way they could. I even offered to pay partial payments. They refused to accept any payments. Then in Jan 2008, I receive foreclosure notice. I paid Feb. & March payments, thinking that a company called First American was in the process of helping me. I set up a phone appointment but never heard back from them. I've been advised to request either a REINSTATEMENT, REPAYMENT PLAN OR A LOAN MODIFICATION, but i can never get a hold of anyone. I'm afraid that I'll come home one day and can't get into my home.

We also did what suntrust told us to do, now they will not help and we are in foreclosure. Anytime we call they forward us to the lawyers. We made a payment so we should have only been 2 behind and they kicked back the payment and sent us into foreclosure there has to be something we can do. We fell behind cuz they said they would help and after we were behind they said you have to pay everything up to date before we can help you...This company is unfair and should NOT be able to do this. We have 6 kids, medical bills and I am a business owner. We want to take legal actions and get everyone involved that suntrust has done wrong to. Please email me if you want to help or also need help, there has to be something we can do if we all come together.

SUNTRUST Mortgage - Avoid this company at all cost!!!!

I am desperate to refinance, and can't. It's true what was said above, you do what is told to you.... and you get screwed. Speaking to someone on the phone is a waste of time, because it almost always turns in to a case of ...... "there is no record of that....".
I HIGHLY suggest that if you have to call the Suntrust Mortgage customer service number you do what I have resorted to doing.
MARCH into the local branch, ask for the branch manager and have them call the corporate number from their office! That way you have a company associate witnessing what is being said/aggreed upon over the phone. After 3 consecutive years of Suntrust F***ing up my mortgage.... this is what I do.

The company policy of sending back partial payments is about the most ignorant thing I have ever heard of! It's no wonder that banks are failing.... hope Suntrust goes under next!

I am about ready to send them the keys and tell them they can have the house, no home is worth all this hassle.

My situation with SunTrust began in Sept. 2008 when my husband got laid off of work. At that time I contacted them and asked for any type of assistance that they could give me in paying my mortgage, but there response was “Nothing we can do for you unless you are 90+days behind.” So, apparently there was nothing that could be done at that time. We were able to pay our bill on time until January of 2009, when we started to fall behind again. I made another call, same story. When Obama passed his plan this year, I immediately started the loan modification process. That began in April, after five months, countless phone calls and hours on the phone; I finally got my loan modification package in the mail in September. Hoping for a miracle, a major disappointment appeared before my eyes when I opened the package, the mortgage had only decreased $11.00. How could that be, considering we had such a dramatic decrease in our income. According to SunTrust, they only take our income into consideration, not our debt. But, they told us to send back the paperwork unsigned and they would look for another workout option. So, here we go again! As of today, we are 90+ days behind on our mortgage payment, as SunTrust once told us to do. When I called and asked for help I am now told they can’t help me because I am 90+ days behind. When asked about their previous statement of “having to be” 90 days late to receive help, they said that things are different now. How convenient for them! We received our letter of default but are told they won’t proceed with the actual sale of our house because we are in the loan modification process, but I am sure that’s a lie too. I am very interested in talking with others about hearing what your situation might be. I am also looking for any advice that someone might want to give. I am going to fight this all the way through, to the point where SunTrust will WANT TO GIVE ME BACK MY HOME!!

Does anyone know if a "class action suit" has been filed against SunTrust for advising borrowers to default for 90-days (destroying what is left of their credit) and then denying loan modifications so the property can go to foreclosure? What is going on is criminal.

lets ban together ..this is criminal. why didnt i find this site earlier. they are liars and crooks! didnt they start this economic downfall in the first place. now my husbands job is affected causing us to fall....i consider it all a blessing now because after 2/2 when my home is sold and foreclosed i will no longer be a slave to a finance company! everything will be saved and paid up front..the banks will pay ME intrest. lets see how long they last if we all do that! then maybe they will listen.

I am currently in a foreclosure lawsuit with Suntrust, who had no idea they were sueing me until I filed a Request to Produce upon them. They didn't produce anything I asked for, namely the recorded telephone conversations I asked for. My story is very similar to the ones I read above. Only, mine stems from Suntrust's error in not notifying me of my escrow deficiency (because of their ADMITTED failure to analyze the escrow in a timely manner!). As they told many of you, they told me they cannot help me lower the significantly increased payments until I "defaulted" my loan. I did everything they asked me to do and they still filed foreclosure. I'm now trying to mediate with their attorneys. I have seriously considered filing a class action suit against them for deceit, slander and defamation of character (I'm sure we can add a couple more complaints in there). I refuse to give up without a fight. If anyone is interested in joining me, please post your interest.

I agree totally with all that has been stated here. I am a Mortgage Broker, and since none of the banks are lending money, my business is almost non-existent. After all I can take loan applications all day long but with appraisals coming in low and the lenders steadily increasing the credit standards, very few loans are actually being funded. I have several clients in this situation I have tried to assist without charging anything unless we actually accomplish something, little chance if that. Once upon a time I actually told my clients that if their lender was SunTrust, you were better off dealing with them directly rather than paying an outside agency to work for you with out any positive results. At this point it is beyond me, more foreclosures, means lower values, meaning more people upside down in their home. It seems obvious that since a lot of Mortgage Brokers are looking for work, then companies like SunTrust should hire local representatives to visit these homes and give SunTrust some return on their investment since something is better than none, and it would help families stay put until we see some kind of economic turn around. Simple, yes, don’t bet on it, the trend of foreclosure seems to be the way they want to proceed, with no consideration of us, it looks like more Tent Cities will be built, and then city ordinance will tell you its illegal to camp here. I think its time to raise hell, and let the media and these clowns in the bank know, you are not only hurting the Real Estate effected, but you are destroying families, children, the elderly and way too many more to mention here. I appreciate posts like this because if anything maybe someone will get the message, I doubt it but it’s worth a try. The government refuses to demand that all foreclosure be stopped and the lender must work out a program to help, but now they can insist that your Sons and Daughters go to some sand castle desert and fight and Die for the American way, what is that, Screw the Little Peoples. Revolution.

SHE BRINGS HOME AROUND $900 PER MONTH.AFTER PAYING FOR OUR INSURANCE.WE HAD A COMMERCIAL LOAN WITH SUNTRUST,FOR A OLD COM. BUILDING THAT WE TURNED INTO
A HOUSE.THAT WE'VE BEEN LIVING IN FOR AROUND 5 YEARS.BACK IN OCTOBER
WE CALLED SUNTRUST TO TALK TO SOMEONE ABOUT MAKING HOME AFFORDABLE WE FINALLY GOT IN TOUCH WITH SOMEONE THAT COULD HELP US HIS NAME WAS DERRICK HE SAID SUNTRUST HAD A HOME RETENSION PROGRAM BUT HE COULN'T DO ANYTHING TO MODIFY OUR LOAN UNLESS WE WHERE 3 MONTHS BEHIND (WE WHERE NOT BEHIND ANY ON OUR LOAN)
I ASKED HIM IF I GOT BEHIND 3 MONTHS WOULD HE BE ABLE TO HELP US, AND HE SAID, YES. 3 MONTHS WENT BY.WE MADE OUR 4TH MONTHS PAYMENT AND WE GOT A LETTER FROM SUNTRUST REQUESTING THE $83,000

WE STARTED WORKING WITH BRIAN BOVBJERG IN ORLANDO W/ SUNTRUST
THE ONLY THING HE COULD DO WAS GIVE US A NEW LOAN. BUT WE RAN INTO A PROBLEM THE BUILDING WAS IN THE NAME OF OUR OLD BUSINESS.
A BUSINESS WE CLOSED 5 YEARS AGO
IT WAS GOING TO COST $2,500 AND A COUPLE MONTHS TO PUT IT INTO OUR NAMES AND BRIAN KEPT TALKING ABOUT FORECLOSING ON US. WE KEPT TELLING HIM FORECLOSER WAS NOT AN OPTION FOR US BECAUSE WE HAD AROUND $220,000 EQUITY IN THE BUILDING
WE ALSO KNEW WE HAD TO SPEND AROUND $2000.00 TO GET OUR LOAN PAID UP.ON FRIDAY JAN. 29, BRIAN SAID HE HAD ANOTHER POSSIBLE OPTION. WE COULD TRY TO SETTLE OUR LOAN WITH SUNTRUST.HE ASKED IF I COULD COME UP WITH $40,000

HE SAID WE HAD A PROBLEM. HE JUST FOUND OUT OUR BUILDING WAS WORTH $300,000 HE SAID SUNTRUST WOULD BE BETTER OFF TO FC SELL THE BUILDING, GET THEIR MONEY BACK AND MAKE MONEY. HE SAID THE ONLY WAY SUNTRUST COULD SETTLE WAS IF MY BUILDING WAS ONLY WORTH $30,000.
HE SAID OUR ONLY OPTIONS WHERE FOR SUNTRUST TO FC OR WE WOULD HAVE TO PAY TO PUT THE BUILDING IN JEFF AND LAURA NAME. A FEW DAYS LATER I FILED A COMPLAINT TO THE FEDERAL RESERVE OF ATLANTA. COMPLAINING ABOUT DERRICK W/ SUNTRUST TELLING US WE NEEDED TO BE BEHIND 3 MONTHS BEFORE HE COULD HELP US. AND BRIAN TELLING US WE COULD TRY TO SETTLE THE LOAN. US SPENDING THREE DAYS PLANNING, GETTING OUR HOPES UP AND GETTING THE $40,000 THEN, BRIAN TELLING US HE CAN'T SETTLE.
FEB. 25, 2010 I RECEIVED A LETTER FROM CHERYL POTES FROM SUNTRUST IN RESPONCE TO THE FEDERAL RESERVES INVESTIGATION INTO MY COMPLAINT.
IN SHORT, BRIAN TOLD CHERYL A BUNCH OF MADE UP CRAP ABOUT WHAT WAS GOING ON. HE SAID HE WAS WORKING WITH ME TO ACCOMODATE MY REQUEST TO MODIFY OR SETTLE THE LOAN. BRIAN, IS THE ONE THAT SUGGESTED WE SETTLE.
HE ALSO SAID THE REASON WE WASN'T ABLE TO SETTLE WAS BECAUSE WE DECLINED TO HAVE THE PROPERTY APPRAISED, THIS DOESN'T EVEN MAKE SINCE, I DIDN'T DECLINE AND WHY WOULD I DECLINE AN APPRAISAL
I ALREADY HAD THE $40,000 TO SETTLE. A FEW DAYS LATER I CALLED BERTHA SMITH AND TOLD HER MY PROBLEMS W/ BRIANS STATEMENTS. SHE JUST SAID THERE'S ALWAYS TWO SIDES TO A STORY. AND SHE COULDN'T REVISE THE LETTER BECAUSE IT HAD ALREADY BEEN SENT TO THE FEDERAL RESERVE. MY PAYMENT IS NOW GOING TO BE $950.00 A MONTH UP FROM $898.00. ORIGINALLY I WAS JUST WANTING A LITTLE ADJUSTMENT SO WE COULD MAKE OUR MONTHLY BILLS WITH OUT HAVING TO SELL SOMETHING EVERY MONTH. AFTER WRITING THIS COMPLAINT I RECEIVED A CALL FROM BRIAN TODAY ON MY VOICE MAIL. OVER A WEEK AGO WE TOLD BERTHA WE DID NOT WANT TO TALK TO BRIAN AGAIN. WE DID NOT TRUST HIM. WE WERE ASSURED BY BERTHA WE WOULD NOT BE CONTACTED AGAIN BY BRIAN. HE SAID BERTHA WAS A LITTLE UNDER THE WEATHER SO HE WAS CALLING US TO LET US KNOW WE WOULD NEED ANOTHER $1000.00 TO FINISH UP THIS LOAN. WE HAVE ALREADY PAID $2006.33 TO SUNTRUST FOR INTEREST AND LATE CHARGES AS REQUESTED IN CHERYL POTES LETTER. PLUS $2500.00 TO RE-OPEN OUR OLD BUSINESS. I'VE BEEN SELLING MY COLLECTABLES AND ANTIQUES THAT I DIDN'T WANT TO SELL AT OUR LOCAL FLEA MARKET AND E-BAY TO COME UP WITH HIS MONEY.
I WILL HAVE TO START SELLING EVEN MORE TO PAY THIS EXTRA $1000.00. THIS COULD TAKE ANOTHER MONTH AND I KNOW SUNTRUST WANT LIKE THIS.
I DON'T KNOW IF ANYONE HEARS ME, BUT I DON'T HAVE THIS KIND OF MONEY, IN THIS ECONOMY. UNTIL TODAY NO ONE HAS TOLD ME ANYTHING ABOUT THIS EXTRA $1000.00

PLEASE DON'T TAKE THIS AS A THREAT.

Subject: SUNTRUST MORTGAGE REFUSES TO HELP MODIFY MORTGAGE

What is a home owner supposed to do with a home that is severly underwater, in foreclosure and has a bank that refuses to offer and work with any of the Obama plans that have been offered to help home owners keep their homes ??

My mortgage company Suntrust Mtg, is refusing to offer any of the Obama plans to their customers that need help. They have told me that it is cheaper for them to foreclose on me, kick me out of my home, short sale it to someone else instead of working with me to reduce my mortgage payment and the principle due and help keep me in my home.

I have no where to go, I have no family here, I have lived in my home for 6 years - never once was late on a mtg payment of $2200 until Dec 2008, due to several auto accidents I have some permanent disabiling injuries and I am now on SS Disablilty. I need to stay in my home but I am having no luck with Suntrust who is refusing to work with me. They have already started foreclosure on me and have advised me to use my time to find another place to live or figure out a way to start making more money, instead of working with me to help me keep my home.

Oct 2008 I contacted Suntrust and adivised them I was going to start having problems in paying my mtg. payment, they told me they could not help me because I was current on my loan. The only way they could help me was to stop paying my loan for 3 months than once I was late for 90 days than they could help me. So, Dec 2008 I stopped paying my mtg, because I couldn't make the full payment any longer and they would not accept a partial payment. Here we are April 2010, my home is in foreclosure and they will not help unless I can make $5000 a month in income. Which is impossible because I am on Permanent Disability/SSD with numerous spinal cord injuries.

It is very frustrating to see that some homeowners are able to get assistance depending on whom their mortgage is with, but if you have a mortgage company like I do with Suntrust who absolutely refuses to work with you - than what is a homeowner to do ? HUD agencies cannot help, because it ultimately comes down to the bank being willing to work with the homeowner to reduce payments or the principle balance.

I told Suntrust that it was now mandatory to go to mediation before they could foreclose ..... they said it doesn't really matter. If the bank does not want to participate in any reduction of the loan there is no judge or mediator that will force them to do anything they do not want to do - and they will continue foreclosure proceedings to kick me out of the home.

I have an attorney who has filed in court to dismiss the foreclosure for improper filing bank in Nov 2009. But we have heard nothing from the banks attorney at all. I understand if we do not hear thing by Oct 2009 the Courts will automatically dismiss the foreclosure for lack of prosecution on the Plaintiffs side.

Wow! I have the exact same story as Kelley R. AMAZING! I have beein in this for over a year and I'm sick about it. They told me on the phone to stop paying or we won't help you! I want that recording!

If you have been foreclosed on and there is an active case in the court system, you can do a Request to Produce to request a copy of the phone recording. Suntrust won't give it to you within the 30 days they have to produce it because they either don't have it or they're too scared to give it to you. Then you can file a Motion to Compel and get a court date in front of the judge. The judge will then decide if they HAVE to produce it or not. I think if more citizens start fighting back the judges will start getting pissed off at the mtg companies. Don't stay quiet! Fight for your house! I managed to save my house, got suntrust to cut my payments in half. They're attorneys hated working for them because suntrust wouldn't even cooperate with THEM. We settled on my modification after a phone conference between me, a rep from Suntrust and Suntrust's attorney. If you have been filed on, check your local clerk of court's office and find out who Suntrust's attorneys are. Then call them directly and set up a conference. You do not need your own attorney for this.

I lived in Boston in 2004 after signing a contract with Avatar in Kissimmee, Fl to have my home built. After contacting a mortgage broker and title company in Kissimmee, the broker assured me by phone that he had "several" lenders that would be willing to give me a loan based on my credit score. I moved to Florida, stayed with a friend and three days before the closing got a call in work from this broker saying he had some bad news. The news was "no one" would give me a loan???, but that he "personally" would give it to me since "he" felt so badly about this. Well, you can image my hysteria. He wrote the loan for 24 months and they said he would help me find another Mortage company. Well, we found SUNTRUST. They more than willingly gave me a loan in July 2005 at 6.75% for 30 years. I had a wonderful job and then in July 2009 my income was cut from $1000 per week to $250 (salary plus commission). I was in the furniture business which the decline in the housing market greatly affected. Now I am having problems paying my mortgage and asked Suntrust to work with me. I asked if I could make partial payments as well. They said no...all or nothing...so I had no choice, but, to pay nothing. They ALSO told me the same saying I would have to be three months behind. They had mentioned a loan modification at that time when I was at 90 days. I called for "MONTHS" and I couldn't get anyone to call me back. I was served in the interim with a Summons for Foreclosure noticing they had lost, misplaced, damaged, etc. the NOTE. So after seeing on the Today Show about Producing the Note, I filed on my own a Motion to Request Production of Documents with a follow-up of Motion to Compel to Suntrust's attorneys. Well, how coincidentally Suntrust called me almost immediately to offer me a modification. They went over it with me on the phone and had a payment $200 less than my original mortgage. I asked them several times if this was the actual amount to agree upon and they said "yes". They sent the modification package to me to be retured by February 15, 2010. That was President's Day weekend. They sent it incorrectly by FED-EX to a wrong address and I never received it. I called the back looking for it and they had to track it finding that incorrect address. They re-sent it to me marked "URGENT" and told me I had to sign it and have it back "overnight" the next day. I wanted to have an attorney look it over with me and because of the holiday, I had no time. I asked Suntrust for more time and their answer was...."Take it or leave it", but, get it back immediately. I was signing under duress, but, sent it back. Well, now I get the final documents and the amount was different. It was now $200 more because they didn't include taxes over the phone. There's much more, but, this is what I now have an attorney for. I despise Suntrust for not having employees who understand and are educated enough to work with the consumer in keeping their dream and what they have worked so hard all their lives for.
