Repossession or Foreclosure... what is the difference and which can Vanderbilt do?

January 14, 2008

I received a court order to appear for repossession of my mobile home in our reservation. I have 20 days to respond back to them. Please help! I do not want to loose my home for my children.

Repossession generally is the term used for personal property. Things like cars. Foreclosure is the judicial process for real property. If your mobile home is real property they will foreclose. If it is a trailer not permanent, they may just repossess it. Most likely it will be a foreclosure.

To save it, pay your bills.

what if i don't want to save it. i want to get out from under it. will they garnish my wages, or put a judgement agaist me. what is the next step after foreclosure?

Please inform me how I would respond to a summons with an Acknowledgment of Receipt of Summons. Where would I find this form outside of an attorney's office?

Thank you,
G. Everett

My Son needs his X-Wifes name off his loan or the court will sell it in October, He has tried many time with Vanderbilt and they want take her name off they know they will loose money when this happens and still dont care... So I guess he will just have to walk away from it and thats ashame because he has worked with them to keep payments up to date..I dont understand there reasoning behind not careing to loose money on this loan

Posted By m. wilson on August 21, 2008 at 06:37 PM

Listen up, file a complaint against
Vanderbilt. I have been fighting with this co. for 10 years, and 130,000.00 out of pocket later, I am still fighting them, it takes years folks, and I have been to ever state federal and anything else you can think of for help, now the fbi, also in litigation with them they forclosed on me for a payment that I made, they have provided through this litigation, forged documents, generic payment history documents, so forth, and the local judge here believes them...well went to the court of appeals prose...brought back to local jurisdiction...they are embezzeling funds, misappropriating funds, and commitng crimes against state...with forgeries and fraud. will I lose my home probably, will I give up? Probably NOT. Warren Buffett I got ur number...cmon git r done folks, and God
Speed.

MY husband and i had bought a trailor in 1999 through vanderbilt the biggest mistake we ever made ever.we made our payments always on time and then my husband lost his job we got a little behind and we finally caught our payments back up ,but that didn't matter to them we lost our home anyway and the trailor we bought was only $20,000.00 good deal right,no after they repoed our home we got a letter in the mail that they sold our trailor and now we owe them $25,000.00. we paid on that trailor for 6 years how can this be possible. NEVER EVER buy a home through vanderbilt they need to be shut down and investigated .My husband and i have had our credit ruined because of these people do not trust them.

WELL; FROM ALL THESE COMMENTS I AM A BIT SURPRISED I THOUGHT ADULTS SIGNE FO MORTGAGES IE TAKING RESPONSIBILITY FOR DEBY THEY INCURR ( SIGN FOR) VANDERBILT MTG IS A LONG TIME RESPECTABLE MTG CO WHICH YOU ALL CHOOSE TO DO BUSINESS WITH, IF YOU WOULD TAKE THE TIME AND HAVE THE INCLANATION TO ACTUALLY READ WHAT YOU SIGNED YOU WOULD NOT BE SURPRISED BY WHAT YOU ARE DEALING WITH. IE IF YOU DO NOT INSURE YOUR HOME VANDERBILT AND ANY OTHER MTG CO WILL PUT "LENDER PLACED INSURANCE" ON THE HOME AND CHARGE YOU BACK THE COST THEREFORE INSURE YOUR HOME. IF YOU OR YOUR NEWLY DEPARTED SPOUSE SIGNED FOR THE RESPONSIBILITY OF DEBT ON THE HOME THEN THEY ARE RESPONSIBLE FOR THE THE DEBT; DOES NOT MATTER THEY ARE GETTING DIVORCED ETC...
Posted By mk on January 27, 2009 at 06:31 PM
ALSO; IF YOU WERE NOT CREDIT WORTHY AT TIME OF BUYING THE HOME YOU MAY HAVE A SIMPLE INTEREST LOAN... ALSO VMF SERVICES LOANS ALREADY MADE BY OTHER COMPANIES TO YOUR GRIPE IS NOT AGAINST VANDERBILT BUT THE FORMER COMPANY
JUST BECAUSE YOU MAKE YOUR MTG PMT TO VANDERBILT DOES NOT MEAN THEY LOANED YOU THE MONEY FOR THE HOME

want to buy forclosure homes I want to find out how

We bought our home brand new in 2002. We always sent our payment in on time. Until once we fell behind. We were first time home buyers along with having our first baby. The first time we were late they let us know by harassing us until we told them when we would be caught up with our payment. They were awful to us and rude. We tried to explain our situation to them but they didn't care. Instead of calling and being reasonable all they had to say is if it wasn't paid in two weeks they were taking our home. Funny because it wasn't even a month late! Ever since this has happened we aren't in no hurry to pay these people. We pay it when we feel like it, maybe if they weren't so rude they wouldn't have so many problems with people. They are really going to be upset when they get their house back! We are sick of dealing with such rude, awful, UNPROFESSIONAL people. They even went as far as to call the people that live down the street from us (Whom we don't even know) to tell them to have us call them!! The lady that was called was highly upset with these people. She said they were even RUDE to her and she doesn't even have an account with them!! Something has to be done about these people! I understand when you owe people money their job is to get you to pay what you owe them BUT when you are unprofessional and rude about it...GOOD LUCK getting your money! At this point in the economy people are walking away from there houses left and right...maybe if Vanderbilt wouldn't talk to their customers they way they did people would fight a little harder to keep their homes! I can't even begin to explain how rude these people are!

I didn't even buy my home from Vanderbuilt but they are still ruining my life. I bought my home from Oakwood which was supposed to be a land home deal. After traveling from NY to NC with all my belongings in a truck, I was informed at the signing that I didn't own the land. "Don't worry" I was told. Stay there for 6 months and we'll refinance you and get you your own land. Oakwood went bankrupt and there goes my promise. My lawyer told me to turn in the keys to Oakwood and walk away. That was back in 2004. I did and heard nothing for 3 years. Then I get a letter from Vanderbuilt saying I owed them $56,000. It seems that Oakwood sold all their assets to Vanderbuilt and I got caught up in the shuffle. Meanwhile instead of putting the house up for sale for fair market value, they sold it to the jerk who owned the land it was on for less than 1/3 what the fair market value was. They then said I owed them the difference. They have screwed up my credit so bad that I can't get the house I'm trying to buy. What I can't figure out is why did they take it off Trans Union and Experian but not Equifax. Do they know that Equifax is the only one the creditors use?

These people are heartless & rude! They call my neighbors & my family after being 2 weeks late. My son has cystic fibrosis and is in the hospital alot, we have enough going on without them trying to humiliate us to everyone. I have lived in this house for 10 years, they see that I don't want to lose it and still give me shit every 2 weeks. They have said nasty things to me that I don't even think are legal to say. They talk to with a threating tone like I'm their kid or something. I avoid their calls now. I took my answering machine out of my house & alot of stress went with it, you might want to think about it.

I didn't buy my home from Vanderbilt but they bought the loan so I got stuck with them.

Now I can no longer pay due to the bad economy after 10 years on a 15 year mortgage, They REFUSE to work with me. I own the land out right it sits on and the mortgage is only on the MH and the land is worth more than the MH and I've got it for sale but can't sell due to economy.

They are scum

Over the past few years I have received nothing but rude and disrespectful service Vanderbilt. In particular, the instance where a representative from your company came to my home and interrupted the wake for my grandson. I had been on the phone approximately two days prior and told them that I would address this matter as soon I had buried my grandson. The individual knew what he was doing because a funeral wreath on my porch. After that contact with Vanderbilt I vowed and told them that I never wanted to speak with anyone from their company again, and if you needed to contact me to do it by mail. Your actions show a complete lack of respect for myself and my family. As you might guess they paid no attention to that request and once again are hounding and harrassing me over $50. This company has no respect for anyone.
