I can't get a straight answer with Citi Residential

February 14, 2008

The house is actually 3 bedroom and 3 full baths. with a 2 car garage. We have been trying every since October of 2005 trying to work with Citi Residential formally AMC. We have asked about deferring a payment but they told me they don't fo that. We also tried to refinance but could not now due to the late payments. I am currently not working and have asked them can they take my mortgage back to the 1340.00 i use to pay so that my wife can handle the payment with what she makes they won't budge. I am currently trying to find out if they are participating in the loan modification program that was just sign known as the life line and I cannot seem to get a straight answer. Please let us know if there is anything that you can assist us with. I also tried to sell the house last year but was unsuccessful.

I have three simple questions.
1 What is the names and address of all of the directors of CITI Residential Lending?

2. You stopped three checks from me and now my house has exposed mold, which is causing more health problems to my family and self, beyond what we have now.

3. Why is that Ms. Virginia Gutierrez is the only person I can talk to, and it gets me upset when she thinks she is a lawyer, giving legal advice, and so on. I also want to let you know from your blatant disrespect to my family's health, and other finical problems, YOU WILL NOT GET MY HOUSE!! We can work something out, and I will tell you I will not throw the first punch, but when it does happen, I will fight for my life, along with my families because of the threats Ms. Gutierrez has made about being "Forced out of our house," I don't take threats lightly, so I'll tell you now. He who throws the first punch, fires the first shot, or any other acts of violence, will be met with equal, or greater return.

Tell Ms. Gutierrez to stop practicing law, when she is not a lawyer, and also make it crystal clear to "Gina", never threaten me, and stop complaining to others that I'm the one who is threatening others, like she stated in a letter to the Minnesota Attorney General's office.

I'm also with Citi Residential and have tried working with a home modification company to help me with my past due payments and lower my payments. Citi Residential refuses to work with them and claims they do not do deferments.

To anyone who may have any contact info on anyone higher up than a customer service rep. let me know. We have had nothing but hell with citiresidential since Sept 2008. I have a binder 3 inch. thick of people, departments, times, dates, you name it that I have spoke with regarding a so called moretorum we were suppose to be in due to hurricane Ike in Texas and convenant to them they sold to Chase and did not take care of anything they where suppose to and now when I talk to Chase they tell me Citi should still be able to correct their mistake, but Citi says they do not have any info on my account that everything was forwarded to Chase. Chase has told us they are lying they have everything to help us they just don't want to. The higher ups at Citi do not handle anything they leave it to customer service people who have no authority to handle anything and do not take care of business and you wonder why the problems we are having are the way they are. It is the higher ups in the companies who do not take responsiblity for their employees lies and deceptions. I have documentation for all conversations and can tell you word for word what was said but when you contact them they say they don't have notes. Ask them to hear the so call recorded converstions and they deny you, but they tell you this call is being monitered. If this is so then they should have all the evidence they need to prove my word against their customer service and their disaster department.

I fell behind 2 months in pmts and Citi Residential was so kind to set up a repayment plan that required me to pay $4700 a month for four months. I am a single mother that works two jobs. I managed for two months then called and asked for a loan mod in April 2008 to take the now ONE MONTH past due pmt and move to the end of the loan. Citi Residential agreed to review and instructed me multiple times DO NOT SEND IN ANY PMTS UNTIL WE COMPLETE THE MODIFICATION. I called weekly for the modification status only to get "We are still reviewing, we will contact you, do not send in money or it will mess up our calculations for the loan mod. In September 2008 I was laid off from my job, thus having to spend some of the money I set aside for my mortgage. In Novmember 2008 I hired a company to assist me with this loan mod because it was taking Citi Residential way too long to complete. In mid December, I received a letter from Citi Residential that they DENIED my request for a loan mod due to "do not meet qualifications". They then issued a Notice of Default and Sold my loan to Citi Mortgage. I thought I would be ok since I hired Federal Loan Modification to assist me with this but that was just as bad. They did nothing but take my money, give me the run around and did not even make contact with Citi Mortgage. My home is now scheduled for Auction on May 29, 2009! Why isn't there more laws or resources to protect borrowers from companies that mislead us. Our homes are at stake and these people do not give a rats ass. I think that Citi (and all their affiliate companies) should be held responsible for their actions (or lack of) and be ordered to do their jobs as loan servicing companies. They are rude, mislead borrowers to get them to default on loans and simply do not know what customer service is. They need a wake up call and think we all should stand up for our rights!

You need to understand that you can hire a modification co but they have no authority over your loan or terms. All they do is the same thing that you do, call mortgage co, ask for a modification, send the paperwork in and take your money for something you can do yourself. The simple thing is you signed a contract to pay your bill and if you could not that they could taker your home. If you default on your loan they will take your collateral just as a car loan. Federal loan modification co cannot do anything that you can not do yourself. From your notes you would have been several months past due and i am not surprised that they would foreclose. Everybody complains that they will not help them, the loan is your responsibility not theirs.
