Legal aid has not worked, does anyone have any suggestions here?

WE CAN NOT FIND ANY HELP WE TRIED LEGAL AID THEY ARE NOT TAKING ANY CASE UNTIL MARCH 10TH 2008.I DONT WANT TO LOSE MY HOME I AM TRYING TO SAVE MY HOME.I AM ON SOCIAL SEC/ .AND MY WIFE WAS TAKING OFF THE LOAN FOR NO REASON. THEN WHEN THEY TOOK ME TO COURT THEY HAVE PUT MY WIFE BACK ON. I WENT TO COURT ON 02/04/2008 WELL THE JUDGE TOOK THE OTHER SIDE. AND THEY WHERE NOT EVEN THERE AND HE HAD NO PAPER WORK ON OCWEN. THERE LAWYER NEVER SEND THE PAPERS IN HE CALL THE LAWYER FROM THE OTHER SIDE AND SHE SAID TO THE JUDGE SHE MISS PLACED THEM AND WOULD HAVE THEM OUT. AND WHEN THE JUDGE GOT THE PAPERS FROM THE OTHER SIDE THEY HAVE MARKED THEM FOR THE 4TH 2008.I DONT SEE HOW YOU COULD GO ON WITH COURT IF THEY WHERE NOT THERE AND THE JUDGE HAD NO REPORT FROM OCWEN LOAN COMPANY.DO YOU KNOW ANY ONE THAT COULD HELP US SAVE OUR HOME WE REALLY NEED HELP.I HAVE EMAILED EVER ONE AND THEY CANT TAKE ANY CASE UNTIL MARCH.I DONT WANT TO FORECLOSURE ON MY HOME I WANT TO SAVE IT.WHAT OCWEN DID TO MY WIFE IS WRONG.MY WIFE CANT GET TO MUCH GOING ON WITH ALL OF THIS. WHAT OCWEN HAS DONE BECAUSE SHE GETS IN TO THIS ATTACKS AND THEY ARE HARD FOR HER TO CONTROL UNTIL SHE TAKES HER MEDS/BUT SHE IS TRYING HER BEST TO HELP ME SAVE THE HOME. AND I THANK GOD FOR HER TRYING TO HELP ME.IF YOU CANT HELP ME DO YOU KNOW ANY ONE THAT COULD HELP ME.

Darin, it's difficult to tell from your post exactly where you are in the legal process. I'm wondering, however, if filing for bankruptcy under Chapter 13 might be an option that could help you.

I know that just the thought of filing for bankruptcy may be difficult, but if it will keep you in your house, it may be the best course of action.

Filing under Chapter 13, moreover, is entirely honorable. It will not eliminate your debt (to do that, you would file under Chapter 7 - but filing under Chapter 7 will not save your home), but what it will do is give you the opportunity to come up with a plan to pay off your debts (including any unpaid mortgage payments) over five years. You can then keep your home simply by making the regular monthly payments.

As soon as the bankruptcy petition is filed, the U.S. Bankruptcy Court will issue what's called an automatic stay. That means that all of the legal proceedings related to Ocwen's filing will have to come to an immediate stop.

Only a bankruptcy attorney can evaluate whether this is the best course of action for you under your particular circumstances, but it's my sense that a lot of people don't know that it's an option when they're facing foreclosure so I thought I would suggest it to you.

I am in Florida too, and also facing an Ocwen foreclosure. Have you sent an answer to the courts and to the lender's attorney. Hardship alone is not enough of a defense, you need to raise legal questions in your answer. Did they send you a letter notifying you that they were accelerating the loan prior to filing a lis pendens? Were you a victim of predatory lending practicies? Are they following federal law in fair debt collection practices? Good luck, and feel free to e-mail me if you get more stuck.

I am in Jacksonville, Florida. My husband and I seperated not long after we bought the house. That is when we first got into trouble. We then reconciled and have been working with HomEq Servicing to keep our home. We were in a re payment plan when I lost my job in January. I, unfortunately worked in the mortgage industry and the company I worked for, closed their doors, and jobs in that field are scarce. My husband worked in construction and had to take another position offered to keep income coming in to support our family. Doing so, he took a decrease in pay. Now that our household income has decreased, they say we don't qualify for a modification, which is what we need. I have a first and second mtg, payments totalling approx. 1500.00 a month. What can I do to get them to modify our loan?? We have three children at home, and are doing all we can to keep a roof over their heads and necessites taken care of. Any advice would be greatly appreciated!!

Do not listen to Ocwen!!!! They are liars who will NOT work with you! You'd be better off either filing Ch 13 so they will be forced to take payments from you regulated by the federal government or if they have already taken your home, file Ch 7 so they will not garnish your wages. You might want to talk to a bankruptcy lawyer to evaluate your situation. Do take action whatever you do but not with Ocwen as they are not your friend. Good luck whatever you decide to do.

This is just terrible!!! And the banks have no reason to even negotiate with this family as long as big government is giving them our hard earned tax dollars to bail them out. Who bails out the little guys? The preident passed a new FHA loan program to help people like you, that was to roll out beginning 10/01/08, but I have checked with several mortgage people, and they still don't have the guidlines in place yet. From what I understand of the new program, they will give you an FHA loan for 90% of homes "Current" value, and bank has to agree to eat the difference, and it is not contingetnt on your current credit score. The main catch is, you can only own 1 property period. Click on my name below for more info.
