Saxon sent me a foreclosure summons, which I was not expecting

February 14, 2008

I am currently about 6 months behind on first and 5 on 2nd. I have tried to work with mortgage company for last few months with no luck. Took over month to talk to anyone and found out the person that was assigned to my case was no longer there and they never returned my calls. Was assigned to a new person and when I finally talked to them, they said need $7-8,000 to consider working it out and didn't state what the settlement would be and I didn't have that due to family unforeseen medical issues. They tried to serve a summons yesterday, which I didn't expect since we were in negotiations, and we really want to keep the house. I feel you might be my last resort to work with them. I know they are probably overcome with foreclosures and thus a long time to process and get back, but has cost me a lot of valuable time! The second mortgage payment is $660 a month, just to let you know. We have some money as good faith, but not the 5 months or so behind.

From our experience, dont send good money after bad, you wont see it! You'll be throwing your money out the window. No one at Saxon knows what they are doing, you never get the same person, you get told a different story each time, a different amount each time. We finally let our home go, after we had an attorney look at the papers and he could not even figure out how they came up with the figures and what all the fees were for, etc... We believe they purposely put us off, by not returning phone calls for over 3 months so it would be on our credit and we would have not choice but to stay with them if we wanted to try to rewrite because no one else would want to touch us after a 90 day late on a mortgage!

Saxon Mortgage misleads mortgagors.
The same happened to me, after negotiating for 3 months, now I received a foreclosure summon.

We need to report it to the federal and the state agencies and To the Congressman.

Ditto on Saxon... and same exact story on "they were working on your case but she is no longer here" so I had to start over, then asked me for $2700 up front and to raise my monthly payment from 1800 to 2400... I was injured and cannot work, so I have 0 income... they are a joke and now they summoned me as well and I have NO idea what to do.

We need to raise attention to our cases collectively. I have called my state rep and am calling anyone who will listen. The whole experience was a cornucopia of disappointment and lies. Tell everyone you know about them and have them tell others. post on blog sites ect. Do anything you can to bring attention to the issue. Companys like this should be shut down. I am considering a web site devoted to the wrong doings of Saxon Mortgage. If I cant save my self I will try and save other from the horrible decision that will surely cost me my home. any suggestion?

I own a house in Florida and I'm currently living in Virginia. They sent a foreclosure notice to my house in Florida and didn't send it to me. EVEN THOUGH THEY HAVE MY NEW ADDRESS. I didn't know about the foreclure until I got a letter from some company about my house being on public records

?We have been waiting 9 months for Saxon Mortgage to CONTACT US regarding a Loan
Modification but Saxon fails to return our phone calls or emails. Our loan is a subprime loan
which has been increasing every 6 months since 4/1/08 and we are unable to refinance as we owe
more than our home is worth. Our only option is to get a loan modification. We have been trying
to contact Saxon Mortgage since 1/8/08 to get this Loan Modification done, but Saxon has
FAILED TO RETURN OUR PHONE CALLS or DO A LOAN MODIFICATION. It has been 9
months. On 12-30-07 Saxon Mortgage agreed to look over our Sub-Prime Mortgage to do a
Loan Modification to freeze our interest rates and possibly lower our monthly payment by
decreasing the interest rate. Saxon mailed the paperwork for us to fill out regarding our income,
banking info, bills, etc. We faxed this information back on January 8, 2008. My wife and I
telephoned Saxon about every other day for the status of this loan modification. We did not
receive a phone call back until March, 2008 wherein the case worker, Sandra Vasquez advised us
to NOT make the April and May, 2008 payments since we were doing a loan modification and
making a payment would "mess up" Saxon's numbers. Ms Vasquez stated the 2 payments will
go to the end of the loan and will NOT BE REPORTED ON OUR CREDIT. She stated she will
call us back in 2 weeks to provide the completed Loan Modification. She never called back, nor
did any other Saxon Representative. My wife or I continued to Telephone & Email the Saxon
Loss Mitigation section and continuously left telephone messages, which went unanswered. In
June 2008 we check our credit report and Saxon DID REPORT the 2 payments that we were told
to not make. We continued to call Saxon Loss Migigation and they said they would expedite our
message and make it top priority. We NEVER received a call. On September 18, 2008 (8
MONTHS SINCE WE HAVE TRIED TO OBTAIN A LOAN MODIFICATION) the Saxon
representative LaKisha said that Saxon did received our fax 8 months ago, but they could not
read it. She asked to refax it - which I did do. Saxon did lie about this as they were working on
the loan modification in April 2008. I have left messages EVERY OTHER DAY for the new
case worker, Ronald Hanes at ext. 204768 - which were not returned. TODAY, OCTOBER 4,
2008, SAXON MAILED US A LETTER STATING THAT THEY CLOSED OUR CASE FOR
A LOAN MODIFICATION DUE TO THEY COULD NOT CONTACT US when we have been
calling EVERY OTHER DAY for 9 months. My wife is a stay at home mother and is home
EVERY day and we also have caller ID - SAXON NEVER CALLED. They have closed the case
since they say THEY cannot get a hold of US!!! We are trying to get help to avoid Foreclosure
and Saxon Mortgage will Not work with us or contact us!

I too have been have problems with Saxon. I have been waiting for 11 months for an answer re: aloan modification and it wasnt until Dec 6 2008 that I found out I had bewen denied and the way I found out was because i gotr a notice of trustee sale for Dec. 29, 2008 Mery Xmas to me and my family huh. I have been trying to workout something with them but they keep giving me different totals each time i call. I guess the fees go up by the minute. i hate this company They waited and waited till fees got so high that we could not afford it so they could take my home my home of 37 years.

We applied for a loan modification in March of 2008 knowing that our rate would adjust in November or 2009...

After our application we had to refax the documents 3 times for them to finally say they'd recieve it.

After calling them many times - in May of 2008 they mentioned they would be working on the modification. In June of 2009 Saxon purchased 1 years worth of Homeowners Insurance on my name because of one month i skipped in 2007. My rate went up $250 a month.

After calling about the application many times in Summer of 08 - they continued to tell us to be patient.

In September of 2008 Hurricane Ike hit me and my family. We incurred some property damage and had to leave town because of the heat, food, power situation. I have a 5 year old, 4 year old and at the time my wife was pregnant. Even though this emergancy situation cost my family $2000 we still made payments to our mortgage.

In October of 2008 - Saxon called me to tell me that i could pay a month late without penalty due to Ike.

We asked then about our Loan Modification and mentioned to them that the adjustment was coming in November.

They continued to tell me not to worry and to be patient.

In November my wife gave birth to my beautiful daughter.

December comes around and I noticed that the mortgage bill is much higher.

So i call saxon and they said "Congratulations - you're loan modification has been approved!" I said finally... The loan modification was approved to freeze the rates from adjusting.

So the rep at Saxon continues to tell me that on November 5th my approval went through and they have frozen rate... I asked them at which rate? They said the rate you currently have.... 9.9999%

I flipped. They approved the modification to freeze the rate at the adjusted figure!!!

In December i paid my mortgage before talking to the rep... The rep mentions to me do not pay the mortgage until February of 2009. The rep also mentions that they will be Fedexing the docs over to me and to watch it in a few days.

Two weeks passes and it's after Christmas - i call them to ask them about the documents. When I call in - the rep asks me about my HOMEOWNERS INSURANCE that they don't show proof... I said i have proof! (KEEP IN MIND I have been paying my homeowners insurance double since June) So I called my agent and he faxed it over three times to them... I call Saxon and the rep said "It's goign to take a few days to look for the fax...We are back-logged."

Fast forward to January 2009... I get a notice of Foreclosure from the laywers of Saxon mortgage. I called Saxon to tell them about this and they asked why haven't i paid for my December payment. I have to explain to the rep the money was placed in upapplied funds... At that time the agent realizes it and says for me to be patient they can't apply those funds until the modification paperwork is recieved on thier end... Keep in mind i still didn't recieve the docs!

A week later i get the docs... The docs say i had 24 hours to sign/notorize and fax back... So i call Saxon and ask them why... They said because February is coming up and if i don't do it in 24 hours the rates will adjust.

I send back The forms out of fear... Then my Homeowners Insurance agent calls me to say that Saxon purchased a years worth of Homeowners... Saxon then notifies me that i have to pay an additional $250 a month for Homeowners on top of the $200 i was paying from June.


This week - i got another notice from the Saxon lawyers...

My wife and i have given up on them.

I want to pay my mortgage but not through all of this. I want to stay in my house - but i just can't handle Saxon!

I tried applying for refinance through other companies and they won't help! WHY???? Because after Hurricane Ike they show we have paid a month late to Saxon! After they told us to pay a month late!

my husband and I refinanced our org mortgage and it was purchased from the original company by Saxon Mtg Company. My husband passed away Aug 21, 2008. I notified Saxon and they said they needed a certified copy of his death certificate........I mailed them one in Nov 2008. Upon his death I lost 2/3 of my income...my son was helping me make the mtg payments and slowly I was wiping out my savings trying to keep the payments up to date. Then I heard about mtg modification...I called Saxon asking them if we could look into this and come to find out they denied ever receiving the death certificate i'd sent to them....4 copies of the death certificate later they finally admitted they'd received one and documented my file. The sent me a loan modification packet and a phone number to fax all the information to them which I filled out and sent to them. when Jan payment was late I kept getting calls from Saxon on a daily basis explaining every time I had applied for a loan modification...every time (a different agent) would tell me there was nothing in my file saying they had received any paperwork to that effect. Finally one late day call I got an agent that gave me a number AND and extension to talk directly to someone in Loss Mitigation. They claimed no paperwork was received and they would send me yet another packet to fill out for the loan modification.....my next notice from Saxon was a foreclosure letter. I have done everything they have asked of me to protect my home and repeatedly have been told all my information has never been received....their excuses have been the company is so busy it takes up to and over 6 weeks for them to keep up with their correspondence...it appears the outgoing notices "fly" out of their office a lot quicker than they read their incoming mail and faxes. I think the right hand does not have a clue what the left hand is doing and if they are so busy why not have more than one telephone number that WILL be answered by someone that can give you an honest answer......every agent i've spoken with has told me something different and none of it seems to be the truth. every time they answer the phone an make the comment "Saxon is a debt collector and any information will be used for that purpose" I feel like they are reading me my miranda rights....and "anything I say can and will be used against me" As it stands it looks like I will lose my Florida home and the kids and I will have no place to go. where is Obama's ruling to stop the foreclosures? Just seems Saxon is in a hurry to sieze as many homes as they can.

i want to sue saxon as they sold my of 40 years without notifiying me . so those that got notices were lucky. these people are not humen and not even the extra stars in the sky will have . imm looking into sueing and any one who want to goalong with me let me know.

I also have SAXON MORTGAGE, they are give horrible customer service,and are always lying! I have been with them for 2 years. The on the second year it was hard for me to make payments due to jobs and ect. So I call them to do a Loan Modification, they told me that i could be approved.So I filed all the Documents they requested. And they told me not to make payments because it would help with the modification.So i did! (Was a relive because i was broke!) Until about a week a go I gto denied now they want me to pay over 6000$. Plus got a Foreclosure notice. Somebody please help, What can I do?

In Feb I received my loan modification documents. I too was told that I should not make Apil payment as this would be pushed to the back of the loan and would mess up their numbers. This also was written into loan documents to lower my interest rate for 5 years. I sent this back the next day certified with the cashier check they required. I followed up in a week and was told that they did not received this..I advised that I had a sign copies of the signture showing it was signed for. They then told me that did receive it but that their legal departments was working on my "Mod". After April 20, I started calling because now it's showing that I am late and I asked them why this "Mod" was taking so long to process and they had no answer for me. Finally, on May 1st, I called to make the new payment amount. They accepted my payment over the phone and said that they would mail me a receipt which I received. They still have NOT posted the payment. I continue to call and now I am being told that they are still working on this "Mod" and that by June it should all be taking care off. So, I will have bad credit, late fees and possibly a forecloser on my record as well...Thanks Saxon!

We were two month behind on our adjustable rate payment when I tried to get Litton to modify our loan and all they did was give me the run-around! I couldn’t believe it when the guy on the phone actually said that my family shouldn’t eat so much because then we would spend less on groceries and would have more money to make our mortgage payment! What a jerk! He also said we should get a cheaper car and a bunch of other stuff that was really rude. Come to find out the loan modification they were going to give us was a just Forbearance Agreement and all it was going to do was add the payments we were behind on to the back of my loan. Since our interest rate was going to stay the same, this would actually make my payment go up! THAT’S what got me into this mess in the first place! My payments are too high! This whole thing was keeping me up at night worrying about what was going to happen to us. I told my friend at work about this and she said I should call the loan modification company that got her loan modified down to 3.75% fixed interest rate! I decided to call them, and in about 45 days they got my interest rate down to 4.35% and it’s a fixed rate too! In 2007 my spouse was arrested for domestic violence. On this same date I left taking my children and filed for a divorce, shortly thereafter. I gave him the home and signed over the deed. My ex-spouse let the home go into foreclosure, and has since entered into a modification loan solely. He used the divorce decree to prove hardship, and has since been accepted. Saxton Mortgage used his income only, made the agreement with him solely, but refuses to remove my name from this new agreement. My credit report still reflects this foreclosure. What can I do??

I have lived in my home for 3 years, my original mortgage company filed bankrupt and now Saxon has taken over my mortgage loan. Wow, i thought i had issues with TB@W, these guys take the cake. I have receipts to prove my payments were made to TB&W, they asked me to fax to them the proof. I did and guess what these sleeze bags do....now they say its behind for different months. Their accounting department must be made up of 5 year olds. My home is up for foreclosure on the 7th of October 2009, they are asking for an ungodly amount of money. Noone returns calls and they are just compulsive liers. My family and I will lose our home, along with many others. My heart and soul goes out to all that are having to go thru this. We are in constant fear and worry. Our lives have been ruined with all the fraud. I am self employed, my wife works for the County in which we live in. We like all of you are hard working honest individuals. What is this world comming too!!!! Write your congressmen, write your attorney general, Please Please sign the Class action Lawsuit! Some of you that have made comments on this site do not list your email address, please email me.......I want to know where we all stand.
